CALL TO ORDER A regular meeting of the City Council of Maplewood, Minnesota was held in the Council Chambers, Municipal Building and called to order at 7:32 P.M. by Mayor Bruton. B. ROLL CALL Robert T. Bruton, Mayor Present Norman G. Anderson, Councilman Present John C. Greavu, Councilman Present Burton A. Murdock, Councilman Present Donald J. Wiegert, Councilman Present APPROVAL OF MINUTES 1. Minutes No. 76 -7 (February 26, 1976) a. Councilman Anderson moved that the Minutes of Meeting No. 76 -7 (February 26, 1976) be approved as submitted. Seconded by Councilman Wiegert. Ayes - all. b. Councilman Anderson requests more detail be put in the Minutes for Council Presentation items, D. APPROVAL OF AGENDA Councilman Wiegert moved to approve the Agenda as amended: 1. Minutes 2. Maplewood Heights Water System 3. Holloway Avenue Improvement 4. Procedures on Selection of Personnel 5. Reproduction in City Hall 6. Highway 36 and Hazelwood Avenue 7. Frost Avenue 8. E. PUBLIC HEARINGS None. - 1 - 3/11 F. AWARDING OF BIDS 1. Diseased Tree Removal a. Manager Miller presented the staff report and recommended that all bids be rejected and staff be authorized to modify specifications and to readvertise. b. Mr. Ron Petite, owner and operator of Anishinabe Enterprises, Inc., spoke regarding his bid, c. Councilman Murdock moved to reject the bids and to authorize staff to modi the specifications and to readvertise the bids for the Diseased Tree Removal Program. Seconded by Councilman Wiegert. d. Following the detailed review of the bids, Councilman Murdock withdrew his motion and Councilman Wiegert his second. e. Councilman Greavu moved to table this matter for one week for a more detailed breakdown. Seconded by Councilman Murdock. Ayes - all. 2. Backhoe /Loader a. Manager Miller presented the staff report. b. Councilman Murdock introduced the following resolution and moved its adoption: 76 -3 -43 BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the bid of Midway Tractor in the amount of $30,140.00 is the lowest responsible bid for the purchase of one (1) Intergral Backhoe /Loader, and the Mayor and Clerk are hereby authorized and directed to enter into a contract with said bidder for and on be- half of the City. Seconded by Councilman Greavu. Ayes - all. G. APPROVAL OF ACCOUNTS Councilman Wiegert moved that the accounts (Part I - Fees, Services, Expenses - Check No. 017892 through Check No. 018014 - $118,955.88; Check No. 1311 through Check No. 1326 - $29,903.43: Part II - Payroll - Check No. 10595A through Check No. 10689 - 819 187.96) in the amount of 181.247.27 be paid as submitted. Seconded by Mayor Bruton. Ayes - all. H. UNFINISHED BUSINESS 1. Subdivision (Final Plat) - DeSoto Park a. Manager Miller presented the staff report and further stated that the staff - 2 - 3/1.1 sees no unusual circumstances involved in the Desoto Park plat which would jus- tify a release from the requirement to provide escrow money for public improve- ments. It is felt that the allowance of a variance in this case would set a precedence for all other subdivision platting within the City of Maplewood. It is therefore recommended that a variance not be granted. The legal staff in- dicates that if a variance is to be considered officially, a public hearing is required. b, Mr, Richard Schreier, the owner, spoke regarding his request. c. Councilman Murdock moved to approve the final Plat of DeSoto Park with lots 1 through 6 and lots 22 through 28 to be the lots in the Plat with the remainin sed street to be combined into 1 Seconded by Councilman Wiegert, Ayes - all, 2. Business and Commercial (Modified) Zone - Ordinance a. Manager Miller presented the ordinance for second reading and final adoption, b. Councilman Anderson introduced the following ordinance and moved its adoption: ORDINANCE NO. 394 AN ORDINANCE AMENDING CHAPTER 907 OF THE MUNICIPAL CODE ESTABLISHING A BUSINESS AND COMMERCIAL (MODIFIED) BC (M) COMMERCIAL DISTRICT THE COUNCIL OF THE CITY OF MAPLEWOOD DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Section 907.050 is added to the Maplewood Municipal Code Chapter 907, 907.050. BC (M) COMMERCIAL DISTRICT. In a BC (M) Commercial District the following regulations shall apply: 1. USE REGULATIONS. A building may be erected or used, and a lot may be used or occupied, for any of the following purposes, and no other: (a) Retail Store; professional and administrative offices; bank or savings and loan; personal service, craftsmen's shop, mortuary; (b) Hotel, motel; (c) Theater, walk in; (d) Job printing shop; (e) Bakery or candy shop producing goods for on- premise retail sale. 2. The following uses when authorized by the lawful governing body by means of a special use permit: (a) All uses permitted in R -3 Residence Districts, except the con- struction of dwelling houses permitted in 904, R -1 and 905, R -2; (b) Laundromat or similar automatic self- service laundry; - 3 - 3/11 (c) Restaurant; (d) Place of amusement, recreation, or assembly other than a theater. 3. Prohibited uses: (a) Drive -in theaters, drive -in restaurants; (b) Commercial or fee parking lots where such use is the only use of a given parcel or where such use provides for general rather than specific use parking. 4, Definitions: (a) Drive -in restaurant. The City Council hereby finds that certain restaurants, due to their particular nature, related activity patterns, or similar factors, have the potential for creating special problems. Restaurants which are heavily oriented to the automobile for their clientel, restaurants which customarily de- velop single purpose buildings or buildings physically designed and constructed to provide specialized identification require par- ticular review to assure compatibility with existing and proposed uses, proper relationship to area traffic and access systems, com- patibility with the community's Comprehensive Plan and to avoid, where possible, problems of potential subsequent use of the pro- perty and its improvements, Section 2. This ordinance shall take effect and be in force from and after its passage and publication as provided by law. Seconded by Councilman Murdock. Ayes - all. C, Councilman Anderson moved to set a date of April 29, 1976 for a public hear- ing to propose the Business Commercial (Modified) Zone District to the south side of Beam Avenue between White Bear Avenue and Hazelwood Avenue. Seconded by Councilman Murdock. Ayes - all. d. Copies of the Ordinance will be available to the public. I. VISITOR PRESENTATIONS 1. Lake Improvement Association a. Mr. Don Watson, Lakes Improvement Association (formerly known as Kohlman, Keller, Gervais Club) requested there be a comprehensive study of the Kohlman, Keller and Gervais Lakes. The Pollution Control Agency has funds available through the EPA and can perhaps be obtained if a study is submitted to them. Little Canada has been contacted and indicated they will contribute matching funds with whomever would contribute. b. Mr. Dan Schadt, Ramsey County Engineering Department - Environmental Ser- vices, stated they have a three stage approach for a situation such as this. - 4 - 3/11 1) Identify the problem (run samples, etc. for a period of a year); 2) Develop a program to clear up the lakes; 3) Actually do the work. The request is for Little Canada, Maplewood and Ramsey County to form a joint agreement to fund the program, The testing program will be approximately $5,000.00. c. Councilman Wiegert moved to refer to staff the possibility of $2,000.00 being in the Budget to apply towards the fund for the comprehensive study. Seconded by Councilman Anderson. Ayes - all. d. Councilman Wiegert introduced the following resolution and moved its adoption: 76 -3 -44 WHEREAS, it appears the quality of the water in Kohlman, Keller and Gervais Lake is below the desired quality; THEREFORE, BE IT RESOLVED, that the City Council of Maplewood, Minnesota, supports the concept of a comprehensive study relative to determining the quality and quantity of the water in the Kohlman, Keller, Gervais Lakes but are unable to provide funding. FURTHER, BE IT RESOLVED, that Ramsey County be requested to consider funding the study. Seconded by Councilman Anderson. Ayes - all. J. NEW BUSINESS 1. Building Plan Review - 2600 White Bear Avenue (Plastic Greenhouses) a. Board Member Lloyd Parsons presented the following Community Design Review Board recommendation: "Board Member Parsons moved the Community Design Review Board recommend to the City Council the proposal for greenhouses be found in conformance with the Com- munity Design Review Board Ordinance subject to the following conditions: 1. The building to be maintained in good condition at all times and reviewed at least annually by the City staff with a report of the condition submitted to the City Council which will have the option to require the removal of the structure if not maintained properly; 2. The applicant to submit a detailed landscape plan for review by the staff indicating permanent type landscaping to provide screening of the building; 3. Because of the nature of the building and its potential as a fire hazard, the applicant be informed of the necessity to submit to the Fire Marshal all of the required data as it relates to Fire Codes; 4. Owner and applicant agree to the above conditions in writing. Board Member Jones seconded. Ayes 6; Nay 1 (Board Member Schulte)" - 5 - 3/11 b. Mr. Luther Hochradel, Windsor Landscaping, stated the only condition he disagreed with was No. 2. There would be trees in containers during summer months, but none in the winter months. C. Councilman Greavu moved to approve the building plan review for a plastic greenhouse at Windsor Landscaping, 2600 White Bear Avenue, subject to the fol ing conditions: 1. The building to be maintained in good condition at all times and reviewed atleast annually by the City staff with a report of the condition submitted to the City Council which will have the option to require removal of the structure if not maintained properly; 2. The applicant to provide plantings in area of greenhouses; 3. Because of the nature of the building and its potential as a fire hazard, the applicant be informed of the necessity to submit to the Fire Marshal all of the required data as it relates to Fire Codes; 4. Owner and applicant agree to the above conditions in writing. Seconded by Councilman Murdock. Ayes - Councilmen Anderson, Greavu, Murdock and Wiegert. Nays - Mayor Bruton. Motion carried. 2. Sign Review - 2626 White Bear Avenue (Larry's Live Bait) a. Manager Miller presented the staff report and recommended Council adopt the recommendation of Community Design Review Board. b. Board Member Lloyd Parson presented the following Community Design Review Board recommendation: "Board Member Schulte moved the Board recommend to the City Council the proposal for signing at 2626 White Bear Avenue be found in conformance with the Community Design Review Board Ordinance subject to the following conditions: 1. The four signs on the mansard roof and the LP gas sign on the north wall shall be the only allowable signs and all other signs are prohibited; 2. Banners and pennants are prohibited except for grand openings and sales limited to a period of 10 days not to exceed four a year; 3. Any sign lighting installed later will not cause any undue glare or re- flection and will be extinguished after business hours. Said lighting plan to be reviewed and approved by staff; 4. Owner and applicant agree to the above conditions in writing. Board Member Huot seconded, Ayes all." C. Councilman Greavu moved to approve the sign for Larry's Live Bait, 2626 White Bear Avenue subject to the recommendations of the Community Design Review Board. Seconded by Councilman Wiegert. Ayes - all. - 6 - 3/11 3, Water Systems Improvements - 1976 a. Manager Miller. stated Council has received the feasibility study for the 1976 Water System Improvements, A representative of Kirkham - Michael is present to report and answer questions. It is recommended that the Council study the various methods of financing and construction prior to setting a public hearing date. b. Mr. Jim Wiley, Kirkham and Michael Associates, explained the report and an- swered questions from the Council. C. Councilman Murdock introduced the following resolution and moved its adoption: 76- 3 -45 RESOLVED, that the feasibility study for the Water Systems Improvement, Pro- ject 75 -16, prepared by Kirkham - Michael and Associates, is hereby accepted and an informal meeting to discuss the report is hereby scheduled for April 6, 1976, Seconded by Councilman Wiegert, Ayes - all, 4. Special Use Permit (Office /Warehouse) - Ordinance a. Manager Miller presented the staff report and recommended that a public hear- ing date be set for April 29th. b. Mayor Bruton moved to establish April 29, 1976 as the date to hold a public hearing for the proposed Office /Warehouse Ordinance, Seconded by Councilman Wiegert. Ayes - all. 5. Assessment Correction a. Manager Miller stated on December 18, 1975, the Council passed a resolution whereby those home owners in Tilsen's Maplewood Heights No. 8 were relieved of certain assessments arising from the Lydia Avenue improvement. It would appear that the County Auditor misinterpreted the Council's intentions and that the payables in 1976 were taken off the tax rolls, but the balance of the assessments were not removed. The staff recommends that the resolution be amended to include at the end the following: "And all remaining balances on properties involved shall be hereby cancelled ". This will clear up the problem we are presently having. b. Councilman Murdock introduced the following resolution and moved its adoption: 76 -3 -46 WHEREAS, by its Resolution dated and adopted the 18th day of December, 1975, the Council of the City of Maplewood, Ramsey County, Minnesota, sought to cancel all assessments for Maplewood Project No, 72 -17 in ROBERT TILSEN'S MAPLEWOOD HEIGHTS NO. 8; and WHEREAS, the Ramsey County Department of Property Taxation merely struck the assessment payable in 1976 from the assessment rolls rather than cancel the entire assessment; NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Maplewood, Ramsey - 7 - 3/11 County, Minnesota that the Ramsey County Department of Property Taxation be directed to cancel in its entirety, the assessments for Maplewood Project No. 72 -17 insofar as the same may pertain to the parcels situated in ROBERT TILSEN'S MAPLEWOOD HEIGHTS NO. 8. Seconded by Councilman Anderson. Ayes - all. 6. 1975 and 1976 Financial Transfers a. Manager Miller presented the year in financial transfers and recommended they be approved. b. Councilman Murdock moved to in the staff report. Seconded by Councilman Wiegert financial transfers as recommended Ayes - all. c. Mayor Bruton moved to set a "shirt sleeve" session for March with Finance Officer Don Ashworth to discuss the City's finances, leaves to take a managerial position with the Citv of Chanhassen. Seconded by Councilman Murdock. Ayes - all. K. COUNCIL PRESENTATIONS 1. Minutes a. Discussion was held regarding having more detail in the Council Presentations portion of the Minutes and the possibility of publishing a more simplified resume to the paper. b. Ayes - all. 2. Maplewood Heights Water a. Mayor Bruton stated he had met with the North Saint Paul Council and they had discussed the situation of the Maplewood Heights area staying with the North Saint Paul water system. b. Mayor Bruton introduced the following resolution and moved its adoption: 76- 3 -47 RESOLVED, by the City Council of Maplewood, Minnesota to remain with the North Saint Paul water system; and HEREBY authorize the staff to proceed with contract negotiations. Seconded by Councilman Wiegert. Ayes - all. Mayor Bruton moved to suspend the Rules of Procedures to continue the Agenda items until Midnight. - 8 - 3/11 Seconded by Councilman Wiegert. Ayes - all. 3. Holloway Avenue Improvements a. Mayor Bruton wished to know if the Council were willing to take State Aid designation off of other streets in Maplewood and apply it to Holloway, which is a total County Road and the County does not have the money to pay for construction. b. Councilman Anderson moved to cancel the hearing date of March 18, 1976 for the Holloway Avenue Improvements. Seconded by Councilman Murdock. Ayes - all. 4. Foreman Selection Procedure a. Councilman Greavu raised the question of the fairness of the selection of the Parks and Recreation Foreman. b. Manager Miller reviewed in general the procedures. C. Council discussed the matter. d. Manager Miller will provide a copy of the written test to the Council. Mayor Bruton moved that all items left on the Agenda be carried over to next meeting of March 18. 1976.
