CALL TO ORDER A regular meeting of the City Council, of Maplewood, Minnesota was held in the Council Chambers, Municipal Building and was called to order at 7:30 P.M. by Mayor Greavu. B. ROLL CALL John C. Greavu, Mayor Present Norman G. Anderson, Councilman Present Burton A. Murdock, Councilman Present Earl L. Nelson, Councilman Present Donald J. Wiegert, Councilman Present. C. APPROVAL OF MINUTES 1. Minutes of Meeting No. 79 -14 (June 7, 1979) Councilman Anderson moved that the Minutes of Meeting No. 79 -14 (June 7 1979) be approved as submitted. Seconded by Councilman Wiegert. Ayes - all. D. APPROVAL OF AGENDA Mayor Greavu moved that the Agenda be approved as amended: 1. Lydia and Furness 2. H -4, Highway Department Representation 3. CONSENT AGENDA Councilman Wiegert moved to remove Consent Agenda Item 7 and place it as item J -8. Seconded by Councilman Anderson. Ayes - all. Councilman Wiegert moved, seconded by Councilman Anderson, that the Consent Agenda Items 1 through 5 be approved as recommended. 1. Accounts Payable Part I - Fees, Services - Expenses, Check No. 003531 through Check No. 003559 - $57,264.80; Check No. 002097 through Check No. 002264 - $106,140.97: Part II - Payroll Check No. 21009 through Check No. 21149 - $47,669.75 in the total amount of $211,075.52. - 1 - 7/5 2. Donation from North Maplewood Lions Club Accept the donation of $500.00 from the North Maplewood Lions Club to be used for the 4th of July fireworks and instructed staff to forward a letter of thanks. 3. Budget Adjustment - Emergency Preparedness Adjusted the 1979 Budget to reflect the receiving of $1,001.50 from the Federal Government as its allocation of excess Civil Defense and monies of 1978, to be used to provide psychological tests to all reserve officers as required by law. 4. Special Exception - 1887 Myrtle Street Approved a special use exception permit to allow Mr. Marson Rinkenberger, 1887 Myrtle Street to operate a tailoring business from his home subject to the following conditions: 1. The applicant shall provide adequate off street parking; 2. Inspection and approval by the Fire Marshal; 3. The special exception shall be issued for a one year period. After one year the Council may review the use for possible problems. If none exist, the permit may be reviewed. 5. Special Exception Approved a special exception permit to allow Mr. Vincent Grundman, 1721 Gurney Street, to operate a car pool referral service from his home for a one year period. After one year, Council may review the use for possible problems, and if none exist, the permit may be renewed. F. PUBLIC HEARINGS 1. Rezoning Plan Amendment - Century and Minnehaha Avenues - Moosbrugger - 7:30 P.M. a. Mayor Greavu convened the meeting for a public hearing regarding the request of Gordon Moosbrugger to rezone the northwest corner of Century Avenue and street from R -1 Single Family Residence to B -C Business and Commercial. The Clerk read the notice of hearing along with the dates of publication. b. Manager Evans presented the staff report with the following recommendations: I. Denial of the Plan Amendment on the basis that: 1. A section of the RH Classification would be eliminated; 2. The housing mix balance as proposed by the Plan would not be met; 3. Vehicular traffic generated by the proposed commercial use is a public safety concern. II. Denial of the rezoning on the basis that it is not consistant with the City's Land Use Plan. C. Chairman Les Axdahl presented the following Planning Commission recommendation: - 2 - 7/5 "Commissioner Pellish moved the Planning Commission recommend denial of the Com- prehensive Plan Amendment on the basis that: 1. A section of the Rh classification would be eliminated. 2. The housing mix balance as proposed by the Plan would not be met. 3. Vehicular traffic generated by the proposed commercial use is a public safety concern. 4. No adequate justification by the applicants. 5. No changed conditions to merit the change has been demonstrated. Commissioner Ellefson seconded. Ayes all. Commissioner Sherburne moved that the Planning Commission recommend to the City Council denial of the proposed zone change based on the following: 1. A section of the Rh classification would be eliminated. 2. The housing mix balance as proposed by the Plan would not be met. 3. Vehicular traffic generated by the proposed commercial use is a public safety concern. 4. No adequatejustification by the applicants. 5. No changed conditions to merit the change has been demonstrated. 6. To grant this rezone would put the zoning of the property in conflict with the Comprehensive Plan. Commissioner Pellish seconded. Ayes all." d. Mr. Gordon Mossbrugger, attorney representing Joseph Carter, owner of the property, spoke on behalf of the proposal. e. Mayor Greavu called for proponents. None were heard. f. Mayor Greavu called for opponents. The following were heard: Mr. John R. Armbruster, 631 No. Century Avenue; Mr. Harry Tevlin, 653 No. Century Avenue; Mr. Dick Schultz, 2681 Margaret Street; Mr. Ronald Hull, 2675 Margaret Street. g. Mayor Greavu closed the public hearing. h. Councilman Wiegert moved to the plan based on Seconded by Councilman Anderson. Ayes - all. 2. Rezoning - 3101 McKnight Road - Kennedy - 7:30 P.M. as a. Mayor Greavu convened the meeting for a public hearing regarding a request of Mr. Charles Kennedy, 3101 No. McKnight Road, to rezone 3101 No. McKnight Road from F - Farm Residence, to R -2 - Double Dwelling Residence. The Clerk read the notice of hearing along with the dates of publication. b. Manager Evans presented the staff report including the following recommend- ation: - 3 - 7/5 I. Approval of the rezoning from F - Farm Residence to R -2 - Double Dwelling Residence subject to: 1. Approval of the amendment to the R -2 District regulations providing for 7500 square foot single family lots. II. Approval of the proposed lot split subject to: 1. Approval of the rezoning from F - Farm Residence to R -S - Double Dwell- ing Residence; 2. Provision of driveway turnarounds on both lots. c. Chairman Les Axdahl presented the following Planning Commission recommendation: "Commissioner Sherburne moved the Planning Commission recommend to the City Council approval of the proposed zone change subject to the following: 1. Approval of the amendment to the R -2 District regulations providing for 7500 square foot single family lots. Commissioner Ellefson seconded. Ayes all." d. Mayor Greavu called for proponents. None were heard. e. Mayor Greavu called for opponents. None were heard. f. Mayor Greavu closed the public hearing. g. Mayor Greavu moved to table this item until after Item H -3 has been discussed. Seconded by Councilman Murdock. Ayes - all. 3. Rezoning - 2750 - 2752 White Bear Avenue - Miller 7:45 P.M. a. Mayor Greavu convened the meeting for a public hearing regarding the request of Craig and J.A. Miller to rezone 2750 -2752 White Bear Avenue from R -2, Double Dwelling Residence to R03 Multiple Family Residential. The Clerk read the notice of hearing along with the dates of publication. b. Manager Evans presented the staff report recommending approval. c. Chairman Les Axdahl presented the following Planning Commission recommend- ation: "Commissioner Sherburne moved the Planning Commission recommend approval of the zone change to the City Council based on the staff analysis and recommendation dated May 24, 1979. Commissioner Kishel seconded. Ayes all." d. Mr. Craig Miller, the applicant, spoke on behalf of the proposal. e. Mayor Greavu called for proponents. The following were heard: Ms. Debbie Kamrath and Ms. Gloria Johnson, 2752 White Bear Avenue; A resident of 2778 White Bear Avenue. - 4 - 7/5 f. Mayor Greavu closed the public hearing. g. Councilman Murdock introduced the following resolution and moved its adoption: 79 - 7 - 177 WHEREAS, a petition was filed with the Council of the City of Maplewood by the owner of the following described property, and a hearing was set as provided under Section 915.020 of the Municipal Code of the City of Maplewood: Unplatted Lands; Ex E 495 ft & ex S 249 ft lying W of sd E 495 ft; the N 399 ft of part Ely of White Bear Avenue of SE 1/4 of SW 1/4 of Section 2, Township 29, Range 22 which has been proposed for rezoning from R -2 to R -3; and WHEREAS, a public hearing was held on July 5, 1979 at 7:45 P.M. in the City Hall, notice thereof having been duly published in the official City news- paper, and notices of said hearing having been mailed to all property owners of record within 350 feet of the area proposed for rezoning; and WHEREAS, all objections and recommendations relative thereto were heard by the City Council; and WHEREAS, it appears for the best interest of the public that said petition be granted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, that the petition for the above described rezoning be granted. Seconded by Councilman Nelson. Ayes - all. 4. Special Use Permit - St. Paul Water Department - South of Roselawn Avenue, East of Rice Street - 8:15 P.M. a. Mayor Greavu convened the meeting for a public hearing regarding the request of the St. Paul Water Department for a special use permit to construct a sludge thickening facility. The Clerk read the notice of hearing along with the dates of publication. b. Mananger Evans presented the staff report with the following recommendation: I. Approval of the special use permit for the new sludge thickening facility, based on the finding that the new facility is necessary to comply with the regulations of the Safe Drinking Water Act, and therefore, necessary for the health and welfare to the public. II. Approval of the building and site plans. C. Chairman Les Axdahl presented the following Planning Commission recommendat- ion: "Commissioner Barrett moved the Planning Commission recommend to the City Council approval of the special use permit for the new sludge thickening facility, based on the finding that the new facility is necessary.,to comply with the regulations of the Safe Drinking Water Act, and, therefore, necessary for the health and welfare of the public. - 5 - 7/5 Commissioner Kishel seconded. Ayes all." d. Mr. Elmer Huset, General Manager of St. Paul Water Department, explained the proposal. e. Mayor Greavu called for proponents. The following were heard: Mr. Jim Commander, 1708 Sylvan, asked questions regarding the facility. f. Mayor Greavu called for opponents. None were heard. g. Mayor Greavu closed the public hearing. h. Councilman Anderson introduced the following resolution and moved its adoption: 79 -7 -178 WHEREAS, a petition was filed with the City of Maplewood as provided under Section 915.010 of the Municipal Code of the City of Maplewood, said petition having been signed by more than 50% of the owners of property within 200 feet of the property described as follows: A piece of land in the N 1/2 of the SW 1/4 of Sec. 18, T. 29, R. 22, 4th P.M. described as follows: beg at the point where the E L of the conduit r -o -w of the party of the second part, according to its map of said r -o -w on record in the office of the Register of Deeds, crosses and intersections the S L of the N 1/2 described above: thence E 450 ft to a point on said S L above named; thence due N 435 ft to a point; thence due W 488 ft to the E L of the conduit r -o -w aforesaid; thence Sly along the E L of said conduit r -o -w to the place of begin- ning, containing 3.03 acres of land which has been proposed for Special Use Permit. WHEREAS, a public hearing was held on July 5, 1979, at 8:15 P.M. in the City Hall, notice thereof having been duly published in the official City news- paper, and notices of said hearing having been mailed to all property owners of record within 200 feet of the area proposed for a special use permit to construct a sludge thickening facility on property zoned F - Farm Residence; and WHEREAS, the City Planning Commission has made its recommendations; and WHEREAS, it appears for the best interest of the public that said petition be granted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the petition for the above described Special Use Permit for construction of a sludge thickening facility at the St. Paul Water Treatment Facility be granted. Seconded by Councilman Wiegert. Ayes - all. 5. Hillwood Drive and Dorland Road, Project 78 -10 8:00 P.M. - 6 - 7/5 a. Mayor Greavu convened the meeting for a public hearing regarding the pro- posed improvement of McKnight Road to approximately 2000 feet east between Mailand Road and Linwood Avenue; and from Linwood Avenue to approximately 600 feet south between McKnight Road and approximately 1300 feet east by construction of sanitary sewer, watermain, storm sewer and streets. The Clerk read the notice of hearing along with the dates of publication. b. Representatives of Schoell and Madson, Inc. presented the specifics of the proposed improvement. c. Mayor Greavu called for proponents. None were heard. d. Mayor Greavu called for opponents. The following were heard: Mr, Roland Crawford, attorney representing George Oxford; Mr. Bob Hennen, Hennen Development; Mr. Gordon Fritchie, 524 Lakewood Drive; Mr. Joseph Lund, 2356 Teakwood Drive; Mr. Tom Wood, 2370 Teakwood. e. Councilman Nelson moved to table the Engineer. Consulting Engineer_ L Seconded by Councilman Wiegert. Ayes - all. G. AWARD OF BIDS None. H. UNFINISHED BUSINESS 1. Report of Wage Committee meet to a. Mr. Mike Wasiluk, 1747 Frank Street, stated the Wage Committee Chairman Bill Lorenz could not attend this meeting and he will represent the Committee. Mr. Wasiluk presented the report. b. The following Wage Committee members presented their views: Mrs. Frank Juker, 1965 Barclay Street; Mrs. Irene Gonzagowski, 2575 Carver Avenue; Mr. Don Houghton, 1825 Lakewood Drive. c. Councilman Wiegert moved to receive the report of the Wage Committee and refer it to the Manager. Seconded by Councilman Anderson. Ayes - all. 2. Report from City Manager - Salaries and Wages a. Manager Evans presented the staff report. b. Councilman Wiegert moved to approve the Managerts recommen salaries for Police Sergeants for 1979 -80 and 1980 -81; approve Public Works salary be skinned a step in the Dav Dlan in accor or an - 7 - 7/5 the pay plan for the non - represented employees the increases for 1979 be granted in accordance with the established pay schedules for their respective positions. Seconded by Councilman Nelson. Ayes - Councilmen Anderson, Murdock, Nelson and Wiegert. Nays - Mayor Greavu. Councilman Anderson moved to refer the Assistant Fire Marshal's salary to the Manager for investigation. Seconded by Councilman Wiegert. Ayes - all. 3. Zoning Amendment - R -2 Minimum Lot Size a. Manager Evans presented the staff report. b. Councilman Wiegert introduced the following ordinance and moved its adoption: ORDINANCE NO. 471 AN ORDINANCE AMENDING CHAPTER 905 OF THE MAPLEWOOD CODE THE CITY COUNCIL OF MAPLEWOOD DOES HEREBY ORDAIN AS FOLLOWS: Section 1. The following sections are hereby amended to read as follows: TITLE. R -2. Residence District (Medium Density) 905.020. HEIGHT REGULATIONS. No single or two family dwellings shall hereafter be erected or structurally altered hereafter to exceed thirty (30) feet in height measured from the front or street side grade of the site. 905.030. AREA REGULATIONS. No two family dwellings shall be built or struct- urally altered hereafter on a site less than 12,000 square feet in area. No single family dwelling shall be built or structurally altered hereafter on a site less than 7,500 square feet in area. The minimum lot width shall be 75 feet for interior lots and 100 feet for corner lots. No single or two family dwelling shall be built or structurally altered hereafter on any site unless public sanitary sewer is available. The density shall not exceed the maximum density permitted by the land use classification and people per unit designated in the City's adopted Comprehensive Plan. 912.090. LOT SIZE MINIMUMS FOR NEW SUBDIVISIONS. Whenever land is hereafter subdivided into three or more lots or parcels for the purpose of transfer, sale, or improvement, residential lots shall have an average width of seventy -five (75) feet and a minimum area of ten thousand (10,000) square feet. When the land being subdivided is designated as Rm, Medium Density Residential, and is zoned accordingly, an average lot width of seventy -five (75) feet and a minimum lot area of seventy-five hundred (7,500) square feet shall be allowed. - 8 - 7/5 Section 2. This ordinance shall take effect after its passage and publication. Seconded by Councilman Nelson. Ayes - all. d. Councilman Wiegert introduced the following ordinance and moved its adoption: ORDINANCE NO. 472 AN ORDINANCE AMENDING CHAPTER 1005 OF THE MAPLEWOOD ORDINANCE THE CITY COUNCIL OF MAPLEWOOD DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Section 1005.010 is hereby amended to read as follows: 1005.010. LOT STANDARDS (1) The minimum lot dimensions in subdivisions designated for single - family detached dwelling developments shall be: (aa) 75 feet wide at the established building setback line and on outside street curvatures, (bb) not less than 60 feet at the front lot line, (cc) not less than 10,000 square feet in area, (dd) not less than 7,500 square feet in area if designated as Rm, Medium Density Residential. Section 2. This Ordinance shall take effect upon its passage and publication. Seconded by Councilman Nelson. Ayes - all. F. UNFINISHED BUSINESS (continued) 2. Rezoning - 3101 N. Councilman Anderson introduced the following resolution and moved its adoption: 79- 7 -179 WHEREAS, a petition was filed with the Council of the City of Maplewood by the owner of the following described property, and a hearing was set as provided under Section 915.020 of the Municipal Code of the City of Maplewood: Unplatted Lands: The East 133 ft of the South 150 ft of the N 333 ft of the NE 1/4 of Section 2, Township 29, Range 22 which has been proposed for rezoning from F -Farm Residence to R -2 Double Dwelling Residence; and WHEREAS, a public hearing was held on July 5, 1979 at 7:30 P.M. in the City Hall, notice thereof having been duly published in the official City newspaper, and notices of said hearing having been mailed to all property owners of record within 350 feet of the area proposed for rezoning; and - 9 - 7/5 WHEREAS, all objections and recommendations relative thereto were heard by the City Council; and WHEREAS, it appears for the best interest of the public that said petition be granted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, that the petition for the above described rezoning be granted. Mr. Merritt Lindsey, representative from Minnesota Department of Transportation, spoke regarding the State Aid Five Year Street Plan. b. Council directed questions to Mr. Lindsey and expressed their concerns re- garding specific areas. I. VISITOR PRESENTATIONS 1. Mr. Terrance Haglund, 2308 Dobe Court a. Mr. Hoglund requested permission to move into his newly constructed home prior to the street being completed. b. Councilman Murdock moved to declare an emergency situation and allow Mr. Haglund to moved into his home Drior to the street being completed. subiect to Mr. Haglund signing a hold harmless agreement with the City indicatedin that if the City's emergency facilities cannot reach Mr. Haglund's home, the City could not be faulted$ based on Governor declared transportation emergency. Mr. Kent Rudeen, attorney representing the Mottaz's at 1732 So. Rosewood Ave- nue, stated the problems Mr. Mottaz is experiencing due to the reconstruction of County Ditch 17. b. Mayor Greavu moved to obtain outside to restoring and correcting Mr. Mottaz's Motion died for lack of a second. o figure costs as C. Councilman Wiegert moved to refer the matter to the City Manager with a report back by next meeting with recommendations on how to proceed and to obtain a neutral eneineer's opinion, if necessarv. Seconded by Councilman Anderson. Ayes - all. 2. Codification of Ordinances Proposals, Deleted. 3. Plan Amendment - Highwood Avenue and McKnight Road - Newell a. Manager Evans presented the staff report including the following recommend- ations: I. Redesignate the two parcels on the northeast corner of Highwood Avenue and McKnight Road from Park and Church use to RL, Low Density Residential, based on the following findings: 1. The Maplewood Park and Open Space Study does not propose the site for park development; 2. Those members of the Parks Commission at the June 11 meeting recommended that the site not be developed for park use; 3. A two acre tot lot is proposed to the northeast of the site. II. Refer the exact location of the tot lot to the Parks and Recreation Commission. The proposed site should then be sent to Midwest Planning for consideration in the Plan update. b. Chairman Les Axdahl presented the following Planning Commission recommendation: - 11 - 7/5 "Commissioner Sherburne moved that the Planning Commission recommend to the City Council that the proposed amendment to the Comprehensive Plan be approved based on the following: 1. The Maplewood Park and Open Space Study does not propose the site for park development; 2. Those members of the Parks Commission at the June 11 meeting recommended that the site not be developed for park use; 3. A two acre tot lot is proposed to the northwest. Commissioner Kishel seconded. Councilman Wiegert moved to approve the plan amendment from P - Parks to RL - Low Density Residential to the Comprehensive Plan based on the Planning Commissio recommendation and introduced the following resolution and moved its adoption: 79 - 7 - 180 WHEREAS, the Maplewood City Council and the Maplewood Planning Commission have prepared and adopted a Comprehensive Community Plan in compliance with the require- ments of Section 462.355 of the State Planning Enabling Legislation; and WHEREAS, said Section 462.355 provides for subsequent amendment of said Com- prehensive Plan which reflect changed conditions; and WHEREAS, the Maplewood Planning Commission has conducted the required public hearing and has given consideration to all evidence and testimony submitted at such hearing held on June 18, 1979, and has adopted said amendment and forwarded said amendment to the City Council for certification; and WHEREAS, the Maplewood City Council has reviewed said amendment; NOW, THEREFORE, BE IT RESOLVED that the Maplewood City Council hereby adopts and amends the Comprehensive Plan for Maplewood. Councilman Anderson stated he had received complaints about the resident at northeast corner of Lydia and Furness. The house is on a hill and everytime it rains the property washes away and the dirt leaves a mess and it is reported the resident does nothing. b. Staff to investigate. 2. Grandview Street a. Councilman Wiegert moved to approve the closing of the street for a street party on Grandview between Germain Street and Hazelwood Avenue, July 7, 1979, commencing at 5:00 P.M. subject to the usual conditions. Ayes - all. 5. Estimated Census a. Mayor Greavu commented on the Metropolitan Council estimated census for Maplewood at 27,530. It seems low. b. Staff will present a report to the Metro Council arguing that Maplewood should be higher. L. ADMINISTRATION 1. Youth Service Bureau a. Mayor Greavu introduced the following resolution and moved its adoption: 79 - 7 - 181 WHEREAS, the East Communities Youth Service Bureau has been strongly supported by the municipalities of North St. Paul, Maplewood, Oakdale, and School District 11622 for the past four years; and WHEREAS, local financial support by the component participants is limited to the amounts currently appropriated to the bureau; and - 1- 7/5 WHEREAS, unlike most Youth Service Bureaus, the East Communities Bureau has a Board of Directors representing the four major participants which oversee the financial and program aspects of the bureau; and WHEREAS, the Youth Service Bureau has proved it is a viable, stable service to the community the last four years by the services it provides young people and families; and WHEREAS, the Bureau continues to have requests for expansion of services not available within the community, which necessitates the need for additional revenues from appropriate sources to develop realistic planning to provide adequate and accesible resources to this suburban area; NOW, THEREFORE, BE IT RESOLVED that the City of Maplewood hereby encourages the St. Paul Foundation to consider the request for funding to provide Long Range Planning for services to youth and families in our suburban area by the Youth Service Bureau; and BE IT FURTHER RESOLVED, that the City of Maplewood pledges its continued support and commitment to the East Communities Youth Service Bureau.
