" I ®i ADDENDUM TO THE AGENDA Meeting No. 71 -4 I T E M G -1 A copy is enclosed. Roger Singer will make the presentation. H -la The final adoption of this plat requires the adjustment of the deed restrictions as well as the plat. Approval is recommended subject to the filing and recording of the re- vised deed restrictions. The changes are relative to the dedication as a public street of the cul -de -sac. H -lb The Tilsen Construction Company has submitted a letter in which Mr. Buetow agrees to sell his property "only upon official resolution by the Maplewood Village Council that Beam Avenue remain 66' wide . . ." The staff continues to feel that the addition seven feet is needed to continue the existing 44 foot width east and that to do so an additional seven feet will be required if adequate space for sidewalks, trees, and snow storage is to be provided. It is admitted that a 44 foot street can be fit into a 66 foot right -of -way, but we do not agree that it is desirable or adequate. No matter what the decision of the Council it should be based on the justification of the street and not on whether or not a tract of land will be developed. A report is enclosed. H -2 The planning staff feels that the.._:40 acre Jordan Farm should not properly be developed commercially and feels that it should be utilized for county park purposes. If this is not possible it should be utilized residentially. The Planning Commission feels that a special exception (it is zoned commercially) for residential usage should be favorably endorsed subject to five conditions. Both the staff and the Commssion feel that no final action can be. taken without a plan for the entire forty acre site being submitted by the developers. 11-3 A copy is enclosed. I1-4 We have discussed the plans with the Council previously; however, we did not receive a federal grant, as per the 1971 Budget, and are reassessing the amount of money available. The renovation includes all three floors. It appears now that about $8,200 will be available. I -1 A hearing date of February 18 is recommended. A proper petition has been filed by the Mt. Zion Hebrew Congregation Cemetery for the vacation of Effingham Avenue from Payne Avenue to Greenbrier Street (vacated). 0 I -2 This application is being reviewed. The house would be moved to the east side of Dieter Street north of Frost Avenue (behind 1521 Frost). It appears it will be recommended for approval. I -3 Authorization to have soil tests made on County Road C to determine the reason for the shifting of the sewer is requested. The maximum cost is estimated at $1,870. (see enclosed letter from Soil Engineering Services. I -4 This purchase was anticipated by the 1971 Budget. The Parks and Recreation Commission recommends the purchase. I -5 The staff and the Parks and Recreation Commission recommend the hiring of Brauer & Associates to prepare a site plan for the Magoffin Park at an estimated cost of $3,000. $4,800. is included in the 1971 Budget for the development of this park site. OTHER The Village snowmobile is now in operation. I have been advised that the problem of students at Tartan High crossing Highway #120 is being alleviated by the bussing of students. �e MINUTES OF MAPLEWOOD VILLAGE COUNCIL 7:30 P.M., THURSDAY, JANUARY 21, 1971 COUNCIL CHAMBERS, MUNICIPAL BUILDING MEETING NO. 71 - 4 A. CALL TO ORDER A regular meeting of the Village Council of Maplewood, Minnesota was held in the Council Chambers, Municipal Building and was called to order at 7:31 P.M. by Mayor Axdahl. B. ROLL CALL Lester G. Axdahl, Mayor Present John C. Greavu, Councilman Present Harald L. Haugan, Councilman Present Patricia L. Olson, Councilwoman Present Donald J. Wiegert, Councilman Present C. APPROVAL OF MINUTES 1. Minutes No. 1 (January 7, 1971) Councilman Greavu moved to approve the minutes of Meeting No. 1 (January 7, 1971) as corrected: Page 5 Item H -2 -e: "plat changes" instead of "plat variations" Page 12 Item J -2 -a: "to" instead of "of" Page 12 Item J -2 -d: "sumbit the report in two weeks ". Seconded by Councilman Wiegert. Ayes - all. 2. Minutes No. 2 (January 12, 1971) Councilman Wiegert moved that the Minutes of Meeting No. 2 (Jan- uary 12, 1971) be approved as submitted. Commissioner Roger Singer, Planning Commission, presented the First Annual Planning Commission Report to the Council. He re- quested the Council accept the report and discuss it at a joint meeting,of the Council and the Planning Commission. b. Councilman Wiegert moved to accept the report with "thanks" and that further, a letter of commendation be sent to each member of the Planning Commission for long and hard labor on this project. Seconded by Councilman Greavu. Ayes - all. C. A joint meeting between the Council and Planning Commission will be held Thursday, January 28, 1971 at 7:30 P.M. in the Council Chambers. H. UNFINISHED BUSINESS 1. Subdivision Plats a. Netnorlin 1. Manager Miller stated the final adoption of this plat re- quires the adjustment of the deed restrictions as well as the plat. Approval is recommended subject to the filing and re- cording of the revised deed restrictions. The changes are re- lative to the dedication as a public street of the cul -de -sac. b. The Netnorlin Plat had been denied by the Ramsey County Plat Commission and they suggested that the Cul -de -sac be changed. c. Councilman Greavu restrictions to a Dublic Seconded by Councilwoman Olson. - 2 - 1/21 Ayes - all. b. Tilsen's Maplewood Heights No. 7 1. Manager Miller stated that the Tilsen Construction Company has submitted a letter in which Mr. Buetow agrees to sell his property "only upon official resolution by the Maplewood Village Council that Beam Avenue remain 66' wide ". A condition of the Tilsen Maplewood Heights No. 7 Plat was the dedication of 7 ft. of additional right of way along the north side of Beam Avenue. Mr. Buetow wishes this condition be waived. 2. Kenneth Tilsen, brother of Robert Tilsen, spoke on behalf of deleting the dedication of the additional 7 foot right of way from the plat. He stated Beam Avenue ends a short distance east of McKnight Road and also that North Saint Paul had no plans to expand the south side of Beam Avenue. 3. Councilwoman Olson moved to approve the plat with the change of a 66`foot right of wav for Beam Avenue. Seconded by Councilman Haugan. Ayes - all. 2. Special Exception Request - Jordan Farm a. Manager Miller stated that staff feels that the 40 acre Jordan Farm should not properly be developed commercially and feels that it should be utilized for county park purposes. b. Commissioner Roger Singer read the following Planning Commission recommendation: The Planner reviewed the matter and area in which the site was located. Recommendation was made that the subject site be first of all, planned and developed in conjunction with the existing County park lands bordering the site on the north, east, and south. As a second recommendation should the first be unacceptable or un- attainable, then such site should be planned for residential use and a special exception should be encouraged and approved subject to an acceptable detailed total plan for the entire 40 acre tract. After discussing the issues, Commissioner Mogren moved that the Commission recommend to the Council that a special exception for residential use from the existing B.C. (Commercial District Re- gulations) be favorably endorsed subject to the following condit- ions: (1) The total 40 acre site must be planned in its totality. (2) That a commercial development not be planned to exceed a maximum of 8 acres. (3) The official special exception does not become effective until a detailed plan for the site has been approved by the Village Council. (4) That the Planning Commission be authorized to review and recommend to the Council the plan upon which the specific special exception will be based. - 3 - 1/21 Commissioner Stolzman seconded Motion carred. Ayes - all. c. A representative from Midwest Planning and Research, the de- velopers, spoke on behalf of the plan and also stated that the Zoo Board was not interested in purchasing the property. d. Councilman Wiegert introduced the following resolution and moved its adoption: (resolution to the Ramsey County Board) 71 - 1 - 7 WHEREAS, there is a tract of approximately 40 acres lying within what is known as the "Jordan Farm ", which is still private property, and WHEREAS the owners of said tract have requested the Village of Maplewood for appropriate zoning so as to develop the land, and WHEREAS, said 40 acres borders County Park lands and may be de- sirable as a part of said park, BE IT RESOLVED that the Village of Maplewood hereby requests that the Board of County Commissioners of Ramsey County review the site and advise the Village of Maplewood as to whether or not they intend to acquire said 40 acres. BE IT FURTHER RESOLVED that the Village will again consider the request of the owners at its meeting March 4, 1971, and therefore requests that the County give its advice prior to March 4, 1971. BE IT FURTHER RESOLVED that the Village Clerk is hereby directed to send a copy of this resolution to each member of the County Board of Commissioners. Seconded by Councilwoman Olson. Ayes - all. e. Councilwoman Olson moved to table this matter until a x is received from the Ramsey County Board and from Staff. Seconded by Councilman Greavu. Ayes - all. 3. Ordinance No. 280 (Snowmobile regulations) Second Reading. a. Manager Miller presented Ordinance No. 280, relating to snow- mobiles, for final approval. b. Village Attorney Don Lais explained the Ordinance in detail. General changes were made. C. Councilwoman Olson introduced the following ordinance and moved its adoption: - 4 - 1/21 ORDINANCE NO. 280 AN ORDINANCE AMENDING THE MAPLEWOOD CODE BY AMENDING CHAPTER 1215 REGARDING SNOWMOBILES Section 1. Chapter 1215 is hereby amended in its entirety to read as follows: 1215 SNOWMOBILES 1215.010 ADOPTION OF SNOWMOBILE STATUTES. It is the intent of this ordinance to suppliment Minnesota Statutes 84.81 through 84.88 and Chapter 169 with respect to the operation and regulations of snowmobiles, and said statutes as hereafter amended are hereby adopted and incorporated as if fully set out herein. 1215.020 DEFINITIONS, For purposes of this ordinance, the following definitions are hereby set forth: A. "SNOWMOBILE" - a power driven, self - propelled vehicle designed to travel upon snow, ice or natural terrain. B. "OPERATOR" - The person who handles and operates the controls which are used to start, stop and direct the course of travel of a snowmobile. C. "DEAD -MAN THROTTLE" - a device which automatically cuts the fuel supply to the engine whenever the operator releases pressure upon the throt- tle or accelerator. 1215.030. UNLAWFUL CIRCUMSTANCES. It shall be unlawful for any person to drive, operate, control or direct the course of travel of any snow- mobile under the following circumstances. Subd. 1. Upon private property without permission of the owner or per- son entitled to possession of such property. Subd. 2. Upon any school grounds, park property, playgrounds, recreat- ion areas or golf course except as and at such times as the persons in con- trol of such property may authorize or designate. Subd. 3. In any manner wh;.ch creates unnecessary and unusual noise and disturbance, either by the machine itself or the persons riding upon such machine. Subd. 4. In a careless, negligent, dangerous manner which is reasonably possible to endanger the bodily health or safety of any person or the se- curity of any property. Subd. 5. Without having the sno4mobile registered as provided by Sec- tion 84.82 of Minnesota Statutes, except upon the private property of the owner of such vehicle. Subd. 6. Within or across any public street or road right -of -way or - 5 - 1/21 upon or across any public lands or waters unless the operator is at least 14 years of age and, if under 18 years of age, has in possession a valid snowmobile safety certificate issued by the Commissioner of Conservation of the State of Minnesota. Subd. 7. After the hour of 10:00 P.M. on any day or before the hours of 7:00 A.M. on any day. Subd. 8. a) Speed in excess of 30 miles per hour unless otherwise posted, b) Speed in excess of 15 miles per hour when within 150 feet of the shore line of any lake or waterway, ice fisherman, fishouse, skat- ing rink or area, sledding or ski tow area or where persons not on snow- mobiles are present. Subd. 9. The following areas are hereby prohibited for operation of snowmobiles: Skating rinks, sledding areas, skiing areas or areas in use for other recreational purposes and any public land or waters posted and designated as a prohibited area. Subd. 10. When towing another person or thing on skis, sled, tobaggan or other device unless by means of a rigid tow bar of not more than 10 feet in length except at the direction of a Police Officer. Subd. 11. With more passengers than the designed capacity of the par- ticular snowmobile. 215.040 UNATTENDED VIOLATIONS. a) No snowmobile shall be unattended while the motor is running or while the key is in the ignition switch. b) No operator shall leave a snowmobile unattended upon any public land or waters. A law enforcement officer finding such unattended snow- mobile may seize same. Any snowmobile seized shall be held for 60 days subject to claim by the owner thereof after appearance in Municipal Court and an order of said Court ordering same released to the claimant upon payment of any and all reasonable towing and storage charges. 1215.050, RACES. Snowmobile races may be held only upon permission of the Village Council after favorable recommendation by the Public Safety Director and subject to such conditions as the Council shall prescribe. 1215.060. RECREATION PROGRAMS. If the Director of Recreation for Maple- wood provides for snowmobile programs as a part of the department- sponsored recreation events, the Director shall have the authority to designate Vil- lage -owned land areas as routes or areas for snowmobile operation. 1215.070. EQUIPMENT REQUIREMENTS. In order to lawfully operate a snowmobile in Maplewoo4, such vehicle shall be equipped as follows: l Subd. 1. Muffler to reduce operating noises; and no cut -out, bypass, or similar device to defeat muffling shall be allowed. - 6 - 1/21 Subd. 2. Adequate brakes as provided in Minnesota Statutes Section 169.67. Subd. 3. At least one headlight and one tail - light. Subd. 4. A safety throttle, commonly described as a "dead -man" throt- tle, which shall be in operating condition at all times the vehicle is in use. 1215.080. STREET AND HIGHWAY RESTRICTIONS. No snowmobile shall be operated upon any street or highway or within the right of way thereof, except to cross such street at right angles to the centerline. No snow- mobile shall cross any divided highway except at an established inter- section crossing. The Council may by resolution allow other specified types of snowmobile operation in a street or road right of way for parades or specially designated events. Section 2. This ordinance shall be enforced in the same manner as any other provision of the Maplewood Code. Section 3. This ordinance shall take effect and be in force from and after its passage and publication. Seconded by Councilman Wiegert. Ayes - all. 4. Renovation - Village Hall. a. Manager Miller requested authorization to proceed with the ad- vertising for bids on the renovation of the Village Hall, It ap- pears that about $8,200.00 will be available for the renovation of the three floors. b. Councilman Wiegert moved to authorize the Staff to call for bids Seconded by Councilman Greavu. Ayes - all. C. Following further discussion, Councilman Greavu moved that a study be made of adding two stories above the garage. Seconded by Councilman Wiegert. Ayes - all. U DIE MAIN8440m, 1, Street Vacation Request. Hearing Date. a. Manager Miller stated a petition has been filed by the Mt.Zion Hebrew Congregation Cemetary for the vacation of Effingham Avenue from Payne Avenue to Greenbrier Street. House Moving Permit - Henry E. Olson. Ayes - all. a. Manager Miller presented a request from Mr. Henry Olson, 1525 Frost Avenue to move a house from St. Paul to a vacant lot on Dieter Street behind: his home. (Legally described as South ? of Lot 9 and all of Lots 10 and 11, Block 35, Gladstone Plat 2). Staff re- commends approval on condition the applicant meets all of the ord- inance requirements. b. Councilman Wiegert moved the appro move a house into Maplewood subject to Dlied with. Seconded by Councilman Greavu. 3. Sanitary Sewer Test Authorization of Mr. Olson's request to f: Ayes - all. a. Manager Miller stated that staff is requesting authorization to have soil tests made on County Road C (sanitary sewer Imp. 68- SAS -1) to determine the reasons for the shifting of the sewer main. The cost is estimated at $1,870.00. b. Village Engineer Kuusisto stated that in the contract to construct sanitary sewer mains on County Road C it was stated that the contract - or was to remove "bad" soil and to replace it with "good" soil. The tests will confirm if this actually took place. c. Councilman Greavu moved to authorize staff to proceed with the soil tests on County Road C. Seconded by Councilwoman Olson. Ayes - all. 4. Purchase of Park Property. a. Manager Miller read the following Park and Recreation Commission recommendations regarding the purchase of the proposed Demont and Flandrau park site: At the regular meeting of the Park and Recreation Commission on January 11, 1971, the Commission discussed information for- warded to us from Village Attorney, Don Lais, regarding purchase of the proposed Demont and Flandrau Park Site. After a thorough discussion the Commission voted unanimously to recommend that the Village Attorney proceed to purchase the 8.1 acre tract for an amount not to exceed $22,000.00. The Commission further re- commends that the attorney proceed toward purchase of the small 1.4 acre tract. It is our understanding that the purchase will be for a five year contract for deed and that the present owner will pay all assessments presently outstanding. The 1971 Budget includes $11,985.00 for first -year payments on this and the Frank and Frisbie sites. - 8 - 1/21 b. Manager Miller stated that the purchase of this property was anticipated by the 1971 budget. C. Councilman Wiegert moved that staff be authorized to proceed with Durchasin2 the DroDosed Demont and Flandran Park Site. Seconded by Councilman Greavu. Ayes - all. 5. Engineering Services - Park Development. a. Manager Miller stated the staff and the Parks and Recreation Commission recommend the hiring of the firm of Brauer and Associates to prepare a site plan for the Magoffin Park, at an estimated cost of $3,000.00. $4,800.00 is included in the 1971 Budget for the de- velopment of this park site. b. Councilman Greavu moved that the firm of Brauer and Associ be hired to prepare the Magoffin Park Site Plan with two stipu to be included: 1. Any design will take cognizance of any future requirement for completing water loop for Adolphus. 2. Project a possible fire lane as public safety roadway. i Seconded by Councilman Wiegert. Ayes - Councilwoman 0lson, Councilmen Greavu, Haugan and Wiegert. Nay - Mayor Axdahl. 6. Resolution - Correction to Bond Issue. a. Councilman Greavu introduced the following resolution and moved its adoption: 71 - 1 - 8 BE IT RESOLVED that the minutes of the meeting of November 24, 1970, on page 6, at paragraph number 7 be corrected to read as follows: 7. The Village Clerk is directed to cause said bonds to be pre- pared and the Mayor and Clerk are authorized and directed to execute the same by the facsimile signature of the Mayor and the manual signature of the Village Clerk, and to cause said coupons to be executed and authenticated by the printed, engraved or lith- ographed facsimile signatures of said officers. BE IT FURTHER RESOLVED that the bonds as issued are hereby ratified, including the manual signatures of the Clerk and the facsimile sig- nature of the Mayor. - 9 - 1/21 Seconded by Councilman Haugan. 7. Hill High School Snowmobile Race Ayes - all. a. Manager Miller stated he had received a request from Hill High School to hold a snowmobile race on January 29, 1971 from 10:30 A.M, to 12:30 P.M. at the school in conjunction with "Sno days ". b' Councilman Greavu moved to approve the snowmobile race to be held by Hill High School, January 29, 1971. Seconded by Councilman Wiegert. Ayes - all. J. COUNCIL PRESENTATIONS 1. Mayor a. Councilman Haugan will attend the meeting in Richfield on Sat- urday, January 30, 1971. The purpose of this meeting is to discuss legislative issues for Cities and Villages, with population of 10,000 to 100 ;000. 2. Council a. Councilman Wiegert stated he had read in the Ramsey County Board Minutes where the Chairman of the Recreation Committee is appointing, among the residents of Ramsey County, a special citizens task force to formulate and present an over all park and recreation plan for Ramsey County, Councilman Wiegert further stated he did not recognize any of the names and did not know if we are represented and perhaps we should be. Councilman Wiegert introduced the following resolution and moved its adoption: 71 - 1 - 9 WHEREAS, the Ramsey County Committee has formed a special citizens task force to formulate, promote and present a park and recreation plan for Ramsey County, and WHEREAS, substantial areas of recreation exist in the Village of Maplewood. BE IT RESOLVED thatthe Village Council of Maplewood, Minnesota hereby requests permission to nominate one or more appointees to serve on such citizen task force. Seconded by Councilman Haugan. Ayes - all. b. Councilman Greavu requested Staff contact Ramsey County to place a "No U Turn" sign on the south end median of McKnight Road at High- way 94. - 10 - 1/21 K. ADMINISTRATIVE PRESENTATIONS y11 1. Manager a. Staff is meeting with North Saint Paul and negotiating with them on the Eleventh Avenue intersection. b. Has received a copy of the Proposals for Reform of Property Tax assessment in Minnesota which is available to the Council. c. Presented Council with a status report on items referred to staff. d. Northern States Power has notified the Village of a gas rate increase. N.S.P. has a 20 year franchise with the Village. No mention is made in the ordinance whereby Council approves or dis- approves. e. There will be a staff meeting Monday, January 25, 1971 at 1:00 P.M. to discuss the Conway Avenue feasibility study.
