A regular meeting of the City Council of Maplewood, Minnesota was held in the Council
Chambers, Municipal Building and was called to order at 7:30 P.M. by Mayor Greavu.

Resolution No. 79 -6 -138
WHEREAS, M.S.A. 138.17 governs the destruction of city records; and
WHEREAS, a list of records has been presented to the council with a request in
writing that destruction be approved by the council;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA:
1. That the Finance Director is hereby directed to apply to the Minnesota
State Historical Society for an order auhtorizing destruction of the
records as described in the attached list.
2. That upon approval by the State of the attached application, the Finance
Director is hereby authorized and directed to destroy the records listed.
5. Budget Transfer - Community Services
Budget Transfer of $1310.00 from Department 146 - program supplies to 4120 to Depart-
ment 146 capitol outlay 4640 to purchase five canoes.

WHEREAS, the Board of County Commissioners of Ramsey County by resolution dated
Nov.7, 1977, Classified as non - conservation land, certain land lying within the limits
of the City of Maplewood; and

8. Removal of Name From On Sale Liquor License (Harvey)
Removed the name of Mr. David Adams as a partner in the On Sale Liquor License of
Kim Shell, Inc., dba Red Rooster Liquor Lounge, 2015 Woodlyn Avenue.
9. On Sale Liquor License Name Change (Cormican)
Change the name of Mister Pizza On Sale Liquor License, 1820 Rice Street, to the
Chalet Liquor Lounge On Sale Liquor License.
10. Designation of Applicant for Reimbursement (Schaller)
Resolution No. 79 -6 -152
WHEREAS, the City of Maplewood wishes to make application for police training
reimbursement funds;
WHEREAS, the City of Maplewood is required to designate an official applicant
to apply for said funds;
WHEREAS, the State of Minnesota does provide funds for reimbursement of police
training;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Maplewood
does hereby designate the Director of Public Safety, Richard W. Schaller, as the
official applicant to apply for police training reimbursement funds.
11. Midwest Regional Workshop Conference on Elections (City Clerk)
Approved travel and training application for the City Clerk to attend the Midwest
Regional Workshop Conference on Elections at Madison, Wisconsin, July 22 through
July 25, 1979.
F. PUBLIC HEARINGS
Mayor Greavu recessed the meeting at 7:35 P.M. to convene as the Board of Adjustments
and Appeals.
Mayor Greavu reconvened the meeting at 8:06 P.M.

2. Small Kennel License - 1375 No. Century Avenue - 7:30 P.M.
a. Mayor Greavu convened the meeting for a public hearing regarding a request
of Mr. Phillip A. Bienhoff, 1375 No. Century Avenue, for a small private kennel
license. The Clerk read the notice of hearing along with the dates of publication.
b. Manager Evans presented the staff report.
c. Mr. Bienhoff, the applicant, spoke on behalf of his proposal.
d. Mayor Greavu called for proponents. None were heard.
e. Mayor Greavu called for opponents. None were heard.
f. Mayor Greavu closed the public hearing.
g. Councilman Wiegert moved to grant a small private kennel license to P
Bienhoff, 1375 No. Century Avenue to house family pets, subject to review
license annually.
Seconded by Councilman Murdock. Ayes - all.
3. Rezoning (F to R -3 - 2029 Edgerton Street - Handschin - 7:45 P.M.
a. Mayor Greavu convened the meeting for a public hearing regarding a request
of Mr. Robert Handschin to rezone the property at 2029 Edgerton from F to R -3.
The Clerk read the notice of hearing along with the dates of publication.
b. Manager Evans presented the staff report with the recommendation of approval
of the rezoning.
c. Chairman Axdahl presented the following Planning Commission recommendation:
"Commissioner Fischer moved that the Planning Commission recommend that the City
Council approve the rezoning from F, Farm Residential to R -3, Multiple as such
action will bring the zoning of subject parcel into conformance with the Land
Use Element of the Comprehensive Plan.
Commissioner Kent seconded.
Ayes all."
d. Mr. Robert Handschin, the applicant, spoke on behalf of the proposal.
e. Mayor Greavu called for proponents. None were heard.

h. Councilman Wiegert introduced the following resolution and moved its adoption:

WHEREAS, a public hearing was held on June 21, 1979, at 7:45 P.M. in the
City Hall, notice thereof having been duly published in the official City news-
paper, and notices of said hearing having been mailed to all property owners
of record within 200 feet of the area proposed for rezoning; and
WHEREAS, all objections and recommendations relative thereto were heard by the
City Council; and

1. Mayor Greavu convened the meeting for a public hearing regarding a special
use permit and plan amendment to construct and operate a Fire Station Public
Works Facility at Lower Afton Road and Londin Lane. The Clerk read the notice
of hearing along with the dates of publication.
2. Manager Evans presented the staff report and presented the following re-
commendation:
Staff recommends that the City Council authorize the Racchini firm to perform
the proposed tasks for $1,100. To provide funds for this endeavor, a budget
transfer from the contingency account 101 - 161 -4910 in the amount of $1,100.00
to the Fire Fighting account 101- 124 -4490 is necessary. Staff recommends
this budget transfer.
Approval of the Plan Amendment based on the County's refusal to sell the Lin-
wood /Century site.
3. Mayor Greavu called for persons who wished to express their views. The

appurtenant work; and
WHEREAS, the said City Engineer has prepared the aforesaid preliminary plans
for the improvement herein described:
1. The report of the City Engineer advising this Council that the proposed
improvement from County Road "C" to approximately 800 feet South between
Duluth Street and approximately 1300 feet East by construction of sanitary
sewer, watermain, storm sewer, streets and appurtenant work is feasible and
should best be made as proposed, is hereby received.

a. Manager Evans stated he had a conflict of interest on this proposal and would
not make a recommendation.
b. Mr. Carlson stated Mr. Robert Tilsen is requesting permission to move two
families into Maplewood Heights No. 9 Addition before the roads are completed.
There has been a delay in obtaining asphalt material, etc. The roads will be in
condition for emergency vehicles to use and Tilsen will maintain the roads in
that condition until the blacktop is installed.
c. Councilman Wiegert moved to declare an emergency and the ordinan
to allow the two families to move into the Maplewood Heights No. 9 A
before the road is completed subject to a "hold harmless" agreement
being signed and that the road way be maintained in a safe manner at

(a) Chapter 474, Minnesota Statutes, known as the Minnesota Municipal Indust-
rial Development Act (the "Act ") gives municipalities the power to issue revenue
bonds for the purpose of the encouragement and development of economically sound
industry and commerce to prevent so far as possible the emergence of blighted and
marginal lands and areas of chronic unemployment;
(b) The City Council of the City of Maplewood (the "City ") has received from
MHN Restaurant Partnership, a Minnesota Partnership (the "Borrower "), a proposal
that the City undertake and finance a project hereinafter described, through the

issuance of its industrial revenue bonds (which may be in the form of a single
debt instrument) (the "Bonds ") pursuant to the Act;
(c) Before proceeding with consideration of the request of the Company it

a. Councilman Anderson stated he feels it was a mistake to separate the building.

2. Casey Lake

a. Manager Evans stated the Ramsey Soil and Water Conservation District is
offering a grant for 75% of the cost of a new outlet up to a maximum of $10,980.
The remaining 25% would be shared equally between North St. Paul and Maplewood,
since the lake crosses corporate boundaries. The City of North St. Paul has
already endorsed the project. At a maximum, Maplewood's share of the cost is
estimated at $2,000. The City's share could be funded from the storm sewer
maintenance budget. It is recommended that the City Council authorize staff to
pursue the grant from the Ramsey Soil and Water Conservation District.
b. Councilman Wiegert moved to authorize staff to pursue the grant from the
Ramsey Soil and Water Conservation District to help finance a new outlet to
Casey Lake.

3. Summer Help
a. Manager Evans presented the staff report.

Aides to work on a backlog of routine items in the Engineering Department and
