CALL TO ORDER A regular meeting of the City Council of Maplewood, Minnesota, was held in the Council Chambers, Municipal Building and was called to order at 7:35 P.M. By Mayor Greavu. B. APPROVAL OF MINUTES 1. Minutes of Meeting No. 79 -8 (April 5, 1979) Councilman Wiegert moved to approve the Minutes of Meeting No. 79 -8 (April 5, 1979) as submitted. Seconded by Councilman Anderson. F. PUBLIC HEARING 1. Rezoning Procedure - 7:30 P.M. a. Mayor Greavu convened the meeting for a public hearing regarding processing re- zoning applications and amendments to the Zoning ordinance as resolutions rather than ordinances. The Clerk read the notice of hearing along with the dates of publication. b. Manager Evans presented the staff report. c. Chairman Les Axdahl presented the following Planning Commission recommendation: - 2 - 5/3 "Commissioner Sherburne moved that the Planning Commission recommend to the City Council approval of the Ordinance amendment to Section 915 as presented by Staff. Commissioner Pellish seconded. Ayes - all." d. Mayor Greavu called for proponents. None were heard. e. Mayor Greavu called for opponents. None were heard. f. Mayor Greavu closed the public hearing. g. Councilman Anderson moved to approve first reading of an ordinance to amend Zoning Section 915. Seconded by Councilman Nelson. Ayes - all. G. AWARD OF BIDS 1. Tennis Court - Maplecrest Park a. Manager Evans presented the staff report. b. Councilman Murdock introduced the following resolutions and moved their adoption: 79- 5 -108A BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA that the bid of T.A. Schifsky in the amount of $10,351.00 is the lowest responsible bid for the construction of a Tennis Court at Maplecrest Park and the Mayor and Clerk are hereby authorized and directed to enter into a contract with said bidder for and on behalf of the City. 79- 5 -108B BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA that the bid of Cyclone Fence, Inc. in the amount of $5,317.00 is the lowest responsible bid for the construct- ion of fencing at Maplecrest Park and the Mayor and Clerk are hereby authorized and directed to enter into a contract with said bidder for and on behalf of the City. Seconded by Councilman Anderson. Ayes - all. 2. Goodrich Park Lights a. Manager Evans presented the staff report. b. Councilman Wiegert introduced the following resolution and moved its adoption: 79 -5 -109 BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the bid of L.P.D. Electric in the amount of $46,890.00 is the lowest responsible bid for the construction of lighting at Goodrich Park and the Mayor and Clerk are hereby author- ized and directed to enter into a contract with said bidder for and on behalf of the City. Seconded by Councilman Murdock. Ayes - all. - 3 - 5/3 H c. Councilman Wiegert moved to approve a project budget of $50,090.00 for the Good- rich Park lighting. Seconded by Councilman Murdock. Ayes - all. Mayor Greavu recessed the meeting at 7:49 P.M. to convene as the Board of Adjustments and Appeals. Mayor Greavu reconvened the meeting at 8:14 P.M. UNFINISHED BUSINESS 1. Michael Wasiluk, 1747 Frank Street a. Mr. Wasiluk questioned what time the discussion regarding the Public Works Dir- ector would be held. He has another meeting, but wishes to be heard regarding this item. b. Council informed Mr. Wasiluk that it is the last item on the agenda. J. NEW BUSINESS 1. Attorney Presentations - Robert Hulke - Client a. Michael DeCoursey, 1200 Minnesota Building, attorney representing Mr. Robert Hulke, owner of property at 1831 White Bear Avenue, stated he was interested in know- ing what the zoning plans are for White Bear Avenue from Frost Avenue to Larpenteur Avenue. It has been under discussion for a long time, but nothing has been settled. b. Councilman Anderson requested time to canvass the neighborhood to see who wishes to rezone or who doesn't. C. No action taken. 2. Fire Station Construction - Lower Afton Road and Londin Lane a. Manager Evans presented the staff report. b. Duane Williams, representing East County Lane Fire Department Chief Bob Bade, spoke on behalf of the construction of a new fire station. C. Councilman Wiegert moved to refer this matter to staff for financial review. Seconded by Councilman Anderson. Ayes - all. 3. Harry Zacho - Sewer Assessment a. Mr. Zacho requested to appear before the Council to discuss what he feels was an unfair levying of Sanitary Sewer No. 2 assessments. b. Proposed Ordinance for Control of Domestic Cats a. Mrs. Bonnie Qualley, 2089 Beam Avenue presented a petition signed by 23 residents objecting to the proposed ordinance. b. Mrs. Ruth Deschene, Director of Minnesota State Humane Society, presented a film showing effects of rabies on society. She also spoke in favor of controlling domes- tic cats. c. Mrs. Geralding Harrison, 2092 Barclay Street, presented a petition representing 25 residents in favor of the proposed ordinance. d. The following residents voiced their opinions regarding the ordinance: Mr. Jim Commander, 1708 Sylvan Street; Mrs. Irene Ganzogowski, 2575 Carver Avenue; Mr. Jon Belisle, Brookview Drive; Mrs. Eleanor Ledo, 2510 Carver Avenue; Mr. Mike Wasiluk, 1747 Frank Street; Mr. Les Axdahl, 2209 Payne Avenue. e. Councilman Nelson introduced the following ordinance and moved its adoption: ORDINANCE NO. 468 AN ORDINANCE REGULATING CATS IN THE CITY OF MAPLEWOOD THE COU14CIL OF THE CITY OF MAPLEWOOD DOES HEREBY ORDAIN AS FOLLOWS: Section 1. The Maplewood Municipal Code is hereby amended by adding thereto Section 1105 entitled "Cats" and shall read as follows: 1105.010. TERMS. As used in this ordinance the following terms mean: OWNER: Any person, partnership or corporation keeping or harboring a cat or cats; CAT: Any animal that is a member of the feline species; ANIMAL SHELTER: Any premises designated by the City Manager for the purpose of impounding and caring for animals held under authority of this ordinance; OFFICER: Any person designated by the City to enforce the provisions of this ord- inance; PERSON: An individual, partnership, company or corporation. CLERK: Maplewood City Clerk. 1105.020. PERMIT FEES. No person shall, without first obtaining a permit therefor in writing from the Clerk, own, keep, harbor, or have custody of any cat over three months of age. No more than two (2) cats over three (3) months of age shall be housed or be kept on any one residential site in any area of the City zoned residential R -1 or R -2. No more than one cat of any age shall be kept in a dwelling unit in any area of the City zoned R -3. - 5 - 5/3 1105.030. PERMIT FEES. A permit shall be issued for each cat owned, kept or maintained by any person upon payment of the fee as follows: (a) For each cat, $1.50; (b) No fee or permit shall be required of any humane society or veterinary hospital. 1105.040. PERMIT YEAR. The permit year shall commence on March 1 of each year and terminate on the last day of February of the following year. A new permit shall be obtained each year by every owner and a new fee paid. A permit, if not revoked, shall be valid until the end of the permit year. Renewal permits must be obtained prior to March 1st and there shall be a late penalty charge of $1.00 on all renewal permits issued after April 1st of each year. No permit shall be issued unless there is a certificate of vaccination for rabies not more than one year prior to the expiration of the license. 1105.050. REVOCATION. The Council may revoke any permit if the person holding the permit refuses or fails to comply with this ordinance, the regulations promulgated by the Council, or any state or local law governing curelty to animals or the keeping of animals. Any person whose permit is revoked shall, within ten days thereafter, humanely dispose of all cats being owned, kept, or harbored by such person and no part of the per- mit fee shall be refunded. 1105.060. TAGS. Upon issuing a permit to keep any cat, the Clerk shall issue to the owner a metallic or durable plastic tag, stamped with an identifying number and with the year of issuance and so designed that it may be convenietly fastened to the cat's collar or harness by the owner and shall be worn at all times. The Clerk shall maintain a record of the identifying numbers and shall make this record available to the public. 1105.070. RESTRAINT OF PREMISES. (1) All cats shall be kept under restraint at any time such cat is off of the owner's premises. (2) It shall be the obligation and responsibility of the owner or custodian of any cat in the city, whether permanently or temporarily therein, to prevent such cat from committing any act which constitutes a nuisance as defined herein. 1105.080. NUISANCE. For the purpose of this section, a cat shall be deemed to con- stitute a nuisance when: (1) The cat is not confined to the owner's or custodian's property by adequate fencing or leashing, or if the cat is off the premises of the owner or custodian and is not under control of the owner or custodian by a leash not exceeding 8 feet in length, when not con- fined in a motor vehicle or cage. (2) The cat commits damage to the person or property of anyone other than the owner or creates a nuisance on the property of one other than the owner such as damaging proper- ty, plantings or structures, or which deposits fecal material on property other than that of the owner, or which scratches or bites a person, or which cries, howls or loudly mews at night to disturb people other than the owner. (3) Failure on the part of the owner or custodian to prevent his cat from committing an act of nuisance shall be a petit misdemeanor and shall be subject to the penalty provided for such offense. 6 - 5/3 1105.090. IMPOUNDED CATS. Unrestrained cats may be taken by police, the City animal control officer, or the Humane Society and impounded in an animal shelter, and there con- fined in a humane manner. Impounded cats shall be kept for not less than five days unless reclaimed by their owners. If by a permit, tag or by other means the owner can be iden- tified, the animal control officer shall immediately upon impoundment notify the owner by telephone or mail of the impoundment of the cat. Cats not claimed by their owners within five days shall be humanely disposed of by an agency designated by the Council. 1105.100. IMPOUNDING FEE. Any owner reclaiming an animal shall pay a fee of $2.00, plus $2.00 for each day that the animal has been impounded. The owner may also be pro- ceeded against for violation of this ordinance and his permit may be revoked. 1105.110. FEMALE CATS IN HEAT. Every female cat in heat shall be confined in a building or secure enclosure, in such manner that such female cat cannot come into contact with another cat except for planned breeding. 1105.120. NON- RESIDENTS. The provisions herein requiring a permit shall not apply to non - residents of the City who keep the cat under.restraint and are not kept within the City for more than 30 days. 1105.130. VIOLATION AND PENALTY. Any person violating any of the provisions of this ordinance shall be deemed guilty of a petit misdemeanor and shall be punished by a fine of not more than $100.00. If any violation be continuing, each day's violation shall be deemed a separate violation. If any person be found guilty by a court of violation of this ordinance, his permit to won, keep, harbor or have custody of a cat or cats shall be deemed automatically revoked and no new permit may be issued for a period of one year thereafter. Section 2. This ordinance shall take effect upon passage and publication. Seconded by Councilman Murdock. Ayes - Councilmen Anderson, Murdock, Nelson and Wiegert. Nays - Mayor Greavu. Motion carried. 5. Left Turn Lane - Beam Avenue and White Bear Avenue a. Manager Evans presented the staff report recommending that a public hearing be established for June 7, 1979 after which action on the plans and specifications can be taken. Staff recommends approval of the plans and specifications and denial of the City participation in the traffic signal at this time. b. Councilman Wiegert introduced the following resolution and moved its adoption: resaRtf, WHEREAS, the City Engineer for the City of Maplewood and the County of Ramsey have been authorized and directed to prepare preliminary plans for the construction of a left turn lane on White Bear Avenue at Beam Avenue; and WHEREAS, the said City Engineer has prepared the aforesaid preliminary plans for the improvement herein described: - 7- 5/3 1. The report of the City Engineer advising this Council that the proposed improvement on Beam Avenue by the construction of a left turn lane is feasible and should best be made as proposed, it hereby received. 2. The Council will consider the aforesaid improvement in accordance with the reports. 3. A public hearing will be held in the Council Chambers of the City Hall at 1380 Frost Avenue on Thursday, June 7, 1979 at 7:30 P.M. to consider said improve- ment. NOTICE OF HEARING CONSTRUCTION OF LEFT TURN LANE ON WHITE BEAR AVENUE TO WHOM IT MAY CONCERN: WHEREAS, the City Council of the City of Maplewood, Ramsey County, Minnesota, and the County of Ramsey deem it necessary and expedient that the improvement herein- after described be made; NOW, THEREFORE, notice is hereby given that the City Council will hold a public hearing on said improvement at the following time and place within said City: Date and Time: Thursday, June 7, 1979 at 7:30 P.M. Location: City Hall, 1380 Frost Avenue The general nature of the improvement is the construction of a left turn lane on White Bear Avenue at Beam Avenue. Manager Miller presented the staff report recommending Council initiate a feasibil- ity study to be completed by Kirkham, Michael and Associates. b. Councilman Wiegert introduced the following resolution and moved its adoption: 79 -5 -111 WHEREAS, the City Council has determined that it is necessary and expedient that the area described as Ar -Mon Properties, Incorporated (aka English Manor P.U.D.) located at the intersection of English Street and County Road "B" be improved by the construction of storm sewers; - 8 - 5/3 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the improvement as hereinbefore described is hereby referred to the City Engineer, and he is instructed to report to the Council with all convenient speed advising the Council in a preliminary way as to whether the proposed improvement is feasible and should best be made as proposed, and the estimated cost of the improvement as recommended. BE IT FURTHER RESOLVED that the Developer, Ar -Mon Properties, shall pay the costs of said feasibility study should the project not be ordered. Kirkham, Michael and Assoicates is designated to complete the feasibility study. Seconded by Councilman Anderson. Ayes - Councilmen Anderson, Murdock, Nelson and Wiegert. Nays - Mayor Greavu. Motion carried. 7. Plan Amendment - Density Figure Amendment - Weber Investment a. Manager Evans presented the staff report. b. Councilman Wiegert moved to table this item until the meeting of May 17, 1979. Seconded by Councilman Anderson. Ayes - all. 8. Plan Amendment - OS /S /RL to Rm - Crestview Forest Townhouses a. Manager Evans presented the staff rpoert with the following recommendations: I. Denial of the proposed Land Use Plan amendments from OS, Open Space, S, School, and RL, Low Density Residential to Rm, Medium Density Residential, on the basis that: 1. The proposed density would exceed the planned density of the Vista Hills Neigh- borhood. 2. Increasing the density would compound the existing deficiencies in the Highwood Avenue interceptor. 3. Increased density would result in the loss of more trees and increased erosion problems on the steep slopes. II. Approval of a Plan Amendment to RLE, Residential Low Density Extended, for the subject property, on the basis that: 1. There are significant wetlands, steep slopes, and tree cover that can be better preserved by clustering townhouse units at low density than by a single dwelling residential development. 2. Townhouses would meet the City's policy of providing for a wide choice of housing. 3. Townhouses would be compatible with surrounding single family homes. The property to the west is planned as a City Park, the property to the south is undeveloped land planned for open space and the property to the east is County workhouse property. - 9 - 5/3 III. Tabling of the preliminary planned unit development until: 1. Density is reduced to RLE standards. 2. Area of driveways is reduced whereever possible to preserve more of the trees and reduce run -off. 3. The City's drainage plan is revised to reflect the increased run -off from the above Plan Change. 4. Existing Wetlands are preserved to handle this run -off, wherever possible. 5. A grading and drainage plan is submitted. IV. The City's Planning Consultant shall compensate for the increase in density on the subject lot by considering the proposed amendments in the staff analysis section as part of the updating of the Land Use Plan. b. Councilman Wiegert moved that this Council address the Metropolitan Council an the Metropllitan Waste Control Commission that the Highwood Interceptor shown as a Metro interceptor is inadequate and is in urgent need of rehabilitation. Seconded by Councilman Anderson. Ayes - all. c. Chairman Les Axdahl presented the following Planning Commission recommendation: "Commissioner Pellish moved the Planning Commission recommend denial of the proposed Land Use Plan Amendment from OS, Open Space, S, School, and RL, Low Density Resident- ial to Rm, Medium Density Residential on the basis that: 1. Councilman Anderson moved to suspend the Rules of Procedures to extend the meeting to the deadline. Seconded by Councilman Wiegert. Ayes - all. e. Councilman Wiegert moved to refer the to the Planning Commission for review_ Seconded by Councilman Anderson. Ayes - all. f. Councilman Wiegert introduced the following resolution and moved its adoption: 79 -5 -112 WHEREAS, the Maplewood City Council and the Maplewood Planning Commission have prepared and adopted a Comprehensive Community Plan in compliance with the require- ments of Section 462.355 of the State Planning Enabling Legislation; and WHEREAS, said Section 462.355 provides for subsequent amendment of said Compre- hensive Plan which reflect changed conditions; and WHEREAS, the Maplewood Planning Commission has conducted the required public hearing and has given consideration to all evidence and testimony submitted at such hearing held on April 16, 1979 and has adopted said amendment and forwarded said amendment to the City Council for certification; and WHEREAS, the Maplewood City Council has reviewed said amendment; NOW, THEREFORE, BE IT RESOLVED that the Maplewood City Council hereby adopts and amends the Comprehensive Plan for Maplewood. Seconded by Councilman Anderson. Ayes - all. K. COUNCIL PRESENTATIONS 1. Codification a. Councilman Anderson stated he is wondering when the codification by the Adminis- trative Assistant will be completed. b. Staff stated they would review. 2. Referandum - Open Space and Parks a. Councilman Anderson commented that perhaps there should be a referandum to see if residents want open space and parks. b. No action taken. 3. Identity a. Councilman Murdock stated due to the lateness of the meeting he would bring this up at another time. - 11 - 5/3 4. Battle Creek a. Mayor Greavu discussed that the St. Paul part of Battle Creek is being repaired consistantly but nothing is done on the Maplewood part. b. No action taken. 5. Letter - Tri Lake Association a. Mayor Greavu stated he received a letter from Mr. Don Watson,Tri Lake Association, requesting Council to ask Ramsey County to purchase a dredger. b. Mayor Greavu introduced the following resolution and moved its adoption: 79 -5 -113 RESOLVED, that the City Council of Maplewood, Minnesota, request Ramsey County to investigate the purchasing of a dredger that could be used on the Keller- Gervais- Lake Kohlman chain of Lakes. Seconded by Councilman Wiegert. Ayes - all. 6. Parkway Drive and Highway 61 a. Director of Public Works Bittner reported on the progress of negotiations with the Minnesota Department of Transportation regarding the construction of Parkway Drive and Highway 61 intersection. Councilman Wiegert moved to suspend the Rules of Procedures and extend the meeting past the midnight deadline. Seconded by Councilman Anderson. Ayes - all. b. Mr. Jerry Hurley, 925 Parkway Drive and his attorney, Mr. John Daubney, spoke against the proposal and explained how it will effect his property. c. Councilman Murdock introduced the following resolution and moved its adoption: 79 -5 -114 WHEREAS, certain complaints have been received from homeowners on Parkway Drive concerning the revision of the intersection of Parkway and T.H. 61 and the construction attendant thereto; and WHEREAS, said homeowners have declared that completion of said construction will cause severe damage to the liveability of their property; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, that it takes a non - supportive attitude on the present design involved in the construction of the revised intersection of Parkway and T.H. 61, and hereby directs that the Minnesota Department of Transportation and Ramsey County be notified of this attitude partic- ularly as it relates to the closeness of redesigned Parkway to the homes on the north side of said street.
