Availability Charge 1976 k MINUTES OF MAPLEWOOD CITY COUNCIL 7:30 P.M., Thursday, January 22, 1976 Council Chambers, Municipal Building Meeting No. 76 -3 CALL TO ORDER A regular meeting of the City Council of Maplewood, Minnesota, was held in the Council Chambers, Municipal Building and was called to order at 7:32 P.M. by Mayor Bruton. APPROVAL OF MINUTES 1. Minutes No. 76 -1 (January 8, 1976) Councilman Wiegert moved that the Minutes of Meeting No. 76 -1 (January 8, 1976) be approved as submitted. Seconded by Mayor Bruton. Ayes - all. 2. Minutes No. 76 -2 (January 15, 1976) Councilman Anderson moved that the Minutes of Meeting No. 76 -2 (January 15, 1976) be approved as submitted. Seconded by Councilman Wiegert. Sewer Cleaning - Clarification 6. Frost Avenue 7. 49'ers Contract Seconded by Councilman Anderson. Ayes - all. E. PUBLIC HEARINGS None. AWARDING OF BIDS - 1 - 1/22 1. Vehicle - Fire Marshal a. Manager Miller stated the staff has been adivsed that the previous net data$4,004.58 per unit received for two American Motors Matador four door sedans for police cruisers is still open for the purchase of additional vehicles. The Fire Marshal has examined the vehicle and determined that it will be adequate to meet the needs of his office. The replacement of the Fire Marshal's station wagon is included in the 1976 budget. It is recommend- ed that the Council authorize the purchase of one additional four door American Motors Matador. b. Mayor Bruton introduced the following resolution and moved its adoption: 76 -1- 12 BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the bid of Grand AMC Jeep, 654 University Avenue, St. Paul, Minnesota, in the amount of $4,004.58 is the lowest responsible bid for the purchase of one 4 door American Motors Matador sedan to be used as Fire Marchal's car and the Mayor and Clerk are hereby authorized and directed to enter into a contract with said bidder for and on behalf of the City. Seconded by Councilman Wiegert. Ayes - all. G. APPROVAL OF ACCOUNTS Councilman Greavu moved that the accounts (Part I - Fees Services Expenses - Ch No. 17269 through Check No. 17445 - $110,727.10; Check No 1207 through Check No 1247 - $55,994.33: Part II - Payroll Check No. 10163 through Check No 10263 - $31,206.04) in the amount of $197.927.47 be Daid as s„bmitrPA_ Seconded by Councilman Wiegert. Ayes - all. H. UNFINISHED BUSINESS 1. Street Improvement ( Median) - White Bear Avenue a. Manager Miller stated staff has received correspondence from the County re- garding the requested median proposal on White Bear Avenue between Cope Avenue and County Road B. If the Council wishes to proceed with the project, it is recommend- ed that an informational meeting date be established. b. Councilman Wiegert moved that Ramsey County be advised that the Council is inclined to agree with the County's findings and to ask what solutions if an they have. Seconded by Councilman Anderson. Ayes - all. 2. Regular Council Meeting Dates - Ordinance (Adoption) a. Manager Miller stated the ordinance establishing the second and fourth Thurs- days of each month as the regular meeting dates of the Council was placed on first reading on January 15. Second reading and adoption is recommended. b. Mayor Bruton introduced the following ordinance and moved its adoption: - 2 - 1/22 ORDINANCE NO. 393 AN ORDINANCE ESTABLISHING CHAPTER 212 OF THE MAPLEWOOD MUNICIPAL CODE ESTABLISHING REGULAR COUNCIL MEETING DATES IT IS HEREBY ORDAINED by the City Council of the City of Maplewood, as follows: Section 1. That Chapter 212 of the Municipal Code is hereby established reading as follows: 212.010. REGULAR. MEETINGS. The Maplewood City Council shall hold regular meetings on the second and fourth Thursdays of each month at 7:30 P.M., provided that said date does not fall on a date designated by law as a legal holiday. Section 2. This Ordinance shall take effect and be in force from and after its passage and publication as provided by law. Seconded by Councilman Anderson. Ayes - all. I. VISITOR PRESENTATIONS None. NEW BUSINESS 1. Traffic Control (Street Signs) - Larpenteur Avenue and Prosperity Road a. Manager Miller stated the County of Ramsey has studied the intersection of Larpenteur Avenue and Prosperity Road for the past year at the request of the Home and School Association of Presentation of the Blessed Virgin Mary Church. The traffic accident history and traffic volumes are marginal as to the warrants to change the existing controls. The County Engineering Department believes some benefits may be derived from a four -way stop control at Larpenteur and Prosperity. Normal experience with the installation of the four -way stop sign configuration at this type of location is a decrease in right -angle accidents and a decrease in the severity of accidents with an increase to rear -end accidents. The staff concurs that a four -way stop at this location would appear to be benefic- ial and recommends the City Council to request this installation by Ramsey County. b. Councilman Anderson introduced the following resolution and moved its adoption: 76- 1 -13 WHEREAS, a year -long traffic study of the intersection of Larpenteur Avenue and Prosperity Road by the Ramsey County Engineer has been completed; and WHEREAS, the results of said traffic study indicate that some benefit will accrue from the installation of four -way stop signs; - 3 - 1/22 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the County of Ramsey is hereby requested to install four -way stop signs at said intersection. Seconded by Mayor Bruton. Ayes - all. 2. Parking Control - Larpenteur Avenue and McMenemy Street a. Manager Miller stated the Ramsey County Traffic Engineer has reported numerous phone calls to his office concerning visibility problems at the corner of Larpen- teur and McMenemy. There appear a large nember of cars parking on Larpenteur Ave- nue, obstructing the vision of those vehicles attempting to enter Larpenteur from McMenemy. This information has been relayed to the City of St. Paul for their comments. On the Maplewood side of Larpenteur west of McMenemy is an apartment house with off - street parking. On the east side is a residence facing McMenemy and with the driveway exiting on McMenemy. The prohibition of parking should not be detrimen- tal to either properties. It is recommended that Ramsey County be asked to remove parking for a distance of 75 feet either side of McMenemy on Larpenteur Avenue. b. Councilman Wiegert introduced the following resolution and moved its adoption: 76 -1 -14 WHEREAS, parked vehicles on Larpenteur Avenue at the intersection of McMenemy Street pose a potential traffic hazard by obscruing the vision of drivers south- bound on McMenemy; and WHEREAS, elimination of parking on the north side of Larpenteur at the Mc- Menemy intersection will not be detrimental to the adjacent properties; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA that the County of Ramsey post the north side of Larpenteur Avenue for a distance of 75 feet either side of McMenemy Street "No Parking Any Time ". Seconded by Councilman Anderson. Ayes - all. 3. Street Improvement - Beam Avenue, Second Street to Bellaire Avenue (Supplemental Agreement) a. Manager Miller stated installation of curb and gutter on this project was accomplished in a marginal to sub - standard degree. A portion of the work was re- jected and new curb and gutter put in which met specifications. That which was marginal has been negotiated with the contractor to be paid for at a reduced price of $1.57 per linear foot. This price equates to the cost of the concrete used with no payment whatsoever for the installation. A savings of $1,692.24 is real- ized within the project. It is recommended that the Supplemental Agreement be accepted by the City Council dependent upon the concurrence of the North St. Paul City Council. b. Councilman Wiegert introduced the following resolution and moved its adoption: - 4 - 1/22 76 -1 -15 A. The City Council of the City of Maplewood has heretofore ordered made Improve- ment Project No. 71 -19 and has let a construction contract therefore pursuant to Minnesota Statutes Chapter 429, B. Said construction contract was awarded on a unit price basis for a total con- tract price of $60,481.00. C. It is necessary and expedient that said contract be modified so as to reduce the unit price of 1923 lin, feet of B -618 Concrete Curb and Gutter to $1.57 per lin, ft. Said reduction to lower the total contract by $1692.24. D. A supplemental agreement, attached hereto and incorporated herein by reference, has been presented to the Council for the purpose of effecting such modification. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MAPLEWOOD, MINNESOTA, that the Mayor and City Clerk are hereby authorized and directed to modify the existing contract with respect to Project No. 71 -19 by executing said Supplemental Agreement. Seconded by Councilman Anderson. Ayes - all. 4. Property Divisions a. Manager Miller stated there are six property assessment divisions to be approved. Approval is recommended. b. Division No. 49438 Councilman Greavu introduced the following resolution and moved its adoption: 76- I -16 WHEREAS, pursuant to Resolution 62 -8 -189 of the City Council of Maplewood, adopted August 30, 1962, the special assessments for the construction of Sanitary Sewer Improvement 5, Project 4 were levied against the attached list of described properties; said list made a part herein; and WHEREAS, the above mentioned properties have been conveyed and are described according to the attached list, said list made a part herein; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the assessments for Sanitary Sewer Improvement 5, Project 4 against the here- tofore mentioned properties be correctly certified to the Auditor of Ramsey County in the amounts stated on the attached list; said list made a part herein. Division No. 50086 Councilman Wiegert introduced the following resolution and moved its adoption: - 5 - 1/22 76 -1 -17 WHEREAS, pursuant to Resolution 75 -7 -136 of the City Council of Maplewood, adopted July 31, 1975, the special assessments for the construction of White Bear Avenue Improvement were levied against the attached list of described properties; said list made a part herein; and WHEREAS, the above mentioned properties have been conveyed and are described according to the attached list, said list made a part herein; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the assessments for White Bear Avenue Improvement against the heretofore mentioned properties be correctly certified to the Auditor of Ramsey County in the amounts stated on the attached list; said list made a part herein. Division No. 50088 Councilman Greavu introduced the following resolution and moved its adoption: 76 -1 -18 WHEREAS, pursuant to Resolution No. 61 -9 -169 of the City Council of Maplewood adopted September 7, 1961, the special assessments for the construction of Sanitary Sewer No. 3 were levied against the attached list of described properties; said list made i part herein; and WHEREAS, the above mentioned properties have been conveyed and are described according to the attached list, said list made a part herein; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the assessments for Sanitary Sewer No. 3 against the heretofore mentioned properties be correctly certified to the Auditor of Ramsey County in the amounts stated on the attached list, said list made a part herein. Division No. 50391 Councilman Wiegert introduced the following resolution and moved its adoption: 76- I -20 WHEREAS, pursuant to Resolution 75 -8 -155 and 75 -8 -154 of the City Council of Maplewood, adopted August 14, 1975, the special assessments for the construction of Lydia Avenue Utility Improvements and Lydia Avenue Street Improvements were levied against the attached list of described properties; said list made a part herein; and WHEREAS, the above mentioned properties have been conveyed and are described according to the attached list, said list made a part herein; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the assessments for Lydia Avenue Utility Improvements and Lydia Avenue Street Improvement against the heretofore mentioned properties be correctly certified to the Auditor of Ramsey County in the amounts stated on the attached list; said list made a part herein. Division No. 50525 Councilman Wiegert introduced the following resolution and moved its adoption: 76- 1 -21 WHEREAS, pursuant to Resolution 71 -10 -217 of the City Council of Maplewood, adopted October 7, 1971, the special assessments for the construction of Sanitary Sewer Improvement 2A (1972) were levied against the attached list of described properties; said list made _a part herein; and WHEREAS, the above mentioned properties have been conveyed and are described according to the attached list, said list made a part herein; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the assessments for Sanitary Sewer Improvement 2A (1972) against the here- tofore mentioned properties be correctly certified to the Auditor of Ramsey County in the amounts stated on the attached list; said list made a part herein. Division No. 50614 Councilman Greavu introduced the following resolution and moved its adoption: 76- 1 -22 WHEREAS, pursuant to Resolution 70- 9 -147A and 75 -7 -131 of the City Council of Maplewood, adopted September 18, 1970 and July 31, 1975, the special assessments for the construction of Storm Sewer Improvement 69- 4(1970) and Sanitary Sewer Improvement 10 (1975) were levied against the attached list of described properties said list made a part herein; and - 7 - 1/22 WHEREAS, the above mentioned properties have been conveyed and are described according to the attached list, said list made a part herein; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the assessments for Storm Sewer Improvement 69 -4 (1970) and Sanitary Sewer Improvement 10 (1975) against the heretofore mentioned properties be correctly certified to the Auditor of Ramsey County in the amounts stated on the attached list, said list made a part herein. Seconded by Councilman Wiegert. Ayes - all. 5. Park Availability Charge - 1976 a. Manager Miller presented the staff report. b. Commissioner Bernie Grover presented the following Park and Recreation Com- mission recommendation: "A Motion was entered by Commissioner Fox, seconded by Commissioner Qualley -- "The Park Commission shall recommend to the City Council that the 1976 Park Area Charge assessment be based on figures of $4,500 per acre for acquisition and $8,250 per acre for development. Inflationary increases on land and development are the basis for our recommendation, realizing these charges are still below actual development costs." Ayes all." c. Mayor Bruton moved to table Item J -5 to third last item on Agenda. Seconded by Councilman Anderson. Ayes - all. 6. Opticom - Woodbury Usage a. Manager Miller stated the City of Woodbury requests Maplewood's authorization to use Opticom signal control units on Woodbury ambulances while traveling through Maplewood. Woodbury agrees to hold Maplewood harmless of "any and all liability, loss or damage ". It is recommended that the Council approve Woodbury's request. b. Councilman Greavu moved to grant authorization to enter into an agreement with the City of Woodbury to use Opticom signal control units on Woodbury ambulances while traveling through Maplewood as recommended by staff_ Seconded by Councilman Wiegert. Ayes - all. 7. Sanitary Sewer Improvement - Easement a. Manager Miller stated the public improvement project for County Road "D" be- tween White Bear Avenue and Hazelwood Avenue requires a sanitary sewer crossing of the Burlington- Northern Railroad tracks to connect to the Beltline Interceptor presently under construction. A permit request has been filed with the Burlington- Northern Railroad Company and they have agreed to a contract contingent upon the City Council approval plus pay- ment of $15.00 per year for the first five (5) years and $5.00 per year thereafter. The contract is in keeping with other contracts required by Burlington- Northern for permit applications and it is recommended that the City Council approve the permit and authorize payment of $75.00 for the first five years. - 8 - 1/22 b. Councilman Wiegert introduced the following resolution and moved its adoption: 76- 1 -23 WHEREAS, Project No. 74 -11 requires a crossing of the Burlington Northern Inc. R.O.W. at County Road "D "; and WHEREAS, a contract has been tendered to the City which is consistent with previous contracts between the parties; and WHEREAS, the terms of the contract provide for payment of $15.00 per year for the first five years and $5.00 per year for each year thereafter; NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the contract is hereby approved and that the payment of $75.00 for the first five years is hereby authorized. Seconded by Councilman Anderson. Ayes - all. 8. Tax Abatement - Resolution a. Manager Miller stated a resolution is required to abate the taxes on the Edgerton Park Site ( Ostergren property) which was acquired by the City. Approval of the resolution is recommended. b. Councilman Greavu introduced the following resolution and moved its adoption: 76 -1 -24 A RESOLUTION requesting abatement and removal from taxation records of Taxation Division of Ramsey County, Minnesota, the real estate taxes assessed for the year of 1975 payable in 1976, affecting property owned by the City of Maplewood (Former- ly: Village of Maplewood, Minnesota) by virtue of a contract for deed executed by Charles L. Ostergren, dated February 8, 1971, described as follows, to wit: "Except the W 1661, the east 1/2 of the south 1/2 of the north 1/2 of the southeast 1/4 of the northwest 1/4 subject to streets, in Section 17, Township 29, Range 22, subject to survey." IDENTIFIED as Code No. 57 01710 040 32 in the office of Property Taxation, Ramsey County, Minnesota. WHEREAS, the City of Maplewood (Formerly: Village of Maplewood) acquired the above described property for the Edgerton Park Site pursuant to Contract for Deed as above stated and has complied with the terms and conditions of said Contract for Deed; and WHEREAS, there are real estate taxes in the total amount of for the year of 1975, payable in 1976. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the above taxes as recited in the total amount of $ , BE ABATED and removed from the taxation records of the Department of Taxation, Ramsey County, Minnesota, for the year of 1975. Seconded by Councilman Anderson. Ayes - all. - 9 - 1/22 9. Suburban Rate Authority - Representative a. Manager Miller stated that he was presently Maplewood's representative on the Suburban Rate Authority which deals with electric rates in the suburban areas. It is recommended that he be appointed to that position and that Bob Collier be designated as alternate. b. Councilman Anderson introduced the following resolution and moved its adoption: 76 - 1 - 25 BE IT RESOLVED by the City Council of the City of Maplewood, Minnesota, as follows: Michael G. Miller is hereby designated as a director of the Suburban Rate Authority, and Bobby D. Collier is hereby designated to serve as alternate dir- ector of the Suburban Rate Authority for the year 1976 and until their successors are appointed. Seconded by Councilman Wiegert. Ayes - all. K. COUNCIL PRESENTATIONS 1. A M M Policy a. Mayor Bruton stated after Council had passed the resolution supporting AMM 1976 Legislative Policies, they were again revised. Is it Council's wish to support the revisions. b. Mayor Bruton and request a Director of A Seconded by Councilman Wiegert. 2. 35E Noise Barriers t the AMM Leeis Ayes - all. tors and Vern a. Mayor Bruton commented on the noise barriers contemplated for 35E. He has heard from several residents regarding this matter. b. Council to wait for report from Planning Commission before discussing. 3. Planning Commission Appointment a. Mayor Bruton stated there was a vacancy because of Roger Singer's resignation, which Council has accepted. He talked with Mr. Lloyd Parsons and Mr. Parsons does not wish to serve on both the Community Design Review Board and the Planning Com- mission. He will gladly serve on either one,but not both. b. Manager Miller stated the Newsletter contained an article regarding the vacancy on the Planning Commission. 4. Planning Commission Meeting - 10 - 1/22 a. Mayor Bruton Sleeve Session on meet with the Planning Commission for a Shirt Seconded by Councilman Anderson. Ayes - all. b. Suggested Agenda for that meeting: Planning Concepts Planning Priorities Residential Zoning 5. Sewer Cleaning - Clarification a. Councilman Greavu wished clarification regarding billings for sewer back ups to residents. b. Manager Miller explained procedures. c. Council instructed staff to include an article, informing residents where they can call in case of an emergency, regarding sewer back ups. 6. Frost Avenue - Railroad Crossing Councilman Anderson stated County had done some work on Frost Avenue Railroad Crossing, but further work is needed. L. ADMINISTRATIVE PRESENTATIONS 1. Reports a. Vehicle Logos 1. Manager Miller stated last year the Council ordered that new logos be placed upon all staff vehicles which will include the maple leaf. The staff has proceeded to acquire the necessary logos; however, we have received an estimate of $39.00 per vehicle for removing the existing door signs from the vehicle and to prepare the door for the new logos. The cost for the logos itself will be $17.14 per unit for the blue vehicles, and $15.22 per unit for the yellow fleet plus the cost of labor for installation. It would seem that placement of the new logos on vehicles which will be re- placed this year would be uneconomical. It is suggested that those vehicles to be replaced in 1976 not receive the new logos. The new logos would be placed upn the replacement vehicle. Delivery should be in about 23 days. b. Condor Lawsuit 1. Manager Miller stated the Office of the City Attorney recommends "that the Council determined that the actions complained of arose out of the per- formance of those discretionary functions properly vested in the named de- fendents and the City Attorney be advised to pursue, on behalf of all said named defendents, contingent only upon the continued cooperation of said de- fendents, in the timely prosecution of this defense." 2. Councilman Greavu moved to approve recommendation of the staff. Seconded by Councilman Wiegert. Ayes - all. - 11 - 1/22 C. Stop Sign - Hazelwood Crossing 1. Manager Miller stated existing stop signs were ordered placed at the above named crossing by the Public Service Commission. They have done little to maintain, and the signs are defaced to the point where enforcement would be questionable. Accidents and near accidents do happen at that intersection due to the stop signs. It is recommended that the City Council request the Public Service Commission to remove the existing stop signs. If the Public Service Commission feels that traffic control is required, then it is requested that the Soo Line in- stall a semaphore control at their expense at the location. 2. Councilman Wiegert introduced the following resolution and moved its adoption: 76 -1 -26 BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the Minnesota Public Service Commission is hereby requested to remove the "Stop" signs at the intersection of Hazelwood Street and the Soo Line Railroad and to install automatic traffic actuated warning devices when and if warranted. Seconded by Councilman Anderson. Ayes - all. d. Sanitary Sewer Improvement 35E and Roselawn 1. Manager Miller stated a feasibility report has been prepared for sewer relief at the Roselawn and 35E location. The project involves a portion of County roadway which the County says they will replace, with the City install- ing curb and gutter and storm sewer.
