CALL TO ORDER A regular meeting of the City Council of Maplewood, Minnesota was held in the Council Chambers, Municipal Building and was called to order at 7:30 P.M. by Mayor Bruton. B. Murdock, Councilman Present APPROVAL OF MINUTES 1. Minutes No. 74 -21 (June 27, 1974) Councilman Wiegert moved that the Minutes of Meeting No. 74 -21 (June 27, 1974) be approved as submitted. Dog Control - Ordinance Ayes - all. a1L 1 - X.CO, Jc .74; Check No. 2 24 through Check Ayes - all. - Check No. 229 - a. Manager Miller stated the Council and staff have been receiving many complaints relative to the enforcement of the dog control ordinance this year. A check with the dog catching service indicated that the main problem in enforcing the existing dog control ordinance was that the service was limited in its authority to pick up - 1 - 7/18 dogs on private property and to determine when a dog was not under control of the owner. The present dog control ordinance requires only that the dog be "on the premises of its owner or accompanied by a responsible person and under that person's control..." The proposed ordinance would provide that dogs be kept under control "in an enclosure or on a chain or leash so as to be unable to leave the owner's premises" when on the owner's property and "on a leash" when off the owner's proper- ty. A summary of the proposed ordinance was included in the Maplewood City News- letter along with a notice that the ordinance would be discussed at the July 18 meeting. Thirteen letters for the ordinance and nine letters against the ordinance have been received. Second reading and final adoption are recommended. b. Mayor Bruton called for persons who wished to speak for or against the ordin- ance. The following were heard: Mrs. Eva Kjear, 1867 Myrtle Street, spoke on behalf of herself and two neighbors who are for the ordinance; Mr. Raschke, 2660 No. English Street, for the ordinance; Phyllis Piontek, 2573 Western Avenue, representing her mother Mrs. Margaret M. Parker, 1912 McMenemy Road, is against the proposed ordinance; Marian Hathaway, 2344 Bush, against the proposed ordinance; Dale Reed, 2014 Radatz, against the ordinance; Bill Howard, 931 County Road C, against the ordinance, enforce the present ordinance; Diane Buttermore, 2035 Radatz, against the proposed ordinance, enforce the present ordinance properly; A resident of 2300 Stillwater Road, doesn't think they should have to be penned at all times; Irene Gonzagowski, 2575 Carver Avenue, against the ordinance of having them penned or chained; Roberta Denery, 2425 E. Linwood, for the ordinance; Mrs. Charles Smith, 2239 Hazelwood Avenue, for the ordinance; Mrs. Margaret Parker, 1912 McMenemy Road, should enforce present law as it is written, not in favor of ordinance. c. Councilman Murdock introduced the following resolution and moved its adoption: 74 -7 -159 WHEREAS, the Maplewood Council has received many complaints of dogs running loose bothering and even injuring children, property and other dogs; and WHEREAS, the Council was advised that the Municipal Court bail schedule for loose dogs is $5.00; BE IT HEREBY RESOLVED THAT THE COUNCIL OF THE CITY OF MAPLEWOOD respectfully requests that the Municipal Court eliminate the bail and require an owner to make - 2 - 7/18 a court appearance on all dog violations; and BE IT FURTHER RESOLVED that said Council requests that the Court levy a fine of atleast $25.00 for a first violation of the Dog Control Ordinance and atleast $100.00 for a second such violation. Seconded by Councilman Wiegert. Ayes - all. d. Councilman Anderson introduced the following ordinance and moved its adoption: ORDINANCE NO. 368 ORDINANCE AMENDING CHAPTER 1101 OF THE MAPLEWOOD MUNICIPAL CITY CODE PERTAINING TO DOGS Section 1. Section 1101.010 is hereby amended to read as follows: 1101.010. ANIMAL: Any living dog; ANIMAL SHELTER: any premises designated by the City administrative authority for the purposes of impounding and caring for animals held under authority of this ordinance; CLERIC: Maplewood City Clerk; OFFICER: any person designated by the City Council as a law enforcement officer; OWNER: any person, partnership or corporation owning, keeping or harboring animals; PERSON: any individual, partnership, company or corporation; PET SHOP: Any person, partnership or corporation engaged in the business of feeding, buying, selling or boarding animals of any species; RESTRAINT: An animal shall be deemed to be under restraint if, when on the premises of the owner, it is kept in an enclosure or on a chain or leash so as to be unable to leave the owner's premises or if, when off the owner's premises, when such dog is on a leash and is kept under the control of the accompanying persons; VETERINARY HOSPITAL: Any establishment maintained and operated by licensed veterinarian for the diagnosis and treatment of diseases and injuries of animals. Section 2. Section 1101.080 is hereby amended to read as follows: 1101.080. RESTRAINT: Subd, 1. All dogs shall be kept under restraint at all times. Subd. 2. It shall be the obligation and responsibility of the owner or custodian of any dog in the City, whether permanently or temporarily therein, to prevent any such dog from committing any act which constitutes a nuisance as de- fined herein. It shall be considered a nuisance for any dog to bark at night, to frequest school grounds or public beaches, to chase vehicles, to molest or annoy any person, if such person is not on the property of the owner or custodian of such dog, or to molest, defile or destroy any property, public or private. Failure on the part of the owner or custodian to prevent a dog from committing a nuisance shall be subject to the penalty hereinafter provided. Section 3. Section 1101.090 is hereby amended to read as follows: 1101.090. IMPOUNDED DOGS. Unrestrained dogs may be taken by police, the City dog warden or the Humane Society and impounded in an animal shelter, and there con- fined in a humane manner. Impounded dogs shall be kept for not less than five days unless reclaimed by their owners. If by a permit tag or by other means the owner - 3 - 7/18 can be identified, the Clerk shall immediately upon impoundment notify the owner by telephone or mail of the impoundment of the animal. Dogs not claimed by their owners within five days shall be humanely disposed of by an agency delegated by the Council to exercise that authority. Section 4. Section 1101.050 is hereby amended to provide as follows: 1101.050. PERMIT YEAR. Subd. 1. The permit year shall commence on March 1 of each year and termin- ate on the last day of February of the following year. A new permit shall be obtain- ed each year by every owner and a new fee paid. A permit, if not revoked, shall be valid until the end of the permit year. Subd. 2. No permit shall be granted for a dog which has not been vaccinated against rabies as provided in this section on said date, but not more than two years will have elapsed from the date of such vaccination to the time of the expir- ation of the license to be issued. Vaccination shall be performed only by a doctor qualified to practice veterinarian medicine in the state in which the dog is vac- cinated and the applicant shall present a certificate from a qualified veterinar- ian showing that the dog to be licensed has been given a vaccination against rabies and the date on which said vaccination was administered. Section 5. This ordinance shall take effect and be in force upon passage and publication. Seconded by Councilman Murdock. Ayes - all. 2. Interchange - Highway 36 (Feasibility Study) a. Manager Miller presented the staff report. b. Dr. Arthur Hawnn, Howard Needles, Tammen and Bergendoff, presented the feas- ibility study. c. Mr. Henry Kristal, representing the Highway 61 and 36 committee, commented on the study. d. Councilman Wiegert moved to endorse and accept the feasibility study and refe it to the North East Task Force and recommend for the north side - alternate No. and to leave alternate No. 4 for further study. Seconded by Councilman Anderson. Ayes - Councilmen Anderson, Greavu, Mur- dock and Wiegert. Nays - Mayor Bruton. Motion carried. 3. Billboard Request - Aldrich Arena a. Manager Miller recommended this item be tabled to the August 1, 1974 meeting. b. Councilman Wiegert moved to table Item G -3 until the meeting of August 1, 1974. Seconded by Councilman Murdock. Ayes - all. - 4 - 7/18 H. VISITOR PRESENTATIONS 1. Mrs. Mary Harmon, 2045 Radatz Avenue, submitted a petition signed by 36 residents requesting reconsideration of the Council action relative to the improving of Radatz Avenue from White Bear Avenue to Frederick Street. The residents feel they were not informed of the proposed improvements. Councilman Murdock moved to place the on the Aueust 1. 1974 aeenda. Seconded by Councilman Greavu. Ayes - all. INEMERI%IAnJRV4Q x.`bM 1. Sign Permit - McDonald's (Cope Avenue) a. Manager Miller presented the staff report and stated it is recommended that the proposed sign be found not to be in conformance with the Community Design Re- view Board Ordinance, in that the design and location of the proposed sign and its relationship to neighboring existing and proposed developments and traffic is such that it would impair the desirability of investment and occupation in the neighbor- hood, and as this sign would constitute a precedent for additional signing that in the collective such signing would unreasonably interfere with the use and enjoy- ment of neighboring, existing and proposed developments and would create traffic congestion. Further, that the design and location of the proposed sign is not in keeping with the character of the surrounding neighborhood and is detrimental to the harmonious, orderly, and attractive development contemplated by the Maplewood Municipal Ordinance and the City's Comprehensive Plan. b. Member Tom Glasow presented the following Community Design Review Board recom- mendation: "Board Member Peterson moved that the Board recommend to the City Council that the sign proposal be denied based on the Manager's report. Board Member Glasow seconded. Motion carried Ayes 4 Nay 1." c. Mr. Randy Berg, representing McDonald's, spoke on behalf of the requested sign. d. Councilman Anderson moved to deny the request for the sign submitted by Mc- Donald's. based on the reasons Qiven in the staff report and the Community Design Review Board recommendation. Seconded by Mayor Bruton. Ayes - Mayor Bruton, Councilmen Anderson and Wiegert. Nays - Councilmen Greavu and Murdock. Motion carried. 2. Park Donation - Kohlman Lane a. Manager Miller stated Mr. and Mrs. Charles L. Schwab have offered to donate 2.33 acres of land with 495 feet of frontage along Kohlman Lane (northwesterly). The Schwabs indicate that they wish to plat the rest of their property to the north into residential lots. - 5 - 7/18 The Plan for Maplewood indicates the entire area for light residential (RI); however, both the proposed Open Space Plan and Drainage Plan indicate the area in question as open space. The Drainage Plan indicates the proposed donation area as part of a holding pond. The property proposed for dedication presently has assessments in the amount of $6,697.50 against the property. Acceptance of the proposed dedication would result in the assumption of these assessments by the City. The assumption of these assess- ments was not assumed by the 1974 budget. It is felt that the proposed dedication area is necessary to the drainage system of the City and that the proposed area is, in fact, unbuildable. It is therefore recommended that the dedication be accepted. It is also recommended that the dedication be accepted. It is also recommended that the assessments against the property be cancelled. The City will then assume the payment of those projects through general taxation through the bond fund for the project. b. Councilman Wiegert moved to accept the 2.33 acres of land donated by Mr. and Mrs. Charles L. Schwab as recommended by staff. Seconded by Mayor Bruton. Ayes - all. c. Councilman Wiegert introduced the following resolution and moved its adoption: 74 -7 -160 WHEREAS, pursuant to resolution 72 -9 -196 of the City Council of Maplewood, Minnesota, adopted September 6, 1972, the special assessments for the construction of Kohlman Lane Improvement 69 -15 were levied against property described as 57- 00410- 150 -52; and WHEREAS, the above described property has been donated to the City of Maple- wood for Open Space purposes; WHEREAS, a portion of the assessment in the amount of $6,697.50 (2.33 acres and 495 feet) should be cancelled; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the assessments for Kohlman Lane Improvement 69 -15, in the amount of $6,697.50 against 57- 00410- 150 -52 be, and the same hereby are, cancelled. Seconded by Mayor Bruton. Ayes - all. 3. Christmas Tree Lighting - Ordinance a. Manager Miller stated the ordinance proposal was prepared by the Department of Public Safety and is aimed at avoiding serious Christmas tree fire problems "in any hospital, nursing home, convalescent home, homes for the aged, orphanges, or other places housing the sick or handicapped, or in hotel lobbies, theatres, public buildings, department stores, schools and other places of public assemblage..." This type of provision is not included in the Uniform Fire Code, but is written to compare with the City of St. Paul requirement. b. Mayor Bruton moved first reading of the ordinance pertaining to Christmas tree lighting and requested staff to consider a modification that would not include every small office that might exist or will exist in the future in Maplewood, as well as display trees. - 6 -- 7/18 Seconded by Councilman Anderson. Ayes - all. 4. Smoking (Prohibited in Certain Buildings and Areas) - Ordinance a. Manager Miller stated with the development of major commercial developments within the community, it is felt that a "No Smoking" provision to be added to the City Code outlining areas where smoking is prohibited. The Department of Public Safety states that the proposed provisions are "similar to our neighbor city and has proven to be very effective when necessary to implement ". First reading of the ordinance is recommended. b. Councilman Anderson moved first reading of an ordinance pertaining to smoking being prohibited in certain buildings and areas. Seconded by Mayor Bruton. Ayes - all. J. COUNCIL PRESENTATIONS 1. Mayor Bruton stated he received a letter from the Board of Water Commissioners. They state that at its meeting of June 27, they accepted Maplewood's resolution and moved that contract negotiations be started. 2. Mayor Bruton stated the Council received a letter requesting a traffic light. Staff will investigate. 3. Councilman Wiegert stated he clipped an article from the Minneapolis Star regard- ing a Minneapolis 7 -11 store. Councilman Wiegert moved that the Manager send the 7 -11 store a letter requesting their intent on the Maplewood 7 -11 store. Seconded by Councilman Murdock. Ayes - all. 4. Councilman Wiegert stated an invitation has been received from the Ramsey County League for their annual picnic on August 9, 1974. He recommends attending. 5. Councilman Wiegert stated that the Connemara condominium used a procedure other than platting and used a new condominium law to accomplish the platting. He questions whether or not the County allowed this procedure when we had asked them not to allow lot divisions and secondly how should we proceed on assessments for the condominiums. Manager Miller stated the law does allow the filing of the condominium without going through the City. Do you wish to ask the County to require approval of the City on that? As for the assessments, we end up with about 97 assessment splits for that. Staff will investigate. 6. Councilman Murdock wished to know what is happening with the lot on Kenwood Drive. There is four feet of water standing there. Staff to investigate. 7. Councilman Greavu stated he was asked to set a time for this Council to set up a meeting with the people in the area for the Northeast Task Force. Notices to be sent out for August 27, 1974 at John Glenn Jr. High School. - 7 - 7/18 i 8. Councilman Greavu stated Mr. Reed has completed his six months and hopes that the Manager will come up with some recommendations at the next meeting, as well as for the two other employees who have completed their six months. Also, what are we doing regarding Marcie Mottaz. Manager Miller stated the attorney general has refused to comment or give his opinion regarding her salary. We are no where on that. K. ADMINISTRATIVE PRESENTATIONS 1. Manager Miller stated hearing dates for the preliminary plat for the Kodale Addition, the rezoning of a portion of the Maple Greens P.U.D. from M -2 to FR and a side yard variance for the southwest corner of Standridge Avenue and Bartelmy Lane should be established. A hearing date of August 29 (special meeting) is recommended. Copies of the staff reports on these items is included in the July 15 Planning Com- mission packet. Councilman Greavu moved to set August 29, 1974 as the hearing date for the three items submitted by the Manager. _ Seconded by Councilman Murdock. Ayes - all. 2. Manager Miller stated the St. Paul Pistol Club has asked for permission to hold their annual shoot at the Linwood Range on August 18th. We recommend permission be granted with conditions. Councilman Greavu moved to approve the request of the St. Paul Pistol Club to hold their annual shoot at the Linwood Range on August, 18, 1974, subject to the following conditions: 1. An adequate liability insurance policy be furnished; 2. The shoot shall be conducted in accordance with all safety range rules; 3. The neighbors within 500 feet of the range be advised of the event at least 25 days before the shoot; 4. The applicants agree to the above conditions in writing. Seconded by Councilman Wiegert.
