CALL TO ORDER A regular meeting of the City Council of Maplewood, Minnesota, was held in the Council Chambers, Municipal Building and was called to order at 7:33 P.M. B. ROLL CALL John C. Minutes of Meeting No. 79 -25 (October 4, 1979) Councilman Wiegert moved to approve the Minutes of Meeting No. 79 -25 (October 4, 1979) as submitted. Seconded by Councilman Murdock. Ayes - all. 2. Closing of Construction Account for Londin Lane Improvement The Construction Account for the Londin Lane Improvement 71 -12 approved to be closed by the following actions: 1) The special assessments receivable be transferred to the debt service account for the G.O. Bonds of 1973 and (2) the remaining cash in this account be transferred to the construction account for Project 76 -7, Mailand Road Improve- ment. 3. State City Engineers Association - Public Works Director Approval of travel and training of the Director of Public Works Bill Bittner to attend the State City Engineer's Association Annual Conference in Alexandria, Minn- esota, from January 14 thru 17, 1980. 6. Racchini and Associates prepare the plans and specifications for the construction of the new fire station at Lower Afton Road and Londin Lane. F. PUBLIC HEARINGS 1. Rezoning /Plan Amendment: McKnight Road and Minnehaha - 3M - 7:30 P.M. a. Mayor Greavu convened the meeting for a public hearing regarding a request of the 3M Company for a rezoning from B -C, Business- Commercial to M -1, Light Manufacturing and a Plan Amendment from LSC, Limited Service Commercial to DR, Development and Research, the Southeast corner of McKnight Road and Minnehaha Avenue. The Clerk stated the hearing notice was in order and noted the dates of publication. b. Manager Evans presented the staff report. c. Chairman Les Axdahl presented the following Planning Commission recommendation: - 3 - 11/15 "Commissioner Sherburne moved the Planning Commission recommend to the City Council approval of the M -1, Light Manufacturing Zone, based on the following: 1. An office - research use would beimore attractive and compatible with the surrounding area than the existing drive -in. 2. The surrounding property is planned for development- research use and zoned M -1. 3. A new development- research zoning district should be established for 3M's property with the future revision of the zoning ordinance. Commissioner Pellish seconded. Ayes - 8. Commissioner Pellish moved that the Planning Commission recommend approval of the Comprehensive Plan Amendment from LSC to DR based on the following: 1. A continuation of the 3M development- research facility would produce a better tax base, more jobs, and should be more attractive than the existing drive -in use. 2. The proposed amendment would be a logical extension of the existing DR property owned by 3M to the east and south. 3. Including the present LSC parcel with the surrounding 3M land will increase flexibility in site design- creating opportunities for more landscaped areas and better traffic circulation. Commissioner Kishel seconded. Ayes - 8 d. Mr. Bob Saules, representing 3M Real Estate Department, spoke on behalf of the proposal. e. Mayor Greavu called for proponents. None were heard. f. Mayor Greavu called for opponents. None were heard. g. Mayor Greavu closed the public hearing. h. Councilman Wiegert introduced the following resolution and moved its adoption: 79 - 11 - 301 WHEREAS, a petition was filed with the Council of the City of Maplewood by the owner of the following described property, and a hearing was set as provided under Section 915.020 of the Municipal Code of the City of Maplewood: The N 785 ft of the NW 1/4 of the NW 1/4 of Section 36, Township 29, Range 22 which has been proposed for rezoning from BC to M -1; and WHEREAS, a public hearing was held on November 15, 1979 at 7:30 P.M. in the City Hall, notice thereof having been duly published in the official City news- paper, and notices of said hearing having been mailed to all property owners of record within 350 feet of the area proposed for rezoning; and - 4 - 11/15 WHEREAS, all objections and recommendations relative thereto were heard by the City Council; and WHEREAS, it appears for the best interest of the public that said petition be granted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, that the petition for the above described rezoning be granted. Seconded.by Councilman Nelson. Ayes - all. i. Councilman Wiegert introduced the following resolution and moved its adoption: 79 - 11 - 302 WHEREAS, the Maplewood City Council and the Maplewood Planning Commission have prepared and adopted a Comprehensive Community Plan in compliance with the require- ments of Section 462.355 of the State Planning Enabling Legislation; and WHEREAS, said Section 462.355 provides for subsequent amendment of said Com- prehensive Plan which reflect changed conditions; and WHEREAS, the Maplewood Planning Commission has conducted the required public hearing and has given consideration to all evidence and testimony submitted at such hearing held on November 5, 1979 and has adopted said amendment and forwarded said amendment to the City Council for certification; and WHEREAS, the Maplewood City Council has reviewed said amendment; NOW, THEREFORE, BE IT RESOLVED that the Maplewood City Council hereby adopts and amends the Comprehensive Plan for Maplewood. Seconded by Councilman Anderson. Ayes - all. 2. Rezoning - Eldridge Avenue - Schreier - 7:45 P.M. a. Mayor Greavu convened the meeting for a public hearing regarding a request of Richard Schreier to rezone Lot 13, Block 1, DeSoto Park Second Addition from R -1 to $ -2. The Clerk stated the hearing notice was found to be in order and noted the dates of publication. b. Manager Evans presented the staff report. c. Chairman Les Axdahl presented the following Planning Commission recommendation: "Commissioner Sherburne moved the Planning Commission recommend to the City Council approval of the rezoning from R -1 to R -2 on the basis that: 1. Council had previously intended to rezone this lot in return for the abandon- ment of the 1973 PUD. This was not done, because of an administrative over- sight. 2. The rezoning would be consistent with the Land Use Plan. Commissioner Barrett seconded. Ayes all." d. Mr. Richard Schreier, 2125 DeSoto Street, the applicant, spoke on behalf of the proposal. - 5 - 11 /15 e. Mayor Greavu called for proponents. None were heard. f. Mayor Greavu called for opponents. The following were heard: Mr. Marty Ferris, 2112 Burr Street; Mr, and Mrs. Lenon Bean, 2098 Burr Street, submitted a letter of opposition; Mr. Jim Bergan, 2113 Burr Street; Letter from Mr. Herbert Douglas, 2099 Burr Street; Ms. Joan Arndt, 478 Eldridge Street; Mr. Mark Thompson, 2078 Burr Street. g. Mayor Greavu closed the public hearing. h. Mayor Greavu moved to delay action due to the past history of this property, to allow the attorneys to clarify the City's position. Seconded by Councilman Murdock. Ayes - all. 3. Special Use Permit - 2720 Stillwater Road - Knowlans - 8:00 P.M. a. Mayor Greavu convened the meeting for a public hearing regarding the request of Knowlan's for a special use permit to construct a parking lot on property zoned R -l. The Clerk stated the hearing notice was in order and noted the dates of publication. b. Manager Evans presented the staff report. c. Chairman Les Axdahl presented the following Planning Commission recommendations: "Commissioner Sherburne moved that the Planning Commission recommend to the City Council the granting of the special use permit for a parking lot at 2730 Stillwater Road based on the following: 1. A portion of the lot is already designated SC, Service Commercial 2. The proposed parking lot would be consistent with the SC designation. 3. The goal of using the Rm designation as a buffer zone on the subject lot can be achieved by the use of landscaping or fencing for screening. Approval is conditioned on the following: 1. A landscaping plan shall be submitted for approval by the Community Design Review Board, which provides for heavy screening along the westerly lot line and as wide a setback as the parking layout will allow. 2. The applicant shall provide the City with an irrevocable letter of credit to guarantee the removal of the house and garage. 3. An access to the rear of the adjacent lot, Lot 4, Block 1, Midvale Acres, be negotiated to both the acceptance of Knowlan's and Mr. Jasinski. Commissioner Kishel seconded. Ayes all." d. Mr. Mike Galvan, Jr., representing Knowlans spoke on behalf of the proposal. e. Mayor Greavu called for proponents. The following were heard: Mr. Lee Jasinski, 2702 Stillwater Road (He requested a right of way for him to enter his garage from the parking lot). Mr. Bill Lorenz, 2659 Stillwater Road; - 6 - 11/15 Several residents in the area expressed their desire to have Knowlans reopened. f. Mayor Greavu called for opponents. None were heard. g. Mayor Greavu closed the public hearing. h. Councilman Murdock introduced the following resolution and moved its adoption: 79 - 11 - 303 WHEREAS, a petition was filed with the City of Maplewood as provided under Section 915.010 of the Municipal Code of the City of Maplewood, said petition having been signed by more than 50% of the owners of property within 200 feet of the property described as follows: Lot 3, Block 1, Midvale Acres which has been proposed for Special Use Permit. WHEREAS, a public hearing was held on November 15, 1979, at 8:00 P.M. in the City Hall, notice thereof having been duly published in the official City newspaper, and notices of said hearing having been mailed to all property owners of record within 200 feet of the area proposed for special use permit to construct a parking lot on R -1 zoned property; and WHEREAS, the City Planning Commission has made its recommendations; and WHEREAS, it appears for the best interest of the public that said petition be granted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the petition for the above described Special Use Permit to construct a parking lot on R -1 (Single Family) zoned property be granted, subject to all con- ditions contained in the staff report. Seconded by Councilman Nelson. Ayes - all. G. AWARD OF BIDS None. H. UNFINISHED BUSINESS 1. George Holter - Old Public Works Facility a. Mr. Holter, Richfield Bus Company, spoke on behalf of his request to use the former public works facility for storage of buses. b. Councilman Murdock moved to deny Mr. Holters request hold to the agreement that the building be removed by De Seconded by Councilman Wiegert. Ayes - Mayor Greavu; Councilmen Murdock, Nelson and Wiegert. Nays - Councilman Anderson. - 7 - 11/15 I. VISITOR PRESE14TATIONS None. J. NEW BUSINESS 1. Ordinance to Increase Sewer Rates - First Reading a. Manager Evans presented the staff report. b. Mayor Greavu moved first reading of an ordinance to increase the sewer rates as recommended in the staff report. Seconded by Councilman Wiegert. Ayes - all. 2. Paramedic Ambulance Services - Charges for 1980 a. Manager Evans presented the staff report. b. Councilman Anderson introduced the following resolution and moved its adoption: 79 -11 -304 WHEREAS, the City of Maplewood needs revenue from service charges to cover costs in excess of the specially authorized tax levy for the paramedic program; and WHEREAS, the City of Maplewood is authorized to impose reasonable charges for emergency and paramedic ambulance services by Minnesota Statutes 471.476 and by special laws (Chapter 426, Laws of 1975, and Chapter 743, Laws of 1978); and WHEREAS, it is fair and reasonable to charge for services rendered based upon the length of time services are provided between arrival at the scene and arrival at the hospital or clinic. NOW, THEREFORE, BE IT RESOLVED, that the following charges shall be effective January 1, 1980: Charge Length of Time Services Rendered $120 Over 50 minutes $ 80 31 - 50 minutes $ 40 11 - 30 minutes BE IT FURTHER RESOLVED, that there shall be no charge for services rendered when the length of services is 10 minutes or less, when the patient is not trans- ported, or when the patient is transported to the detoxification center. Seconded by Councilman Wiegert. Ayes - all. 3. Tax Increment Financing Proposal - Maplewood.. Knolls a. Manager Evans presented the staff report. b. Councilman Murdock moved to deny the request of the Maplewood Knolls developer for tax increment financing and that the Council deliberations be forwarded to the Maplewood Housing and Redevelopment Authority. - 8 - 11/15 Seconded by Councilman Anderson. Ayes - all. 4. Feasibility Study - Frost Avenue, Frost Avenue Connection and East Shore Drive Improvements 78 -9 a. Manager Evans presented the staff report. b. Councilman Wiegert introduced the following resolution and moved its adoption: 79 - 11 - 305 WHEREAS, the City Engineer for the City of Maplewood has been authorized and directed to prepare preliminary plans for the improvement of Frost Avenue Connect- ion and East Shore Drive, Maplewood Project 78 -9, by construction of curb and gutter, watermain and storm sewer and necessary appurtenances; and WHEREAS, the said City Engineer has prepared the aforesaid preliminary plans for the improvement herein described: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, as follows: 1. The report of the City Engineer advising this Council that the proposed improvement on Frost Avenue and East Shore Drive, Maplewood Project 78 -9, is feasible and should best be made as proposed, is hereby received. 2. The Council will consider the aforesaid improvement in accordance with the reports and the assessment of benefited property for all or a portion of the cost of the improvement according to M.S.A. Chapter 429, at an estimated total cost of the improvement of $261,200. 3. A public hearing will be held in the Council Chambers of the City Hall at 1380 Frost Avenue on Thursday, the 20th day of December, 1979, at 7:30 P.M. to consider said improvement. The notice for said public hearing shall be in substantially the following form: NOTICE OF HEARING OF PUBLIC IMPROVEMENT TO WHOM IT MAY CONCERN: WHEREAS, the City Council of the City of Maplewood, Ramsey County, Minnesota, deems it necessary and expedient that the improvement hereinafter described, be made; NOW, THEREFORE, notice is hereby given that the City Council will hold a public hearing on said improvement at the following time and place within the said City: Date and Time: December 20, 1979 at 7:30 P.M. Location: Council Chambers of the City Hall, 1380 Frost Avenue The general nature of the improvement is the construction of curb and gutter, watermain and storm sewer and necessary appurtenances in the following described area: Frost Avenue Connection between East Shore Drive and Frost Avenue; Frost Avenue between English Street and Keller Parkway Bridge; and - 9 - 11/15 East Shore Drive from Adele Street to approximately 1000 feet West, Maplewood Project 78 -9. The total estimated cost of said improvement is $261,200. It is proposed to assess every lot, piece or parcel of land benefited by said improvement whether abutting thereon or not, based upon benefits received without regard to cash valuation. Persons desiring to be heard with reference to the proposed improvement should be present at this hearing. This Council proposes to proceed under the authority granted by Chapter 429 M.S.A. Manager Evans presented the staff report. b. Councilman Murdock introduced the following resolution and moved its adoption: 79 - 11 - 306 WHEREAS, the Land and Water Conservation Fund Act and the State Natural Resources Fund provides for the making of grants to assist local public bodies in the acquisition and development of outdoor recreation projects. WHEREAS, the City of Maplewood desires to acquire and develop certain land known as North Hazelwood Park, which land is to be held and used for permanent open space; WHEREAS, in order for the proposed project to be eligible for approval, there must be proof that it is part of a comprehensive outdoor recreation plan and 5 -year action program (capital improvement); and WHEREAS, Maplewood has an original or revised 5 -year action program which includes North Hazelwood Park; WHEREAS, it is estimated that the cost of acquiring and developing said interest shall be $122,000.00. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD: - 10 - 11/15 1. That an application be made to the Office of Local and Urban Affairs of the State Planning Agency for a grant from the Land and Water Conservation - Fund as amended in 1965 for an amount presently estimated to be $122,000.00 and the applicant will pay the balance of the cost from other funds available to it. 2. That an application be made to the Office of Local and Urban Affairs of the State Planning Agency for a grant from the Natural Resource Fund (Minnesota Law, 1979, Chapter 333, Section 31, Subdivision 3, paragraphs (j) and (k) for an amount presently estimated to be $122,000.00 and the applicant will pay the balance of the cost from other funds available to it. 3. That the Chairman, County Board of Commissioners is hereby authorized and directed to execute and to file A) such application and B) the 5 year action program with the State Planning Agency, Office of Local and Urban Affairs, and to provide additional information and furnish such documents as may be required by said Agency, to execute such contracts as are required by said Agency, and to act as the authorized correspondent of the applicant. 4. That the proposed acquisition and development is in accordance with plans for the allocation of land for open space uses, and that should said grant be made, the applicant will acquire develop and retain said land for use designated in said application and approved by the Office of Local and Urban Affairs and the H.C.R.S. 5. That the United States of America and the State of Minnesota be, and they hereby are, assured of full compliance by the applicant with the regulations of the Department of the Interior, effectuating Title VI of the Civil Rights Act of 1964. Seconded by Councilman Anderson. Ayes - all. 6. Rezoning Initiation - Roselawn and 35 E (Voight) a. Manager Evans stated the developer of the property at Roselawn and 35E request the City to initiate a rezoning from F -R (Farm- Residence) to M -1 (light manufacturing). b. Councilman Nelson moved to initiate a requested by Mr. Voight subject to Mr. Vo ation. Seconded by Councilman Wiegert. nil the Ayes - Mayor Greavu; Councilmen Nelson and Wiegert. Nays - Councilmen Anderson and Murdock. 7. One Hour Parking - 1255 East Highway 36 - Mayflower a. Manager Evans presented the staff report. b. Councilman Anderson of Hiehways 36 and 61 b Seconded by Councilman Wiegert. Ayes - all. 8. Maple Wheel Liquor License - 11 - 11/15 northeast a. Manager Evans presented the staff report with the suggestion that before Mr. James Bachel is licensed he furnish the City with affidavits of sole ownership of the Maple Wheel and his previous ownership relationship to this licensed premises. In addition, a public hearing should be scheduled for Bachel's application. b. Mr. James Bachel spoke on behalf of his request to be the license holder of the Maple Wheel Liquor License. c. Council directed Mr. Bachel to contact the City Clerk to proceed with a new application for a liquor license for the Maple Wheel. 9. 1980 Budget Change - Council Salaries a. Manager Evans stated at the last Council meeting an ordinance was adopted increasing the salaries of councilmembers. It is recommended that the 1980 Budget be revised by a transfer of $1,500 from the contingency account to the Council salaries account to cover the salary increase. b. No Right Turn - Highway 36 and White Bear Avenue a. Manager Evans stated the City of Maplewood has, for some time, indicated a desire to have a "no right turn on red" condition when turning south on White Bear Avenue from the eastbound Highway 36 ramp. The Ramsey County Engineering department informally requested the State Department of Transportation to review this matter in 1978 and received a negative response. If the City wishes to pursue the matter further, it is recommended that a resolution requesting such signing be addressed to Ramsey County and the Minnesota Department of Transportation. b. Councilman Wiegert introduced the following resolution and moved its adoption: 79 - 11 - 307 RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that Ramsey County is hereby requested to arrange with the State of Minnesota, Department of Transportation for the installation of a sign at the eastbound exit of .Highway 36 and White Bear Avenue that will prohibit a right turn on White Bear Avenue on a red light semaphore. Councilman Anderson stated the Council packets seem to have duplication as to the staff reports which are given in the Planning Commission packet and the Community Design Review Board packets as well as in the Council packets. 3. School Closings a. Councilman Anderson stated that schools in Maplewood are being closed, but he questioned if Maplewood is ever notified first. b. Staff stated Maplewood City Council has not been notified. 4. Paraphenalia a. Councilman Wiegert commented on recent articles regarding the selling of drug paraphenalia. He requested staff obtain the model ordinance that was mentioned. 5. North Suburban Chamber of Commerce a. Councilman Wiegert commented on an article in the St. Paul Area Chamber of Commerce News regarding a statement from St. Paul that the water that discharges into their sewer system from surrounding municipalities should be paid for by the municipalities. Councilman Wiegert has requested that the North Suburban Chamber of Commerce support the Municipalities against such payment and they are favorably inclined. 6. Rights of Way a. Mayor Greavu suggested staff investigate where the State owns large footage of property right -of -way and inform the property owners that would be affected. 7. Highway 120 Speed Limit - Upper Afton Road to Highwood Avenue a. Mayor Greavu requested staff ask the State to check the speed limit on Highway 120. b.
