A. CALL TO ORDER Mayor Bruton reconvened the meeting of May 20, 1976 at 7:30 P.M., Tuesday, May 25, 1976. B. ROLL CALL Robert T. Bruton, Mayor Present Norman G. Anderson, Councilman Present John C. Greavu, Councilman Present Burton A. Murdock, Councilman Present Donald J. Wiegert, Councilman Present UNFINISHED BUSINESS 2. Zone Change (FR to BCM) - Beam Avenue, White Bear Avenue to Hazelwood Street (Second Reading) a. Discussion was held on the motion that was on the floor when the meeting adjourned last Thursday. b. Councilman Wiegert withdrew his motion of last Thursday regarding Beam Avenue Zone Change. Councilman Anderson withdrew his second. C. Following discussion, Councilman Murdock introduced the following ordinance and moved its adoption: ORDINANCE NO. 397 AN ORDINANCE AMENDING THE MAPLEWOOD ZONING CODE THE COUNCIL OF THE CITY OF MAPLEWOOD DOES HEREBY ORDAIN AS FOLLOWS: Section 1. That the following described property is hereby rezoned from FR (Farm Residential) to BC (M) Business Commercial (Modified), to wit: UNPLATTED LANDS: Commending at the Northwest corner of the Southeast 1/4 of Section 3, Township 29, Range 22, being a point on the center line of Beam Avenue; thence Easterly along the center line of Beam Avenue to a point on the center line of White Bear Avenue lying approximately 700 feet west of the center of and on the North line of the Southwest 1/4 of Section 2, Township 29, Range 22; thence Southerly along the center line of White Bear Avenue to a point 305 feet South of the center line of Beam Avenue; thence Westerly along a line parallel to - 1 - 5/25 the center line of Beam Avenue a distance of approximately 565 feet; thence Southerly a distance of approximately 10 feet; thence Westerly a distance of approximately 285 feet along aline parallel to the center line of Beam Avenue; thence Southerly along a line parallel to the center line of Southlawn Drive to a point 390 feet South of the center line of Beam Avenue; thence Westerly along a line parallel to the center line of Beam Avenue and 390 feet South of said center line to a apoint on the center line of Southlawn Drive; thence Southerly along the center line of Southlawn Drive a distance of 54 feet to a point 444 feet South of the center line of Beam Avenue; thence Westerly along a line parallel to a said center line a distance of 910 feet; thence Northerly along a line parallel to the center line of Southlawn Drive a distance of 88 feet; thence Westerly along a line parallel to the center line of Beam Avenue to the Easterly right -of -way line of Kennard Street; thence Southerly along said Easterly line of Kennard Street to a point on the North line extended of the City of Maplewood ponding areas as recorded on Document No. 1817563; thence Westerly along said North line of the Maplewood Ponding area to a point on the center line on Hazelwood Avenue; thence Northerly along the center line of Hazelwood Avenue to the center line of Beam Avenue, being the point of beginning. Section 2. This ordinance shall take effect upon its passage and publication. Seconded by Councilman Creavu. Ayes - all. d. Councilman Murdock moved first reading of a proposed amendment to the BCM Ordinanre: Item 3 to be attached as F under Item 1 -F. "Any use of the same general character as any of the above permitted uses as determined by the Council provided that no use which is noxious or hazardous shall be permitted." Seconded by Councilman Anderson. Ayes - all. 3. Assessment Corrections a. Manager Miller stated this matter had been tabled for further investigation. He referred a letter to the Council from the attorney stating the reasons for recommending the proposed changes. b. Water Improvement 71 -6 Councilman Wiegert introduced the following resolution and moved its adoption: 76 -5 -86 WHEREAS, pursuant to resolution 75 -8 -153 of the City .council of Maplewood, Minnesota, adopted August 14, 1975, the special assessments for the construction of Beebe Road Water Improvement 71 -6 were levied against property described by County Auditor's Code No. 57 01410 020 86. WHEREAS, $4,694.62 of the aforesaid assessment was levied in error;7' - 2 - 5/25 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the assessment for Beebe Road Water Improvement 71 -6 against the property described by County Auditor's Code No. 57 01410 020 86 be correctly certified to the Auditor of Ramsey County by deleting therefrom the amount of $4,694.62. Seconded by Councilman Anderson. Ayes - all. C. Sanitary Sewer Improvement 71 -6 Councilman Wiegert introduced the following resolution and moved its adoption; 76 -5 -87 WHEREAS, pursuant to resolution 75 -8 -153 of the City Council of Maplewood, adopted August 14, 1975 the special assessments for the construction of Beebe Road Storm Sewer Improvement No. 71 -6 were levied against property described by County Auditor's Code No. 57 01410 020 86; and WHEREAS, it is the desire of this Council that a portion of said assessment against the property described herein be deferred; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the assessment for Beebe Road Storm Sewer Improvement No. 71 -6 against the property described by County Auditor's Code No. 57 01410 020 86 in the amount of $1,636.24 be and hereby is deferred. BE IT FURTHER RESOLVED, that the Ramsey County Auditor be and is hereby authorized to make the necessary changes in his records to properly reflect this 'action. Seconded by Mayor Bruton. Ayes - all. d. Storm Sewer Improvement 71 -6 Councilman Wiegert introduced the following resolution and moved its adoption: r7.l37 WHEREAS, pursuant to resolution 75 -8 -153 of the City Council of Maplewood, Minnesota, adopted August 14, 1975, the special assessments for the construction of Beebe Road Sanitary Sewer Improvement 71 76 were levied against property de- scribed by County Auditor's Code No. 57 01410 020 86. WHEREAS, $4,168.22 of the aforesaid assessment was levied in error; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the assessment for Beebe Road Sanitary Sewer Improvement 71 -6 against the property described by County Auditor's Code No. 57 01410 020 86 be correctly certified to the Auditor of Ramsey County by deleting therefrom the amount of $4,168.22. Seconded by Councilman Greavu. Ayes - all. F. COUNCIL PRESENTATIONS 5. Speed Limit on McKnight - 3 - 5/25 Councilman Greavu stated he owes the County Board or someone from the County an apology for .accusing them of setting the speed limit on McKnight Road. He found it was set by the State. 6. Beam Avenue Dr. Nelson wished to thank Council for their perservering and dedication regard- ing Beam Avenue. 7. K S T P a. Councilman Wiegert stated that at the Association of Metropolitan Municipal- ities meeting last week they discussed power lines coming into the area and KSTP is quite concerned that they will interfere with their towers. b. Staff to investigate. G. ADMINISTRATIVE PRESENTATIONS 1. Election Judge Certification a. Ayes - all. - 4 - 5/25 2. Tax Abatement Resolution a. Councilman Wiegert introduced the following resolution and moved its adoption: - 76 -5 -90 A RESOLUTION requesting abatement and removal from taxation records of the Department of Property Taxation, Ramsey County, Minnesota, the real estate taxes assessed for the year of 1975, payable in 1976, affecting property owned by the City of Maplewood by virtue of a QUIT CLAIM DEED dated June 1, 1975 from TILSEN HOMES, INC., as Grantor. Property described as per VERI -FAX copy of STATEMENT OF REAL ESTATE TAXES Payable in 1976, Ramsey County, Minnesota, attached hereto; Property acquired is IDENTIFIED as Code Number 57 00210 060 09 in the office of Property Taxation, Ramsey County, Minnesota. WHEREAS, the City of Maplewood acquired said property as per STATEMENT OF REAL ESTATE TAXES Payable in 1976 from TILSEN HOMES, INC, for Maplewood Heights Park Expansion purposes. RE: Maplewood Project No. 73 -13; and WHEREAS, there are real estate taxes in the total amount of $283.82 as per attached statement for year of 1975 payable in 1976; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the above taxes as recited in the total amount of $283.82, BE ABATED and re- moved from the taxation records of the Property Taxation Division of Ramsey County, Minnesota for the year of 1975, payable in 1976. Seconded by Mayor Bruton. Ayes - all. 3. Trees a. Councilman Murdock wished to know if there is any way we can build up a stock pile of trees, some place they can be planted for future use. b.
