CALL TO ORDER A regular meeting of the City Council of Maplewood, Minnesota, was held in the Council Chambers of the Municipal Building and was called to order at 7:30 P.M. by Mayor Murdock. B. APPROVAL OF MINUTES 1. Minutes No. 77 -24 (August 25, 1977) Councilman Greavu moved that the Minutes of Meeting No. 77 -24 (August 25 1977) be approved as corrected: Page 1, Item C -1 " Councilmenn Greavu and Wiegert voted 'Nay "'(Item E -1 -3: 7- 14 -77) Seconded by Councilman Wiegert. Ayes - all. D. APPROVAL OF AGENDA Councilman Wiegert moved to approve the Agenda as amended: 1. Contractors - Bonds and Licenses 2. Vandalism 3. Personnel 4. I94 Sound Barriers Seconded by Councilman Anderson. Ayes - all. E. PUBLIC HEARINGS 1. Special Use Permit - Public Works Building South of County Road B at Hazel Street 7:30 p.m. a. Mayor Murdock convened the meeting for a public hearing regarding the request of the City of Maplewood to obtain a special use permit to construct a Public Works Facility and access drives on property located approximately 300 feet south of County Road B and approximately 250 feet east of White Bear Avenue. The Clerk read the notice of hearing along with the dates of publication. b. Acting Manager Blank presented the staff report with the recommendation for approval with the following conditions: 1. Compliance with Community Design Review Board recommendations; 2. Approval of drainage plan by the Ramsey- Washington Metro Watershed District; - I - 9/22 3. Staff approval of erosion control measures to prevent downstream sediment damage; 4. Amendment of the Land Use section of the Comprehensive Plan to an Open Space designation of the proposed site; 5. Amendment of the Municipal Facilities section of the Comprehensive Plan to reflect the current proposal. c. Chairman Les Axdahl presented the following Planning Commission recommendation: "Commissioner Pellish moved the Planning Commission recommend to the City Council approval of the special use permit for the City Public Works Facility subject to the following conditions: 1. Compliance with Community Design Review Board recommendations; 2. Approval of drainage plan by the Ramsey- Washington Metro Watershed District; 3. Staff approval of erosion control measures to prevent downstream sediment damage; 4. Amendment of the Land Use Section of the Comprehensive Plan to an Open Space designation of the proposed site; 5. Amendment of the Municipal Facilities section of the Comprehensive Plan to reflect the current proposal. Commissioner Kishel seconded. Ayes all." d. Mr. Iver Wicklander, County Road B, asked questions concerning the garage facility. e. Mayor Murdock called for proponents. None were heard. f. Mayor Murdock called for opponents. None were heard. g. Mayor Murdock closed the public hearing. h. Councilman Anderson moved to approve the Special Use Permit to construct a Public Works facility and holding pond south of County Road B and East of White Bear Avenue subject to the following conditions: 1. Compliance with Community Design Review Board recommendations; 2. Approval of drainage plan by the Ramsey- Washington Metro Watershed District; 3. Staff approval of erosion control measures to prevent downstream sediment damage; 4. Amendment of the Land Use Section of the Comprehensive Plan to an Open Space designation of the proposed site; 5. Amendment of the Municipal Facilities section of the Comprehensive Plan to reflect the current proposal. 6. Further study be made regarding another egress and ingress other than Hazel Street. Seconded by Councilman Wiegert. Ayes - all. Mayor Murdock recessed the meeting at 7:52 P.M. to convene as the Maplewood Board of Adjustments and Appeals. Mayor Murdock reconvened the meeting at 8:06 P.M. Councilman Greavu moved to suspend the Rules of Procedures to discuss the next item. Seconded by Councilman Wiegert. Ayes - all. - 2 - 9/22 J. PUBLIC HEARING (continued) 2. Street Vacations - Kennard Street between Brooks and Demont Streets and Brooks Street (115 feet) between Kennard and Germain Streets - 7 :45 P.M. a. Mayor Murdock convened the meeting for a public hearing regarding the request of Mr. Roger K. Gehrt for vacation of streets within his Ridgewind Addition Plat. The Clerk read the notice of hearing along with the dates of publication. b. Acting Manager Blank presented the staff report recommending approval based on the finding that it is in the public interest to so vacate. The rights -of -way to be vacated serve no public purpose with the platting of Ridgewind and may there- fore be vacated. c. Mr. Roger Gehrt, the applicant, spoke on behalf of his proposal. d. Mayor Murdock called for proponents. None were heard. e. Mayor Murdock called for opponents. None were heard. f. Mayor Murdock closed the public hearing. g. Councilman Wiegert introduced the following resolution and moved its adoption: 77 -9 -189 WHEREAS, the owners of more than 50% of the property abutting the south 164.03 feet of Kennard Street, between East Brooks Avenue and Demont Street and the east 115 feet of East Brooks Avenue between Kennard Street and Germain Street have filed a request for the vacation of the said streets; and WHEREAS, the hearing on said petition was preceeded by two weeks published and posted notice; and WHEREAS, no one has appeared in opposition to said petition; and WHEREAS, it appears for the best interest of the public that said street be vacated; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that Kennard Street between Brooks Avenue and Demont Street effecting Lots 7 and 8, Oswald Park, Subj to Avenue, the W 165 ft of N 400 ft of Lot 4; E. G. Rogers Garden Lots and the east 115 feet of Brooks Avenue between Kennard Street and Germain Street effecting Lot 8, Oswald Park and the east 145 feet of North 1/2 of Lot 6, E. G. Rogers Garden Lots, be and the same are hereby vacated. Seconded by Councilman Anderson. Ayes - all. - 3 - 9/22 3. Kennel License - 819 Mayer Street - 8:00 P.M. a. Mayor Murdock convened the meeting for a public hearing regarding the request of Mr. Michael J. Riley, 819 Meyer Street for a small Kennel License to provide housing to keep four dogs (one of which is old and will be put to sleep). The Clerk read the notice of hearing along with the dates of publication. b. Acting Manager Blank presented the staff report and presented a petition signed by the neighbors agreeing to the kennel license. c. Mr. Michael Riley, 819 Meyer Street, the applicant, spoke on behalf of the proposal. d. Mayor Murdock called for proponents. None were heard. e. Mayor Murdock called for opponents. Nays - Councilman Anderson. 4. Kennel License - 2360 E. County Road D - 8:00 P.M. a. Mayor Murdock convened the meeting for a public hearing regarding the request of Mr. Larry Mehsikomer to operate a commercial kennel license at 2360 E. County Road D. The Clerk read the notice of hearing along with the dates of publication. b. Acting Manager Bland stated the applicant wishes to operate a commercial kennel. He will be involved in grooming, boarding and breeding of dogs. The property is owned by Clayton Huckenpoehler, who previously operated a kennel. In 1968, a special use permit was granted to Jane and Clayton Huckenpoehler to operate a commercial kennel. After many complaints were received in 1973 regarding the operations of the kennel, Mr. Huckenpoehler was invited to attend a Council meeting. On January 17, 1974, the Commercial Kennel Special Use Permit was declared null and void and a small kennel license was granted. The area residents have signed a petition in opposition of the kennel. C. Mr. Larry Mehsikomer, 2205 E. County Road D, the applicant, spoke on behalf of the proposal. d. Mayor Murdock called for proponents. The following were heard: Mr—Clayton Huckenpoehler, 2360 E. Mayor Murdock closed the public hearing. - 4 - 9/22 g. Councilman Anderson moved to deny the request of Mr. Larry Mehsikomer to operate a commercial kennel at 2360 E. County Road D. based on the fact the property is Seconded by Councilman Wiegert. Ayes - all. 5. Subdivision - Preliminary Plat - Roselawn Avenue between Payne Avenue and Edgerton Street - 8:15 P.M. a. Mayor Murdock convened the meeting for a public hearing regarding the request of Mr. Donald Kortus, 1930 Edgerton Street, for approval of a preliminary plat for six lots. The Clerk read the notice of hearing along with the dates of publication. b. Acting Manager Blank presented the staff report recommending approval with the following conditions: 1. Submission of a soil test on Lots 1 -3; 2. Installation of sidewalks on Roselawn Avenue and Edgerton Street. These are planned major collector and minor arterial streets leading to a school. Safe pedestrian access should be provided; 3. Submission of a bond, letter of credit, or cash escrow of 150% of the es- timated cost of the sidewalks, to insure installation; 4. Installation of a driveway turnaround on Lot 5. This is important because of visibility problems caused by the steep hill on Edgerton, and because of the high volume of traffic anticipated; 5. Erosion controls to be implemented during construction, as suggested by the Soil Conservation Service. This is important to protect the water quality of the pond in Forest Lawm Cemetery. C. Councilman Anderson moved to approve the preliminary plat of his property on the North side of Roselawn Avenue between Payne. Street, subject to the - Planning - Commission recommendation: 1. Submission of a soil test on Lots 1 - 3; 2. Installation of a driveway turnaround on Lot 5. This is important because of visibility problems caused by the steep hill on Edgerton, and because of the high volume of traffic anticipated; 3. Seconded by Mayor Murdock. Ayes - all. F. AWARDING OF BIDS None. G. APPROVAL OF ACCOUNTS 1. Acting Manager Blank stated payment No. 5 for the Public Works Facility architect (Setter, Leach and Lindstrom) is included in the Accounts Payable. Payment No. 4 was not included due to an administrative oversight. It is recommended that the Payment No. 4 be added to the Accounts Payable. It is the amount of $8,087.27. 2. Councilman Anderson moved to approve Payment #4 to Setter, Leach and Lindstrom, architect for the Public Works Facility. Seconded by Councilman Wiegert. 3. Councilman Anderson moved that the Check No. 2283 through Check No. 2291 - amount Seconded by Councilman Wiegert. H. UNFINISHED BUSINESS Ayes - all. I - Fees, Services eck No. 023800 thr Ayes - all. 1. Subdivision - Preliminary Plats - Time Extensions a. Maplewood Heights No. 9 1. Acting Manager Blank presented the staff report recommending approval for 90 days, provided that the water looping plan as proposed is acceptable to the City Engineering Department. The proposed plat is identical to that previously approved by the Council and will not result in assessments to surrounding proper- ty owners, 2. Councilman Greavu moved to approve the request of Robert Tilsen for a 90 day time extension for completion of Maplewood Heights No 9 subject to staff - 6 - 9/22 recommendation and original conditions. Seconded by Councilman Kent. Ayes - all. b. Car Don Estates 1. Acting Manager Blank presented the staff report recommending approval of a 90 day time extension. 2. Councilman Greavu moved to approve a final plat for Car Don Estates subject to r time extension to complete the Seconded by Councilman Wiegert. Ayes - all. I. VISITOR PRESENTATIONS None. J. NEW BUSINESS 1. Street Improvements - Petitions: a. Highwood Avenue and Sterling Street c 1. Acting Manager Blank stated staff has received a petition with the signatures of 47% of the affected front footage for public improvements on Sterling Street and Highwood Avenue, east of the Pleasantview Park Addition. It is recommended that a feasibility study be ordered, 2. Councilman Wiegert introduced the following resolution and moved its adoption: 77 - 9 - 190 WHEREAS, a certain petition has been received by the City Council for the improvement of Sterling Street and Highwood Avenue, adjacent to the NW 1/4 of the SE 1/4 of Section 13, Township 29N, Range 22W by construction of streets, storm sewers, sanitary sewers, watermains and all necessary appurtenances; and WHEREAS, the said petition has been declared to be signed by the required percentage of owners of property affected thereby; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the petition as hereinbefore described is hereby referred to the City Engineer, and he is instructed to report to the Council with all convenient speed advising the Council in a preliminary way as to whether the proposed im- provement is feasible and should best be made as proposed, and the estimated cost of the improvement as recommended. Seconded by Councilman Anderson. Ayes - all. b. Carey Heights Drive 1. Acting Manager Blank stated staff has received a petition containing the signatures of 61% of the front footage for the improvement at Carey Heights Drive, west of Highway 61 and south of County Road "D ". It is recommended that a feasibility study be ordered. - 7 - 9/22 2. Councilman Greavu introduced the following resolution and moved its adoption: 77 - 9 - 191 WHEREAS, a certain petition has been filed by the City Council for the improvement of Carey Heights Drive, west of Highway 61, commencing at County Road "D" to the south approximately 1500 feet by construction of street, water mains, sanitary sewer, storm sewer and all necessary appur- tenances; and WHEREAS, the said petition has been declared to be signed by the required percentage of owners of property affected thereby, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the petition as hereinbefore described is hereby referred to the City Engineer, and he is instructed to report to the Council with all convenient speed advising the Council in a preliminary way as to whether the proposed improvement is feasible and should best be made as proposed, and the estimated cost of the improvement as recommended. Seconded by Councilman Wiegert. 3. Park Improvement - Maplewood Heights Ayes - all. a. Acting Manager Blank stated at their last regular meeting, the Parks and Recreation Commission moved to recommend to the City Council the expenditure of $6,000 for construction of an 8 foot wide asphalt walking and biking path within Maplewood Heights Park. The pathway is a part of the master plan for this park. The funds to be expended are budgeted in the Neighborhood Account ($4,000) and this years General Fund for park improvements ($2,000). Staff also recommends expending $6,000 for an asphalt trail at Maplewood Heights Park. This project would be the City's first attempt at promoting biking as a recreational activity. b. Councilman Greavu introduced the following resolution and moved its adoption: 77 - 9 - 192 WHEREAS, pursuant to Resolution 61 -9 -169 and 75 -7 -124 of the City Council of Maplewood, Minnesota adopted September 7, 1961 and July 31, 1975, the special assessments for the construction of Sanitary Sewer No. 3 (1961) and Diseased Tree Program 74 -6 (1975) were levied against the attached list of described properties; said list made a part herein; and WHEREAS, the above mentioned properties have been conveyed and are des- - 8 - 9 -22 cribed according to the attached list, said list made a part herein; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the assessments for Sanitary Sewer No.. 3 (1961) and Diseased Tree Program 74- 6(1975) against the heretofore mentioned properties be correctly certified to the Auditor of Ramsey County in the amounts stated on the attached list; said list made a part herein. Councilman Wiegert moved to refer this matter back to staff for further investigation. Seconded by Councilman Anderson. K. Council Presentations Ayes - all. Mayor Murdock moved to suspend the Rules of Procedures to discuss Item K - 4 at this time. Seconded by Councilman Anderson. 4. I - 94 Sound Barrier Ayes - all. a. Mr. Gary Orlich, Minnesota Transportation Department, spoke explaining the Transportation Department position and policies regarding sound barriers. b. The following persons voiced their opinions: Myra Hirsch read a statement from Christ Methodist Church asking that the sound barrier be shorten and not be constructed in front of the Church. Rod Winchell, 188 O'Day Street requested the barrier remain as proposed originally and before any change be made a public hearing be held. Charles Bergh, a resident, is in favor of the barrier but not in front of the Church. A resident of St. Paul and a member of the Church does not want the barrier constructed in front of the Church. Will Hirsch, member of the Church, does not want the barrier constructed in front of the Church. C. No action taken. 1. Contractors - Bonds - Licenses a. Mayor Murdock questioned the licensing and bonding requirements of contractors. b. Staff answered his questions. 2. Vandalism a. Councilman Wiegert read a report regarding vandalism costs in Maplewood and surrounding communities. He stated that perhaps M.A.A. could help in some way to reduce vandalism in the parks. b. The suggustion will be presented to M.A.A. at the time of the budget hearing. - 10 - 9/22 3. Personnel a. Councilman Anderson asked if when employees leave City employment if they were allowed to take property - City owned- with them. b.
