CALL TO ORDER A regular meeting of the City Council of Maplewood, Minnesota, was held in the Council Chambers, Municipal Building and called to order at 7:31 P.M. by Mayor Bruton. B. ROLL CALL Robert T. Bruton, Mayor Present Norman G. Anderson, Councilman Present John C. Greavu, Councilman Present Burton A. Murdock, Councilman Present Donald J. Wiegert, Councilman Present C. APPROVAL OF MINUTES 1. Minutes No. 76 -9 (March 18, 1976) Councilman Greavu moved that the Minutes of Meeting No. 76 -9 (March 18, 1976) be approved as submitted. Seconded by Councilman Murdock. Ayes - all. 2. Minutes No. 76 -10 (March 25, 1976) Councilman Murdock moved that the Minutes of Meeting No. 76 -10 (March 25, 1976) be approved as submitted. Seconded by Councilman Wiegert. Ayes - all. APPROVAL OF AGENDA Councilman Wiegert moved to approve the Agenda as amended: 1. Monitor -Sewer 2. Rules of Procedures 3. Resignation - Planning Commission Seconded by Councilman Anderson. Ayes - all. E. PUBLIC HEARINGS None. F. AWARDING OF BIDS 1. Diseased Tree Removal a. Manager Miller stated bids were received April 7, 1976. The apparant low bidder is L and B Tree Service in the amount of $90,693.21. Award of the bid to L and B is recommended. - 1 - 4/8 b. Councilman Anderson introduced the following resolution and moved its adoption: 76 -4 -57 BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the bid of L & B Tree Service in the amount of $90,693.21 is the lowest respon- sible bid for the removal of diseased shade trees and the necessary restoration within the City of Maplewood, and the Mayor and Clerk are hereby authorized and directed to enter into a contract with said bidder for and on behalf of the City. Seconded by Mayor Bruton, Ayes - all. G. APPROVAL OF ACCOUNTS Councilman Anderson moved that the accounts (Part I - Fees, Services, Expenses Check No. 018180 through Check No. 018304 - $206,182.81; Check No. 1365 throng Check No. 1389 = $28,775.27: Part II - Payroll - Check No. 10793 through Chec No. 10895 - $39,803.84) in the amount of $274,761.92 be paid as submitted. Seconded by Mayor Bruton. Ayes - all. H. UNFINISHED BUSINESS 1, Sign Review - U -Haul Moving Center (2242 White Bear Avenue) a, Manager Miller stated he had a request from the representative of U -Haul Company to table this item until April 22, 1976 meeting, b, Councilman Anderson moved to table Item H -1 until the meeting of April 22, 1976. Seconded by Councilman Wiegert. Ayes - all. I. VISITOR PRESENTATIONS None, J. NEW BUSINESS 1. Sewer Bill Late Charge - Request for Cancellation a. Manager Miller stated staff has received a request from Mr. Charles F, VanderVoort, Maple Manor Apartments, that the late charge on the last two quarters of the sewer rental bills for 1975 be cancelled. Ownership of the apartments had changed, but the City was never notified. b, Councilman Greavu moved to deny the request to cancel the sewer rental late charge bill. Seconded by Councilman Murdock. Ayes - all. - 2 - 4/8 2. Building Plan Approval Extension - Bank and Office Building (White Bear Avenue) a. Manager Miller stated the applicants are requesting a time extension for construction of the Maplewood Bank Building from April 15 to July 15, 1976. The staff can see no reason why the extension should not be granted as there appear to be no changes in conditions since the deadline was set. b. Councilman Anderson moved to approve the time extension for construction of the Maplewood State Bank Building to July 15, 1976 subject to conditions of Seconded by Councilman Greavu. Ayes - all. 3. Parade Permit - White Bear Avenue Business Men's Association a. Manager Miller stated staff received a request from the White Bear Avenue Business Men's Association for a parade permit in conjunction with the Ramsey County Fair on July 29, 1976, from approximately 6:00 P.M. to 9:00 P.M. The Public Safety staff reports that Prosperity Road would better accomodate the projected volume of traffic than would Flandrau Street as a detour for White Bear Avenue. It is also pointed out that overtime payments for adequate police protection for the parade may be required. The Public Works staff reports that there may be a need for temporary "no parking" signing and barricade, the placement and removal of which will also require overtime. The staff feels that the parade route as suggested is acceptable if Prosperity Road is used as the detour rather than Flandrau -as proposed. It is therefore recommended that approval of the parade permit be given. b. Councilman Anderson mo Avenue Business Men's Asso as recommended by staff. Seconded by Councilman Wiegert 4. Building Plan and Site Reviews: the Parade Permit for the White Bear 9. 1976 from 6:00 P.M. to 9:00 P.M. Ayes - all. a. Victory of Christ Church (Gervais Avenue) 1. Board Member Hyland presented the following Community Design Review Board recommendation: "Board Member Howard moved the Community Design Review Baord recommend to the City Council the proposal for construction of a church building be approved as it is found to be in conformance with the Community Design Review Board Ordinance subject to the following conditions: 1. A culvert shall be installed at the Gervais Avenue access in accordance with the standards determined by the City Engineer; 2. A detailed plan for terraces to be installed on cut slopes toward the pond in order to prevent sedimentation from collecting in the pond shall be prepared and submitted to the staff for approval; 3. An additional landscape and site plan shall be submitted for staff review and approval indicating preservation of existing vegetation in the areas to be developed, substantial increase in landscaping and showing of the present grade together with the proposed changes in grade and drainage; - 3 - 4/8 4. Construction shall commence within 120 days of City Council approval; 5. The proposed freestanding sign shall be constructed in accordance with the Municipal Code; 6. If the parking lot is to be paved at any future date, a system of settling basins shall be installed as approved by the City Engineer for the purpose of reducing pollution of the pond; 7. A plan for the installation of security lights illuminating the parking lot shall be prepared and submitted to the staff for approval; 8. Owner and applicant shall agree to the above conditions in writing. Board Member Jones seconded. Ayes all." 2. Mr. Carl Elmquist, Elmquist Construction Company, spoke regarding the request and requested Council to approve the larger sign. 3. Councilman Murdock moved to approve the building and s Victory in Christ Lutheran Church subject to condtions as Seconded by Councilman Greavu. Ayes - all. b. Maplewood Office Park - Cope Avenue 1. Board Member Hyland presented the following Community Design Review Board recommendation: "Chairman Simkins moved that the Community Design Review Board recommend to the City louncil approval of the proposed Maplewood Office park as it is found to be in conformance with the Community Design Review Board Ordinance subject to the following conditions: 1. The third building phase which includes the three story building in the northerly 180 feet of the north parking lot is not a part of this recommendation for approval for the following reasons: A. The architectural design is not consistent with Phase I and II; B. The site does not provide adequate parking for a building of this size; C. The size of this building will physically and aesthetically dominate this site and detract from the other buildings; D. Phase III is not at this time required by the owner. 2. The freestanding Maplewood Office Park indentifcation signs to be revised to eliminate the two small sign panels on each end of the main sign. The tenant signing not to be approved until detailed information is received on location of the signing in relation to the building and on the sign construction; 3. Submit an additional landscape plan for staff review and approval indicating additional landscaping and site drainage and extension of the berm along Cope Avenue frontage; 4. Phase I construction shall commence within 120 days of City council approval in addition the special exception previously granted shall expire if construction of Phase I has not commenced within 120 days of Council approval; 5. Phase II construction shall commence within 12 months from the date occupancy is given for Phase I. 6. The ground identification signs proposed and the parking will conform with the City Code; - 4 - 4/8 7. The sidewalk and landscaping on the south property line along Cope Avenue shall be approved by the City Engineer; 8. The owner and applicant shall agree to the above conditions in writing. Board Member Huot seconded. Ayes all." 2. Mr. Carl Elmquist, Elmquist Construction Company, spoke regarding his request. 3. Councilman Anderson moved to approve the building and site plan for the Maplewood Office Park subject to the following conditions: 1. Submit an additional landscape plan for staff review and approval indicating additional landscaping and site drainage and extension of the berm along Cope Avenue frontage; 2. Phase I construction shall commence within 120 days of City Council approval in addition the special exception previously granted shall expire if construction of Phase I has not commenced within 120 days of Council approval; 3. Phase II construction shall commence within 12 months from date of occupancy of the second building for Phase I; 4. Phase III construction shall commence within 24 months from date of occupancy of the second building for Phase II; 5. The sidewalk and landscaping on the south property line along Cope Avenue shall be approved by the City Engineer; 6. The free standing Maplewood Office Park identification sign facing Highway 36, subject to a 15 foot setback, shall be allowed, subject only to logos. Any free standing Maplewood Office Park identification signs to be located on Cope Avenue to be revaluated thru the Com- munity Design Review Board and tenant signing not to be approved until detailed information is received on the location of the signing in relation to the building and on the sign construction; 7. The owner and applicant shall agree to the above conditions in writing. Seconded by Councilman Murdock. Ayes - all. c. M M Development Company - Second Building 1. Board Member Hyland presented the following Community Design Review Board recommendation: "Board Member Howard moved the Community Design Review Board recommend to the City Council approval of the building and site plan as presented to the Council on June 5, 1975 and approved subject to the conditions established by the Council at that meeting. Board Member Schulte seconded. Ayes all." 2, Mr, Jim Sorenson, representing M M Development Company, stated he wished to withdraw the letter dated March 30, 1976 that they submitted and he further stated the conditions of the Community Design Review Board are satisfactory, 3. Manager Miller presented four property assessment divisions for approval. b. Director of Public Works Collier explained the divisions. c. Division No. 050445 Councilman Greavu introduced the following resolution and moved its adoption: 76 -4 -58 WHEREAS, pursuant to Resolution 60 -9 -95 and 74 -8 -180 of the City Council of Maplewood, adopted September 1, 1960 and August 19, 1974, the special assess- ments for the construction of Sanitary Sewer No. 2 (1960) and Water Improve- ment 73 -1 (1974) were levied against the attached list of described properties; said list made a part herein; and WHEREAS, the above mentioned properties have been conveyed and are de- scribed according to the attached list, said list made a part herein; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the assessments for Sanitary Sewer No. 2 (1960) and Water Improvement 73 -1 (1974) against the heretofore mentioned properties be correctly certified to the Auditor of Ramsey County in the amounts stated on the attached list; said list made a part herein. Seconded by Councilman Wiegert. Ayes - all. d. Division No. 050854 Councilman Wiegert introduced the following resolution and moved its adoption: 76 -4 -59 WHEREAS, pursuant to Resolution 65 -8 -247, 71 -10 -216, 75 -8 -153 and 75 -8 -152 of the City Council of Maplewood, adopted August 25, 1965, October 7, 1971, August 14, 1975 and August 14, 1975, the special assessments for the construction of Sewer and Water No. 2 (1965) Sanitary Sewer lA (1972), Sewer and Water and Street 71 -6 (1975) and Street Improvement 71 -6 (1975) were levied against the attached list of described properties; said list made a part herein; and WHEREAS, the above mentioned properties have been conveyed and are de- scribed according to the attached list, said list made a part herein; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the assessments for Sewer and Water No. 2 (1965), Sanitary Sewer lA (1972), Sewer, Water and Street 71 -6 (1975) and Street Improvement 71 -6 (1975) against the heretofore mentioned properties be correctly certified to the Auditor of Ramsey County in the amounts stated on the attached list; said list made a part herein. Division No. 050860 Councilman Wiegert introduced the following resolution and moved its adoption; 76 -4 -60 WHEREAS, pursuant to Resolution 66 -9 -271 of the City Council of Maple- wood, adopted September 15, 1966, the special assessments for the construct- ion of Water Improvement No, 5 (1966) were levied against the attached list of described properties; said list made a part herein; and WHEREAS, the above mentioned properties have been conveyed and are de- scribed according to the attached list, said list made a part herein; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the assessments for Water Improvement No. 5 (1966) against the hereto- fore mentioned properties be correctly certified to the Auditor of Ramsey County in the amounts stated on the attached list; said list made a part herein. Division No, 050686 Councilman Wiegert introduced the following resolution and moved its adoption. 76 -4 -61 WHEREAS, pursuant to Resolution 70 -9 -130 of the City Council of Maplewood, adopted September 1, 1970, the special assessments for the construction of White Bear Avenue 69 -5 (1970) were levied against the attached list of de- scribed properties; said list made a part herein; and WHEREAS, the above mentioned properties have been conveyed and are de- scribed according to the attached list, said list made a part herein; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINN- ESOTA, that the assessments for White Bear Avenue 69 -5 (1970) against the heretofore mentioned properties be correctly certified to the Auditor of Ramsey County in the amounts stated on the attached list; said list made a part herein. Seconded by Councilman Anderson. Ayes - all. 6. Street Improvement - Furness Court (Final Plans) a. Manager Miller stated final plans for Furness Court have been completed and will be available for Council review. It is recommended that the final plans be approved and a bid opening date set for May 11, 1976. b. Director of Public Works Collier presented the specifics of the improve- ments. C. Councilman Wiegert introduced the fol adoption: resolution and moved its - 7 - 4/8 76 -4 -62 WHEREAS, pursuant to resolution passed by the City council on April 8, 1976, plans and specifications for Furness Court grading, paving and utilities, Maplewood Project No. 75 -8, have been prepared by (or under the direction of) the City Engineer, who has presented such plans and specifications to the Council for approval, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MAPLEWOOD, MINNESOTA: 1. Such plans and specifications, a copy of which are attached hereto and made a part hereof, are hereby approved and ordered placed on file in the office of the City Clerk. 2. The City Clerk shall prepare and cause to be inserted in the official paper and in the Construction Bulletin an advertisement for bids upon the making of such improvement under such approved plans and specifications. The advertisement shall be published twice, at least ten days before date set for bid opening, shall specify the work to be done, shall state that bids will be publicly opened and considered by the Council at 9:00 A.M., C.D.S.T., on the 11th day of May, 1976, at the City Hall and that no bids shall be considered unless sealed and filed with the Clerk and accompanied by a certified check or bid bond, payable to the City of Maplewood, Minnesota, for 5% of the amount of such bid. 3. The City Clerk and City Engineer are hereby authorized and instructed to receive, open and read aloud bids received at the time and place herein noted, and to tabulate the bids received. The Council will consider the bids, and the award of a contract, at the regular City Council meeting of May 13, 1976, ADVERTISEMENT FOR BIDS The City Council of Maplewood, Minnesota, will receive sealed bids for Maplewood Project No. 75 -8 for the construction of approximately: 280 Tons Bituminous Paving 265 Lineal Feet V.C. Pipe Sewer 245 Lineal Feet 6" D.I.P. Water Main 700 Lineal Feet B618 Concrete Curb and Gutter all within the City limits on a basis of cash payment for the work. Bids will be received until 9:00 A,M., C.D.S.T, on the 11th day of May, 1976, at the Municipal Building, 1380 Frost Avenue, Maplewood, Minnesota, at which time and place all bids will be publicly opened, read aloud and considered. Proposals must be placed in a sealed envelope with the statement thereon indicating proposal for bid contained within and addressed to the City of Maplewood, Minnesota. Proposals shall be submitted to the City Clerk on or before the above stated time. Proposal is for the furnishing of all labor, equipment and materials and performing all work in connection with the above stated construction. Proposal forms, including specifications, are on file in the office of - 8 - 4/8 the City Engineer, City of Maplewood, 1380 Frost Avenue, Maplewood, Minn- esota, 55109. Copies of the document may be obtained by depositing Fifteen Dollars ($15.00) with the Engineer, The amount of deposit for one set of documents will be refunded upon return of the plans and documents in good condition within ten days after the opening of bids. All bids must be accompanied by a certified check or bid bond, payable to the City of Maplewood, Minnesota, in an amount equal to five per cent (5%) of the total bid, conditioned that if the bidder is the successful bidder, he will enter into a contract in accordance with said bid and will furnish such performance bonds as are specified. No bidder may withdraw his receipt of bids without the consent of the owner. The City reserves the right to reject any or all bids and to waive any informalities in bidding, and further reserves the right to award the contract in the best interest of the City. Mrs. Lucille E. Councilman Murdock requested staff to monitor the maintenance and operational costs of the McMenemy sewer problem for last year. b. Staff will investigate. 2. Rules of Procedures a. Councilman Creavu stated that if a Councilman is late to a meeting and Approval of Agenda has been completed, does that mean he cannot put additional items on the Agenda. It happened to him the meeting of March 25, 1976 and he had four items to discuss. b. Mayor Bruton explained that if a Councilman is late to a meeting and misses Approval of Agenda, the Rules of Procedures can be waived to place his items on the Agenda. 3. Resignations a. Mayor Bruton moved to accept with from the Planning Commission and that his faithful, valuable service. Seconded by Councilman Wiegert "..L. Manager Miller stated the Northeast Area Transportation Study has been completed and is available for review. A copy is included in each Council member's packet. It is recommended that the study be referred to the Planning Commission for review. 2. Councilman Wiegert moved to refer the Northeast Area Transportation Study to the Planning Commission for review. Seconded by Mayor Bruton. Ayes - all. b. Communication - Sewer Board 1. Manager Miller stated he had received a communication from the Metro- politan Waste Control Commission requesting a meeting with the City to discuss the Carver Lake Interceptor. 2. Council instructed the Manager to invite the Waste Control Commission to the April 22, 1976 meeting. M. ADJOURNMENT 10:10 P.M. C «tip J - 10 - 4/8 TABULATION OF BIDS Pursuant to due call and notice thereof, a special meeting of the officials de- ignatecl for a bid opening by the City Council of Maplewood was convened at 9:00 A.M., C.S.T., Tuesday, April 20, 1976. The purpose of this meeting was to receive, open and publicly read aloud bids for construction of Sterling Street, Improvement 76--2. Present were William C. Cass and Dennis L. Peck.
