(L) ADMINISTRATIVE PRESENTATIONS I (M) ADJOURNMENT MINUTES OF MAPLEWOOD CITY COUNCIL 7:30 P.M., Thursday, January 26, 1978 Council Chambers, Municipal Building Meeting No. 78 -2 A regular meeting of the City Council of Maplewood, Minnesota was held in the Council Chambers, Municipal Building and was called to order at 7:30 P.M. by Mayor Greavu. B. ROLL CALL John C. Greavu, Mayor Present Norman G. Anderson, Councilman Present Roger F. Fontaine, Councilman Present Earl L. Nelson, Councilman Present Donald J. Wiegert, Councilman Present C. APPROVAL OF MINUTES 1. Minutes No. 77 -33 (November 10, 1977) Councilman Anderson moved that the Minutes of Meeting No be approved as corrected: Page 2 - Item F -la "prohibitively" Page 15 - Item K -6 "schools" Seconded by Councilman Wiegert. Ayes - all. D. APPROVAL OF AGENDA Councilman Anderson moved the Agenda be approved as amended: 1. White Bear Avenue - County Road B to Cope Avenue 2. M A A 3. Committee 4. Appointment 5. Orientation 6. Deed Correction Seconded by Councilman Wiegert. Ayes - all. -33 (November 10. 19 Mayor Greavu recessed the meeting at 7:34 P.M. to convene as the Maplewood Board of Appeals and Ajustments. Mayor Greavu convened the meeting at 8:05 P.M. E. PUBLIC HEARINGS 1. Liquor License - Off Sale - 2730 Stillwater Avenue 7:45 P.M. a. Mayor Greavu convened the meeting for a public hearing regarding the request of John and Ruth Gormley to obtain on Off Sale intoxicating liquor license to be located at 2730 Stillwater Road. The Clerk read the notice of hearing along with the dates of publication. - 1 - 1/26 b. Manager Miller stated the usual background investigation has been made on trans- fer applicants John J. Gormley and Ruth A. Gormley. There is no reason that their application should not be approved. c. Mr. and Mrs. Gormley were present at the hearing. d. Mayor Greavu called for proponents. None were heard. e. Mayor Greavu called for opponents. None were heard. f. Mayor Greavu closed the public hearing. g. Councilman Nelson introduced the following resolution and moved its adoption: 78 -1 -14 NOTICE IS HEREBY GIVEN, that pursuant to action by the City Council of the City of Maplewood on January 26, 1978, an Off Sale Intoxicating Liquor License was approved for John and Ruth Gormley, dba J and R Liquors, 2730 Stillwater Avenue. The Council proceeded in this matter as outlined under the provisions of the City Ordinances. Seconded by Councilman Wiegert. Ayes - all. 2. Liquor License - On Sale - 1820 Rice Street 7:45 P.M. a. Mayor Greavu convened the meeting for a public hearing regarding the request of Gary P. and Susan Cormican, 1820 Rice Street, to obtain an On Sale intoxicating liquor license. The Clerk read the notice of hearing along with the dates of pub- lication. b. Manager Miller stated staff has made the usual background investigation of applicants Gary P. Cormican and Susan Kay Cormican for an on -sale liquor license at Mr. Pizza Restaurant, 1820 North Rice Street. We have located no information that would prevent their being issued a license. However, the unique nature of this establishment presents problems in controlling the sales as it did with 3.2 beer sales. Among them, are the fact that this business has evolved from a fast food service operation with a large drive -up business and a small on- premises sit -down type customer. It has seating for only approximately 60 customers. They still have take -out and sit -in types of operation. In this immediate area you have an approved amusement park with many youthful patrons and one of the large swimming beaches in Ramsey County. The potential for law violations at this location is very great. Staff recommends in view of the foregoing that the application be denied. C. Attorney D. Patrick McCullough, representing the applicants, spoke on behalf of the proposal. d. The applicants, Gary and Susan Cormican, explained to the Council how they intended to divide the building to insure compliance with liquor license policies. e. Mayor Greavu called for proponents. None were heard. f. Mayor Greavu called for opponents. None were heard. g. Mayor Greavu closed the public hearing. - 2 - 1/26 i h. Councilman Anderson moved to grant an On Sale Liquor License to the portion of the building designated Bar and Restaurant and that the stated division of the building be completed within 30 days. 1 Seconded by Councilman Wiegert. Ayes - all. h. Councilman Anderson introduced the following resolution and moved its adoption: 78 -1 -15 NOTICE IS HEREBY GIVEN, that pursuant to action by the City Council of the City of Maplewood on January 26, 1978, an On Sale Intoxicating Liquor License was approved for Gary P. and Susan Kay Cormican, dba Mr. Pizza, 1820 No. Rice Street. The Council is proceeding in this matter as outlined under the provisions of the City Ordinances. Seconded by Councilman Wiegert. Ayes - all. F. AWARDING OF BIDS 1. Police Patrol Vehicles a. Manager Miller stated bids were received for 2 carryall type vehicles and for 2 vans. Ralph Thomas Chevrolet was the apparent low bidder on the 2 carryalls. There was confusion on the bids for the vans and it is recommended the bids for the vans be rejected and reheard. b. Councilman Anderson introduced the following resolution and moved its adoption: 78 -1 -16 BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA; that the bid of Ralph Thomas Chevrolet in the amount of $15,851.00 . is the lowest responsible bid for the purchase of two (2) Police Carryall Type Vehicles and the Mayor and Clerk are hereby authorized and directed to enter into a contract with said bidder for and on behalf of the City. Seconded by Councilman Wiegert. Ayes - all. c. Councilman Wiegert moved to reject the bids received for the two vans and author- ize staff to readvertise. Seconded by Councilman Nelson. Ayes - all. APPROVAL OF ACCOUNTS Councilman Anderson moved that the accounts (Part I - Fees, Services, ExF No. 002516 through Check No. 002542 - $242,171.21; Check No. 025201 throe 025320- $128,.925.02: part II - Payroll -Check #16340 through Check No. $49,184.19) in the amount of $420,280.42 be paid as submitted. Seconded by Councilman Wiegert. Ayes — all. -3- 1/26 H. UNFINISHED BUSINESS 1. Zone Change - FR to M -1 - West Side of Hazelwood Street, North of Beam Avenue - Adoption a. Manager Miller stated the public hearing for this proposed zone change was held on December 29, 1977. The item was again discussed on January 12 and the subject was again carried over to this date. Final passage of all zoning ordinances requires four affirmative votes. b. Mr. Richard Schreier, the applicant, spoke on behalf of his request. C. Following Council discussion, Councilman Wiegert introduced the following ordinance and moved its adoption: ORDINANCE NO. 436 AN ORDINANCE AMENDING THE MAPLEWOOD ZONING CODE THE CITY COUNCIL OF THE CITY OF MAPLEWOOD DOES HEREBY ORDAIN AS FOLLOWS: Section 1. That the following described property is hereby rezoned from FR - (Farm Residential) to M -1 (Light Manufacturing) All that part of the Northwest 1/4 of Section 3, Township 29, Range 22 lying Easterly of the East Line of Northern Pacific Railway right of way (a parcel of land located north of Beam Avenue, South of County Road D, West of Hazelwood Street) Section 2. This Ordinance shall take effect upon its passage and publication. Seconded by Councilman Nelson. Motion carried. 2. Annual Appointments - Boards and Commission Ayes - Mayor Greavu, Councilmen Fontaine, Nelson and Wiegert. Nays - Councilman Anderson. a. Manager Miller stated Edward O'Mara's term on the Police Civil Service Commission expires in February. He has indicated a desire to continue on the Commission. This item was discussed briefly at the January 12 meeting and carried over until this time. A gentleman in the audience suffered an apparent heart attack and the Paramedics were called. Mayor Greavu recessed the meeting at 8:47 P.M. Mayor Greavu reconvened the meeting at 9:34 P.M. H. UNFINISHED BUSINESS (continued) 2. Annual Appointments - Boards and Commission (continued) b. Mayor Greavu moved to re- appoint Edward O'Mara to the Police Civil Service Commission for a three year term. Seconded by Councilman Anderson.
