PUBLIC HEARINGS Ayes - all. 1. Liquor License - On Sale - 1696 White Bear Avenue - Jim Bo's Maple Leaf Lounge 7:30 P.M. a. Mayor Murdock convened the meeting for a public hearing regarding a request for an On Sale Liquor License at 1696 White Bear Avenue. The Clerk read the notice of hearing along with the dates of publication. b. Manager Miller stated the present owners of Jimbo's propose to sell that oper- ation to Patrick J. Scovill (Oakdale), Charles W. Wlidenauer (St. Paul) and Paul J. Maki (White Bear Lake. Some uncertainty about the completion of the sale re- sulted in a delay in the police background investigations. It is recommended that the license be issued subject to completion of the police background investigations to the satisfaction of the Director of Public Safety. c. The applicants were not in attendance. d. Mayor Murdock called for proponents. None were heard. e. Mayor Murdock called for opponents. The following were heard. f. Mayor Murdock closed the public hearing. g. Councilman Anderson moved to continue this matter to September 8, 1977 at 7:30 P.M. Seconded by Councilman Wiegert. Ayes - all. F. AWARDING OF BIDS 1. Equipment Rental a. Manager Miller stated the City annually seeks bids on rates which contractors will provide equipment for the City as required by the City. Due to the fact that some of the equipment might not be available when we need it, the City starts with the low bidder and utilizes the first equipment available at the lowest cost at the time the equipment is needed. We therefore recommend the awarding of the contract to all of the bidders. This is the normal procedure which is carried out annually. b. Councilman Wiegert introduced the following resolution and moved its adoption: 77 - 8 - 155 BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the bid of Shafer Contracting, Inc., Shifsky and Sons, and Brisson Pump be accepted for that period through June 30, 1978, and the Mayor and Clerk are hereby authorized and directed to enter into a contract with said bidders for and on behalf of the City. Seconded by Councilman Anderson. Ayes - all. - 2 - 8/25 2. Aggregates, Bituminous Materials, Salt and Fertilizer a. Manager Miller stated it is recommended that the bids for the materials, except salt, be awarded as shown in the shaded areas on the enclosed tabulations. It is also recommended that the bid of Cargill be rejected and that the staff be author- ized to readvertise for rock salt. b. Councilman Anderson introduced the fallowing resolution and moved its adoption: 77 -8 -156 BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the bids of T. A. Schifsky & Sons, Alexander Construction, Barton Contracting Company, J.L. Shiely Company, Byran Rock Company and VanWaters and Rogers be accepted for those items shown as shaded on the attached bid tabulation through June 30, 1978, and the Mayor and Clerk are hereby authorized and directed to enter into a contract with said bidders for and on behalf of the City. BE IT ALSO RESOLVED that the bid of Cargill, Inc., be rejected and staff be authorized to readvertise for rock salt. Seconded by Councilman Wiegert. Ayes - all. 3. Gasoline a. Manager Miller stated only one bid was received for gasoline and diesel fuel and I am advised that the bid does not meet the conditions of the specifications. It is therefore recommended that the bid be rejected and that the staff be author- ized to purchase gasoline and diesel fuel at the market price at the time of need. Staff feels that we can get a more favorable pricing with that method. b. Mayor Murdock introduced the following resolution and moved its adoption: 77 -8 -157 BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the bid of Standard Oil Company be rejected as not meeting specifications and that the staff be directed to purchase gasoline and diesel oil on the open market, at the lowest price obtainable at the time of purchase. Seconded by Councilman Kent. Ayes - all. 4. Trail Bike a. Manager Miller presented the staff report and stated it is recommended that the bid be awarded to Tousley Ford as the lowest responsible bidder. b. Councilman Anderson introduced the following resolution and moved its adoption: 77 -8 -158 BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the bid of Tousley Ford in the amount of $1,169.00 is the lowest responsible bid for the pur- chase of a 1976 - 500 cc Yamaha motorcycle and the Mayor and Clerk are hereby authorized and directed to enter into a contract with said bidder for and on behalf of the City. - 3 - 8/25 Seconded by Councilman Wiegert. Manager Miller presented the staff report and stated the applicant has agreed, in writing, to the conditions given by the Community Design Review Board. b. Board Member Sjolander presented the following Community Design Review Board recommendation: "Board Member Haugan moved the Board recommend to the City Council the addition proposed at 1675 E. County Road C be found in conformance with the Community Design Review Board Ordinance subject to the following conditions: 1. The five foot side yard setback to be adhered to; 2. Approve the site plan which indicates a door on the easterly elevation; 3. Owner and applicant agree to the above conditions in writing. Board Member Hoot seconded. c. Ayes all." )lans for the garage addition ect to the Ayes - all. 2. Building Plan Review and Bid Authorization - Maplewood Public Works Building a. Manager Miller presented the staff report and stated it is recommended that the proposed Public Works Facility be found to be in conformance with the Community Design Review Board Ordinance subject to the comments of the Board and the following conditions: 1. All parking stalls, other than handicapped, shall be 10 by 20 feet in size; 2. A revised landscaping plan shall be submitted for staff review and approval, providing for additional landscaping in the open grass areas and along the northerly elevation of the building; 3. Security lights shall not cause undue glare to adjacent properties; 4. The proposed chain link fence shall have added sight obscuring qualities so to - 4 - 8/25 screen the subject site from adjacent properties to the east, north and south. The fence shall be no less than 80% opaque. 5. Owner and applicant agree to the above conditions in writing. b. Board Member Sjolander presented the following Community Design Review Board recommendation: "Board Member Huot moved the Board recommend to the City louncil the proposed City of Maplewood Public Works Facility be found to be in conformance with the Community Design Review Board Ordinance subject to the following conditions: 1. All parking stalls, other than handicapped, shall be 10 by 20 feet in size; 2. A revised landscaping plan shall be submitted for staff review and approval, providing for additional landscaping in the open grass areas and along the elevations of the building; 3. Security lights shall not cause undue glare to adjacent properties; 4. The chain link fence shall be reviewed by staff in respect to elevations and adequate view from adjacent properties; 5. Gas and diesel pump station locations be improved to provide safer public access to County Road B via VanDyke alignment; 6. Trash storage to be adequately screened from view; 7. All zoning and platting regulations shall be complied with (i.e. fence height variance, special use permit, lot division, etc.); 8. Owner and applicant agree to the above conditions in writing. Chairman Schulte seconded. Ayes - all." C. Mr. Jack Borman, representing Setter, Leach and Lindstrom, presented the specifics of the plans. d. Councilman Wiegert moved approval of the building plans for the Public Works Facility subject to the following conditions: 1. All parking stalls, other than handicapped, shall be 10 by 20 feet in size; 2. A revised landscaping plan shall be submitted for staff review and approval, providing for additional landscaping in the open grass areas and along the elevations of the building; 3. Security lights shall not cause undue glare to adjacent properties; 4. The chain link fence shall be reviewed by staff in respect to elevations and adequate view from adjacent properties; 5. Gas and diesel pump station locations be improved to provide safer public access to County Road B via VanDyke alignment; 6. Trash storage to be adequately screened from view; 7. All zoning and platting regulations shall be complied with (i.e. fence height variance, special use permit, lot division, etc.); 8. Owner and applicant agree to the above conditions in writing. Seconded by Councilman Anderson. Ayes - all. e. Councilman Wiegert moved to authorize staff to proceed with advertisement of bids for the Public Works Facility. Seconded by Councilman Anderson. Ayes - all. - 5 - 8/25 3. Chemical Distribution Facility - White Bear Lake a. Manager Miller presented the staff report.. b. Mr. Don Watson, Director of Keller - Kohlman - Gervais Lakes Association, spoke on the associations concerns regarding the chemical facility and how it could affect the lakes in the City. c. Mr. C. Drake, Director of Keller - Kohlman - Gervais Lakes Association also spoke regarding his concerns. d. Mr. Don Christensen, 1111 E. County Road C, expressed his concern. e. Mr. Bill Howard, 931 E. County Road C, also expressed his concern. f. Councilman Anderson introduced the following resolution and moved its adoption: 77 -8 -160 WHEREAS, the Maplewood City Council has been apprised of the fact that an applicant is presently before the White Bear Lake City Council to locate and con- struct a chemical storage, mixing and distribution center along a water course that leads into and through the City of Maplewood, its lakes and environs; and WHEREAS, the location of such a facility presents the potential for significant environmental implications: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that it convey its concerns to the City of White Bear Lake that the proposed chemical facility be perused to determine whether there is a potential for sig- nificant environmental effects arising out of the construction, installation and maintenance of such chemical distribution facility. Seconded by Councilman Wiegert. Ayes - all. 4. Minnesota Housing Finance Agency Home Improvement Grant Program a. Manager Miller stated Maplewood presently makes these home improvement grants available to its citizens through our BRA and through the Metropolitan Housing and Redevelopment Authority. The attached resolution will allow the continuance of that program and passage is therefore recommended. b. Commission Member Lorraine Fisher presented the Housing and Redevelopment Author- ity report. c. Councilman Wiegert introduced the following resolution and moved its adoption: 77 - 8 - 161 WHEREAS, the Minnesota Housing Finance Agency, State of Minnesota, has been authorized to undertake a program to provide grants of funds to property owners for the purpose of housing rehabilitation; WHEREAS, the City of Maplewood desires to assist low income homeowners in making repairs to their homes for the purpose of correcting defects directly affecting the safety, habitability, and /or energy usage of the property; - 6 - 8/25 WHEREAS, the Minnesota Housing Finance Agency, State of Minnesota, will accept applications from housing and redevelopment authorities desiring to administer these home improvement grant program funds; WHEREAS, the Metropolitan Council has all the powers and duties of a housing and redevelopment authority pursuant to Minnesota Statutes, 1976, Section 473.193 to 473.201 under the provisions of the Minnesota Housing Redevelopment Act, Minn- esota Statutes, 1976, Sections 462.411 to 462.711; and WHEREAS, the City of Maplewood desires to participate in the Minnesota Housing Finance Agency Home Improvement Grant Program through the Metropolitan Council Housing and Redevelopment Authority; NOW, THEREFORE, BE IT RESOLVED: That the Metropolitan Council is hereby request- ed to include the City of Maplewood in an application for state Home Improvement Grant Program funds and that upon approval of such application, the City and the Metropolitan Council are authorized to enter into an agreement for operating the program within the City. Seconded by Councilman Greavu. Ayes - all. 5. Metro Waste Control Commission - Strength Charge a. Manager Miller presented the staff report. b. Mayor Murdock introduced the following resolution and moved its adoption: 77 -8 -162 WHEREAS, the Maplewood Code relating to sewer service charges provides that additional sewer charges may be imposed by the City Council for sewage waste un- usual in character; and WHEREAS, the Metropolitan Waste Control Commission has determined to impose an industrial user sewer strength charge in order to receive and retain grants in compliance with the Federal Water Pollution Control Act; and WHEREAS, the City of Maplewood will be billed sewer strength charges for in- dustrial users within the City. NOW, THEREFORE, BE IT RESOLVED, that the staff is hereby authorized and directed to bill industrial users sewer strength charges as determined by the Metropolitan Waste Control Commission and the terms of payment shall be the same that the M.W.C.C. provides when these charges are billed to the City. Seconded by Councilman Wiegert. Ayes - all. 6. Donations - Acceptance a. Manager Miller stated the Department of Community Services recently received a $300 donation from the North Maplewood Lions Club for Maplewood's Trainable Men- tally Retarded Day Camp Program. The donation will be used to purchase program supplies and equipment for special events. The Department of Public Safety received a donation of $20 from Mrs. Robert Gill for the police canine program. - 7 - 8/25 It is recommended that the Council accept these donations with thanks. b. Councilman Wiegert moved to accept the donation of $300 from the North Lions Club for purchase of program supplies and eeuinment for snecia7 even to Seconded by Mayor Murdock. C. Paramedic Bill - Hardship and a letter a. Manager Miller presented a request from Mrs. Maynard G. Mitthun, 6875 Stillwater Blvd. to have their paramedic charge of $35 dropped due to hardship. Staff recom- mends that the Council cancel this paramedic charge because the hardship case pre- sented appears to justify this action. b. Councilman Wiegert moved to to Seconded by Councilman Greavu. Ayes - all. 8. Street Improvement - Supplemental Agreement - Conway Avenue of Mrs. Mavnard G a. Manager Miller presented a supplemental agreement amending the project to make needed sanitary sewer and bituminous surfacing changes along with allowing for the redesign of the lighting system and a reasonable deduction for curb and gutter which did not meet the letter of the specifications. In evaluating this supplemental agreement, please take into consideration the fact that the lighting system is a unit price item and our redesign deleted sufficient work to reduce the total price by some $18,000.00 which will not appear until the final estimate for the project. This modification, including the deletions, will increase the light level on the pavement significantly beyond that which was orig- inally designed, has caused the light system to give a more uniform level than or- iginally designed, and has reduced the energy required by liz kw /hour. I would recommend that this supplemental agreement be approved. b. Councilman Greavu introduced the following resolution and moved its adoption: 77 -8 -163 WHEREAS: A. The City Council of the City of Maplewood has heretofore ordered made Im- provement Project No. 73 -9 and has let a construction contract therefor pursuant to Minnesota Statutes Chapter 429. B. Said construction contract was awarded on a unit price basis for a total contract price of $197,344.21; - 8 - 8/25 C. It is necessary and expedient that said contract be modified so as to include additional units of work at the same unit price at a cost of $7,540.92, which additional amount does not exceed 25% of the original contract price. D. Said additional units of work have heretofore been ordered made pursuant to subdivision 1 of M.S.A. Section 429.031. E. A Supplemental Agreement, attached hereto and incorporated herein by re- ference, has been presented to the Council for the purpose of effecting such mod- ification. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COU14CIL OF THE CITY OF MAPLEWOOD, MINNESOTA, that the Mayor and City Clerk are hereby authorized and directed to modify the existing contract with respect to Project No. 73 -9 by executing said Supplemental Agreement. Seconded by Councilman Wiegert. Ayes - all. 9. Suburban Ramsey County Emergency Communications Board - Joint Powers Agreement a. Manager Miller stated the St. Paul- Ramsey County Criminal Justice Coordinating Council has proposed the attached joint powers agreement which would establish the Suburban Ramsey eounty Emergency Communication Board for the general purpose of providing "for an organization through which the parties may jointly and cooper- atively participate in the development, implementation, operation, and maintenance of an intergrated public safety emergency communication system for the Ramsey County suburban area ". It will be a benefit to Maplewood to belong to this Board in order that we may have imput on any decisions relative to emergency communications in the suburban area. North St. Paul, Roseville and White Bear Lake have all adopted the agreement. The agreement commits Maplewood to nothing except membership on the board. It is therefore recommended that the Council adopt the attached joint powers agreement. b. Mayor Murdock introduced the following resolution and moved its adoption: 77 -8 -159 WHEREAS, the City of Maplewood wishes to participate with other local govern- mental jurisdictions in improving emergency response and communications capabilities of law enforcement, fire service and emergency medical services for all Maplewood residents; and WHEREAS, a joint and cooperative planning effort of all interested local govern- ments in suburban Ramsey County has produced a joint powers agreement that offers great potential for improving all aspects of citizen emergency notification and public safety agency response through the effective use of radio and telephone com- munications; BE IT RESOLVED, that Mayor Burton A. Murdock be authorized to sign the Joint Powers Agreement establishing the Suburban Ramsey County Emergency Communications Board on behalf of City of Maplewood. Seconded by Councilman Wiegert. Ayes - all. 10. Rules of Procedures - Council Work Sessions - 9 - 8/25 a. Manager Miller stated with the ever- increasing need for Council meeting time, the staff feels that it would be beneficial if the staff and the Council met at regular work sessions two times per month on the Mondays before regular Council meetings. It is felt that these meetings should be concise and should only last from 5:00 P.M. to 6:00 P.M. This would allow the Council to ask questions directly of staff and for staff to make technical presentations and thus save time from regualr Council meetings. These meetings would come of course, remain open to the public as required by the open meeting law. It is recommended that the Rules of Procedure be amended to read "The City Council shall also hold regular work session meetings on the Mondays prior to regular meet- ings. Such work sessions shall be informal, in the Council Chambers and shall begin at 5:00 P.M. and last no later than 6:00 P.M. When Monday is a holiday, the work session will be held the next day ". This section should be added under Section 1, Meetings, Regular. It is recommended that this amendment be adopted. b. Councilman Greavu moved that cedure be amended to add: "The meetings on the Mondays prior to P.M. When Seconded by Councilman Wiegert. City Council shall also h regular meetings. Such and shall begin at 5:00 P day the work session shal 11. Paramedic Vehicle - Budget Transfer Ayes - all. of the regular work session sessions shall be i and last no later th next day. a. Manager Miller presented the staff report and stated staff recommends that the insurance company's offer of $8,820.42 be accepted and that a budget transfer be approved to finance the uninsured expenses by surpluses presently available in the Police Aid Fund. b. Councilman Wiegert moved that the Insurance Committee be requested for "input" regarding this matter. Seconded by Mayor Murdock. Ayes - all. c. Councilman Wiegert moved to accept the insurance company's offer of $8,820 and that a budget transfer be approved to finance the uninsured expenses by so Seconded by Councilman Anderson. They were advised the hearing had been continued to September 8, 1977. K. COUNCIL PRESENTATIONS 1. National Guard Bumper Stickers a. Mayor Murdock stated he had a request from the National Guard to place bumper stickers on City vehicles. b. Mayor Murdock on Citv vehicles Seconded by Councilman Anderson. Motion carried. 2. Elm Trees the stickers Ayes - Mayor Murdock, Councilmen Anderson, Greavu and Wiegert. Nays - Councilman Kent. a. Mayor Murdock commented on problems McDonald's Restaurant on Cope Avenue had regarding Dutch Elm Diseased Trees. b. Staff will investigate. 3. Annexation a. Mayor Murdock commented on an article newspaper relating to a discussion on St. wood. b. Discussion held, but no action taken. 4. County Ditch 17 that appeared in the St. Paul Dispatch Paul annexing the southern "leg" of Maple- a. Councilman Anderson questioned several '.toms regarding the construction of curbing catch basins and a concern regarding the ponding area. b. Staff will investigate. 5. Assessments - Water Improvement 75 -16 a. Councilman Anderson questioned if the Council previously hadn't adopted some - 11 - 8/25 formulas for assessing the water main on Flandrau, Frost and English. b. Several discussions had been held but nothing formally adopted and the assess- ments can not be adopted until at the assessment hearing. 6. Vehicle Pool a. Councilman Anderson stated he has received quite a few comments on City Public Works vehicles just standing. "Is there a vehicle pool and how does it work "? b. Staff answered Councilman Anderson's questions and informed him all three main- tenance departments use the same equipment. L. ADMINISTRATIVE PRESENTATIONS 1. Assessments a. Manager Miller stated that due to the last hearing on assessments not meeting the necessary requirements, it is recommended all the hearings be reheard on Sept- ember 15, 1977. Also, he presented the figures for the Furness Court Improvement No. 75 -8 as requested by Council. The assessments have been figured on an equal assessment per lot. b. Councilman Anderson introduced the following resolution and moved its adoption: (ordering assessment roll) 77 -8 -166 WHEREAS, the City Clerk and City Engineer have presented the final figures for the improvement of Furness Court Northward from Lydia Avenue; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, as follows: that the City Clerk and City Engineer shall forthwith calculate the proper amount to be specially assessed for such improvement against every assess- able lot, piece or parcel of land abutting on the streets affected, without regard to cash valuation, as provided by law, and they shall file a copy of such proposed assessment in the City Office for inspection. FURTHER, the Clerk shall, upon completion of such proposed assessment notify the Council thereof. Seconded by Councilman Greavu. Ayes - Councilmen Anderson, Greavu, Kent and Wiegert. Improvement No. 75 -8 Furness Court Councilman Greavu introduced the following resolution and moved its adoption: (ordering public hearing) 77 -8 -167 WHEREAS, the Clerk and the Engineer have, at the direction of the Council, pre- pared an assessment roll for the construction of streets, utilities and appurtenances on Furness Court from Lydia Avenue Northward, and the said assessment roll is on file in the Office of the City Clerk; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA: - 12 - 8/25 1. A hearing shall be held on the 15th day of September, 1977, at the City Hall at 8:00 P.M. to pass upon such proposed assessment and at such time and place all persons owning property affected by such improvement will be given an opportunity to be heard with reference to such assessment. 2. Mayor Murdock introduced the following resolution and moved its adoption: 77 -8 -173 BE IT RESOLVED by the City Council of the City of Maplewood, Ramsey County, Minnesota, as follows: WHEREAS, Maplewood Storm Sewer Project No. 74 -18, County Ditch 17 necessitates the construction of an earthen dike and installation of a reinforced concrete pipe through a certain right -of -way owned by the Soo Line Railroad Company; and WHEREAS, said Soo Line Railroad Company offers to grant its permit for said construction and installation in consideration of the mutual promises as set forth in that Pipe Line Crossing Permit No. 21721, a copy of which is attached; and WHEREAS, the City deems it reasonable, necessary and authorized by law to enter into said Permit Agreement. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Maplewood, authorizes its Mayor and Clerk of execute, attest and deliver the hereinbefore de- scribed Pipe Line Crossing Permit No. 21721.
