1. Site and Building Plan - Merit Chevrolet (Clarification)
a. Manager Miller presented staff report.

b. A representative of Merit Chevrolet spoke and requested clarification of
several conditions.
C. Councilman Anderson moved that the following conditions as amended be approved:
1. The area between the proposed storage building and the existing paved
parking and access area shall be surfaced in accordance with the require-
ments of the City Engineer. Preferable (sp) with a crushed rock surface;
2. The landscaped area adjacent to the Brookview Drive entrance shall be re-
furbished including replacement of shrubs and trees within the existing
surveyed lines;
3. Landscaping along the west property line behind the proposed building
be sodded, with russian olive trees and evergreen trees planted at a
density of one tree for each 12 feet of building length. A landscaping
plan shall be submitted for staff approval. All existing trees other than
diseased elm trees along the west property line shall remain;
4. The building location shall be as shown on the plan submitted, dated
August 27, 1975 Scheme 2, which shows the building parallel to the west
property line .located equal distance between the north and south property
lines. The building shall be located 10 feet east of the west property
line. (This condition modifies condition number 2 of November 6, 1975);
5. West elevations of the building shall have cedar siding with cedar battens
at 2 foot on center. The east elevation of the building shall be blue to
match existing buildings;
6. The proposed storage building be relocated 30 feet to the south.
7. A landscape plan be submitted for staff approval indicating screening of
the residential area along the southerly property line. Installation of
a landscape berm where possible to screen the storage building, along
with sodding and removal of all waste material from adjacent area;
8. Construct a drainage system from the parking lot south to Brookview Drive
of adequate dimension determined by the City Engineer; add a dissipator or
an equal system as required by the City Engineer and also complete an
asphalt curb on the parking lot to the west and south;
9. Owner and applicant agree to the above conditions in writing.

2. Special Exception (Milk Processing) - 2080 Rice Street
a. Manager Miller presented the staff report and stated the applicant recently

asked that action on their building plans be speeded up to allow earlier construct-
ion than would normally be required by the Design Review process. The staff in-
formed the applicants that frost footings and foundation permits may be issued
prior to Design Review by the staff with a written stipulation that they agree to
conform to requirements established by the Council at the time of final building
approval. As of the writing of this report, application has not been made for
the foundation permit. The applicants also request some type of approval of the
first stage of construction at the November 18 meeting.
b. Mr. Roger Sax, representing Schroeder Milk, spoke on behalf of their request.
Councilman Murdock arrived at 9:17 P.M.
C. Councilman Greavu moved to issue the building permit to finish the building
and that the applicant proceed with the process of applying to the Community Design
Review Board and that the special exception be granted.
Seconded by Councilman Wiegert. Ayes - Councilmen Anderson, Greavu, Murdock
and Wiegert.
Nays - Mayor Bruton.
Mayor Bruton stated he voted nay on the grounds that the City has rules, regulations
and ordinances that should be followed.
Motion carried.
3. Lot Division - Arcade Street
a. Manager Miller presented the staff report and stated it appears that some con-
fusion was likely from the discussions at the original approval of this lot divis-
ion. It should be pointed out that these lots are deep and will result in areas
of 17,175 square feet for each lot in the northeast corner of the property. Such
large lots can result in future tax and assessment burdens and requests for future
lot divisions. However, the provision of three lots occurring due to lot divisions
is acceptable within previous Council practices. It it stherefore recommended that
the proposed amendment to the lot division of October 14 be granted subject to the
conditions of that approval.
b. Mr. Little, the applicant, and Mr. Kohutek, the prospective buyer, spoke on
the changing of the lot division.
c. Councilman Wiegert moved to approve a new lot division as requested by Mr.
Little, 813 E. County Road B (3 lots).
Seconded by Councilman Murdock. Ayes - all.
4. Street Improvement - Beebe Road (Supplemental Agreement)
a. Manager Miller stated construction of Beebe Road in 1975 stopped short of
Larpenteur Avenue in order that several large water mains could later be installed
from Larpenteur Avenue to the Beebe Road Booster Station. That work has now been
completed and it is necessary to finalize the construction of Beebe Road through
the installation of certain storm sewers and other piping arrangements, new base
and asphalt base and wearing course. C. S. McCrossan Company has agreed to do
this work at the same unit prices as those bid for the Conway Avenue Street improve-
ment. This would reduce the amount expected under normal bid award procedures

and should result in a savings to the City. The supplemental agreement indicates
a cost for the work of $9,510.25 which should be distributed between the Beebe
Road Street and booster station projects. Acceptance of the supplemental agreement
is recommended.
b. Mayor Bruton introduced the following resolution and moved its adoption:

WHEREAS:
A. The City Council of the City of Maplewood has heretofore ordered made
Improvement Project No. 73 -9 and has let a construction contract therefor pursuant
to Minnesota Statutes Chapter 429;
B. Said construction contract was awarded on a unit price basis for a total
contract price of $197,344.21;
C. It is necessary and expedient that said contract be modified so as to
include additional units of work as the same unit price at a cost of $9,510.25,
which additional amount does not exceed 25% of the original contract price;
D. The completion of the Beebe Road Project was dependent upon the completion
of the Water Booster Station;
E. The timing of said Beebe Road Project is such that it can now be included
in the Conway Avenue Project;
F. Said additional units of work have heretofore been ordered made pursuant
to subdivision 1 of M.S.A. Section 429.031.
G. A supplemental agreement, attached hereto and incorporated herein by
reference, has been presented to the Council for the purpose of effecting such
modification.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MAPLEWOOD,
MINNESOTA, that the Mayor and City Clerk are hereby authorized and directed to
modify the existing contract with respect to Project No. 73 -9 by executing said
Supplemental Agreement.

5. Water and Sewer Improvement - Bellaire Avenue Between Beam and Lydia Avenue (Final
Payment)
a. Manager Miller stated the contractor has satisfactorily completed the work for
the installation of utilities on Bellaire Avenue between Beam and Lydia Avenues.
The final cost was $33,687.00 as compared to the original contract of $32,356.00.
The final payment of $4,216.26 is recommended.
b. Councilman Greavu introduced the following resolution and moved its adoption:

WHEREAS, pursuant to a written contract signed with the City on July 27,
1976 Gerald Stepaniak, Inc. has satisfactorily completed the construction of

utilities on Bellaire Avenue, Maplewood Project No. 75 -11, in accordance with
such contract;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA,
that the work completed under such contract is hereby accepted and approved; and
BE IT FURTHER RESOLVED, that the City Clerk and Mayor are hereby directed to
issue a proper order for the final payment on such contract, taking the contractor's
receipt in full.

6. Park Improvement - Michael Lane Nature Center Engineering Agreement
a. Manager Miller stated the Minnesota Office of Local and Urban Affairs has noti-
fied us that the Michael Lane Nature Center grant has been approved for 1976 and
that we may proceed with planning and development. Before we proceed too far, we
are required to acquire permits from both the Federal Corps of Engineers and the
Ramsey- Washington Metropolitan Watershed District. In order to complete the permit
applications, it will be necessary to complete construction drawings. In 1974
Brauer & Associates completed a feasibility study for the Michael Lane Nature
Center. That firm has worked hard in obtaining both federal and state money for
this project. It is recommended that the firm of Brauer & Associates be retained
to prepare construction documents and specifications for a flat fee of $5,450.00
in accordance with the attached agreement.
b. Councilman Anderson moved that the firm of Brauer and Associates be retained

7. Sanitary Sewer Rate - Ordinance (Second Reading)
a. Manager Miller stated second reading and final adoption of the ordinance es-
tablishing new sewer rates effective January 1, 1977 is in order.
b. Councilman Murdock introduced the following ordinance and moved its adoption:

AMENDING THE MAPLEWOOD CODE
RELATING TO
SEWER SERVICE CHARGES
THE COUNCIL OF THE CITY OF 14APLEWOOD DOES HEREBY ORDAIN AS FOLLOWS:
Section 1. Chapter 206.140 is hereby amended to read as follows:
206.141. RATES. The following reates and charges are hereby established
for all sanitary sewer services furnished by and in the City of Maplewood:
(1) The quarterly residential rates shall be:

(2) Non - residential rates shall be as follows:

Non - residential sewer service charges shall be a minimum of $64.00
annually per sewer service connection.
(3) The senior citizen rate shall be billed only to those that meet all
of the following conditions:
(a) Must be residential property occupied by no more than two
persons;
(b) One of the occupants must be the owner and billed directly
by the City of Maplewood;
(c) One of the occupants must be at least 65 years of age or older;
(d) If occupied by two persons, the second occupant must be atleast
62 years of age or older;
(e) Annually after November 1st and before December 15th, one of the
occupants must file an affidavit with the City Clerk stating
that all of the conditions required in this ordinance are
applicable to his or her residence. In the case of rental prop-
. erty, the senior citizen shall submit proof that he or she is
responsible for payment of the sewer service charge.
Affidavits accepted and approved by the City Clerk at a time other
than that specified above, shall entitle the resident to the senior
Citizen rate for each full quarter remaining in the year not including
the quarter during which the affidavit is filed.
(4) The rate for properties used jointly for residential and commercial
purposed that are not metered separately shall be billed at non-
residential rates.
(5) In respect to property which shall be connected with the City sewer
system for the discharge and disposal of other residential, commer-
cial or industrial sewage waste, or any waste unusual in either
character or amount, then in addition to all applicable charges
hereunder, the City council reserves the right to impose such supple-
mental sewage rate charge as said City council shall determine as
reasonable and warranted on the basis of all relevant factors.
206.142. FLOW CALCULATIONS. Annually during the month of January, the Director
of Public Works shall determine, for each property billed at non-
residential rates, the effluent discharged during the preceding year.
One fourth of this amount shall be used to calculate the quarterly
bill for the current year.
For the purpose of determining the quantity of effluent discharged

from any property within the City of Maplewood, the Director of
Public Works shall determine the lowest quarter of water usage
during the preceding year, either through direct water meter read-
ings, or if not metered, by reasonable estimating methods (i.e.
special metering devices, comparison to similar types of land and
water uses, etc.). The quantity of water used, as determined or
estimated above, shall be the quantity of effluent discharged sub-
ject to the rate structure. However, if determined by the Director
of Public Works that the lowest quarter's water usage during the
preceding year does not reflect a reasonable estimate of probable
effluent to be discharged during the current year, the Director of
Public Works shall use any other equitable and reasonable method
to estimate the probable effluent to be discharged in the follow-
ing current year (i.e., special metering devices of effluent dis-
charged, total yearly or estimated yearly usage, consumption minus
estimated water usage not discharged into the sewer system, com-
parison with similar uses, etc.). All new properties connecting
to sanitary sewer and applicable to the non - residential rate struct-
ure, as defined in this section, shall be assigned an estimated
quantity of discharge, by any of the methods above which reason-
ably reflect such probable discharge. Such estimated quantity shall.
be subject to the rate structure, herein defined, until the end
of that year at which time the Director of Public Works shall in-
clude such property into his study of applicable properties under
this paragraph.
206.143. STATEMENTS. All properties shall be billed quarterly. Statements
shall be mailed to "occupant" at the address of the property except
for:
(a) Residents billed at the senior citizen rate;
(b) Properties for which someone other than the occupant
has requested to be billed.

206.144 DELINQUENT ACCOUNTS. There shall be added to all statements not
paid by the date indicated in Section 206.143 a delinquency charge
of one dollar or ten percent of the amount due, whichever is greater.
Annually by October 10th, the City Clerk shall deliver to the
Council for adoption an assessment roll providing for collection
of all delinquent amounts billed through the second quarter. Upon
adoption by the Council, these accounts, including penalties and
interest, shall be certified to the County Auditor for collection
with taxes during the ensuing year. Such action may be optional or

subsequent to taking legal action to collect delinquent accounts.
206.145. COMMENCEMENT OF SEWER SERVICE CHARGES. Sewer service charges shall
commence on the date of application for an "Occupancy Permit" or
"Final Plumbing Inspection ", whichever shall be first. Failure to
obtain either of these permits, as required in the City Code, shall
be subject to the penalties of the code relevant to such permits,
penalties of Chapter 206, and retroactive billing made from the date
occupancy occurred as determined by the building official.
206.146. NON- USAGE. Adjustments in billing for any property for non -usage
of the sewer service facilities may be granted by the City Clerk if
proof is submitted by the applicant that water service had been
terminated for a period of not less than 30 days.
Section 2. This ordinance shall take effect and be in force beginning January 1,
1977.

J. NEW BUSINESS
1. Lot Division - Arcade Street (Little) See H -3
2. Assessment Correction - Highwood Avenue
a. Manager Miller stated in 1968 sanitary sewer project resulted in a main being
placed along Highwood Avenue in the Pleasant View Park area. The assessments for
this project along Highwood Avenue were deferred subject to the usual conditions.
In 1975 a portion of this land was sold and an assessment levied. The owner of a
large portion of land on the north side of Highwood Avenue commenced an appeal
of the assessment based upon a 30 -foot ravine between the sanitary sewer main and
a buildable site (see attached map). A detailed engineering examination of the
site reveals that it is engineeringly possible to fill the ravine adequately . enough
to afford direct sewer connections; however, it appears that this would not be
economically feasible at this time. For that reason it is recommended that the
assessment for the parcel of land with the ravine be canceled and that any future
building on the site be subject to a cash connection charge in lieu of the assess-
ment.

Minnesota, adopted 7- 31 -75, the special assessments for the construction of High-
wood Avenue Improvement 68 -SAS -2 were levied against property described as
57 01300 220 04; and
WHEREAS, the assessments as herein described are to be cancelled in the amount
of $4,682.13;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA,
that the assessments for Highwood Avenue Improvement 68 -SAS -2 against 57 01300 220

3. Maplewood Garden Courts - Beebe Road
a. Manager Miller stated in August of this year the Maplewood HRA reviewed a
proposed subsidized housing project to be constructed on Beebe Road to the south
and west of the Archer Heights 236 project. That review resulted in a report from
the HRA which recommended "denial of this proposal, or any similar proposal in this
area, as being inconsistent with the housing goals of the City of Maplewood ". A
copy of that report is attached. The proponents of the proposed apartment develop-
ment have requested inclusion on the November 18 agenda because they indicate that
the financing of their project is being held up by the HRA recommendation.
b. Commissioner Duane Prew presented the Planning Commission views.
c. Mr. Walt Johnson, Rothschild Mortgage Company, representing Mr. Louis Lundgren,
the architect and the sponsor of the proposed project, explained to the Council what
has occurred.
d. Mr. Dwight Jesup and Mrs. Fran Joker, members of the Human Relations Commission
and the Housing and Redevelopment Authority respectively presented their views.
e. No action taken.
3. 1977 Liquor License
a. Manager Miller presented a list of the existing On and Off Sale Liquor Licenses
which are requesting renewal. Included on the list for Off -Sale Liquor Licenses is
the House of Liquor at 2627 White Bear Avenue. The House of Liquors was involved
in both a charge of sale to under aged individuals and a fine in the amount of
$100.00 has been paid. Staff recommends that December 9 be established as a hearing
date to consider the suspension of said license. Due to the fact that we are dis-
cussing suspension, it is recommended that the attached resolutions renewing both
On and Off -Sale Liquor Licenses, including the House of Liquors, be passed.

a. Manager Miller stated the City Attorney advises us that if we pass the re-
solution as presented the taxes against the Maplecrest Park area on Arcade Street
will be canceled. This will result in a much lessor net cost to the City for the
property as the larger share of the purchase price to be the payment of property
taxes.

WHEREAS, the Board of County Commissioners of.Ramsey County by resolution
dated October 4, 1976, calssified as non- conservation land, certain land lying
within the limits of the City of Maplewood, Ramsey County, Minnesota; and
WHEREAS, a certified copy of the Classification Resolution, together with
a list of the land classified has been submitted for approval of the classifi-
cation and sale of the land classified in accordance with M.S.A., Section 282.01,
Sub. 1;
NOW, THEREFORE, BE IT RESOLVED that the classification land shown on said
list as non - conservation land and the sale thereof be and hereby is approved; and
BE IT FURTHER RESOLVED, that the City Clerk be and hereby is authorized -
to file a certified copy of this Resolution in the office of the Ramsey County
Land Commissioner.

WHEREAS, a feasibility report has been ordered for additions to the roadways
system in the Radatz, Beam, Woodlyn, McKnight, Southlawn area; and

istics;
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA,
HEREBY directs the Engineer to consider the construction of Ariel Street from Beam
Avenue to Radatz Avenue in conjunction with the extension of Mapleview Avenue from

appreciate a listing of those instances mentioned by the chamber members.

L. ADMINISTRATIVE PRESENTATIONS
1. Meeting Dates
a. Manager Miller stated the staff would like to meet with the Council in a shirt
sleeve session on November 29 (a Monday) to review the Park and Public Works bond
issues in detail. Also, the staff would like to discuss salaries at this time.
The Council agreed upon November 30 (a Tuesday night) to meet with the Community
Design Review Board and other interested individuals relative to the sign ordinance.
The staff would also like to meet with the Council in a shirt sleeve session on
the evening of December 7 (a Tuesday night) to discuss the contents of the proposed
street plan prior to the development of specifications for the development of that
plan.
It is recommended that the Council establish the above dates as shirt sleeve sessions.
All of the meetings would, of course, be held at 7:30 P.M.
b. Mayor Bruton moved to hold a "shirt sleeve" session November 29,
P.M. at the Heritage Center to discuss the proposed Bond issue and s
