WHEREAS, the City Council of Maplewood, Minnesota, has deemed it expedient and
necessary that the lease arrangement with the State of Minnesota for the following
described land:

of the northwest quarter of Section 10, Township 29 north, Range 22
west.
be extended for the period from December 1, 1979, to November 30, 1980.
NOW, THEREFORE, BE IT RESOLVED that the authorized City Officials are directed
to execute the lease and forward same to the State of Minnesota.
5. Final Payment - McKnight Road Improvement

WHEREAS, pursuant to a written contract signed with the City on September 7,
1978, Orfei and Sons, Inc. of 1156 Homer Street, St. Paul, Minnesota, has satis-
factorily completed the improvement of sanitary sewers, watermains, service
connections and all necessary appurtenances on McKnight Road between the line of
Linwood Avenue and Highwood Avenue in accordance with such contract,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF MAPLEWOOD, MINNESOTA, the work
completed under said contract is hereby accepted and approved, and
BE IT FURTHER RESOLVED: that the City Clerk and Mayor are hereby directed to
issue a proper order for the final payment on such contract, taking the contractor's
receipt in full.
6. Junked Vehicle Ordinance - Second Reading
ORDINANCE NO. 477
AN ORDINANCE AMENDING SECTION 602
CONCERNING PUBLIC NUISANCE.
THE COUNCIL OF THE CITY OF MAPLEWOOD DOES HEREBY ORDAIN AS FOLLOWS;
Section 1. Section 602.050 is hereby amended by adding a definition to
Section J which will read as follows:
A junk vehicle shall include any motor vehicle or trailer
which is not in an operable condition, or which is partially
dismantled, or which is used for the sale of parts or as a source
of repair and replacement parts for other vehicles or which is
kept for scrapping, dismantling or salvage. The following
vehicles shall not be considered junk vehicles:
(1) An unlicensed vehicle for sale in an automobile sales
lot; and
(2) A pioneer or classic car, as defined in M.S.A. 165.10,
if actively being restored.
Section 2. This ordinance shall take effect upon passage and publication.
7. Time Extension - Clausen Addition.
Approved a 90 day time extension of the preliminary plat for the Clauson
Addition.

F. PUBLIC HEARINGS
1. Liquor License - On -Sale - 1820 Rice Street - Claussen, 7:30 P.M.
a. Mayor Greavu convened the meeting for a public hearing regarding the request
of Roger and Sandra Claussen for an On -Sale Intoxicating Liquor License at 1820
Rice Street. The Clerk stated the hearing notice was in order and properly pub-
lished.
b. Manager Evans presented the staff report.
c. The applicants, Roger and Sandra Claussen, signed an affadavit stating they
do not hold any interests in any other liquor license or establishments.
d. Mayor Greavu called for proponents. None were heard.
e. Mayor Greavu called for opponents. None were heard.
f. Mayor Greavu closed the public hearing.
g. Mayor Greavu introduced the following resolution and moved its adoption:

NOTICE IS HEREBY GIVEN, that pursuant to action by the City Council of the
City of Maplewood on October 19, 1979, an On Sale Intoxicating Liquor License was
approved for Roger Thomas Claussen and Sandra Joan Claussen, dba The Chalet Lounge
( Claussen, Inc.), 1820 Rice Street.
The Council proceeded in this matter as outlined under the provisions of the
City Ordinance.

6. Temporary Mobile Home Permit - 1487 Century Avenue North - Vanderhoff
a. Manager Evans presented the staff report.
b. Mrs. Jean Flipp, 2682 E. Geranium St., representing Mrs. Gerda Vanderhoff,
the applicant, stated Mrs. Vanderhoff would connect the Mobile Home to the
utilities.
c. Mayor Greavu moved to approve a temporary three month permit to install a
mobile home on the property at 1487 North Century Avenue and the applicant can
renew the Permit for an additional three months.
Seconded by Councilman Murdock. Ayes - all.
F. PUBLIC HEARINGS
2. Used Car Lot - Rice and Roselawn - Jerry Anderson, 7:45 P.M.
a. Mayor Greavu convened the meeting for a public hearing regarding the request
of Mr. Jerry Anderson to operate a Used Car Lot at 1908 Rice Street. The Clerk
stated the hearing notice was in order and noted the dates of publication.

a. Manager Evans presented the staff report recommending that staff be authorized
to execute a lease agreement with Ramsey County for court space during 1980 at
$6.09 per square foot.

2. Feasibility Study - Duluth Street Storm Sewer
a. Manager Evans presented the staff report.
b. Assistant City Engineer Ken Haider explained the specifics of the study.
c. Mr. Mike Wasiluk, 1747 Frank Street, spoke regarding the proposal.
d. Councilman Wiegert introduced the following resolution and moved its adoption:

WHEREAS, the City Engineer for the City of Maplewood has been authorized
and directed to prepare preliminary plans for the improvement of the area
bounded by Frisbie Avenue on the North, English Street on the East, Larpen-
teur Avenue on the South, and Phalen Place on the West, Project No. 79 -5, by
construction of storm sewers and appurtenances, and
WHEREAS, the said City Engineer has prepared the aforesaid preliminary plans
for the improvement herein described:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA,
as follows:

1. The report of the City Engineer advising this Council that
the proposed improvement of the aforementioned area by construc-
tion of storm sewers and appurtenances is feasible and should best
be made as proposed, is hereby received.
2. The Council will consider the aforesaid improvement in accor-
dance with the reports and the assessment of benefited property for
all or a portion of the cost of the improvement according to M.S.A.
Chapter 429, at an estimated total cost of the improvement of
$390,000.
3. A public hearing will be held in the Council Chambers of the
City Hall at 1380 Frost Avenue on Thursday, the 6th day of December,
1979, at 7:45 P.M. to consider said improvement. The notice for said
public hearing shall be in substantially the following form:
NOTICE OF HEARING OF PUBLIC IMPROVEMENT
TO WHOM IT MAY CONCERN:
WHEREAS, the City Council of the City of Maplewood, Ramsey County,
Minnesota, deems it necessary and expedient that the improvement herein-
after described, be made,
NOW, THEREFORE, notice is hereby given that the City Council will hold
a pulbic hearing on said improvement at the following time and place within
the said City:
Date and Time: December 6, 1979, at 7:45 P.M.
Location: Council Chambers of the City Hall, 1380 Frost Avenue.
The general nature of the improvement is the construction of storm
sewers and appurtenances in the following described area:
The area bounded by Frisbie Avenue on the North, English
Street on the East, Larpenteur Avenue on the South, and
Phalen Place on the West.
The total estimated cost of said improvement is $390,000.
It is proposed to assess every lot, piece or parcel of land benefited
by said improvement whether abutting thereon or not, based upon benefits
received without regard to cash valuation.
Persons desiring to be heard with reference to the proposed improvement
should be present at this hearing.
This Council proposes to proceed under the authority granted by Chapter
429, M.S.A.

of Appeals and Adjustments.

F. PUBLIC HEARINGS (Continued)
4. Special Use Permit: 550 East Roselawn Avenue, Maple Manor, 8:15 P.M.
a. Mayor Greavu convened the meeting for a public hearing regarding the request
of the Maple Manor Nursing Home for a Special Use Permit to expand a parking lot
onto F (Farm Residential) zoned property. The Clerk stated the public hearing
notice was found to be in order and stated the date of publication.
b. Manager Evans presented the staff report with the following recommendations:
Approval of the Special Use Permit conditioned on:
1. Transfer of ownership of the property to Maple Manor by the pro-
visions of the Clausen Addition Final Plat or by application for
a lot division.
2. The Applicant submit a landscaping plan that includes a four foot
screening fence and shows placement of night safety and security
lighting. The screening fence shall be constructed along the south,
west, and east sides of the existing and proposed parking lot.
Approval is based on the following findings:
1. The parking lot expansion would alleviate an existing shortage.
2. Off- street parking is allowed as a principal use in any zoning district
by a special use permit.
3. City Council may attach conditions as they find necessary to a special
use permit.
4. R -3, multiple residence district uses are required to submit landscaping
plans as part of their site and building plans.
5. The proposed parking lot expansion area will eventually be surrounded
on three sides by single family residences.
6. There is a significant drop in elevation into the proposed single
family residence lots to the south and west of the parking lot.
7. A four foot fence could screen the direct impact of most of the park-
ing lot headlights from the future homeowners.
8. The addition of landscape plantings would also reduce the impact of a
parking lot being situated in the midst of a single family residential
area.

c. Chairman Les Axdahl presented the following Planning Commission recommenda-
tion:
Commissioner Fischer moved that the Planning Commission recommend to the
City Council approval of the special use permit for Maple Manor of Maplewood
conditioned on:
1. Transfer of ownership of the property to Maple Manor and Outlot A to the
adjacent property by the provisions of the Clausen Addition final plat
or by application for a lot division.
2. The applicant submit a landscaping plan that includes a four foot screening
fence and shows placement of night safety and security lighting. The screen-
ing fence shall be constructed along all but the north side of the proposed
and existing parking lots, where single family residences will abut, including
the south and east sides of the existing parking lot.

h. Councilman Murdock introduced the following resolution and moved its adoption:

WHEREAS, a petition was filed with the City of Maplewood as provided under
Section 915.010 of the Municipal Code of the City of Maplewood, said petition having
been signed by more than 50% of the owners of property within 350 feet of the prop -
erty described as follows:
South 100 feet of the North 330 feet of the West 175 feet of the
Northeast quarter of the Northeast quarter of the Southwest quarter
of Section 17, Township 29, Range 22
which has been proposed for Special Use Permit.
WHEREAS, a public hearing was held on October 18, 1979, at 8:15 P.M. in the
City Hall, notice thereof having been duly published in the official City news-
paper, and notices of said hearing having been mailed to all property owners of
record within 350 feet of the area proposed for an expansion of a parking lot on
F (Farm Residential) zoned property; and
WHEREAS, the City Planning Commission has made its recommendations; and
WHEREAS, it appears for the best interest of the public that said petition be
granted;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that
the petition for the above described Special Use Permit for an expansion of the Maple
Manor Nursing Home parking lot onto F (Farm Residential) zoned property be granted,
subject to the following conditions:
1. Transfer of ownership of the property to Maple Manor and Outlet A to the
adjacent property by the provisions of the Clausen Addition final plat or
by application for a lot division.
2. The applicant submit a landscaping plan that includes a four foot screening
fence and shows placement of night safety and security lighting. The screen-
ing fence shall be constructed along the north, south, east and west side
of the proposed and existing parking lots.
Seconded by Councilman Anderson. Ayes - all.
G. AWARD OF BIDS

H. UNFINISHED BUSINESS
1. Gethsemane Church - Parking Lot Rent Request
a. Manager Evans stated Gethsemane Lutheran Church is requesting a fee of
$500.00 per season for rental of the parking lot at the Gethsemane Park fields.
It is recommended that payment not be made for the following reasons:
It was fully understood by both parties at the time the lease was
originally worked out that the parking lot would be open for public

use. While the church has retained control of the facilities for
church use, they have also received substantial cost savings. This includes
such things as a $11,359 deferred assessment, and savings on items such as
insurance, mowing, fertilizer, herbicide, etc. Other improvements which
they benefit from are two hockey rinks, pleasure rink, park building, and
two new softball fields.
I am not sure we can spend money for a service which is not covered by
a formal agreement. If we do pay - does this mean we can park as many
cars as we wish, including Sunday morning? Also, we deal with two other
churches (Holy Redeemer and Cross Lutheran) who may also wish to be paid
for this kind of use. Finally, this is a nonbudgeted item at this time,
and based on their letter, we have no way of knowing what they will ask
for next year.

3. Feasibility Study - Sandhurst Drive, Van Dyke to Hazel - Imp. 78 -21
a. Manager Evans presented the staff report.
b. Assistant City Engineer Ken Haider presented the specifics of the study.
c. Councilman Anderson moved to approve the second alternate and introduced the
following resolution and moved its adoption.

WHEREAS, the City Engineer for the City of Maplewood has been authorized and
directed to prepare preliminary plans for the improvement of Sandhurst Drive from
Van Dyke Street to Hazel Street, Project No. 78 -21, by construction of watermains,
sanitary sewer, curb and gutter, service connections, appurtenances and necessary
street reconstruction, and
WHEREAS, the said City Engineer has prepared the aforesaid preliminary plans
for the improvement herein described,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, as
follows:
1. The report of the City Engineer advising this Council that the proposed
improvement on Sandhurst Street by construction of streets, sanitary sewer,
curb and gutter, watermains and storm drain facilities is feasible and
should best be made as proposed, is hereby received.
2. The Council will consider the aforesaid improvement in accordance with

the reports and the assessment of benefited property for all or a
portion of the cost of the improvement according to M.S.A. Chapter 429,
at an estimated total cost of the improvement of $84,400.
3. A,public hearing will be held in the Council Chambers of the City Hall
at 1380 Frost Avenue on Thursday, the 6th day of December, 1979, at
7:30 P.M..to consider said improvement. The notice for said public
hearing shall be in substantially the following form:

4. Feasibility Study - Van Dyke Street, South of County Road "C" - Imp. 79 -2
a. Manager Evans presented the staff report with the recommendation that the
public improvement be denied and the petition sponsor pursue the improvements as
an independent developer.
b. Councilman Anderson introduced the following resolution and moved its adoption:

WHEREAS, pursuant to resolution of the Council adopted on February 15,
1979, a report has been prepared by the Director of Public Works with refer-
ence to the improvement of Van Dyke Street from County Road "C" southward a
distance of 620 feet by the construction of streets, curb and gutter, storm
sewers, sanitary sewers, watermains and all necessary appurtenances, and this
report was received by the Council on October 18, 1979,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA:
1. The improvement as proposed is not considered feasible as a local
improvement project under the provisions of Minnesota Statutes Chapter
429.

5. Time Extension - 1644 Myrtle Street - Miller
a. Manager Evans presented the staff report with the recommendation of
approval of a time extension until March 31, 1980. If the work is not com-
pleted by that time, the rental unit will have to be vacated.
b. Mayor Greavu moved to approve the time extension to complet
March 31, 1980, for 1644 Myrtle Street with the condition that
not completed by that date. the rental unit will have to be vac

7. Ordinance Re: Liquor License Applications
a. Manager Evans stated the proposed ordinance would make it amisdemeanor
to file false statements on the applications for liquor licenses.
b. Councilman Wiegert moved first reading of an ordinance making it a mis-
demeanor offense to file false statements on liquor license applications.

K. COUNCIL PRESENTATIONS
1. White Bear Avenue and Cope Avenue
a. Councilman Anderson questioned what is the status of the White Bear Avenue
and Cope Avenue problem.
b. Staff stated the County will be getting back to us.

2. Council Salaries
a. Councilman Wiegert stated it has-been brought to his attention that any
raise in Council salaries would have to be approved prior to an election for
Council. Since the election is November 6, perhaps this would be the time to
discuss salary raises.
b. Following further discussion, Councilman Murdock moved first reading of an
ordinance to increase the Mayor and Council salaries effective January, 1980.
Seconded by Councilman Wiegert. Ayes - Councilmen Murdock, Nelson,
and Wiegert.
Nays - Mayor Greavu, Councilman
Anderson.
3. Lot Split
a. Councilman Murdock commented on problems that arose from a lot split that
was approved by the Council for the property at the Southeast corner of McKnight
Road and Carver Avenue. Because of the division, there is now cash connection
charges due for hooking into the City sewer and water lines, and the new people
buying the property were unaware of the charges. How can this be avoided?
b. Council referred the question to staff.
4. DeSoto Park Second Addition - Initiate Rezoning.

5. Hours of Service - Century Auto

Seconded by Councilman Murdock. Ayes - all.
6. Lakeshore Ordinance
a. Mayor Greavu commented that the D.N.R. wishes to be contacted before muni-
cipalities pass any lakeshore ordinances.
7. Open Space
a. Mayor Greavu questioned if there was any way the City could find out if
people who are against development in their specific areas, could purchase the
land.
b. Staff will investigate.

8. Speed Limit - Parkway Drive and Highway 61.
a. Mayor Greavu introduced the following 'resolution -and moved - its - adoption:

RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that Ramsey
County is hereby requested to arrange with the State of Minnesota,
Department of Transportation, for an evaluation of the speed zones on
Frost Avenue /Parkway Drive between English Street and Larpenteur Avenue.

9. McKnight Road Alignment
a. Mayor Greavu stated he had met with the County and that the McKnight
Road alignment may be changed again.
