CALL TO ORDER A regular meeting of the City Council of Maplewood, Minnesota, was held in the Council Chambers, Municipal Building and was called to order at 7:32 P.M. by Mayor Bruton. B. APPROVAL OF MINUTES 1. Minutes No. 76 -5 (February 12, 1976) Councilman Anderson moved to approve the Minutes of Meeting No. 76 -5 (February 12 1976) as submitted. Seconded by Councilman Wiegert. Ayes - all. 2. Minutes No. 76 -6 (February 19, 1976) Councilman Wiegert moved to approve the Minutes of Meeting No. 76 -6 (February 19 1976) as submitted. Seconded by Councilman Anderson. Ayes - all. Carver Lake Interceptor Seconded by Councilman Anderson. Ayes - all. PUBLIC HEARINGS None. - 1 - 2/26 F. AWARDING OF BIDS 1. Backhoe a. Manager Miller stated bids were opened on February 17, 1976, for the ac- quisition of one (1) Integral Backhoe /Loader. Attached is a list of bids. It is recommended that the low bid of Midway Tractor Company for a Ford Backhoe/ Loader in the amount of $32,140.00 be accepted. This amount has been included in the 1976 budget and will come from the Street Maintenance Department and the Utility Fund. b. Councilman Anderson moved to table for two weeks to allow staff to investi- gate other alternatives. Seconded by Councilman Greavu. Ayes - all. G. APPROVAL OF ACCOUNTS Councilman Wiegert moved to approv Check No. 017688 through Check No No. 1310 - $561,091.19: Part II - $33,874.97) in the amount of $727, Seconded by Councilman Anderson. H. UNFINISHED BUSINESS 1. Section 8 - Rent Assistance Program ccounts (Part I - Fees, Services, Expenses - 1 - $132,362.51; Check No. 1274 through Check 1 - Check No. 10493 through Check No. 10595 - be Daid as submitted. Ayes - all. a. Manager Miller presented the staff report and further stated the Section 8 program appears to accomplish what the Council has previously indicated as a desirable situation. It provides utilization of existing units constructed by the private sector. It lessens the need for "public housing" and distributes this type of housing throughout the community. It takes no units off the public tax rolls. The details of exactly how the program will be carried out can be covered at another time and must not necessarily be dtermined now. It is there- fore recommended that the Council adopt the proposed resolution which was in- cluded in my report of February 19. b. Mayor Bruton read a letter of support from the Maplewood Human Relations Commission. C. Chairman Janet Kampf presented the Maplewood Human Relations Commission re- commendations and answered questions from the Council. d. Mr. Dwight Jessup presented the Maplewood Housing and Redevelopment Author- ity's report and answered questions from the Council. Mr. Bill Nemitz, Maplewood H.R.A., also spoke. e. Councilman Anderson introduced the following resolution and moved its adoption: 76 -2 -42 - WHEREAS, the Metropolitan Council has been duly organized pursuant to Minn - esota Statutes Section 473.08, Subd. 3, Section 473B.06, Subd. 14, and has all of the powers and duties of a housing and redevelopment authority pursuant to Laws 1974, Chapter 359 under the provisions of the Municipal Housing and Redevel- opment Act, Minnesota Statutes, Sections 462.411 to 462.711, and acts amendatory - 2 - 2/26 thereof; and WHEREAS, the City of Maplewood and the Metropolitan Council desire to assist lower income families and elderly to obtain adequate housing in the City of Maple- wood at a price they can afford, and to accomplish this purpose desire to apply for federal funds to undertake a program of subsidizing rent payments to land- lords who provide adequate housing to such individuals and families. NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF MAPLEWOOD that the Metropolitan Council is hereby authorized to include the City of Maplewood in its application for federal funds to implement a program of rental assistance to lower income families and elderly, and that upon federal approval of such application, the City of Maplewood and the Metropolitan Council will enter into an agreement for operating the program within the City. Seconded by Mayor Bruton. Ayes - all. I. VISITOR PRESENTATIONS 1. Maplewood Moose Lodge a. Mr. Don Denly and Mr. Harold Bunde; representatives of Maplewood Moose Lodge, invited Council to the opening day of the Moose International Bowling Tournament to be held at the Maplewood Bowl starting in April. Also requested the Mayor to write a letter of welcome to be included in the tournament brochure. J. NEW BUSINESS 1. Building and Site Plan Review - Winchell's Donut House (Rice and Larpenteur) a. Manager Miller stated Council had received a letter from Winchell Donut House agreeing to all the recommendations given by the Community Design Review Board. b. Board Member Don Hoot presented the following Community Design Review Board recommendation: "Chairman Simkins moved the Board recommend to the City Council approval of the plans for Winchell Donut House, Rice and Larpenteur, subject to the following conditions: 1. Extend the parapet wall around the rear elevation of the building to provide screening of the roof top equipment; 2. Rotate the proposed trash enclosure 90 degrees to face the south and provide screening in all directions; 3. All utilities serving the site should be under grounded when entering the property; 4. Security cover for the entire length of the roof top ladder shall be provided; 5. Submit a drainage plan for review and approval by the City Engineer; 6. Relocate the free standing sign in the vicinity of parking stall #1 in order to observe the 15 foot setback requirement and provide in this area a continous curb and landscaped area adjacent to the sign. The sign shall be redesigned as a ground sign. Maximum height of the sign shall be 9 feet 6 inches sitting on a one foot high base with the "24 hour" sign omitted and the design of that submitted to staff for their approval. Wall signs are approved for the west elevation only. All other signs are prohibited. - 3 - 2/26 7. Submit a revised landscaping plan for staff review and approval in- dicating additional trees to be planted along the street frontage and landscaping adjacent to the ground sign and north property line. Pro- vide a 6 foot wide concrete walk diagonally through the landscaped area within the property line adjacent to the ground sign. 8. Applicant and owner shall commence construction within 120 days of the date of the City Council approval of plans. 9. Exterior lights, except for security lighting, to be extinguished after business hours. Provide additional security lighting on the east and north elevations of the building. The City shall retain the right to review and to require modifications subsequent to the completion of the building any exterior lighting which may cause any undue glare and re- flection and to require ground,lighting on the perimeter of the site if necessary. 10. Remove existing curb along south edge of the property line located half way between the property line and Larpenteur Avenue curb upon approval of the County Highway Department. 11. Owner and applicant agree to the above conditions in writing. Board Member Howard seconded. Ayes - all." C. Mr. Richard Evans, Winchell Donut House, spoke stating he agreed to the con- ditions. d. Mayor Bruton thanked Mr. Evans for his cooperation. e. Councilman Anderson moved to approve the building and site plan review for Winchell Donut House. Rice Street and Larpenteur Avenue. subject to the recom- Seconded by Councilman Wiegert. Ayes - all. 2. Sign Review - 1806 North St. Paul Road (Imported Auto Parts - Champion Auto Stores) a. Board Member Don Huot presented the following Community Design Review Board recommendation: "Board Member Hyland moved the Board recommend to the City Council the proposal of the Imported Auto Parts /Champion Auto be found in conformance with the Commun- ity Design Review Board Ordinance subject to the following conditions: 1. The wall signs on the west, south and north elevation shall be the only allowable sings, the free standing sign be removed. The tops of the Im- ported Auto Parts sign on the north elevation and tops of the Champion Auto Store signs on the west elevation and on the south elevation shall be situated two feet below the top of the parapet. 2. The entire building to be repainted. 3. The illumination of the wall sign to be extinguished after regular business hours. - 4 - 2/26 4. Lighting for the Imported Auto Parts sign on the west elevation shall be strip fluorescent mounted above the sign and shielded in a manner so it shines on the sign only and not cause glare. 5. Trash shall be stored and screened from view in an enclosure constructed of material architecturally compatible with the main structure. 6. Parking spaces shall be 10 by 20 feet. 7. Manager Miller stated Tilsen's Maplewood Heights 116 was approved with two dimensions interposed. It is recommended that the Council authorize the proper dimensions to be placed on the lot lines and the approval forwarded to the plat commission for final resolution. b. Mayor Bruton moved to authorize the proper dimensions be placed on the lot lines of Robert Tilsen's Maplewood Heights No 6 and that the approval be for- warded to the Plat Commission of Ramsey County. Seconded by Councilman Wiegert. Ayes - all. 4. Final Plat Approval - DeSoto Park a. Manager Miller stated the final plat for DeSoto Park has been completed and is basically in accordance with the preliminary plat. The escrow and construction agreement has been verbally agreed upon by City staff and the developers. It is recommended that the final plat be approved subject to written approval of the - 5 - 2/26 agreement by the developer and assurances of escrowed moneys to pay for the public improvements in accordance with City ordinances. b. Mr. Richard Schreier, developer, requests permission from the Council to sell the exterior lots before escrowing the monies to construct the interior streets. c. Councilman Wiegert moved to table Item J -4 for two weeks to allow for further staff investigation. Seconded by Councilman Anderson. Ayes - all. 5. Sale of Vehicle - Fire Marshal a. Manager Miller stated the Fire Marshal's 1972 Plymouth station wagon will be replaced by a 1976 Matador sedan in the next few weeks. Gladstone Fire Department has requested that they be considered as a purchaser for the old Fire Marshal's car to be placed in their use as a contract fire department to the City. Staff recommends that the City louncil authorize the sale of this vehicle to the Gladstone Fire Department for $1,200.00. b. Councilman Greavu moved to offer the three fire departments to bid on the Fire Marshal's vehicle, starting bid to be $1,200 and staff be authorized to to the highest bidder. Seconded by Councilman Anderson. Ayes - all. 6. Appointments - Commission a. Parks and Recreation Commission 1. Manager Miller stated four applications were received for two Park Com- mission vacancies. The Commission recommends the appointment of James McKenzie (1014 South Crestivew Drive) for the three year term and Tom Christensen (1834 East Summer Avenue) for the two year term. 2. Planning Commission d to accept the recommendation of the P. int James McKenzie to a three year term term to fill the vacancies on the Park Ayes - all. 1. Manager Miller presented the following Planning Commission recommendation: "Commissioner Waldron moved the Planning Commission recommend to the City Council the names of Terry Holt and Joseph Pellish for consideration to fill the vacancy on the Planning Commission created by the resignation of Roger Singer. Commissioner Fischer seconded. Ayes - all." - 6 - 2/26 2. Councilman Greavu moved to appoint[ Joseph.Pellish'to a three year Seconded by Councilman Anderson. K. COUNCIL PRESENTATIONS 1. Planning Commission Mayor Bruton moved to accept the ning Commission and that a lette Seconded by Councilman Greavu. 2. Change in Aid Formula Ayes - all. Lori of Ayes - all. from Mayor Bruton stated he had received a resolution proposed by Apple Valley re- garding change in Aid Formula on the question of what census is to be used in making distributions. Councilman Greavu reported on a meeting he had attended pertaining to this subject. Council will wait to take any action to see if the League is proposing anything. 3. Power Line Representative Mayor Bruton stated he will contact Mr. Bob Hajicek to see if he would be inter- ested. 4. McKnight Road and Burns Avenue Councilman Greavu wishes to know if anything has been heard from the State or County relative to the signals at McKnight Road and Burns Avenue. Staff to investigate. 5. Report - Lake Clean -Up Committee Councilman Wiegert reported on a meeting held by the residents around Kohlman, Gervais and Keller Lakes regarding lake quantity and quality. This committee may seek help from Maplewood. 6. Paramedics Councilman Anderson questioned if there shouldn't be two men operating a Para- medic vehicle. Staff stated there are usually two men per unit. L. ADMINISTRATIVE PRESENTATIONS 1. Carver Lake Interceptor a. Manager Miller stated at the last meeting Council ordered a feasibility study for sewer and water construction along the alignment of the Carver Lake Interceptor - 7 - 2/26 and also sent a resolution to the Metropolitan Waste Control Commission. The Commission has advised us that if Maplewood is serious in their proposal it will result in a five to ten year delay in construction of the interceptor. b. Mayor Bruton explained, the the people present, the background of this proposal. c. Ms. Irene Gonzagowski, 2575 Carver Avenue, and Mr. James Miller, 2413 Carver Avenue, spoke regarding the proposal. d. Manager Miller stated his adivse now is to place the feasibility report into a "holding" situation and wait to see how the Metropolitan Waste Control Commiss- ion proceeds. 2. Community Education - Report a. Manager Miller presented a memorandum prepared by the staff of the communities involved in Community Education. Changes to the proposal were recommended. Mayor Bruton, Councilman Anderson and Director of Community Services Eric Blank will attend the meeting on Saturday, February 28, 1976 and present Maplewood's views. 3. Staff Manager Miller reported to the Council on questions previously raised. 4. Dog Ordinance a. Manager Miller stated staff contacted a local veterinarian and these are his recommendations: 1. A puppy should have his first vaccination at about 3 months; 2. One year later (15 months of age) a follow up shot should be administered; 3. While some shots will have an effective life of three years, it is generally felt that the certain life is two years, so a vaccination every two years after 15 moniths of age is recommended. b. No action taken. 5. A gentleman in the audience questioned the procedures of obtaining a sign installers license and permits. Staff answered his questions. M. ADJOURNMENT 10:45 P.M.
