HomeMy WebLinkAboutNo 109 Relating to Sanitary Sewers, Approving Ordinance No. 11746 of the City of St. Paul Amending St. Paul City Ordinance No. 11061 to Permit Certain Property within the Village of Maplewood to Be Connected to the St. Paul Sanitary Sewer System:.i ORDINANCE NO. 109 AN ORDINANCE RELATING TO SANITARY SEWERS, APPROVING ORDINANCE No. 11746 OF THE CITY OF SAINT PAUL AMENDING SAINT PAUL CITY ORDINANCE NO. 11061 TO PERMIT CERTAIN PROPERTY WITHIN THE VILLAGE OF MAPLEWOOD TO BE CONNECTED TO THE SAINT PAUL SANITARY SEWER SYSTEM. THE VILLAGE COUNCIL OF THE VILLAGE OF MAPLEWOOD DOES ORDAINS Section 1. That Ordinance No. 11746 of the City of Saint Paul, amending St. Paul Ordinance No. 11061, is hereby approved and the terms and provisions thereof are hereby accepted by the Council of the Village of Maplewood for and on behalf of the said Village of Maplewood. Section 2. That a copy of this ordinance, after publication, shall be forwarded to the Clerk of theCity of Saint Paul. Section 3. Winkel— An ordinance amending Ordinance No. 11061, entitled: "An ordinance granting permission and authority to the Village of Maple- wood to connect the public sewer' system of said Village of Maplewood to the public sewer system of the City of Saint Paul and thereafter maintain and operate the same as an outlet for said public sewer system of said Vil- lagefor public sewage conveyance and disposal purposes, and providing applicatble terms d conditions." approved July 26, 1957, as amended. This is an emergency ordinance ren- dered an for the preservation of the public peace, health and safety. The Council of the City of Saint Paul Does Ordain: SECTION 1 That saidOrdinance No. 11061, ap- proved July 26, 1957, as amended, be and the same is hereby further amended so that thereunder and thereby the Village of Maplewood shall be granted permission and authority, subject to all the terms and conditions therein expressed, to construct and thereafter maintain and operate suitable con- nections, according to conventional en- gineering standards approved as to construction, location and elevation by the Commissioner of Public Works of the City of Saint Paul, joining the public sewer system of said Village with the public sewer system of said City, fn the nature of and to be in., and operated as the only outlets for said public sewer system sof said Village and for the expeditious, convenient and effective conveyance and disposal of sewage entering said public sewer system of said Village, at or adjacent to the intersections of Larpenteur Avenue and Rice Street Larpenteur Avenue and Adolphus Street Larpenteur Avenue and Westminster Street Larpenteur Avenue and Agate Streeet and that for said purpose the listing of connections between said Village public sewer system and said City public sewer system, contained in Sec- , tion 1 of said Ordinance, as amended, shall be and the same hereby is, supplemented and extended so as to Include the following additional listings to be inserted therein immediately following the last of such listings now contained therein: Larpenteur Avenue and Rice Street Larpenteur Avenue and Adolphus) Street Larpenteur Avenue and Westminsterl Street Larpenteur Avenue and Agate Streeeti SECTION 2 That said Ordinance No. 11061, as amended, be and the same hereby is further amended in the following par- ticulars, to -wit: That there be and hereby Is inserted in Section 15 of said Ordinance immediately following that certain clause therein contained, quoted as follows: "and from such additional and necessary sewer lines of said Village public sewer system as said City's Commissioner of Public Works shall approve.", the following additional clauses: (7) that part of said Village lying between Conway Street and Lower Afton Road and between McKnight Road as platted and extended southerly and east boun- dary line of said Village; (8) that part of said Village lying between Rice Street and Arcade Street and between the north City Limits of Saint Paul and Minnesota Trunk Highway No. 38, provided that the drainage of said last described area from said Village public sewer system into said City public sewer system hereby authorized shall be and hereby is limited and restricted to such drainage from the sewer lines of said Village public' sewer system, delineated in red thereon and indicated for immediate construc- tion upon the plot plan of Proposed Sanitary Sewer System Improvement No. 3, 1980 for Maplewood, Minnesota, prepared by Bettenburg, Townsend, Stolle and Comb, Architects and Engi- neers, filed in the office of the City Clerk of said City of Saint Paul, which plot plan, by reference hereby is in- corporated herein and made part and parcel of this Ordinance, and from such additional and necessarysewer lines of said Village public sewer system as said City's Commissioner of Public Works shall approve." SECTION 3 That said Ordinance No. 11061, as amended be and the same hereb i "That the presently proposed line of sanitary sewer for construction by said Village in Larpenteur Ave- nue from Soo Line Railroad Bridge to Edgerton Street, as part of said Village's Improvement No. 3, at an estimated construction and engineer- ing cost to be borne, In the first instance by said Village, In the amount of $7565.80, according to plans and specifications prepared or to be prepared therefor by said Village, subject to the approval of said City, I shall be constructed and completed by said Village on or before July 1, 1961, and that said Village's cost therefor, estimated as aforesaid in the amount of $7565.80, shall be and hereby is apportioned between said! Village and said City, on equal basis, and each said City and said Village' shall bear equal portions of said Village's construction and engineer- ing costs as the same shall be in- curred by said Village for its de- signing and construction of said last described line of sanitary sewer; that, as aforesaid, said Village shall be obligated to reimburse said City to the extent of one-half of said City's net cost of said Adolphus- Lerpenteur Sewer System, such re- imbursement to be made within the period of 90 days next after the completion of the designing and con- struction of the same, and said City shall be obligated to reimburse said Village to the extent of one-half of said Village's net cost of said sanitary sewer in Larpenteur Avenue from Soo Line Railroad Bridge to Edgerton Street, such reimbursement to be made within the period of 90 days next after the completion of the designing and construction of the, same; that said last mentioned line of sanitary sewer, to be constructed by said Village, shall be available for sewer service to both said City and said Village hereunder and sub- ject to all of the provisions, terms and conditions of this ordinance.
