Resolution Ordering Improvement after Public Hearing (4 votes) DATE: December 16, 2008 INTRODUCTION A special council meeting is being held at 7:00 p.m., Monday, December 15, 2008 to conduct the public hearing for the White Bear Avenue Improvement project. Notices of the public hearing were published three times in the Maplewood Review and twice in the Pioneer Press. Also, all affected property owners were mailed a notice for the hearing in accordance to MN Statute 429. The feasibility study has been provided as a supplement to the packet and has also been placed on the City?s website. The council should consider 2 motions. The first is whether to proceed with a joint project with Ramsey County and the second, assuming that the first passes, whether to use assessments to reimburse the City for our share of the project costs. This second action is done by adopting a resolution ordering the improvement following the public hearing. BACKGROUND The city council authorized the preparation of a feasibility report at the council meeting on August 25, 2008. The completed report was then provided to the council for the November 24, 2008 meeting. At that time the council accepted the study, authorized the preparation of plans and specifications, ordered the public hearing, set a budget, and entered into a cost-share agreement with Ramsey County. As a brief background, the Maplewood Mall Area Transportation Improvement (MMATI) Study identified the White Bear Avenue corridor between Radatz Avenue and County Road D as the most congested and critical segment of roadway in the area. Ramsey County and Maplewood entered into a joint-powers agreement to conduct a corridor study to identify the scope of needed improvements. The report found that existing traffic volumes on White Bear Avenue at I-694 were at 41,500 vehicles per day which far exceeds the projections for traffic on the roadway by a factor of two. The average speed along the corridor was found to be only 8.6 miles per hour. A 2% rate of growth for traffic is expected for the coming years and without improvements the delays will continue to increase. Numerous improvements have already been implemented as part of the MMATI study including the County Road D re-alignment. Two major improvements are needed in the corridor. The first being a major infrastructure improvement to widen White Bear Avenue to a six lane divided roadway with turn lanes and upgraded intersection designs, which is part of the proposed improvements. Ramsey County and Maplewood secured federal funding for the proposed improvements in the amount currently at $7.4 million, as this corridor was chosen as the top project in the reliever category of the Surface Transportation Program. The federal funding must be authorized for use prior to March 2010 or it is returned to the federal government. Public Hearing Packet Page Number Page 1 of 50 WHITE BEAR AVENUE IMPROVEMENTS PAGE TWO The second improvement, which is not part of this project, is upgrading the interchange where White Bear Avenue intersects I-694. This would be a joint project with the Mn/DOT, Ramsey County, Maplewood, and White Bear Lake. This project would likely occur after the major infrastructure upgrades are completed on White Bear Avenue. Projections place this improvement in the realm of $25 million depending on right of way and design issues. The attached feasibility study provides information on proposed improvements, costs, financing, and projected schedule. Prior to bringing the study to council for approval, an open-house meeting was held with the stakeholders on November 6, 2008. There have been numerous meetings over the past years as this project has proceeded through preliminary design and environmental review. Staff addressed questions from property owners and provided maps, exhibits, and other information as requested. Important issues raised by stakeholders at the open-house were potential right-of-way needs for the project and access related issues during construction. As provided in the feasibility study, it is expected that a portion of the project will begin in 2009 which includes a traffic signal installation at County Road D and Southlawn Drive. This will allow for better construction phasing and traffic detouring once the major corridor improvements start along White Bear Avenue from County Road D to Radatz Avenue. It is important to note the consultant preparing the final design plans will also be preparing a construction phasing plan in order to meet expectation of the stakeholders within the corridor. This will stipulate access requirements, temporary signage, notification information, and will continue to be developed with input from business owners between now and the start of construction in 2010. Ramsey County recently sent out a request for proposals to certified professional right-of-way (ROW) acquisition firms. Once a firm is selected in January, and upon completion of a final ROW plan by the consultant, negotiations will commence. Ramsey County will be facilitating this process. Ramsey County is responsible for the entire costs and thus the process for acquisition of property. Maplewood should avoid becoming involved in the process to avoid claims for takings. PROPOSED IMPROVEMENTS The proposed improvements include the following: Reconstruction and widening of approximately 3,600 feet of White Bear Avenue from north of County Road D to north of Radatz Avenue. White Bear Avenue will be widened from 4-lanes to 6- lanes with a concrete pavement section. Reconstruction of approximately 2,500 feet of County Road D between White Bear Avenue and Southlawn Drive. County Road D will be reconstructed to a 4-lane divided section with bituminous pavement. Traffic signal replacement and the construction of turn lane improvements at the intersections of White Bear Avenue and County Road D, Woodlyn Avenue, Lydia Avenue, and Beam Avenue. This includes improvements to the roadway approaches at each of these intersections. New traffic signal construction on County Road D at the Southlawn Drive and Maplewood Mall entrance roadway intersections. Public Hearing Packet Page Number Page 2 of 50 WHITE BEAR AVENUE IMPROVEMENTS PAGE THREE Storm sewer improvements along the segments of White Bear Avenue and County Road D that are being reconstructed. Water main and sanitary sewer improvements along the segments of White Bear Avenue and County Road D that are being reconstructed. We have assumed that this includes minor repair work for the sanitary sewer and the complete replacement of the water main along White Bear Avenue. The construction of a segment of the Lake Links Regional Trail between Southlawn Drive/Legacy Parkway and Ariel Street/County Road D. It should be noted that storm water treatment will be a great challenge on this project in meeting the 1? infiltration requirement. The Maplewood Mall and surrounding sites are composed mostly of impervious areas and partnering on treatment solutions is being explored. Ramsey-Washington Metro Watershed District (RWMWD) has identified innovative solutions to infiltrate and treat storm water on the mall site. RWMWD has stated that the city can meet its treatment requirement offsite since the White Bear Avenue corridor has limited space. RWMWD has also expressed their willingness to contribute funding to address storm water pollution at the source and to improve the quality of the Kohlman Basin. BUDGET The total project budget as reported in the feasibility study is $16,711,000. The city?s capital improvement program projected $3,550,000 as Maplewood?s contribution towards total project costs. The proposed amount identified in the feasibility study as Maplewood?s contribution is $3,374,000. The White Bear Avenue Improvements, Maplewood City Project 08-13 and Ramsey County Project P- 3202, are proposed to be financed through various funding sources. It should be noted that general obligation improvements bonds are not proposed to finance the project. Municipal State Aid funds and specials assessments make up the majority of the Maplewood share as seen above. Also it should be noted that the sunset date for the federal funding is March of 2010. This project provides our business community with a major investment of over $16.7 million, necessary to address a significant traffic congestion issue, and only 10.4% is proposed to be assessed to these businesses. Regarding Maplewood?s funding, additional negotiations are needed with SPRWS to confirm their participation in the water main replacement work included as a part of the project, in addition to negotiating a contribution from Ramsey County towards water main replacement. This feasibility study and report assumes that SPRWS will fund 50% of the cost of the water main replacement work. RECOMMENDATION There are two votes required for this project. It is recommended that the City Council adopted a motion to approve proceeding with the joint project with Ramsey County. This motion requires a majority of the Council to approved proceeding with the improvements. Secondly, it is recommended that the city council approve the attached resolution ordering the improvement of City Project 08-13 (White Bear Avenue Improvements). The resolution requires a super majority (4/5) of the Council to vote affirmative due to the proposal to assess a portion of the project. Attachments: 1. Feasibility Report Public Hearing Packet Page Number Page 4 of 50 RESOLUTION ORDERING IMPROVEMENT AFTER PUBLIC HEARING WHEREAS, a resolution of the city council adopted the 24th day of November, 2008, fixed a date for a council hearing on the proposed street improvements for the White Bear Avenue Improvements, City Project 08-13. AND WHEREAS, ten days mailed notice and two weeks published notice of the hearing was given, and the hearing was duly held on December 15, 2008, and the council has heard all persons desiring to be heard on the matter and has fully considered the same; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, as follows: 1. That it is necessary, cost-effective and feasible, as detailed in the feasibility report, that the City of Maplewood make improvements to White Bear Avenue Improvements, City Project 08-13. 2. Such improvement is hereby ordered as proposed in the council resolution adopted the 15th day of December 2008. 3. The city?s consultant, Kimley-Horn and Associates, Inc., is the designated engineer for this improvement and is hereby directed to prepare final plans and specifications for the making of said improvement. 4. The finance director is hereby authorized to make the financial transfers necessary to implement the financing plan for the project.
