CALL TO ORDER Mayor Bastian called the meeting to order at 7 p.m. 2. GROUP HOME SPACING Geoff Olson presented the staff report. Mr. Olson explained that the state does not require a separation between group homes for six or fewer persons. Therefore, based on an opinion from the Attorney General's office, it is the city attorney's opinion that the City - cannot require a separation between group homes. Councilmember Zappa suggested that the City lobby to change the law controlling separation between group homes so that all cities follow _ the same guidelines, regardless of the city's size or class designation. Discussion focused on the size of the house on the lot, parking considerations, and the enforcement of violations for all residences. It was decided to submit this item to the HRA for consideration. 4. CODE CHANGE: SINGLE AND DOUBLE DWELLINGS Geoff Olson presented the staff report. The issues of home orientation, homes set farther back than the adjacent homes, and too much lot coverage and house size were discussed. It was suggested P.C./C.C. Joint Meeting -2- Minutes 6-18-91 that the wordage regarding the existing predominant setback on the same street be changed to the same side of the street. It was decided to refer this code change back to the Planning Commission and IIRA for further consideration before submitting it to Council. 5. PLANNED UNIT DEVELOPMENTS/CONDITIONAL USE PERMITS FOR COMMERCIAL ZONING DISTRICTS Commissioner Rossbach presented the background on the updating of the Planned Unit Development (PUD) ordinance. Mr. Rossbach informed the meeting that the Planning Commission hoped, with this updating process, to create more involvement for the City in the PUD process. The continued use of an overlay zoning district to control PUDs and conditions for creating transitional zoning areas for PUD use were discussed. Mr. Rossbach suggested that PUD areas could be zoned in an overlay district to keep the density in a concentrated area in order to preserve open space areas. Staff noted that PUDs are now a conditional use permit, but the suggestion with this updating process is that PUDs be controlled by initiating an overlaying PUD zone. Past PUD proposals and existing PUDs in the City were discussed. It was noted that the City's conditional use permit is effective and gives the City substantial control. It was decided that the Planning Commission will write an initial draft of the PUD ordinance which will create an overlay zoning district for specific areas of the City. This draft of the ordinance will then be reviewed by the City Council. Mayor Bastian said he knows of no legal challenges to PUDs in Minnesota, but said he would check to see if other states have had legal challenges to PUDs. Commissioner Fischer asked Mayor Bastian to also check to see under what circumstances the developer can change the conditions of the PUD and, in addition, what authority the City has to amend the PUD. 6. OPEN SPACE Mayor Bastian reported that an open space committee will be appointed to define open space, identify sites for acquisition and specify the costs to acquire specific property. The Council hopes to present this - as a referendum for the public to vote on as part of the 1992 general election. Possible alternatives for obtaining funding to purchase land for open space would be grants, special legislation, metropolitan park funding and donations. P.C./C.C. Joint Meeting -3- ,.-tinutes 6-18-91 7. LANG-RANGE VISION OF TAE CITY Councilmember Zappa asked staff if the update of the comprehensive plan is nearing completion. Staff said the comprehensive plan will be submitted to the Planning Commission in the next few weeks for their review. After the plan is approved by the Commission and Council it will be submitted to the Metropolitan Council. Zoning classifications for specific areas of the City were discussed. 8. 3M Technical Training Site Geoff Olson presented the landscape plan submitted for this site for the Council's review. 9.
