The annual contracting for gasoline and diesel fuel is an operational need for the city to function
and entering into a fixed price contract for 2027 provides budget stability throughout the year.
Background:
Given the uncertainty in the oil markets, locking in fuel prices for 2027 provides stability in the
budgeting process throughout the year. The city plans to enter into a fixed price fuel contract with
the state from February 1, 2027, through January 31, 2028. For the state’s Fuel Core Team to
secure pricing, all participants must submit fuel quantities estimates by October 22, 2026. Once all
participants have submitted their quantities, the state’s Fuel Core Team will work with fuel market
professionals to lock in the most competitive prices available at that time.

designs and materials all single-family homes in the subdivision must use.
D.R. Horton is the builder of the single-family homes in the Century Ponds subdivision. Nathan Fair,
who represents the overall project developer, has arranged for his company to build higher-end
single-family homes on nine lots within the Century Ponds Second Addition. These homes will use
higher-quality materials and designs, but the lot sizes and setbacks will not change from what the
city council previously approved.
Mr. Fair has submitted revised home plans for these nine lots. The second amendment adds these
plans to the PUD agreement. All homes built on these lots must meet the designs and materials
shown in the revised plans, and the revised plans apply only to these lots.
All other terms of the PUD agreement and the first amendment remain the same.
Previous Actions
On October 27, 2025, the city council approved a PUD for 133 single-family homes and 73
townhomes on the former Battle Creek golf course, at the southwest corner of Lower Afton Road
East and Century Avenue South.
On March 9, 2026, the city council approved the final plat for the first phase of the project, with 84
single-family homes and 34 townhomes.
On August 24, 2026, the city council approved the Century Ponds Second Addition final plat, which
created 14 single-family lots, and the first amendment to the PUD agreement.

Action Requested: Motion Discussion Public Hearing
Form of Action: Resolution Ordinance Contract/Agreement Proclamation
Summary:
The city council has previously expressed support for the creation of a “scattered site” program to
encourage reinvestment in Maplewood while also supporting an affordable home ownership
program. During the April 13, 2026 meetings, the city council and economic development authority
(EDA) expressed a desire to partner with Twin Cities Habitat for Humanity to create a program that
would acquire homes from willing sellers, facilitate necessary rehabilitation, and resell the homes to
qualified homeowners for long-term affordable housing.

Motion to approve a grant agreement between the City of Maplewood and Twin Cities Habitat for
Humanity to support an Affordable Housing Acquisition and Rehabilitation Program.

The city supports the leveraging of resources and partnerships to meet the diverse needs of the
community. In addition, the city promotes quality housing and looks for creative solutions to support
the expansion of housing offerings for a variety of households.

J2
Background:
The city council and EDA have expressed a desire to expand housing options to further support
affordable single-family homeownership through a partnership with Twin Cities Habitat for
Humanity. As a result, staff has worked with Twin Cities Habitat for Humanity to develop an
affordable housing acquisition and rehabilitation program, which creates a partnership between the
City of Maplewood and Twin Cities Habitat for Humanity to buy, rehabilitate, and resell homes as
long-term affordable owner-occupied housing. This proposed program would be supported through
LAHA funds made possible by a dedicated sales tax that helps cities, counties, and tribal nations
develop and preserve affordable housing.
As a part of this partnership, Habitat would acquire existing homes, renovate them, and sell them to
households earning 80% or less of area median income ($105,200 for a family of four), and who
also meet Habitat's own eligibility criteria. Those criteria include credit, debt-to-income ratio,
savings, employment history, and residency requirements, summarized in Exhibit D of the
agreement. The city would provide funding for up to $300,000 per eligible property. The funds
would cover three types of assistance:
Acquisition costs.
Development gap assistance, which covers the difference between total development cost
and the home's fair market value.
Affordability gap assistance, which covers the difference between what the buyer's first
mortgage can support and the home's market value.
Upon sale of each home, Habitat would repay a specified portion of the grant within 60 days. The
remaining funds would stay with the home as permanent gap assistance. The city funds are not
anticipated to cover full project costs. As a result, the city will partner with Habitat to seek additional
sources of public funding, such as the Metropolitan Council and county sources. If additional funds
are secured, the city will be refunded that amount to allow additional resources for a future project.
The initial grant term runs two years from the first disbursement. After that, it renews in one-year
extensions, each funding one to two additional properties. The agreement stays in effect through
each property's Period of Affordability. That period is at least 30 years, secured by a Lasting
Affordability Declaration recorded against the property when it is sold to the homebuyer.
Habitat's obligations:
Statement of Work and Pro Forma:Before acquiring each property, Habitat must submit a
Statement of Work and a Pro Forma (Exhibit A) and complete the described rehabilitation
before the homebuyers closing.
Disbursement requests: Each request (Exhibit B) must include documentation tied to the
type of assistance, such as purchase agreements, proof the price doesn't exceed fair market
value, itemized rehab costs, code-compliance evidence, buyer income and housing-ratio
calculations, and the recorded declaration.
Insurance: Habitat must carry commercial general liability coverage of at least $1.5M per
occurrence and $2M aggregate, naming the city as additional insured, plus builder's risk and
hazard coverage.
Indemnity and compliance: Habitat broadly indemnifies the city and must comply with non-
discrimination laws and the Minnesota Government Data Practices Act.
st
LAHA funds must be spent by December 31 in the fourth year following the year after the aid was
received. This means that the LAHA funds Maplewood received in 2024 must be spent by
st
December 31, 2028. In the event that there are any unspent funds, they must be returned to
Council Packet Page Number 47 of 160

Minnesota Housing. The City of Maplewood has been allocated approximately $1.4 million in LAHA
funding over the timeframe below and has spent $300,000 (for the Beebe and Duluth Street
projects) to date:
2024 Total: $221,506.29
2025 Total: $587,609.31
2026 Total: $596,073.20
In partnership with Twin Cities Habitat for Humanity, the Housing Acquisition and Rehabilitation
Program provides a valuable tool for addressing housing needs in the community. Using LAHA
funds, the program will improve substandard single-family housing, while also providing quality,
long-term affordable homeownership opportunities.

The City of Maplewood grants funds from the Charitable Gambling Tax Fund to support activities
and services that benefit Maplewood residents.
Background:
Per Minnesota Statutes, section 349.213, subdivision 1, paragraph (f)(2), a local unit of government
is allowed to require, by ordinance, a licensed organization to contribute up to 10% of the
organizationÓs net profits derived from lawful gambling to a fund administered by the local unit of
government. The City of Maplewood has adopted an ordinance which requires the 10%
contribution. Cities that collect funds from charitable gambling proceeds must spend the money the
same way charities do Î for defined charitable purposes.

CITY OF MAPLEWOOD
CITY COUNCIL POLICIES ON AWARD OF
CHARITABLE GAMBLING TAX FUNDS
1. All licensed charitable gambling organizations within the City are required to contribute 10%
of net profits derived from lawful gambling activity in the City to the Charitable Gambling
Tax Fund. These funds are dispersed by the City Council for lawful expenditures. The City
must acknowledge financial contributions of licensed organizations conducting lawful
gambling to the community and the recipients of the funds.
2. All applications must be complete and submitted by the application deadline established by
the City Manager.
3. The City of Maplewood grants funds from the Charitable Gambling Tax Fund to support
activities and services that benefit Maplewood residents. The first priority in the granting of
funds will be given to the City of Maplewood domiciled organizations. The second priority
or consideration will be given to funding requests from other organizations which are used
primarily for the benefit of Maplewood residents. Funds shall be distributed for projects,
equipment, or activities that are based in the community, and which primarily benefit
Maplewood residents and will be looked upon more favorably than requests for salaries or
general operating costs.
4. Allocation and Applicant Eligibility
a. Distribution of Funds
Open Allocation of Funds Î Allocate funds without regard to category, allowing full
flexibility to award funds based on application merit across all categories.
b. Application Requirements
Organizations must identify the specific funding category under which they are applying
and provide a detailed description of how the requested funds will be used.
c. Maximum Award
No single organization shall receive more than $7,500 in funding per year.
d. Eligibility for Subsequent Funding
Organizations that receive funding in one year are eligible to apply again the following
year only under a different program category.
5. In general, requests from organized athletic groups will not be funded. Funding for these
programs should be from participating families or community auxiliary groups. There are so
many athletic organizations within the community that the City of Maplewood is not capable
of funding their financial requests or fairly determining appropriate recipients.
6. The amount of Charitable Gambling Tax Funds awarded to any request is determined by a
City Council vote. A request must receive 3 or more votes for funding in order to receive
Charitable Gambling Tax Funds.
Updated 03.09.2026
Council Packet Page Number 89 of 160
J3, Attachment 1
7. All funds granted are required to be expended for the requested project within one year of the
date of the award letter. However, payment will not be made until after January 1 of the
award year. Grant recipients shall submit a letter to the City ManagerÓs office requesting
payment of the grant award as well as providing specific information on how the funds were
used (receipts or other proof of expenditure) for the proposed purpose.
8. No employee or department of the City of Maplewood shall solicit a donation from a
licensed charitable organization without City Manager approval. If there is a financial need
for a specific program that was not funded in the City budget, staff may submit a request to
the City Manager for the use of Charitable Gambling Tax Funds.
9. The allocation of Charitable Gambling Tax Funds is an annual award. A previous receipt of
funds in no way guarantees or commits the City of Maplewood to funding in any subsequent
year. Each yearÓs funding requires a new, separate application.
