A regular meeting of the City Council of Maplewood, Minnesota, was held in the Council
Chambers, Municipal Building, and was called to order at 7:32 P.M. by Mayor Greavu.

Approved the accounts (Part I - Fees, Services, Expenses - Check No. 003896
through Check No. 003911 - $45,545.83; Check No. 003947 through Check No.

22839 - $45,027.36) in the amount of $462,275.66 be paid.
2. Diseased Shade Tree Program
Resolution No. 79 - 12 - 317
WHEREAS, the Minnesota Department of Agriculture requires all municipalities
wishing to apply for State grant -in -aid funds in 1980 to submit a resolution of
the governing body authorizing the municipal program,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MAPLEWOOD,
MINNESOTA:
1. The City Manager is hereby authorized to execute and submit the
1980 Shade Tree Program application to the Minnesota Department of
Agriculture.
3. Time Extension - Trailer, 3 -M
Approved renewal of a temporary permit to use a mobile home as a temporary
office for a car pool operation at 3 -M Company, Building 216.
4. Hillwood Drive - Dorland Road
Approved that Project Number 79 -17 be closed and Council directed Staff
to investigate additional alternatives in Project No. 78 -10 to account for
the changes in the preliminary plat of the Linwood Heights subdivision. Cost
for review of these alternative proposals to be paid for by the Developer.
5. Private Water Main Agreement - Homart - St. Paul Water Department
Approved the Private Watermain Agreement between Homart Development Company
and the St. Paul Water Department to service Woodring, Inc. (Pizza Hut and
Big Ben).
6. Designation of Official Depository
Resolution No. 79 -12 -318
BE IT RESOLVED, that the Hillcrest Mid America State Bank is hereby designated
as the depository for demand deposits of the City of Maplewood based upon the terms
in their proposal dated December 7, 1979, and
BE IT FURTHER RESOLVED, that funds deposited in said bank may be withdrawn by
check when signed by the signature, or by the facsimile signature, of the Mayor,
City Manager, and City Treasurer, and

BE IT FURTHER RESOLVED, that funds in said bank may be wire transferred at
the request of the City Treasurer or Finance Director for purchases of City in-
vestments, and
BE IT FURTHER RESOLVED, that deposits in said bank shall not exceed the
amount of F.D.I.C. insurance covering such deposit unless collateral or a
bond is furnished as additional security, and
BE IT FURTHER RESOLVED, that this depository designation shall be effective
until a new depository is designated.
7. Transfer of Reforestration Grant
Approved transfer of $3,681.82 reforestration grant money from Special
Assessment Fund to the funds that originally financed the reforestration
costs.
8. Budget Transfer - Animal Control
Approved the budget transfer from 101 -121 -4390 - Police Travel and Training
in the amount of $1,600 to 101 -127 -4480 Animal Control Fees - Services.
9. Purchase of Replacement Fire Vehicle Unit 198.
Authorized purchase of 1980 Ford Fairmont in the amount of $4,978.00 as
replacement for Fire Vehicle Unit 198.
10. Adjustment of Developer's Bill - Crestview Additions
Approved that a transfer of $9,659 be authorized from the General Fund
to the Special Assessment Fund as a credit for in -house engineering,
administrative overhead, and interest expense for the Crestview Addition de-
veloper project.
11. Interceptor Maintenance Agreement for 1980 - No. 129.
Resolution No. 79 -12 -319
RESOLVED, that the Metropolitan Waste Control Commission and the City of
Maplewood agree to renew the Interceptor Maintenance Agreement No. 129 which
is correctly in force between these parties. The terms of the Agreement for
the renewal period shall be the same as those contained in the Agreement which
was executed for the January 1, 1979, December 31, 1979 period with the ex-
ception of Section 6.02:
"Section 6.02 Cost Estimates; Payments." The parties estimate that the
total amount of costs which the Commission will be required to pay to
the Municipality for performance of this Agreement in 1980 will be
$12,000.00. Such amount shall be paid in twelve monthly installments as
an advance payment of such costs. On or before March 1, 1981, the Muni-
cipality will submit to the Commission a detailed statement of the actual
costs incurred by the Municipality which the board is required to pay in
accordance with Section 6.01, and will remit to the Commission any amount
paid to the Municipality which is in excess of such actual costs. If the

total of the monthly advances paid by the board is less than the actual
amount of such costs, the Commission shall pay to the Municipality on
or before April 1, 1981, an amount equal to the difference between the
actual costs and the monthly advances previously paid. The Municipality shall
keep detailed records supporting all costs of the types specified in Section
6.01 which it expects the Commission to pay, and shall make the same available
to the Commission on request.
The renewal period for Interceptor Maintenance Agreement No. 129 shall be January 1,
1980 - December 31,1980. That both parties agree to the renewal period and terms
is evidenced by the signatures affixed to this statement.
12. Joint Use Rental Agreement for 1980 - No. 150 - Metropolitan Waste Control
Commission
Resolution No. 79 -12 -320
RESOLVED, that the Metropolitan Waste Control Commission and the City of Maple-
wood agree to renew the Joint Use Rental Agreement No. 150 under the same terms and
conditions contained in the Agreement which is currently in force between these
parties. The Renewal period for Joint Use Rental Agreement No. 150 shall be Janu-
ary 1, 1980 - December 31, 1980.
That both parties agree to the renewal period and terms is evidenced by the
signature affixed to this statement.
13. Financing of Unassessed Sanitary Sewer Costs - Project 76 -7
Approved authorization to transfer $4;519.06 from the Sewer Fund to the
sinking fund for the 1977 Improvement Bonds - Second Series.
14. Final Payment - Project 75 -16, Water Improvements - English Street
Resolution No. 79 -12 -321
WHEREAS, pursuant to a written contract signed with the City on April 20,
1977, American Fidelity Fire Insurance Company has satisfactorily completed
Water Improvements - English Street, Project 75 -16, in accordance with such
contract;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA,
that the work completed under such contract is hereby accepted and approved; and
BE IT FURTHER RESOLVED, that the City Clerk and Mayor are hereby directed to
issue a proper order for the final payment on such contract, taking the contractor's
receipt in full.
F. PUBLIC HEARINGS
1. Frost Avenue Connection - Project 78 -9, 7:30 P.M.
a. Mayor Greavu convened the meeting for a public hearing regarding the
proposed improvement to construct curb and gutter, watermain and storm
sewer and necessary appurtenances in the following described area: Frost
Avenue Connection between East Shore Drive and Frost Avenue; Frost Avenue
between English Street and Keller Parkway Bridge; and East Shore Drive from

Adele Street to approximately 1000 feet west. The Clerk stated the hearing
notice was in order and noted the dates of publication.
b. Assistant City Engineer Haider presented the specifics of the proposed
improvement.
C. Chairman Les Axdahl presented the following Planning Commission recommenda-
tion:
"Commissioner Kishel moved that the Planning Commission recommend
that the proposed improvement project is consistent with the City Land
Use Plan.
Commissioner Prew seconded Ayes all."
d. Mayor Greavu called for persons who wished to be heard for or against the
proposal. The following voiced their opinions:

e. Mayor Greavu closed the public hearing.
f. Councilman Wiegert introduced the following resolution and moved its adoption:

WHEREAS, after due notice of public hearing on the construction of
watermains, storm sewers, curb and gutters and appurtenances on Frost
Avenue, Frost Avenue Connection, and East Shore Drive, a hearing on said
improvement in accordance with the notice duly given was duly held on
December 20, 1979, and the Council has heard all persons desiring to
be heard on the matter and has fully considered the same;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA,
as follows:
1. That it is advisable, expedient and necessary that the City
of Maplewood construct watermains, storm sewers, curb and gutters
and appurtenances on Frost Avenue, Frost Avenue Connection, and
East Shore Drive as described in the notice of hearing thereon, and
orders the same to be made.
2. William Bittner, City Engineer, is designated engineer for
this improvement is hereby directed to prepare final plans and
specifications for the making of said improvement.
3. This improvement is hereby designated to be a part of Maplewood
Project 78 -9.
Seconded by Councilman Nelson. Ayes - all.
Mayor Greavu recessed the meeting at 8:07 P.M. to convene as the Board of Adjust-
ments and Appeals.

Mayor Greavu reconvened the meeting at 8:18 P.M.
3. Linwood Heights Townhouses - Castle Design, 8:00 P.M.
a. Mayor Greavu convened the meeting for a public hearing regarding the
request of Castle Design and Development Company for a special use permit
and subdivision of land on a parcel of land located north of Linwood Avenue,
east of McKnight Road and south of Teakwood Drive. The Clerk stated the
hearing notice was in order and noted the dates of publication.
b. Manager Evans presented the Staff report with the following recommendations:
1. Approval of the Planned Unit Development, subject to the finding
by the Community Design Review Board that the buildings are of a scale,
design, and location that is compatible with single family homes in any
adjacent RL area.
Approval is on the basis that the project meets the first three criteria
of the RLE designation. The fourth criteria dealing with the design of
the units, shall be determined by the Community Design Review Board
during building and site plan review.
2. Approval of the Preliminary Plat, subject to the following conditions:
a. The final plat shall not be approved, unless:
1. Council orders Hillwood Drive from the east side of
the Crestwood Knolls Plat to McKnight Road, including
sanitary sewer, water, storm sewer, and storm water re-
tention ponds.
2. Council orders Dorland Road from proposed Hillwood
Drive to Linwood Avenue, including sanitary sewer, water,
storm sewer, and a storm water retention pond.
3. The lot split is approved by Council and the property for
Dorland Road is deeded to the City.
4. The City Attorney has reviewed and approved the by -laws
and rules of the proposed homeowners' association to assure
all common areas are maintained.
b. Redesignate the common areas as outlots.
c. Approval of final grading and drainage plan by the City
Engineer.
d. Approval of a Planned Unit Development.
3. Approval of the lot split, subject to the deeding of the property for
Dorland Road to the City.

c. Chairman Les Axdahl presented the following Planning Commission recommenda-
tions:
Commissioner Sherburne moved that the Planning Commission recommend to
the City Council approval of the Planned Unit Development, subject to
the finding by the Community Design Review Board that the buildings are
of a scale, design, and location that is compatible with single family
homes in the adjacent RL area.

g. Councilman Anderson moved to approve the preliminary plat for Linwood
Heights Townhouse subject to the conditions given in the Planning Commis-
sion recommendation.
Seconded by Councilman Wiegert. Ayes - all.
h. Councilman Anderson moved to approve the lot split as requested subject
to the deeding of the property for Dorland Road to the City.
Seconded by Councilman Wiegert. Ayes - all.
i. Councilman Anderson introduced the following resolution and moved its
adoption:

WHEREAS, a petition was filed with the City of Maplewood as provided under
Section 915.010 of the Municipal Code of the City of Maplewood, said petition
having been signed by more than 50% of the owners of property within 200 feet
of the property described as follows:
Unplatted Lands except the South 500 feet and except the West 1
rod of Section 12, Township 28, Range 22 also:
The West 60 feet of the East 530 feet of the South 500 feet of the
E12 of the SW; of the SW% of Section 12, Township 28, Range 22, also:
The West 16.5 feet of the E25 of the SA of the SW; of Section 12,
Township 28, Range 22, except the South 500 feet, also:
The W25 of the SA of the SW% of Section 12, Township 28, Range 22,
except the South 700 feet of the West 500 feet and except the West
530 feet lying North of the South 700 feet thereof.
which has been proposed for Special Use Permit.
WHEREAS, a public hearing was held on December 20, 1979, at 8:00 P.M. in the
City Hall, notice thereof having been duly published in the official City news-
paper, and notices of said hearing having been mailed to all property owners of
record within 200 feet of the area proposed for special use permit for Planned
Unit Development to construct 44 townhouses on property zoned F -R (Farm Resi-
dence); and
WHEREAS, the City Planning Commission has made its recommendations;. and
WHEREAS, it appears for the best interest of the public that said petition
be granted;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA,
that the petition for the above described Special Use Permit for Planned Unit
Development to construct 44 townhouses on property zoned F -R (Farm Residence)
be granted, subject to all conditions contained in the Planning Commission re-
port.
Seconded by Councilman Wiegert. Ayes - all.

4: Rezoning and office Use Approval - Roselawn Avenue and McMenemy Street, 8:15 P.M.
a. Mayor Greavu convened the meeting for a public hearing regarding the
request of DeCoster Company to rezone Lot 1, Block 3, Maplewood Office Cen-
ter from F -Farm Residence to LBC - Limited Business Commercial. The Clerk
stated the hearing notice was in order and noted the dates of publication.
b. Manager Evans presented the Staff report with the following recommenda-
tion:
Approval of the rezoning from F, Farm Residence to LBC, Limited Busi-
ness Commercial, based on the following:
1. The intent of the Land Use Plan is to provide a natural transi-
tion in intensity of use from I -35E to the homes east of McMenemy
Street.
2. An LBC zoning is designed to provide this transition.
3. The homes to the north are also planned for Service Commercial
development.
Approval of an office use, with the understanding that:
1. Specific building and site plans must still be approved.
2. Adequate sewer service must be provided for building and site
plan approval.
C. Chairman Les Axdahl presented the following Planning Commission recommenda-
tion:
Commissioner Fischer moved the Planning Commission recommend to the
City Council approval of the rezoning from F, Farm Residence to LBC,
Limited Business Commercial, based on the following:
1. The intent of the Land Use Plan is to provide a natural transi-
tion in the intensity of use from I -35E to the homes east of Mc-
Menemy Street.
2. An LBC zoning is designed to provide this transition.
3. The homes to the north are also planned for Service Commercial de-
velopment.
Commissioner Kishel seconded. Ayes all.
Commissioner Fischer moved the Planning Commission recommend to the City
Council approval of the office use with the condition that:
1. Specific building and site plans must still be approved.
2. Adequate sewer service must be provided for building and site plan
approval.

d. Mr. Doug DeCoster, DeCoster Company, the applicant, spoke on behalf of
his proposal.

g. Councilman Wiegert introduced the following resolution and moved its
adoption:

WHEREAS, a petition was filed with the Council of the City of Maplewood
by the owner of the following described property, and a hearing was set as
provided under Section 915.020 of the Municipal Code of the City of Maple-
wood:
Lot 1, Block 3, Maplewood Office Center
which has been proposed for rezoning from F (Farm Residence) to LBC (Limited
Business Commercial); and
WHEREAS, a public hearing was held on December 20, 1979, at 8:15 P.M. in
the City Hall, notice thereof having been duly published in the official City
newspaper, and notices of said hearing having been mailed to all property
owners of record within 350 feet of the area proposed for rezoning; and
WHEREAS, all objections and recommendations relative thereto were heard
by the City Council; and
WHEREAS, it appears for the best interest of the public that said petition
be granted;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, that the
petition for the above described rezoning be granted subject to the Planning
Commission recommendation.

5. Special Use Permit - Roselawn Avenue and Payne Avenue - Ostrand
a. Mayor Greavu convened the meeting for a public hearing regarding the re-
quest of Mr. George Ostrand, 1695 Ames Avenue, for a Special Use Permit to
construct a double dwelling in an R -1, Single Family Residence Zoned District
on Lot 2, Block 1, Kortus Addition. The Clerk stated the hearing notice was
in order and noted the dates of publication.
b. Manager Evans presented the Staff report with the following recommendation:

Approval of the Special Use Permit for a two - family home in an R -1 Single
Family Residence District, based on the following:
1. Approval of the Special Use Permit would comply with the intent of the
Land Use Plan for areas classified RL.
2. The site would not exceed the density allowed by the Land Use Plan for
RL areas.
Approval of the permit is contingent on:
1. A detailed drainage plan must be approved by the City Engineer, showing
existing and final grade elevations of the lot, the ditch, and the base-
ment floor elevation of the building.
2. Erosion controls to be implemented during construction, as suggested by
the Soil Conservation Service during plat review.
c. Chairman Les Axdahl presented the following Planning Commission recommendation:

in an R -1 Single Family Residence District based on the following:

Commissioner Fischer seconded.
The applicant said he would talk to the adjoining property owners re-
garding the proposed plan.

Minnesota, as follows:
WHEREAS, Rodney M. Gingrich has applied for a used car lot license
at 1909 Clarence Street in the City of Maplewood; and
WHEREAS, the Council of the City of Maplewood finds the following
facts:

1. The subject property abuts on residential property and the
nature of the business is such as to unduly interfere with
the peaceful enjoyment of said residential properties;
2. It is located immediately across Clarence Street from the
Gladstone Fire Station exits and, again, the nature of the
business attracting cars parking in the area may be detri-
mental to the egress from said fire station thereby negatively
interfering with the emergency service.
3. There is no physical definition on the property as to where
the used car lot would be maintained. There are no curbs,
gutters or defined entrance or exit routes or a boundary line
between the proposed used car lot and parking necessary for the
current use of the building on said site.
4. That the City of Maplewood is trying to preserve and maintain
the esthetic values of this downtown Maplewood and such a use
of the property would be detrimental to said objective.
5. There is a sloping on the property away to the Southwest which
would cause polluted drainage to flow over residential properties.
WHEREFORE, IT IS HEREBY RESOLVED by the Council of the City of Maplewood,
Ramsey County, Minnesota, that in view of all of the above findings and based
upon said findings, the application for a used car license is hereby denied.

I. VISITOR PRESENTATION
1. Mr. Donald Nelson, owner of property on Beam Avenue west of White Bear Avenue.
a. Mr. Nelson stated he has been told different versions of the policy
regarding Beam Avenue openings. One time, he was told there could not be
any openings, the next time that they were being allowed.
b. Councilman Wiegert moved to refer to Staff to develop Council's policy
relating to Beam Avenue openings in an understandable form.

J. NEW BUSINESS
1. Resolution on Permit- License Fees
a. Manager Evans stated the City's tax levy for 1979 represented an increase
from 90% to 100% of the levy limit. For 1980, the tax levy again is at 100% of
the levy limit. With inflation presently exceeding 12% and the levy limit based
upon a 6% per capita increase, the City is being forced to increase non -tax reve-
nues to maintain existing services. Recently the Council approved an increase in
paramedic /ambulance service charges to finance a greater portion of these services
with non -tax revenue. Annually recreation program fees are reviewed and revised
as needed to offset increased costs. However, with a few exceptions, license and
permit fees have not been increased since 1970. (On -Sale liquor licnese fees were
increased by $500 in 1977 and electrical permit fees were increased by 25% in
1978.) Therefore, based upon a comparison with fees charged by other cities,

Staff is recommending an increase in Maplewood's license and permit fees.

BUILDING FEE DATA
Where plans are incomplete, or changed so as to require additional plan checking,
an additional plan -check fee shall be charged at a rate established by the Building
Official.
Expiration of Plan Check. Application for which no permit is issued within 180 days
following the date of application shall expire by limitation and plans submitted for
checking may thereafter be returned to the applicant or destroyed by the Building Official.
The Building Official may extend the time for action by the applicant for a period not
exceeding 180 days upon written request by the applicant showing that circumstances
beyond the control of the applicant have prevented action from being taken. In order to
renew action on an application after expiration, the applicant shall resubmit plans and
pay a new plan -check fee.
Reinspection Fee. The fee for each reinspection shall be $10.00.

General. All construction or work for which a permit is required shall be subject
to inspection by the Building Official, and certain types of construction shall have
continuous inspection by special inspectors.
A survey of the lot may be required by the Building Official to verify compliance
of the structure with approved plans.

The issuance of a permit based upon plans and specifications shall not prevent the
Building Official from thereafter requiring the correction of errors in said plans and
specifications or from preventing building operations being carried on thereunder when
in violation of this or any other ordinance of the City or State Building Code.
Expiration. Every permit issued by the Building Official shall expire by limitation
and become null and void, if the building or work authorized by such permit is not commenced
within 120 days from the date of such permit, or if the building or work authorized by
such permit is suspended or abandoned at any time after the work is commenced for a
period of 120 days. Before such work can be recommenced a new permit shall be first
obtained so to do, and the fee therefor shall be one -half the amount required for a new
permit for such work, provided no changes have been made or will be made in the original
plans and specifications for such work; and provided, further, that such suspension or
abandonment has not exceeded one year.
Suspension or Revocation. The Building Official may, in writing, suspend or revoke
a permit issued whenever the permit is issued in error or on the basis of incorrect in-
formation supplied, or in violation of regulations.
Fees
Building Permit Fees. A fee for each building permit shall be paid to the Building
Official as set forth in Table No. A.
The determination of value or valuation under any of the provisions shall be made by
the Building Official. The valuation to be used in computing the permit and plan -check
fees shall be the total value of all construction work for which the permit is issued,
as well as all finish work, painting, roofing, electrical, plumbing, heating, air con -
ditioning, elevators, fire - extinguishing systems and any other permanent work or permanent
equipment.
Where work for which a permit is required is started or proceeded with prior to
obtaining said permit the fees specified in Table No. A shall be doubled, but the payment
of such double fee shall not relieve any persons from fully complying with the requirements
herein stated in the execution of the work not from any other penalties prescribed herein.
Plan- checking Fees. When the valuation of the proposed construction exceeds $1,000.00
and a plan is required to be submitted, a plan checking fee shall be paid to the Building
Official at the time of submitting plans and specification for checking.
Said plan- checking fees shall be the same as in State Building Code.

1. The Contract for 1980 with A.F.S.C.M.E., AFL -CIO Council Supervisors'
Local No. 1056 as presented.
2. 8% salary increase for all non -union personnel (except the Manager)
plus a floating Holiday for those who do not presently have two,
and a fifth week of vacation after 20 years.
3. A reclassification of the Director of Community Development's posi-
tion and an additional $975.00 for that position. The Patrol Lieu-
tenant be placed on par with the Administrative Lieutenant. (An
additional $211.00 to that positon.)
4. Establish the salary of the two Naturalists at $13,500 per year.
5. An additional 1% increase added to the already approved 7% for the
Police Sergeants for 1980.
6. The Director of Emergency Preparedness salary be decreased from
$290.00 to $140.00 a month as requested.
7. Salaries for non -union personnel be considered maximum.
8. Authorized appropriate budget transfers from the contingency account
in the 1980 Budget to the salary account to cover the increases.

interests we should investigate the possibility of a joint cable televi-
sion franchise.
It has been suggested that a Cable T.V. committee as required under the
law be established for these communities with possibly two representatives
from each city. I understand from the City Clerk that you have received
communications from several citizens indicating their interest in serving
on a Cable T.V. committee.
The Minnesota Cable Communications Board has been advised by those cities
mentioned above who were not in the proposed Capitol City Cablevision .
territory of their desire to be included so that they can work with us to
establish a franchise area.
5. Park and Recreation Commission Appointments

6. Condemnation - Cope Avenue Park Acquisition
a. Manager Evans stated the City Attorney has advised that the primary owner
of this proposed park site, Mr. Kavanagh, has rejected our offer to purchase
his land. Our offer was the full appraised value as determined by Mr. Winfield
Mitchell.
I have reviewed this situation with Mr. Bannigan and the State Planning Agency
Staff. It is recommended that the City Attorney be authorized to proceed with
eminent domain proceedings for Mr. Kavanagh's property contained within the
proposed Cope Avenue park site.
The Council should make a finding -that this acquisition is based on the facts
presented in the Brauer Park and Open Space Study completed in 1974. This
plan recommends the acquisition of the Cope Street Park within two to five
years.

authorize the City Attorney to proceed with eminent domain proceedings for

L. ADMINISTRATIVE PRESENTATION
1. Signalization at Kennard and Larpenteur Avenue
a. Manager Evans stated at 7:00 P.M. on December 19 at the request of Mayor
Greavu, Lt. Dennis Delmont represented the City at a meeting at Presentation
School, Larpenteur and Kennard. The purpose of the meeting was to discuss
the possibility and feasibility of installing traffic control signals at.the
interesection of Larpenteur and Kennard. There was lengthy discussion between
State Representative Randy Kelly, County Commissioner Hal Norgard, two members
of the County Engineers Office and approximately 18 residents. The County
Engineers Office reiterated the fact that there was not sufficient warrant
for signalization when traffic studies were conducted in 1972. Mr. Norgard
said he would like to see a new, more current study made, and would order
one if the Maplewood Council would request it of the County Board. As this
is a long standing and volatile issue, it appears to make sense that the in-
volved municipalities be kept aware of the most current conditions.

2. Minnesota Government Data Practices Act

WHEREAS, the Minnesota Government Data Practices Act, Minnesota Statutes,
Section 15.1611 to 15.1698 as amended, requires that this city appoint one
person as the Responsible Authority to administer the requirements for col-
lection, storage, use and dissemination of data on individuals, government
data, and summary data, within this city and,
WHEREAS, the City Council is concerned with the responsible use of city
data and wishes to satisfy this concern by immediately appointing an admini-
stratively qualified Responsible Authority as required under the Act and
assigning duties to that person;

NOW THEREFORE, BE IT RESOLVED. BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA:
1, The City Council of Maplewood, Minnesota, appoints City Manager
Barry Evans, As; the Responsible Authority for the purposes of meeting
all requirements ofthe - Minnesota Government Data Pratices Act, Minne-
sota Statutes, Section 15.1611 through 15,1698, as amended. (Note: an
individual must be appointed, rather than designating this duty to an
office. If a different person is appointed later as the Responsible
Authority, this portion of the resolution must be amended to indicate
the name of the new Responsible Authority.)
2, The - Responsible Authority may designate a city employee or employees
to assist in the - administration and enforcement of the duties of the
Responsible Authority and to be in charge of individual files or systems
containing government data and to receive and comply with requests for
government data. If the Responsible Authority appoints a designee or
designee$, this appointment must be in writing, and the City Council
shall be provided a copy of the appointment. If designees are appointed,
the Responsible Authority shall instruct the designees in the require-
ments of administering and enforcing the Minnesota Government Data
Practices Act. (Note. this is permitted under M.S. 15.1621, Subd. 2.)
3. The duties of the Responsible Authority and designees are as follows:
a. The Responsible Authority shall keep records containing
government data in such an arrangement and condition as to
make them easily accessible for convenient use by the public.
Photographic, photostatic, microphotographic, or microfilmed
records shall be considered as accessible for convenient use
regardless of the size of these records.
b, The Responsible Authority shall establish procedures to
insure that requests for government data are received and com-
plied With in an appropriate and prompt manner.
c, The Responsible Authority or designee shall, upon request
by any person, permit that person to inspect and copy government
data during the normal business hours of the City and at places
provided by the Responsible Authority, and if the person requests,
that person shall be informed of the data's meaning. The Re-
sponsible Authority or designee shall provide copies of government
data upon request, The Responsible Authority or designee shall
require the requesting person to pay the actual cost of making,
certifying and compiling the copies. If the Responsible ` Author
ity or designee is not able to provide copies at the time a request
is made,the - Responsible Authority or designee shall supply copies
as soon as reasonably possible. If the Responsible Authority or
designee determines that the requested government data is classi-
fied so as to deny the requesting person access, the Responsible
Authority or designee shall so inform the requesting person orally
At the time of the request, and in writing as soon thereafter as
possible, and shall cite the statute, temporary classification, or
federal law upon which the determination is made.

d. The Responsible Authority shall prepare a public docu-
ment containing his name, title and address, and a descrip-
tion of each type of record, file, or process relating to
private or confidential data on individuals retained by the
City.. Forms used to collect private and confidential data
shall be included in this document. The Responsible Author-
ity shall update the public document annually and make any
changes necessary to maintain the accuracy of the document.
e. The Responsible Authority shall establish procedures to
assure that all data on individuals is accurate, complete
and current for the purposes for which it was collected; and
establish appropriate security safeguards for all records
containing data on individuals.
f. The Responsible Authority or designee shall prepare sum-
mary data from private or confidential data on individuals
upon the request of any person, provided that the request is
in writing and the cost of preparing the summary data is borne
by the requesting person. The Responsible Authority may delegate
the power to prepare summary data to the administrative officer
respons ble.for any central repository of summary data; or to a
person outside of the City if the person, in writing, sets forth
his purpose and agrees not to disclose, and the Responsible
Authority reasonably determines that the access will not com-
promise private or confidential data on individuals.
g. The Responsible Authority shall prepare a public document
setting forth the rights of the data subject pursuant to the
Minnesota Government Data Practices Act and the specific pro -
cedures in effect in the City for access by the data subjects
to public or private data on individuals.
h. The Responsible Authority or designee shall allow another
Responsible Authority or designee access to data classified as
not public only when the access is authorized or required by
statute or federal law. The Responsible Authority or designee
when supplying government data under this provision may require
the requesting Responsible Authority to pay the actual cost of
supplying the data.
i. The Responsible Authority shall, when appropriate, apply to
the Commissioner of Administration for permission to classify tem-
porarily data or types of data on individuals as private or con-
fidential, or data not on individuals as non - public, on a tem-
porary basis until a proposed statute can be acted upon by the
Legislature.
j. Upon request to the Responsible Authority, or designee, any
individual must be informed whether he is the subject of stored
data on individuals, and whether it is classified as public,
private or confidential. Upon further request, the individual who
is the subject of stored private data on individuals shall be
shown the data without any charge to him and, if he desires, shall
be informed of the content and meaning of that data. The Responsible

Authority or designee shall provide copies of the private
data upon request by the individual subject of the data, and
the cost of providing copies shall be borne by the individual.
The Responsible Authority or designee shall comply immediately,
if possible, with any request made by an individual under this
paragraph, or within five days of the date of the request, ex-
cluding Saturdays, Sundays and legal holidays, if immediate
compliance is not possible. If the Responsible Authority or
designee cannot comply with the request within that time, he
shall so inform the individual, and may have an additional five
days within which to comply with the request, excluding Satur-
days, Sunday and legal holidays.
k, If an individual contests the accuracy or completeness of
public or private data concerning himself, and notifies in
writing the Responsible Authority describing the nature of the
disagreement, the Responsible Authority shall within thirty
days either correct the data found to be inaccurate or incom-
plete and attempt to notify past recipients of inaccurate or
incomplete data, including recipients named by the individual;
or notify the individual that the Responsible Authority be-
lieves the data to be correct. Data which is in dispute shall be
disclosed only if the individual's statement of disagreement is
included with the disclosed data.
4,. This resolution implementing the Minnesota Government Data Practices
Act shall remain in force and effect until modified by the City Council.
