CALL TO ORDER A regular meeting of the City Council of Maplewood, Minnesota, was held in the Council Chambers, Municipal Building and was called to order at 7:32 P.M. by Mayor Greavu. B. APPROVAL OF MINUTES 1. Minutes No. 79 -5 (March 1, 1979) Councilman Anderson moved that the Minutes of Meeting No. 79 -5 (March 1, 1979) be approved as submitted. Seconded by Councilman Wiegert. Arbor Month Resolution 79 -4 -86 Ayes - all WHEREAS, the City of Maplewood is proud of the beautiful shade trees which arch over our streets and homes; and WHEREAS, the City of Maplewood is well known for its native woodlands that provide a serene and healthful setting for our lives; and - 1 - 4/5 WHEREAS, shade tree diseases do threaten our shade trees with destruction; and WHEREAS, citizens all around the State of Minnesota are uniting to celebrate the benefits of our natural tree population and are planting new trees to make our natural tree population and are planting new trees to make our cities and neighborhoods as beautiful as the wilderness areas which surround them; and WHEREAS, this is a commendable effort that the people of this City would do well to join; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MAPLEWOOD, that April 27th is hereby proclaimed as "Arbor Day" in the City of Maplewood and the month of May is proclaimed "Arbor Month "; and BE IT FURTHER RESOLVED that the City of Maplewood calls upon the public spirited and foresighted citizens of this community to plant trees NOW for our pleasure and that of future generations. 2. Additional Data Regarding Proposed Change in Encumbrance Accounting - Resolution 79 -4 -88 WHEREAS, it is the City of Maplewood's intent to maintain its accounting records according to generally accepted accounting principles; and WHEREAS, the National Council on Governmental Accounting has made a change in generally accepted accounting principles regarding encumbrances. NOW, THEREFORE, BE IT RESOLVED, that effective December 31, 1978, the City Council hereby adopts the new principles regarding encumbrances which includes the automatic carry over of appropriations to the subsequent year in order to finance the completion of purchases in progress at year end. 5. Logo for Maplewood Nature Center The Common Yellow - Throat is adopted as the bird to be used as the Maplewood Nature Center Logo. Recommended by the Park and Recreation Commission. 6. Abatement of Taxes for Public Works Facility - Resolution 79 -4 -89 A RESOLUTION requesting cancellation and removal from taxation records in the office of the Director of Property Taxation, Ramsey County, Minnesota, the special assessments in the amount of $523.98 and interest in the amount of $946.98 total of $1,470.96 for the ear of 1978, payable in 1979 which were levied and identified by Code No. 57- 01410- 160 the records of the Director of Property Taxation, Ramsey County. WHEREAS, the City of Maplewood acquired a miscellaneous tract of land in Section 14, Township 29, Range 22 (Unplatted Lands) more particularly described on attached Ramsey County Director of Taxation form attached hereto for a PUBLIC WORKS GARAGE SITE BY TWO (2) Quit Claim Deeds, both dated May 30, 1977. Grantors being Warren A. Olson and Mary L. Olson, husband and wife AND Warren A. Olson and Mary L. Olson, his wife, Robert J. Olson and Betty J. Olson, his wife. Said deeds were duly recorded in Ramsey County Re- corder's office as documents No's 657996 and 657994 on June 5, 1978. Financial Transfers to Close Improvement Projects - Resolution 79 -4 -90 BE IT RESOLVED, that the following interfund transfers be made effective December 31, 1978: 1. Home Occupation - Yoshi's Men's and Women's Styling Shop - Permit Renewal Renewal Permit for Yoshi's Men's and Women's Styling Shop, 1900 Sterling Avenue, for one year be approved. 9. Amendment - Directional Signs - Ordinance - Second Reading and Adoption ORDINANCE NO. 463 AN ORDINANCE AMENDING SECTION 818 OF THE MAPLEWOOD CODE RELATING TO SIGNS THE COUNCIL OF THE CITY OF MAPLEWOOD DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Section 818 of the Maplewood Code is hereby amended to read as follows: 818.040. Administration and Enforcement. 2. Permits: Every person shall before erecting, placing, rebuilding, reconstructing, alter- ing, or moving any sign, other than an incidental holiday, construction, political, or real estate sign, obtain from the Administrator a permit to do so as provided in this ordinance. A permit shall not be required for normal maintenance or change of copy for existing signs. 818.170. District Schedules. 4. On site directional signs, not exceeding four (4) square feet in area, intended to facilitate the movement of pedestrians and vehicles within the site upon which such signs are located. No more than two directional signs may be allowed per curb cut. - 4 - 4/5 5. Not more than two (2) on site directional signs, identifying the location and nature of a building, structure, or use which is not readily visible from the street. Each sign shall not exceed ten (10) square feet in area. F. PUBLIC HEARINGS 1. Rezoning - BC to R -1 - 1715 Edgerton Street - Nelson - lst Reading - 7 :30 P.M. a. Mayor Greavu convened the meeting for a public hearing regarding a zone change of property at 1715 Edgerton Street from BC (Business Commercial) to R -1 (Single Family District). The Clerk read the notice of hearing along with the dates of publication. b. Manager Evans presented the staff report with the recommendation of approval of the rezoning from BC to R -1. c. Chairman Les Axdahl presented the following Planning Commission recommendation: "Commissioner Howard moved that the Planning Commission recommend the City Council initiate the rezoning of Lot 7 as the rezoning would bring the property into con- formance with the Comprehensive Plan and also, the property has no objection. Commissioner Kishel seconded. Ayes all." d. Mayor Greavu called for proponents. None were heard. e. Mayor Greavu called for opponents. None were heard. f. Mayor Greavu closed the public hearing. g. Councilman Wiegert moved first reading of an ordinance to rezone Lot 7, Block 8 King's Addition to the City of St. Paul from B -C (Business Commercial) to R -1 (Sin- gle Family District) located at 1715 Enelish Street. Seconded by Councilman Fontaine. Ayes - all. 2. Plan Amendment /Rezoning - 2091 Belmont Lane - Peterson - First Reading - 7:30 P.M. a. Mayor Greavu convened the meeting for a public hearing regarding a petitioned change in zoning from M -1 (Light Manufacturing) and F (Farm- Residence) to R -1 (Single Family District) and a Plan Amendment to the Comprehensive Land Use Plan for 2091 Belmont Lane. The Clerk read the notice of hearing along with the dates of publication. b. Manager Evans presented the staff report with the following recommendation: I. Approval of the Plan Amendment from OS, Open Space to Rm, Medium Density Re- sidential, based on the following findings: 1. The property to the north is a railroad line that is not conducive to stan- dard single - dwelling home development. 2. The property to the east is zoned for duplexes. 3. The property to the south and west is golf course property. This property would, therefore, not develop into uses incompatible with medium density residential development. - 5 - 4/5 II. Approval of zone change from M -1 and F to R -1 for the property described below: parcel 010 -33 in the NE 1/4 of the NW 1/4 of Section 14, Township 29, Rnage 22 in the City of Maplewood, Ramsey County, Minnesota. Approval is based on the following: 1. An R -1 zone is more compatible with the Land Use Plan than the current zoning of M -1. 2. The property is presently being used for single- dwelling residential use. C. Chairman Les Axdahl presented the following Planning Commission recommendation: "Commissioner Pellish moved the Planning Commission recommend approval of the Com- prehensive Plan amendment from OS, Open Space to Rm, Medium Density Residential based on the following findings: 1. Councilman Wiegert introduced the following resolution and moved its adoption: 79 -4 -91 WHEREAS, the Maplewood City Council and the Maplewood Planning Commission have - 6 - 4/5 prepared and adopted a Comprehensive Community Plan in compliance with the require- ments of Section 462.355 of the State Planning Enabling Legislation; and WHEREAS, said Section 462.355 provides for subsequent amendment of said Com- prehensive Plan which reflect changed conditions; and WHEREAS, the Maplewood Planning Commission has conducted the required public hearing and has given consideration to all evidence and testimony submitted at such hearing held on February 26, 1979 and has adopted said amendment and forwarded said amendment to the City Council for certification; and WHEREAS, the Maplewood City Council has reviewed said amendment; NOW, THEREFORE, BE IT RESOLVED that the Maplewood City Council hereby adopts and amends the Comprehensive Plan for Maplewood. Seconded by Councilman Anderson. Ayes - all. h. Councilman Wiegert moved first reading of an ordinance to rezone the at 2091 E. Belmont Lane zoned M -1 (Light Manufacturing) and FR (Farm -Res to R -1 (Single Family District). Seconded by Councilman Fontaine. Ayes - all. G. AWARD OF BIDS 1. Goodrich Park Lighting a. Manager Evans stated there was an error in the bid of the lowest bidder. It is recommended the bids be rejected and authorization be granted to readvertise. b. Councilman Wiegert moved to reject the bids for the Goodrich Park Lighting and staff be authorized to readvertise. Seconded by Councilman Fontaine. Ayes - all. F. PUBLIC HEARINGS (continued) 3. Preliminary Plat, Rezoning and Lot Split - Linwood Heights - 7:45 P.M. a. Mayor Greavu convened the meeting for a public hearing regarding the request of Castle Design and Development Co., Inc. for a preliminary plat for 40 dwelling lots known as Linwood Heights and a request to rezone the property from F (Farm- Residence) to R -1 (Single Family Residence). The Clerk read the notices of hearing along with the dates of publication. b. Manager Evans presented the staff report with the following recommendation: I. Approval of the Preliminary Plat subject to the following conditions: 1. Implementation of the recommendtions of the Soil Conservation Service in their report of August 28, 1978. 2. The final plat shall not be approved, unless: - 7 - 4/5 a. Council orders Hillwood Drive from the east side of the Crestwood Knolls Plat to McKnight Road, including sanitary sewer, water, storm sewer, and storm water retention ponds. b. Council orders Dorland Road from proposed Hillwood Drive to Linwood Avenue, including sanitary sewer, water, storm sewer, and a storm water rentention pond. C. The approved right -of -way for Hillwood Drive is shown on the final plat. d. The lot split is approved by Council and the property for Dorland Road is deeded to the City. e. Lot 1, block 1 is dropped and the area distributed among lots 2 -10 of block 1. 3. Change Highview Lane to Oakridge Lane. II. Approval of the lot split, subject to the deeding of the property for Dorland Road to the City. III. Approval of first reading for the rezoning. Second reading shall not be given until the final plat has been approved. c. Chairman Les Axdahl presented the following Planning Commission recommendation: "Commissioner Fischer moved the Planning Commission recommend to the City Council approval of the preliminary plat subject to the following conditions: 1. Councilman Anderson moved to approve the preliminary plat for Linwood Heights subject to the renaming of the street and to the conditions given by the Planning Commission. Mayor Greavu convened the meeting for a public hearing regarding a request by Weber Investment Corporation on appeal for a Comprehensive Plan Amendment which was denied by the Maplewood Planning Commission at their meeting of February 26, 1979. The Clerk read the notice of hearing along with the dates of publication. b. Manager Evans presented the staff report. C. Chairman Les Axdahl presented the following Planning Commission recommendation: "Commissioner Howard moved that the Planning Commission recommend denial of the application as the applicant has failed to show that an error was made in the present designation or that conditions have materially changed to justify a change in the designation. Commissioner Barrett seconded. Commissioner Sherburne said he would be in favor of the proposed amendment if there was some way in which the Commission could condition the approval to guarantee de- velopment of the elderly housing and not some other type of high density development. Also if there could be some guarantee that the other problems mentioned at the meeting could be solved, such as providing a buffer for the single family develop- ment and so forth. Voting on the motion: Ayes - 5 Commissioner Howard, Pellish, Prew, Barrett, Axdahl. Nays - 3 Commissioners Sherburne, Fischer, Kishel Abstained - 1 Commissioner Ellefson arrived at the meeting during discussion. Motion carries." - 9 - 4/5 d. Mr. Thomas Weber, Weber Investment Corp., spoke on behalf of his proposal. e. Mayor Greavu called for proponents. The following were heard: Mr. Don 'Conklin, speaking for Mrs. Howlett, owner of the property. f. Mayor Greavu called for opponents. The following were heard: Mr. Dale Newland, 2975 Frederick Parkway, spoke and presented a petition signed by approximately 200 residents; Mr. John Kuehnon, 2981 Frederick Parkway; Mrs. Roxanne Newland, 2975 Frederick Parkway; Mrs. Susan Hoyt, 2993 Furness Street; Mr. Everette Condon, 2967 Beebe Parkway; Mr. Ray Hoyt, 2993 Furness Street; Mrs. Debbie Kasper, 2971 Frederick Parkway. g. Mayor Greavu closed the public hearing. h. Councilman Wiegert moved to table action on the amendment that proposes to change the people per unit figures for elderly housing in accordance with the staff recommendations and ask that the following questions be clarified: What actual plans are pending in terms of building . structureson -the land in question; What are the actual boundaries of the LSC designated land (refer to Planning Commission for review); What land is definitely proposed for Rh. Seconded by Mayor Greavu. Ayes - all. Councilman Nelson moved the staff recommendations regarding the land use designation from R -M to Rh for the purpose of elderly housing with the provision that an agree- ment be reached by the attorney annlicant and land owner that should the annlication or use reverts to Seconded by Councilman Fontaine. Councilman Nelson withdrew his motion. Councilman Nelson moved to table this item until the special meeting of April 9, 1979, at 7:30 P.M. in the Council Chambers. Seconded by Councilman Fontaine. Ayes - all. Councilman Wiegert moved to send a letter to the proper agency in support of Elderly Housing. Seconded by Councilman Fontaine. Ayes - all. - 10 - 4/5 5. Zoning Amendment - Apartment /Townhouse Definition - First Reading - 8:15 P.M. a. Mayor Greavu convened the meeting for a public hearing regarding definitions for townhouses and apartments. The Clerk read the notice of hearing along with the dates of publication. b. Manager Evans presented the staff report and stated after researching definit- ions used by several other communities, staff recommends that the Council give first reading to the following: 906.400. R�3C - Townhouses. Townhouses are defined as multiple dwelling struct- ures consisting of at least three attached dwelling units, with no one unit or portion thereof directly above or below any other unit. Such units are commonly described as row houses, patio homes or quads. C. Chairman Les Axdahl presented the following Planning Commission recommendation: "Commissioner Izishel moved that the Planning Commission recommend to the City Council the definition for apartment and townhouse as indicated in the staff memorandum of February 15, 1979. Commissioner Fischer seconded. Ayes - 8; Nays - l." d. Mayor Greavu called for proponents. None were heard. e. Mayor Greavu called for opponents. None were heard. f. UNFINISHED BUSINESS 1. Plan Amendment Appeal - Fox and Hounds Restaurant a. Manager Evans stated at the March 15 City Council meeting, the Fox and Hounds appeal was tabled until the April 5 meeting to allow the applicant to contact the State Highway Department in regard to leasing or buying part of the I -35E property for parking lot expansion. A copy of the letter that was sent to the Highway Depart- ment was enclosed. As of the writing of this memo, the Highway Department had not responded. I would recommend that the Council table this item until the Highway Department has responded. - 12 - 4/5 b. Only one operator be permitted to work in the shop; 2. There shall be no customer parking on Keller Parkway. All parking must be off - street; 3. The special exception shall be issued for a one year period. After one year, Council may review the use for possible nuisance conditions. If none exist, the permit may be renewed; 4. The work area shall be inspected and approved by the Fire Marshal; 5. Owner and applicant agree to the above conditions in writing. b. Manager Evans presented the staff report with the recommendation that the appeal be denied based on the following: 1. The pattern of development in this area indicates that this lot should be developed as part of a subdivision and that an east -west through street should be put in; 2. The requested lot division would limit the efficient development of the subject property and surrounding properties; 3. The City Council denied a similar request on August 7, 1975. b. Mr. John Luger, the applicant, spoke on behalf of his request. C. Following further discussion, Mr. Luger withdrew his request for appeal. d. Councilman Wiegert moved to accept Mr. Luger's withdrawal of his appeal. Seconded by Councilman Fontaine. Ayes - all. 3. Preliminary Plat Time Extension - Carsgrove's Meadows a. Manager Evans presented the staff report and recommended approval of the time extension for 90 days. b. Planning Commission Appointment a. Manager Evans stated the Planning Commission has recommended the following three candidates for appointment to the vacant Planning Commission position. Their first choice was Chuck Kent, second choice Don Christianson and third choice was Bruce Ryden. A copy of each of their resumes are enclosed. Manager Evans stated an application for cancellation of paramedic ambulance services charges has been received from the mother of Jeffrey Klesk. This individ- ual was taken to the Detoxification Center from a car in the ditch on Sterling north of Larpenteur. b. Councilman Anderson moved to deny the request of Jeffrey Klesk for cancellation of his paramedic bill. Seconded by Councilman Fontaine. Ayes - Mayor Greavu, Councilmen Anderson, Fontaine and Nelson. Nays - Councilman Wiegert. 6. Assessment Cancellation - 2091 Belmont Lane a. Manager Evans presented the staff report and stated it is recommended that the assessment for Project 75 -16 in the amount of $1,159.83 be cancelled. It is also recommended that there be no change made in the assessments for Project 74 -18. b. Mayor Greavu moved to accept the staff's recommendation and introduced the following resolution and moved its adoption: 79 -4 -92 WHEREAS, pursuant to resolution 78 -8 -174 of the City Council of Maplewood, Minnesota, adopted August 22, 1978, the special assessments for the construction of Improvement 75 -16, were levied against property described as 57 01410 010 33; and WHEREAS, it has been determined the above described property does not benefit from said special assessment; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the assessments for Water Improvement 75 -16, in the amount of $1,159.38 against 57 01410 010 33 be, and the same hereby are, cancelled.
