A. CALL TO ORDER
A regular meeting of the City Council of Maplewood, Minnesota, was held in the Council
Chambers, Municipal Building, and was called to order at 7:31 P.M. by Mayor Murdock.

F. AWARDING OF BIDS
Ayes - all.
1. Storm Sewer Improvement - County Road B and Edgerton St.
a. Manager Miller presented the staff report and stated bids were received
and opened for the above project on June 7, 1977, with Shafer Contracting
being the low bidder at $111,831.35. A close review of their bid indicates
that all items are in order and that individual unit prices are reasonable.
The public hearing amount for this project was $90,000, of which 51% was
indicated as City share. The total project cost is now estimated to be
$152,200, with $44,100 assessable at 212q and 5C per square foot.
b. The City Attorney stated a public hearing would not be necessary as
the assessments will remain the same.

C. Councilman Anderson introduced the following resolution and moved its
adoption:

BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the
bid of Shafer Contracting Co., Inc. in the amount of $111,831.35 is the
lowest responsible bid for the construction of storm sewer on Edgerton and
County Road "B ", and the Mayor and Clerk are hereby authorized and directed
to enter into a contract with said bidder for and on behalf of the City.

2. Street Improvements - Mailand Road.
a. Manager Miller presented the staff report.
b. Councilman Wiegert introduced the following resolution and moved its
,adoption:

BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the
bid of Orfei & Sons, Inc. in the amount of $316,971.52 is the lowest
responsible bid for the construction of utilities and pavement on Mailand
Road from McKnight to 1/2 mile East, and the Mayor and Clerk are hereby
authorized and directed to enter into a contract with said bidder for and
on behalf of the City.
Seconded by Councilman Anderson.

Mayor Murdock recessed the meeting at 7:46 P.M. to convene as the Maplewood Board of
Appeals and Adjustments.

E. PUBLIC HEARINGS

G. APPROVAL OF ACCOUNTS
1. Manager Miller stated a payment in the amount of $123,803.10 should be added
to the accounts payable.
2. Councilman Wiegert moved that the accounts ( Part -I - Fees, Services - - - Expenses —
Check No. 002137 through Check No. 002184 - $193.582.84: Check No. 022865

UNFINISHED BUSINESS
1. Median Closure - White Bear Avenue and County Road D.

a. Mayor Murdock stated Ramsey County Commissioner Hal Norgard and Mr.
Wayne Leonard from the Ramsey County Engineer's Office is here to explain
the County's position on the median closure.
b. Ramsey County Commissioner Norgard and Mr. Wayne Leonard from the
Ramsey County Engineer's Office explained the County's position on the
County Road D median closure.
C. Councilman Anderson introduced the following resolution and moved its
adoption:
77 -6 -113
WHEREAS, the City Council of Maplewood, Minnesota, has determined a public
need;
NOW, THEREFORE, BE IT RESOLVED that the City Council requests the County
of Ramsey to construct a left turn lane on White Bear Avenue at the inter-
section of Woodlyn Avenue. Said left turn lane to accommodate the southbound
to eastbound movement.
Seconded by Councilman Wiegert. Ayes - all.
d. Councilman Anderson moved to concur with Ramsey County's decision to
open the median at White 'Bear Avenue Arid 'County Road D on July 5 1977 and
that the Council requests the'County'to continue investigation of alterna-
tives for this intersection.
Seconded by Mayor Murdock. Ayes - all.
2. Ordinances (Second Reading)
a. Liquor License Fees
1. Manager Miller stated at your meeting of June 16, you placed on
first reading an ordinance placing the annual liquor license fee
for on -sale establishments at $2,500.00. This reverses your
previous decision to establish a $4,000.00 annual fee. Second
reading and final adoption is in order.
2. Councilman Anderson introduced the following ordinance and moved its
adoption:
ORDINANCE NO. 424
AN ORDINANCE AMENDING SECTION 703.100
OF THE MAPLEWOOD CODE
CONCERNING ON -SALE LIQUOR LICENSES
The Council of The City of Maplewood Does Hereby Ordain As Follows:
Section 1. Section 703.100 of the Maplewood Code is hereby
amended to read as follows:
703.100 License Fees. The license fee for an "On -Sale license
is hereby fixed at the sum of Two Thousand Five Hundred

and no /100 ($2500.00) Dollars per year. The license
fee for an "Off -Sale" license is hereby fixed at Two
Hundred and no /100 ($200.00) Dollars per year. The
above stated license fee shall apply whether the
license is for a full year or any part of a year.
Section 2. This Ordinance shall take effect and be enforced
from and after its passage and publication as provided
by law.
Seconded by Councilman Wiegert.

b. Animal Control.

2. Councilman Greavu introduced the following ordinance and moved its
adoption:
ORDINANCE NO. 425
AMENDING MAPLEWOOD CODE CHAPTER 1101
BY ADDING SECTION 1101.190
The Council of the City of Maplewood Does Hereby Ordain as Follows:
Section 1. Section 1101.190 of the Municipal Code is to read as follows:
DESTRUCTION OF DANGEROUS DOGS
The Director of Public Safety shall have the authority to order the destruction
of dangerous dogs.
A dangerous dog is a canine animal which has:
1. bitten two or more people, or
2. caused serious bodily injury or disfigurement to any person, or
3. engaged in any attack on any person under circumstances which would
indicate danger to personal safety.
The Director of Public Safety or his appointee from within the Office of
Animal Control after having been advised of the existence of a dangerous
dog may proceed in the following manner:
(a) The Director of Public Safety shall cause the apparent owner to be
notified in writing or in person that his dog appears to be danger-
ous. The apparent owner shall be notified as to dates, times, places
and parties bitten, and shall be given ten (10) days to request a
hearing before the Director of Public Safety for determination as to
the dangerous nature of the dog.

1. If the apparent owner does not request a hearing within ten (10)
days of said notice, the Director of Public Safety may order the
Animal Control Officer to take the dog into custody for destruc-
tion. If the dog is ordered into custody for destruction, the
owner shall immediately make the dog available to the Animal Con-
trol Officer, and failure to do so shall be a misdemeanor.
2. If the owner requests a hearing for determination as to the dan-
gerous nature of the dog, the hearing shall be held before the
Director of Public Safety who shall set a date for hearing not
more than three (3) weeks after demand for said hearing. The
records of the Police Department shall be admissible for considera-
tion by the Director of Public Safety without further foundation.
After considering all evidence pertaining to the temperment of the
dog, the Director of Public Safety shall make determination as to
whether or not the dog is dangerous. I£ the dog is found to be
dangerous, the Director of Public Safety shall make such order as
he deems proper. The Director of Public Safety may order the Ani-
mal Control Officer to take the dog into custody for destruction.
If the dog is ordered into custody for destruction, the owner shall
immediately make the dog available to the Animal Control Officer
and failure to do so shall be a misdemeanor.
(b) If a dangerous dog is running at large, the Animal Control Officer shall
apprehend the dog and if, upon apprehension, the dog bears no identifica-
tion which reasonably reveals it's ownership, the Director of Public
Safety shall impound the dog until the quarantine period is completed.
If the dog has not been claimed, it shall be immediately destroyed.
(c) Any person who harbors a dog after it has been found by the Director
of Public Safety to be dangerous and ordered into custody for destruc-
tion shall be guilty of a misdemeanor.
(d) The Director of Public Safety may, upon application, apply to municipal
court for subpoenaes for hearings under number 2 above.
Section 2. This ordinance shall take effect and be enforced from now and
after its passage and publication as provided by law.

C. Parking - Private Ramps

2. Councilman Wiegert introduced the following ordinance and moved its
adoption:

ORDINANCE NO. 426
AN ORDINANCE AMENDING SECTION 404
OF THE MUNICIPAL CODE
PERTAINING TO MOTOR VEHICLES ON PARKING LOTS
The council of the City of Maplewood does hereby ordain as follows:
Section 1.
Chapter 404 of the Municipal Code is hereby amended to read as follows:
404.010. MAXIMUM SPEED. No person shall operate a motor vehicle on any
privately -owned or publicly -owned parking lot, area or ramp, within the City at a
speed greater than is safe and reasonable in the condition of traffic then existing
therein, and in no event shall such vehicle be operated in excess of a speed of 15
miles per hour. All operation and driving of motor vehicles on such parking lots
or ramps shall be done in a careful manner so that no such starting or erratic move-
ment of said vehicles is engaged in by the driver. It shall be unlawful for any
person to operate any motor vehicle upon such lot or ramp in any manner that would
constitute careless driving if done upon a public street or highway. No person shall
engage in any drag racing, exhibition driving or unreasonable acceleration of a
motor vehicle on any such parking lot, area or ramp.
404.020. PARKING UNIFORMITY. Parking of vehicles on such lots or ramps shall
conform to the markings of stalls or positions for parking which are designated on
the surface of the parking area and no vehicles shall be parked or allowed to stand
in any area of such parking lot or ramp which has been designated or is used as a
lane for moving traffic so that such parking will interfere with the movement of
traffic.
404.030. SIGNS. The Police Department of the City may post signs at any en-
trance to a privately -or publicly -owned parking lot or ramp from a public street
which shall designate one -way traffic for entrance and exit and the driver of any
vehicle entering or leaving such lot shall comply with any signs so posted.
a. Where such private or publicly -owned parking lot or ramp has
traffic control signs within said lot or ramp indicating traffic
direction, speed, yield and /or stop, the driver of any vehicle upon
such lot or ramp shall comply with any such signs.
404.040. NOTICE OF COLLISION. In the event any person who drives a motor
vehicle upon a parking lot, area or ramp, becomes involved in a collision between
the vehicle he is driving and any other vehicle or vehicles or with any person or
personal property, such driver shall leave a notice upon any unattended vehicle or
personal property with which he has collided, giving his name, address and license
number, and in the event he has collided with a person or motor vehicle which is
attended, shall stop and give his name, address and license number to the driver
of the other vehicle or the person with whom . he has collided. Failure on the part
of any person to comply with this section shall constitute a violation of this
ordinance.
404.050. DRIVING UNDER INFLUENCE OF DRUGS OR ALCOHOLIC BEVERAGES. It shall be
unlawful for any person to operate or drive any motor vehicle upon such parking lot,
area or ramp, if to do so upon a public street or highway would constitute a viola-
tion of Minnesota Statutes 169.121 pertaining to driving while under the influence
of alcoholic beverages or narcotic drugs.

404.060. OPEN BOTTLE LAW.
a. No person shall drink or consume intoxicating liquors or non - intoxicating
malt liquor in any motor vehicle when such vehicle is on a privately -owned or pub-
licly -owned parking lot or ramp.
b. No person shall have in his possession on his person while in a private motor
vehicle upon a privately -owned or publicly -owned parking lot or ramp any bottle or
receptical containing intoxicating liquor or non - intoxicating malt liquor which has
been opened or the seal broken or the contents of which has been partially removed.
C. It shall be unlawful for the owner of any private motor vehicle or the
driver if the owner be not then present in the motor vehicle to keep or allow to
be kept in a motor vehicle when such vehicle is upon a privately -owned or publicly -
owned parking lot or ramp any bottle or receptical containing intoxicating liquor
or non - intoxicating malt liquor which has been opened or the seal broken or the
contents of which have been partially removed except when such bottle or receptical
shall be kept in the trunk of the motor vehicle when such vehicle is equipped with
a trunk or kept in such other area of the vehicle not normally occupied by the
driver or passengers if the motor vehicle is not equipped with a trunk. A utility
compartment or glove compartment shall be'deemed within.the area occupied by the
driver and passengers.
d. Whoever violates the provisions of subsections a, b or c of this ordinance
is guilty of a misdemeanor.
Section 2.
This ordinance shall take effect upon passage and publication.

a. Manager Miller stated the applicants have requested this item be
tabled.

4. Northeast Area Streets
a. Supplemental Agreement
1. Manager Miller stated this item was tabled pending a report from the
City Attorney relative to the reasons for the failure to meet the
established deadlines on right -of -way purchase this project. The
supplemental agreement allows $65,300.00 for project delays. The
cost of the project still remains in excess of $60,000.00 under the
original estimate for the project.

2. Councilman Wiegert introduced the following resolution and moved
its adoption:
77 -6 -114
WHEREAS:
A. The City Council of the City of Maplewood has heretofore ordered made
Improvement Project No. 73 -13 and has let a construction contract therefor pursuant
to Minnesota Statutes Chapter 429.
B. Said construction contract was awarded on a unit price basis for a total
contract price of $1,149,921.00.
C. It is necessary and expedient that said contract be modified so as to
include additional units of work at the same unit price at a cost of $65,300.00,
which additional amount does not exceed 25% of the original contract price.
D. Said additional units of work have heretofore been ordered made pursuant
to subdivision 1 (or subdivision 3) of M.S.A. Section 429.031.
E. A Supplemental Agreement, attached hereto and incorporated herein by
reference, has been presented to the Council for the purpose of effecting such
modification.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MAPLEWOOD,
MINNESOTA, that the Mayor and City Clerk are hereby authorized and directed to
modify the existing contract with respect to Project No. 73 -13 by executing said
Supplemental Agreement.

b. Final Payment
Ayes - all
1. Manager Miller stated the consulting engineers have submitted a
recommendation for final payment to the Arcon Construction Com-
pany for this project. The contractor has completed the construc-
tion work in accordance with plans and specifications. Final actual
cost of the project, including Supplemental Agreement 5 (Agenda
Item H -4a) was $1,223,427.25. The cost is lower than the total
contract cost due to savings in quantities of materials necessary.
The actual contract cost is therefore $124,000.00 under the origi-
nal estimate for the project. Final payment is recommended.
2. Mayor Murdock introduced the following resolution and moved its adoption:

WHEREAS, pursuant to a written contract signed with the City, Arcon Con-
struction Co., Inc. has satisfactorily completed Project 73 -13 (Beam, Radatz, Lydia,
and Woodlyn Avenues and Ariel Street) in accordance with such contract;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that
the work completed under such contract is hereby accepted and approved; and

BE IT FURTHER RESOLVED, that the City Clerk and Mayor are hereby directed
to issue a proper order for the final payment on such contract, taking the con-
tractor's receipt in full.

5. Street Plan.

a. Manager Miller stated the proposed street plan was tabled at the last
meeting.
b. Councilman Anderson moved to accept the Transportation Plan as recommended
by the Planning Commission.

J. NEW BUSINESS

Ayes - all.
a. Manager Miller stated the subject property is located approximately
200 feet North of Demont Street on the West side of Flandrau Street and
is composed of two lots having widths of 100 feet on Flandrau Street. The
applicant proposes to add 20 feet from the North lot to the South lot
creating two lots with widths of 100 feet and 80 feet. The North lot is
unimproved and the South lot is presently developed with a house and garage.
The subject property is currently zoned R -1 and the master plan indicates
a low density residential usage for this area.
The proposed lot division does conform with existing codes and would
eliminate one minor code violation on the property. Approval of the
lot division is recommended subject to the addition to the South lot be
recorded.
b. Councilman Anderson moved to approve the lot division as reque
Mr. Harry Duddeck, 2545 Flandrau Street; subject to the addition to
south lot being recorded.

2. Building Plan Reviews:

1. Manager Miller presented the staff report with the recommendation that
the proposed building addition of a two story classroom be found to be in
conformance with the Community Design Review Board Ordinance.
2. Board Member Simpkins presented the following Community Design Review Board
recommendation:
"Board Member Sjolander moved the Community Design Review Baord recommend to
the City Council the proposed building addition for the Gladstone Baptist
Church at 1717 English Street be found to be in conformance with the Community
Design Review Board Ordinance.
Board Member Haugan seconded. Ayes all."

1. Manager Miller presented staff report and stated it is recommended the
proposed triplex and garages be found to be in conformance with the Community
Design Review Board Ordinance subject to the comments of the Board and the
following conditions:
1. Applicant shall pay cash connection charges prior to the issuance of a
building permit;
2. Plans for the two garages shall be submitted to the Community Design
Review Board for their architectural review and approval;
3. The width of the drive separating the two garages shall be a minimum
of 30 feet;
4. A landscaping plan shall be submitted for review and approval by the Board;
5. The parking area shall be curbed to comply with Code;
6. The parking of automobiles and trucks on the easterly side of the subject
property must discontinue upon building permit application;
7. All refuse and garbage containers shall be screened from sight and placed
at the rear of the premises in conformance with Code;
8. Applicant shall provide for the establishment of an easement guaranteeing
access from Stillwater Road to the R -1 zoned portion of the applicant's
property. The easement shall be subject to the approval of the City
Engineer;
9. The owner and applicant shall provide for snow removal from the parking
and access areas with adequate space for storage if removal is not
provided;
10. Applicant and owner shall commence subject development with 120 days of
the date of City Council approval of plans or the City will consider
revocation of said application. Applicant may request an extension at
the time from the City Council;
11. All garages and accessory buildings shall have the same exterior treatment
as the principal use building;
12. The proposed 3 -plex shall be designed and constructed to have the equivalent
of a front on each exterior surface;
13. Building design including windows, doorways, exits, ventilation, etc. shall
be subject to alterations by the Building Official to insure compliance
with the State Building Code; structure shall comply with State Handicapped
Code;

14. External equipment such as air conditioning, ventilating, heating or
similar units shall be screened from view in a manner and with materials
which are compatible with the architecture of the building;
15. Owner and applicant agree to the above conditions in writing.
2. Board Member Simpkins presented the following Community Design Review Board
recommendation:
"Chairman Simkins moved the Community Design Review Board recommend to the City
Council the plans for the tri -plex on 2335 Stillwater Road submitted by Mr.
Bruce Kaspar be denied as they do not conform with the requirements of the Com-
munity Design Review Board Ordinance and City and State Ordinances. Plans shall
be resubmitted to show and reflect the intention of what the developer is plan-
ning on doing. Site plan shall be revised to show the exact boundaries of the
R -3 zoning district and the access easement to the westerly R -1 zoned lot. Site
plan shall also show the revised parking layout, revised grading to conform with
handicapped requirements, accurate location of building, and the building exter-
ior design shall accurately reflect with the developer intends.

3. The applicant, Mr. Bruce Kaspar spoke on behalf of the proposal.
4. Councilman Anderson authorized a lot division creating a lot 355.6' x 165'
to the rear and that lot would include a 50 foot strip of land on the south east

5. Councilman Anderson moved to approve the building plans to construct a tri-
plex requested by Mr. Bruce Kaspar subject to the following conditions:
1. Applicant shall pay cash connection charges for sanitary sewer prior to
the issuance of a building permit;
2. Plans for the two garages shall be submitted to the Community Design Review
Board for their architectural review and approval;
3. The width of the drive separating the two garages shall be a minimum of
30 feet;
4. A landscaping plan shall be submitted for review and approval by the Board;
5. The parking area shall be curbed to comply with Code;
6. The parking of automobiles and trucks on the easterly side to the subject
property must discontinue upon building permit application;
7. All refuse and garbage containers shall be screened from sight and placed
at the rear of the premises in conformance with Code;
8. A lot division shall be recorded prior to issuance of permits. Applicant
shall provide for the establishment of an easement guaranteeing access

12. The proposed 3 -plex shall be desinged and constructed to have the equiva-
lent of a front on each exterior surface. The design of the building shall
be masonite siding four foot on grade line with feather rock on front of
residence;
13. Building design including windows, doorways, exits, ventilation, etc. shall
be subject to alterations by the Building Official to insure compliance
with the State Building Code; structure shall comply with State Handicapped
Code;
14. External equipment such as air conditioning, ventilating, heating or similar
units shall be screened from view in a manner and with materials which are
compatible with the architecture of the building;
15. Owner and applicant agree to the above conditions in writing.

3. H R A - Annual Report
a. Manager Miller stated the Maplewood Housing and Redevelopment Authority wishes
to submit a copy of its 1976 Annual Report to the Council. A member of the HRA
will be present to answer any questions you might have.

c. Councilman Wiegert moved to accept the 1976 Annual Housing and Redevelopment
Authority report.

4. Bicycle Pathway - Phalen Park
a. Manager Miller stated the City of St. Paul:and Ramsey County propose to construct
a bike path and a bridge through Keller Park on the North side of Round Lake. Staff
has reviewed the proposal and feels that the plan is a good one and should be approved.
It is recommended that Maplewood grant the County permission to build a bike path
and bridge through Keller Park as proposed.

5. Ambulance Charge - Hardship Request
a. Manager Miller stated staff has received two hardship requests for cancellation
for ambulance billings. Staff has no reason to believe that these are not hardship

6. Public Hearing Dates
a. Manager Miller stated all work has been completed for the 1976 Diseased Tree
Removal Program. It is recommended a public hearing date of July 26 for the assess-
ments for this project.

WHEREAS, the City Clerk and City Engineer have presented the final figures for
the removal of Diseased Shade Trees, Maplewood Project No. 76 -6;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, as
follows: that the City Clerk and City Engineer shall forthwith calculate the proper
amount to be specially assessed for such improvement against every assessable lot,
piece or parcel of land abutting on the streets affected, without regard to cash
valuation, as provided by law, and they shall file a copy of such proposed assessment
in the City Office for inspection;
FURTHER, the Clerk shall, upon completion of such proposed assessment notify the
Council thereof.

WHEREAS, the Clerk and the Engineer have, at the direction of the Council, pre-
pared an assessment roll for the Removal of Diseased Shade Trees, Maplewood Project
76 -6, and the said assessment roll is on file in the office of the City Clerk;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA;
1. A hearing shall be held on the 26th day of July, 1977 at the City Hall at
7:30 P.M. to pass upon such proposed assessment and at such time and place all
persons owning property affected by such improvement will be given an opportunity
to be heard with reference to such assessment.
2. The City Clerk is hereby idrected to cause a notice of the hearding on the pro-
posed assessment to be published in the official newspaper, at least two weeks
prior to the hearing, and to mail notices to the owners of all property affected
by the said assessment.
3. The notice of hearing shall state the date, time, and place of hearing, the
general nature of the improvement, the area proposed to be assessed, that the
proposed assessment roll is on file with the Clerk, and that written or oral
objections will be considered.

7. Curb Type ^- Crestview Addition
a. Manager Miller stated staff has received a request from the Marvin H. Anderson
Construction Company to appear before you "to discuss the possibility of construct-
ing surmountable curb in lieu of B -618 curb in our project of Crestview ". The Engin-
eering staff had previously reviewed the utilization of surmountable curb in this
project and determined that the guide line established for the use of surmountable
curbing was not met in the area of street grades. It was felt that this type of
curb was not suitable considering the steepness of grade and resulting possible
drainage problems. It is recommended that the request be denited.
b. Mr. Marlin Grant and Mr. Fred Haas, Marvin Anderson Construction Company, Inc.,
spoke on behalf of their request.

c. Mr. Jack Delenthies, Dahn Construction, asked questions of the Council and
presented his views.
d. The matter was referred to staff to provide more information.

a. Councilman Wiegert stated he has a letter from the Association of Metropolitan
Municipalities requesting a delegate be appointed.
b. Councilman Anderson moved to appoint Councilman Wiegert as the Maplewood Delegate
to the Association of Metropolitan Municipalities.

a. Councilman Anderson expressed his views on the hiring of a planner and an engineer

and what alternatives there are.

1. Laborers Pay
a. Manager Miller stated a laborer was recently hired and recommended his salary
be set at the 1976 rate for six months and then a 40(,, increase and that this rate be
used for the next laborer hired.
b. Mayor Murdock moved to set the rate for the newly hired laborer at the 1976
rate and a 40 cent increase after six months and this rate be used for the next
laborer Hired.
