CALL TO ORDER A regular meeting of the City Council of Maplewood, Minnesota, was held in the Council Chambers, Municipal Building and was called to order at 7:30 P.M. by Mayor Murdock. B. APPROVAL OF MINUTES 1. Minutes No. 77 -25 (September 8, 1977) Councilman Anderson moved that the Minutes of Meeting No. 77 -25 (September 8, 1977) be approved as submitted. Seconded by Councilman Wiegert. Ayes - all. 2. Minutes No. 77 -26 (September 15, 1977) Councilman Wiegert moved that the Minutes of No. 77 -26 (September 15. 197 Seconded by Councilman Anderson. Ayes - Mayor Murdock, Councilmen Greavu and Wiegert. Councilman Anderson abstained. 3. Minutes No. 77 -29 (October 6, 1977) Councilman Wiegert moved that the Minutes of Meeting No. 77 -29 (October 6, 1977) be approved as submitted. Seconded by Councilman Greavu. Ayes - Mayor Murdock, Councilmen Greavu and Wiegert. Councilman Anderson abstained. D. APPROVAL OF AGENDA Mayor Murdock moved to approve the Agenda as amended: 1. Johnson's Pond 2. Tree Removal 3. Conway Lights 4. Highway 61 5. Delete Item J -3 Seconded by Councilman Wiegert. Ayes - all. - 1 - 10/27 E. PUBLIC HEARINGS 1. Street Improvement - Left Turn Lane - White Bear Avenue and Woodlyn Avenue - 7:30 P.M. a. Mayor Murdock convened the meeting for a public hearing regarding the construct- ion of a left turn lane on White Bear Avenue Southbound at Woodlyn Avenue. The Clerk read the notice of hearing along with the dates of publication. b. Manager Miller stated on April 17, 1975, the City Council passed a resolution modifying the geometries of the Woodlynn Avenue intersection with White Bear Avenue to accommodate a future left -turn lane on White Bear Avenue and directing staff to meet with Ramsey County Engineers regarding the necessary revisions to their facility. On April 21, 1977, the Council passed a resolution requesting that the County con- struct said left -turn lane and install the necessary modifications to the signal system. At the meeting of September 8, 1977, the Council approved the County plans and ordered the public hearing. No modifications to the sigals are included in the County proposal. The County pro- poses that the modifications be made at an estimated cost of $5,700.00 to be shared equally between City and County and that the equipment then become the property of Ramsey County. No assessments shall be levied for these improvements. Funding shall be from County State Aid Funds. c. Mr. Wayne Leonard, Ramsey County, explained the specifics of the proposal. d. Mayor Murdock called for proponents. None were heard. e. Mayor Murdock called for opponents. None were heard. f. Mayor Murdock closed the public hearing. g. Councilman Wiegert introduced the following resolution and moved its adoption: 77 - 10 - 211 WHEREAS, after due notice of public hearing on the installation of a left -turn lane on White Bear Avenue and Woodlynn Avenue, a hearing on said improvement in accordance with the notice duly given was duly held on October 27, 1977, and the Council has heard all persons desiring to be heard on the matter and has fully con- sidered the same; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, as follows: 1. That it is advisable, expedient and necessary that the City of Maplewood install a left -turn lane on White Bear Avenue and Woodlynn Avenue as described in the notice of hearing thereon, and orders the same to be made. 2. The Ramsey County Engineer is designated engineer for this improvement and is hereby directed to prepare final plans and specifications for the making of said improvement. - 2 - 10/27 3. The Mayor and Clerk are hereby authorized and directed to enter into an agreement with Ramsey County whereby the City and County will each pay a portion of the costs and all equipment installed shall remain the property of the County. Seconded by Councilman Greavu. Ayes - all. Mayor Murdock moved to suspend the Rules of Procedures to discuss Item K -1 at this time. Seconded by Councilman Greavu. Ayes - all. K. COUNCIL PRESENTATIONS 1. Johnson's Pond a. Councilman Greavu questioned Mr. Wayne Leonard, Ramsey County, regarding the ponding on Mr. Arnold Johnson's property, Lower Afton Road and McKnight Road. b. Mr. Leonard stated he would investigate the matter and report to the Manager. Mayor Murdock recessed the meeting to convene as the Board of Adjustments and Appeals at 7:47 P.M. Mayor Murdock reconvened the meeting at 8:09 P.M. E. PUBLIC HEARINGS (continued) 2. Street and Alley Vacation and Special Exception - Highway 36 and Atlantic Street 8:00 P.M. a. Mayor Murdock convened the meeting for a public hearing regarding the vacation of streets and alleys in Block 13, Clifton Addition (Highway 36 and Atlantic Street) and also regarding a special exception to construct a restaurant in M -1 zone. The Clerk read the notice of hearing along with the dates of publication. b. Manager Miller presented the staff report recommending tabling action on the vacation and special exception, until the City Engineering Department can evaluate and recommend an alignment for the proposed frontage road. Until an alignment is established, we cannot determine whether to vacate the existing right -of -way. Va- cation of the right -of -way is essential to the proposed plan, and therefore, the special exception. c. Commissioner Duane Prew presented the Planning Commission recommendation: "Commissioner Pellish moved the Planning Commission table action on the vacation for street and alley and the special exception for atleast 120 days until the City Engineering Department can evaluate and recommend an alignment for the proposed frontage road. Until an alignment is established we cannot determine whether to vacate the existing right -of -way. Vacation of the right -of -way is essential to the proposed plan, and therefore, the special exception. Commissioner Kishel seconded. Ayes all." d. Mr. Dan O'Leary, attorney representing J's Restaurant and owner of the property, requested continuance of this matter until December 8, 1977. e. Mayor Murdock called for proponents. None were heard. f. Mayor Murdock called for opponents. The following were heard: - 3 - 10/27 Mr. Fred Boldt, 1244 E. Cope Avenue. g. Mayor Murdock closed the public hearing. h. Mayor Murdock moved to table this item until the meeting of December 8, 1977 and instruct staff to obtain input from the Metropolitan Council and the State of Seconded by Councilman Greavu. Ayes - all. F. AWARDING OF BIDS 1. Street Improvement - McKnight Road, Radatz Avenue to Beam Avenue - County Project a. Manager Miller stated on February 17, 1977, a public hearing was held for the improvement of McKnight Road from Beam Avenue southward to T.H. 36. The project was approved and staff was authorized to enter into an agreement with Ramsey County relative to the cost of the construction of sidewalks and concrete curb and gutter as it affects Maplewood (West side of McKnight from Beam Avenue to Radatz Avenue). The attached letter indicates the costs to Maplewood and are in accordance with the agreement (and other previous agreements) with Ramsey County. These prices are in line with previous estimates. It is therefore, recommended that the bid of Shafer Contracting be accepted. Further, it is recommended that staff be authorized to prepare a check in favor of Ramsey County in the amount of $4,059.14, said amount representing 90% of the total cost of construction for the curb and gutter and concrete sidewalk. This too is in accordance with the aforementioned agreement between the City and the County. b. Mayor Murdock introduced the following resolution and moved its adoption: 77 - 10 - 212 WHEREAS, the bid of Shafer Contracting was the lowest responsible bid for the construction of sidewalks and concrete curb and gutter as it affects Maplewood (West side of McKnight from Beam Avenue to Radatz); and WHEREAS, said work was done in accordance with an agreement with Ramsey County; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that a check in the amount of $4,059.14 be issued to Ramsey County, said amount representing 90% of the total cost of construction for the curb and gutter and concrete sidewalk. Seconded by Councilman Anderson. Ayes - all. 2. Public Works Facility a. Manager Miller stated eight bids were received ranging from $982,000 to $1,030,000. It is recommended the bids be acknowledged and that staff be given more time to evaluate. - 4 - 10/27 b. Councilman Wiegert moved to receive the bids and allow further time for eval- uation of bids by Staff. Seconded by Councilman Anderson. Ayes - all. G. APPROVAL OF ACCOUNTS Mayor Murdock moved that the accounts (Part I - Fees Services, Expenses - Check No 024116 through Check No. 024327 - $151,442.92; Check No. 002327 through Check No. 002350 - $125,535.56: Part II Payroll - Check No. 15454 through Check No. 15580 - 941.647.67) in the amount of $318,626.15 be paid as submitted. Seconded by Councilman Wiegert. Ayes - all. H. UNFINISHED BUSINESS 1. Community Design Review - Duplexes - Ordinance Adoption a. Manager Miller stated this ordinance was placed on first reading on October 13. It eliminates duplexes from the Community Design Review process. Second reading and final adoption is recommended. b. Councilman Wiegert introduced the following ordinance and moved its adoption: ORDINANCE NO. 429 AN ORDINANCE AMENDING SECTION 202.150 OF THE MAPLEWOOD CODE THE COUNCIL OF THE CITY OF MAPLEWOOD DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Section 202.150, subd. 1, of the Maplewood Code is hereby amended to read as follows: 1. To review all building plans over $5,000 in valuation, except single and two family structures and their accessory structures. Sign applications shall be reviewed as stated in the City Ordinance, (Ordinance 427). Section 2. This Ordinance shall take effect and be in force from and after its passage and publication as provided by law. Seconded by Councilman Anderson. Ayes - all. 2. Zone Change - F to R -2 Between English Street, Northern Pacific Railroad Tracks and Skillman Avenue - Adoption a. Manager Miller stated the public hearing on this rezoning was held on October 20 and the rezoning placed on first reading. Second reading and final adoption is in order. b. Councilman Anderson introduced the following ordinance and moved its adoption: - 5 - 10/27 ORDINANCE NO. 430 AN ORDINANCE AMENDING THE MAPLEWOOD ZONING CODE THE CITY COUNCIL OF THE CITY OF MAPLEWOOD DOES HEREBY ORDAIN AS FOLLOWS: Section 1. That the following described property is hereby rezoned from F (Farm Residence District) to R -2 (Two Family Residence District): Unplatted Lands: The N 80 feet of the S 385 feet of the S 1/2 of the NW 1/4 of the NW 1/4, Section 15, Township 29, Range 22, lying west of the right of way of the Northern Pacific Railway, subject to the W 33 feet thereof, taken for English Street. Section 2. This Ordinance shall take effect upon its passage and publication. Seconded by Councilman Wiegert. Ayes - all. 3. Zoning Code Amendments - Allowance of Duplexes in R -1 (Single Family Residence) and F (Farm Residence) Districts - Adoption a. Manager Miller stated these ordinances allow two family structures meeting R -2 District standards by special use permit in R -2 and FR Districts after a public hearing with notification of property owners within 350 feet. Second reading and final adoption is in order. b. Councilman Greavu introduced the following ordinance and moved its adoption: ORDINANCE NO. 431 AN ORDINANCE AMENDING SECTION 903 OF THE MAPLEWOOD CODE CON- CERNING TWO- FAMILY USE THE COUNCIL OF THE CITY OF MAPLEWOOD DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Section 903.101 is hereby amended by adding thereto Subsection No. 8. 903.010. FARM RESIDENCE DISTRICT. In a farm residence district no building or land shall be used or divided and no building shall be erected, converted or struct- urely altered unless otherwise provided herein, except for one or more of the follow- ing uses: 8. Two - family uses in farm residence district, Section 903.010 and R -1, single family residence district, Section 904.010 including all structures and land elements that meet R -2, double dwelling district standards, may be permitted by a special use permit. All property owners within 350 feet shall be notified of the public hearing. It being the intent of this procedure to allow an occasional interspersing of double dwellings in R -1 and farm residence districts that are consistent with the comprehen- sive plan. Section 2. This Ordinance shall take effect and be in force from and after its passage and publication as provided by law. Seconded by Councilman Wiegert. Ayes - all. - 6 - 10/27 C. Councilman Greavu introduced the following Ordinance and moved its adoption: ORDINANCE NO. 432 AN ORDINANCE AMENDING SECTION 904 OF THE MAPLEWOOD CODE THE COUNCIL OF THE CITY OF MAPLEWOOD DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Section 904.010 is hereby amended to read as follows: 904.010. USE REGULATIONS. In the R -1, residence district, no building or land shall be used and no building shall be erected, converted or structurely altered unless otherwise provided herein except for one or more of the following uses: 8. Two - family uses including all structures and land elements that meet R -2 double dwelling district standards, may be permitted by a special use permit. All property owners within 350 feet shall be notified of the public hearing. It being the intent of this procedure to allow an occasional interspersing of the double dwellings in R -1 and farm residence districts that are consistent with the compre- hensive plan. Section 2. This Ordinance shall take effect and be in force from and after its passage and publication as provided by law. Seconded by Councilman Wiegert. Ayes - all. d. Councilman Greavu introduced the following ordinance and moved its adoption: ORDINANCE NO. 433 AN ORDINANCE AMENDING CHAPTER 911 OF THE MUNICIPAL CODE RELATING TO TWO- FAMILY USES THE COUNCIL OF THE CITY OF MAPLEWOOD DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Section 911.010 is hereby amended by adding thereto a Subsection No. 13. 911.101. SPECIAL USE. Special Use Permits pay the issuance for any of the following: 13. Two - Family uses in farm residence district, Section 903.010 and R -1, single family residence district, Section 904.010 including all structures and land elements that meet R -2, double dwelling district standards, may be permitted by a special use permit. Such use is not subject to review as provided in Section 911.050. All property owners within 350 feet shall be notified of the public hearing. It being the intent of this procedure to allow an occasional interspersing of double dwellings in R -1 and farm residence districts that are consistent with the comprehensive plan. Section 2. This Ordinance shall take effect and be in force from and after its passage and publication as provided by law. Seconded by Councilman Wiegert. Ayes - all. I. VISITOR PRESENTATIONS None. - 7 - 10/27 J. NEW BUSINESS 1. Building Plan Review - Temporary Bank Building - Maplewood State Bank a. Manager Miller presented the staff report recommending approval of the existing and proposed mobile homes for one year. b. Chairman Duane Prew presented the following Planning Commission recommendation: "Commissioner Ellefson moved the Planning Commission recommend to the City Council approval of the existing structure and proposed addition for a period of one year. Commissioner Fischer seconded. Ayes all." c. Director of Community Development Olson presented the following Community Design Review Board recommendation: "Chairman Simkins moved the Community Design Review Board recommend to the City Council the proposal for Maplewood State Bank, 1979 Beam Avenue, be found in con- formance with the Community Design Review Board Ordinance subject to the following conditions: 1. Exit requirements be reviewed by the Fire Marshal to determine if a second exit is necessary in the new addition; 2. Owner and applicant agree to the above conditions in writing. Board Member Haugan seconded. Ayes all." d. Mayor Murdock stated a letter had been received from the applicant agreeing to the conditions. e. Councilman Wiegert moved approval of the existing structure (Maplewood State Bank, 1979 Beam Avenue) and the addition for a period of one year subject to the recommendations of the Planning Commission and the Communitv Design Review Board Seconded by Councilman Anderson. 2. Lot Division a. Edgerton Street, South of County Road B Ayes - all. 1. Manager Miller presented the staff report recommending approval as the three proposed lots all meet the City's lot size and area minimums for build- able lots. 2. The applicant, Mr. John Schultz, spoke on behalf of his proposal. 3. Staff suggested soil tests of the land be taken. 4. Councilman Anderson moved to approve the division of Mr. Schiltz's pro as requested, into 3 lots (Lots A and B 85' x 295' and Lot C 90 ' x 295'). Seconded by Councilman Greavu. Ayes - all. b. Desoto Street 1. Manager Miller presented the staff report recommending approval subject to: - 8 - 10/27 1. Combination of Lot A with the abutting parcel to the west; 2. Owner and applicant agree to the above in writing. 2. Mr. Eugene Hillstrom, the applicant, spoke on behalf of his proposal. 3. Councilman Anderson moved to approve the lot divis Mr. Eugene Hillstrom, 1717 Desoto Street, to divide an lots subiect to the following conditions: 1. Combination of Lot A with the abutting parcel to the west; 2. Owner and applicant agree to the above in writing. Seconded by Councilman Wiegert. Ayes - all. Mayor Murdock recessed the meeting to reconvene as the Board of Appeals and Adjustments at 9:04 P.M. Mayor Murdock reconvened the meeting at 9:12 P.M. J. NEW BUSINESS (continuted) 3. Deleted 4. Paramedic Bill - Hardship a. Manager Miller stated staff received a request from Mrs. Monroe McNeal that her husband's paramedic charge of $35.00 be cancelled on the basis of financial hardship. b. Councilman Greavu moved to cancel th Monroe McNeal due to financial hardship. Seconded by Mayor Murdock. Bill charge of $35.00 of Ayes - all. 5. Lease - Highway 36 - Near English Street - Department of Transportation a. Manager Miller stated for a number of years, the City has leased the subject property located on the north side of Highway 36 between English Street and Barclay Street from the State of Minnesota. The City uses the site, a designated State Gravel Pit, as a storage area for various materials. Currently we have approximately 43,000 cubic yards of black dirt stored on the site. The only cost to the City for the use of the land in accordance with the terms of the lease (see attached copy) is the annual $25.00 charge for the insurance policy. Approval is recommended. b. Councilman Wiegert introduced the following resolution and moved its adoption: 77 - 10 - 213 WHEREAS, the City Council of Maplewood, Minnesota, has deemed it expedient and necessary that the lease arrangement with the State of Minnesota for the following described land: - 9 - 10/27 The west 365 feet of the southwest quarter of the southeast quarter of the northwest quarter of Section 10, Township 29 north, Range 22 west; be extended for the period from December 1, 1977 to November 30, 1978; NOW, THEREFORE, BE IT RESOLVED that the Mayor and Clerk are directed to execute the lease and forward to the State of Minnesota. Seconded by Councilman Anderson. Ayes - all. 6. Fire Station Site - Special Assessments a. Manager Miller stated the attached purchase agreement, approved by the Council on October 13, 1977, provides that the City pay $6,597 calculated as follows: $43,000 Purchase Price - 36,403 Unpaid Special Assessments $ 6,597 City Payment Thus the City has assumed the special assessments and has two alternative courses of action: 1) To make a cash transfer from the Revenue Sharing Fund ($50,000 was budgeted for the land purchase) to the Special Assessment Fund. Effect of this would be to decrease monies available for general City operating costs and to provide the Special Assessment Fund with revenue needed to finance the repayment of outstanding bonds. 2) To cancel these special assessments which would cause an increase in the amount of tax levies required to finance the repayment of outstanding bonds. The first alternative would require a $36,403 tax levy for operating expenses, but this tax levy would be eligible for the homestead credit (equals up to $325 calcu- lated as 45% of a homesteads tax bill for tax levies that are not for bonded debt). The second alternative would require a $36,403 tax levy for bonded debt and this levy would not be eligible for the homestead credit. Therefore, staff recommends the first alternative which will increase homestead credit revenue received from the State and cost less for homesteaded property. b. Councilman Wiegert moved to approve alternative No. 1 (to make a cash transfer of $36,403 from the Revenue Sharing Fund to the Special Assessment Fund) regarding the assessments on the property purchased for the Fire Station. Seconded by Mayor Murdock. Ayes - all. 7. P E R A - Resolution - Part -Time Police Service a. Manager Miller stated in connection with the anticipated retirement by Sergeant Robin A. DeRocker, he has been in contact with the personnel at the Public Employees Retirement Association. Representatives of P.E.R.A. have indicated that according to Chapter 353.64 of Minnesota Statutes, a resolution from the City Council is re- quired in order for Sergeant DeRocker to get retirement benefits credit for his part -time employment as a police officer prior to 1961. In addition, P.E.R.A. representatives advised that this resolution should designate all other officers currently employed who worked on a part -time basis prior to 1961 to enable these officers to get their retirement benefit credits. The necessary payroll deductions and employer contributions were made for these employees prior to 1961 so that there will be no additional costs. - 10 - 10/27 Staff has prepared the appropriate resolution and recommends Council's approval.. b. Councilman Greavu introduced the following resolution and moved its adoption: 77 - 10 - 214 WHEREAS, certain officers of the City of Maplewood Police Department performed duties in a part -time status prior to July 1, 1961; WHEREAS, their duties were performed as sworn police officer, they were protect- ing life and property as peace officers and they had the power to arrest by warrant and perform all the duties regularly attributed to the position of police officer; WHEREAS, in order to clarify these officer's status for police and fire retire- ment under the Public Employees Retirement Association fund, it is necessary for such to be stated by the City Council of Maplewood; NOW, THEREFORE, be it resolved that the City Council of the City of Maplewood, affirms that the following police officers were employed on the dates listed and have performed the duties since that date of police officers: R.W. Schaller 7 -7 -56 T.L. Hagen 6 -1 -57 R.A. DeRocker 8 -27 -57 D.V. Kortus 5 -26 -58 J.J. McNulty 9 -19 -59 J.A. Zappa 5 -1 -61 BE IT FURTHER RESOLVED, that the City Council affirms that Officer D.V. Kortus has remained in part -time status since July 1, 1961. Seconded by Mayor Murdock. Ayes - all. 8. Commissioners Award a. Manager Miller stated in January of 1976, the Court appointed Commissioners awarded $40,050.00 damages plus interest and certain plantings in the matter of condemnation of the Bruentrup lands as affected by the Northeast Area Improvement . Project. As the time for appeal is now past and further matters regarding the survey of the property have been resolved, it is recommended that staff be authorized to prepare a check in favor of Mr. Bruentrup in the amount of $46,581.66 and further to author- ize the installation of the shrubs and trees to the lowest responsible bidder. Quotations and an explanation of the costs were presented. Additionally, in the matters of Hajicek vs. Maplewood and Hause vs. Maplewood, it is recommended that staff be authorized to prepare the necessary checks as stated. These acquisitions are also ossociated with the NE Area Improvement project. In the matter of Zappa vs. Maplewood, it is also recommended that the necessary checks be prepared to settle the pending matter.
