HomeMy WebLinkAboutNo 104 Regulating and Controlling the Setting, Igniting or Starting of Fires within the Village of Maplewood; Establishing Penalties for the Violation Thereof; and, Repealing Ordinances No.20, No. 32. and No. 50ORDINANCE NO. 104 AN ORDINANCE REGULATING AND CONTROLLING THE SETTING, IGNITING OR STARTING OF FIRES WITHIN THE VILLAGE OF MAPLEWOOD; ESTABLISHING PENALTIES FOR THE VIOLATION THEREOF; AND, REPEALING ORDINANCES No. 20, No. 32 and No. 50. THE COUNCIL OF THE VILLAGE OF MAPLEWOOD DOES HEREBY ORDAIN AS FOLLOWS: W RYAS indiscriminate, careless, and negligent setting of fires constitutes a danger to the property and personal safety of persons within theca Village of Maplewood; and, WHEREAS,tncontrolled burning or setting of fires results in unnecessary and preventable work and fire -runs for the Volunteer Fire Department protecting property and lives within the Village of Maplewood; Section 1. No person shall kindle, ignite, set or start any outdoor fire not contained in a Village approved incinerator or burner at any time unless authorized by the issuance of a permit as hereafter provided. Section 2. The burning of any refuse, leaves, waste paper or other combustible material in an approved outdoor incinerator or burner in any residential district of the Village shall be illegal at any time other than the hours between 4:00 P.M. and 9:00 P.M. on any day. Section 3. Any outdoor incinerator or burner must be constructed so as to contain all fly ash, embers or cinders and shall be so constructed and located as to be 15 feet or more in horizontal distance from any building, garage, barn or shed located on the property of the owners or on any adjoining property. Section 4. Any persons engaged in a commercial operation shall refrain from burning any refuse, paper or other combustible material unless such burning is done in an indoor or outdoor incinerator or burner which has been constructed pur- suant to Village inspection and approval and such burning shall be confined to the �. hours between 9:00 A.M. and 6:00 P.M. on any day. Section 5. It shall be unlawful for any person, resident or transient u L to burn, or attempt to burn, garbage in an ordinary refuse burner or outdoor burning vessel which is not specifically designed for the purpose of burning garbage or wet refuse. Section 6. No fire shall ever be started by any person on the surface of any bituminous, asphalt or oil -treated roadway at any time. Section 7. No person shall start any fire except in an approved incinerator or burner at any time without first obtaining from the Fire Department a permit to start such fire. Application for such permit must be made to the Chief of the Fire Department responsible for protecting the area where the property is located upon which the applicant desires to start a fire. This section shall be interpreted to mean that no bonfire, campfire or any other kind of open fire can be started at any location in the Village without obtaining a permit as In.erein provided. Section S. Any person convicted of a violation of any provision of this ordinance shall be guilty of a misdemeanor and subject to a fine of not over $100.00 or imprisonment in the County Jail for not more than 90 days. Section 9. Ordinances No. 20, 32 and 50 are hereby repealed. Section 10. This ordinance is deemed to be an emergency ordinance and shall be in effect from and after its passage and publication.
