Council (K) ADMINISTRATIVE PRESENTATIONS (L) ADJOURNMENT ADDENDUM TO THE AGENDA Meeting No. 70 -25 I^1EM D -1, This vacation is requested to allow the expansion of the Maplewood Bowl to the west. The staff report was included in the last Planning Commission packet. It is recommended that the vacation be approved subject to the conditions in that report regarding easements (utility and access) and purchase of that portion of the sewer (beginning 240 feet north of Frost) which was financed by general obligation. The Planning Commission recommended approval with the conditions regarding the easements. H -1 Don Lais will have your suggested amendments for you. H -2 The State will not approve the Cope Street project until the Council officially adopts a position of ultimately opening the Cope Avenue intersection to the east and providing for access to Cope for the residences northeast of the proposed intersection of Cope and White Bear. We suggest that no award on the bids be made until the State accepts the project for aid. We would hope that approval will be forthcoming soon after submission of a formal resolution stating the Council's intentions and that the bid can then be awarded on September 24. H -3 A copy is enclosed. H -4 It is recommended that Section 911.010 of the Village Code be amended to include an additional item stating, "An, off - street parking lot as a principle use in any district and subject to standards indicated in Section 912.060." This change will allow off - street parking lots in all areas as a special use with Council approval after a public hearing. H -5 The Village Attorney will report any progress. H -6 It is recommended that the existing Village insurance be continued through its third and final year. The cost of the insurance is about $17,000. with the new higher values. I believe that a comprehensive study of our insurance pro- gram should be undertaken and that any such study, if done well, will take time. In addition, the method of determin- ing the coverage (staff.or insurance committee) should be thoroughly studied. H -7 A resolution is necessary to request the cooperation of St. Paul and Ramsey County in providing storm drainage from the Highwood Avenue - McKnight Road area. I -1 A representative of the Human Rights Commission will present the results of its community survey. I -2 Approval is recommended with conditions. I -3 Ordinance is enclosed. I -4 A resolution is necessary to release for sale tax- forfeited lands with the Village. I -5 Enclosed is a copy of a model ordinance which would regulate explosives. Staff has not yet reviewed it. OTHER Another accident occurred on Highway 36 near White Bear Avenue on September 14. A car travelling west jumped the median and struck an eastbound vehicle. Two persons were injured. CALL TO ORDER A regular meeting of the Village Council of Maplewood, Minnesota was held in the Council Chambers, Municipal Building and was called to order at 7:37 P.M. by Mayor Axdahl. B. ROLL CALL Lester G. Axdahl, Mayor Present John C. Greavu, Councilman Present Harald L. Haugan, Councilman Present Patricia L. Olson, Councilwoman Present Donald J. Wiegert, Councilman Present C. APPROVAL OF MINUTES Minutes of Meeting No. 23 (September 3, 1970) Councilman Wiegert moved (September 3. 1970) as c ✓e minutes of Meeting No. 23 Page 3, Item G -2: add "transmission pipes across the creek bed" Page 4, Item H -lb, Line 4: Add "some of which continue to the ground (like slides) and some of which end without warning in a vertical plane." Page 1 Item C -1 (correction to Item H -10) Meeting No. 18 Councilwoman Olson made a statement on the 11th Avenue utilities and would like to have it recorded: That the Staff should have presented the whole picture of the 11th Avenue project including water and sewer at the time we received the request for the construction of Ariel Street to White Bear Avenue for the Target Store. In the future the Staff present all the data for consideration on a given project. Page 1 Item C (Correction to Page 8, 9, 10,11, 12 and 13, Meeting No. 18 to include specific paragraph). Delete the word "and" from the first paragraph in resolutions and delete the second paragraph "WHEREAS, the Engineer has reported that the said improvement has been satisfactorily completed." Seconded by Councilman Haugan. Ayes - all. - 1 - 9 -17 Councilwoman Olson stated "again she would like to protest the fact that the Council did not receive the minutes, she received hers at 10:20 P.M. last night and she feels there has got to be something done to get these minutes to us and not even what we have in our Rules of Procedures as far as I am concerned, I would like to make a motion to change that, I feel that the minutes should come to us by Monday following the meeting and two days after any special hearing and I would like to ask you gentlemen if you are in agreement or if I am in the minority ". Councilwoman Olson corrected her statement as to punctuation. Following discussion, No action was taken. 2. Councilman Wiegert moved to approve the synopsis of Village Attorney Don Lais'`discussion on easements as presented.at the Au ust 20 1970 meeting. eS con e y CounciToman Olson. Ayes - all. D. PUBLIC HEARINGS Vacation (street and alley) - Chambers Street. a. Mayor Axdahl convened the meeting for a public hearing to vacate Chambers Street from Frost Avenue north to Minneapolis - St. Paul Sault Ste Marie Railway Tracks and the north -south 20 foot wide alley in Block 2, Lincoln Park. The Clerk read the notice of hearing. b. A representative of the Planning Commission presented a report recommending approval of the street and alley vacation subject tb staff conditions regarding the necessary easements with the exception of the 3rd condition - the purchase of the sewer main. The Commission felt they would need more information before approving the third condition. c, Mr. James Rohricht, attorney for Mr. and Mrs. Harold Barkdoll, 1940 Atlantic stated that if the alley and street are vacated for the purpose of Mr. Bob Hall enlarging the Maplewood Bowl and adding an additional parking lot. It would cause more run off water to accumulate at the Barkdoll's property and cause more drainage problemsthan exist at the present time. Also, if the alley is vacated, their access to the back of their property (where 'their well is located) would be blocked, The alley is not improved maintained. d. Following further discussions, Mayor Axdahl called for formal objections. The following objectors were heard: Mrs. Mary Peloquin, Mr. and°,(Mrs, Harold Mr. and Mrs. Curney, 1939 Chambers Barkdoll`, 1940 Atlantic 1950 Atlantic - 2 - 9 -17 Mayor Axdahl closed the Public Hearing. Mayor Axdahl called for Council discussion. e. Councilman Greavu introduced the following resolution and moved its adoption: 70- 9- 142 WHEREAS, the owners of more than 50% of the property abutting on Chambers Street have filed a petition for the vacation of the said street, and WHEREAS, the hearinq on said petition was pre- ceded by two weeks published and posted notice, and WHEREAS, those who; wished to.stafe: their opposition were: heard;' and WHEREAS, it appears for the best interest of the public that said street be vacated, NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MAPLEWOOD, MINNESOTA that Chambers Street from a point 200 feet north of the intersection of Frost Avenue and Chambers street to the Minneapolis - St. Paul, Sault Ste. Marie Railway Right -of -Way be and the same are hereby vacated with the Village retaining a 40 ft. sewer easement, beyond the south end of the portion of Chambers Street that was vacated. Seconded by Councilman Haugan. Ayes - Mayor Axdahl, Councilmen Greavu, Haugan and Wiegert. Nay - Councilwoman Olson. f. Councilman Greavu introduced the following resolution and moved its adoption: 70 -9- 143 WHEREAS, the owners of more than 50% of the property abutting on the alley in Block 2, Lincoln Park, Ramsey County, Minnesota have filed a petition for the vacation of the said alley, and WHEREAS, the hearing on said petition was preceeded by two weeks published and posted notice, and WHEREAS, those who wished to strfe: their, opposition were' heard,and - - 3 - 9 -17 WHEREAS, it appears for the best interest of the public that said alley be vacated. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MAPLEWOOD, MINNESOTA, that the alley from a point 200 feet north of Frost Avenue to the Minneapolis -St. Paul Sault Ste. Marie Railway right - of -way in Block 2, Lincoln Park, Ramsey County, Minnesota be and the same is hereby vacated subject to Village retaining the electrical easement. Seconded by Councilman Haugan. E. AWARDING OF BIDS None F. APPROVAL OF ACCOUNTS Ayes - Mayor Axdahl, Councilmen Greavu, Haugan and Wiegert. Nay - Councilwoman Olson. Councilman Wiegert moved that the accounts submitted i.n the amount of $84,406.28 (Part I- fees, Services, Expenses, Check No. 10755 t roe h Check No. 10860, 67,564.87; Part Ii - Payroll,Check No. 1105 throe Check No. 1172, 16,841.41 ) be paid. Seconded by Councilman Greavu. Ayes - all. G. VISITOR PRESENTATION 1. Mr. Elmer Stanke, 910 E. County Road C. Mr. Stanke wished to inform the Council on the progress of having his driveways repaired. He met with the County Engineer, Wednesday they bladed and blacktopped the driveways. He will meet with the County again next week and hopefully the ditch can be cut deeper to provide proper drainage. Mr. Stanke also questioned what had happened regarding the bill he submitted to cover the cost of sprinkling the sod on his property. Staff forwarded the bill to the contractor but had heard nothing. Staff will try to contact the contractor again. Mr. Stanke also stated that the monument was replaced. 2. Mr. Duane Feyereisn, 1954 Hazelwood Street. Mr. Feyereisn presented building plans for a commercial building to be built east of 1221 Frost Avenue. - 4 - 9 -17 Manager Miller Stated since Mr. Feyereisn was requesting action to be taken perhaps the matter could be placed on the agenda under new business. Councilman Wiegert moved to suspend the rules of procedur and place Mr. Feyereisn -s request on the agenda as Item 6 under New Business. Seconded by Councilman Greavu. Ayes - all. H. UNFINISHED BUSINESS 1. Pollution Control a. Ordinances No. 269,270 and 271. (Second Reading) 1. Manager Miller presented the three Ordinances regarding pollution control for acceptance. 2. Following discussion, corrections were made to the ordinances. They would become effective November 1, 1970. 3. At this time, Councilwoman Olson moved reconsideration of the rates set at the last meetinq for the refuse collectors and ask them to appear at the next regular meeting October 1. 1970 to aaain discuss the rates. Seconded by Councilman Haugan. Aues - all. 4. Councilwoman Olson introduced the following ordinance and moved its adoption: (second reading. ORDINANCE NO. 269 AN ORDINANCE AMENDING THE MAPLEWOOD CODE RELATING TO DISPOSAL OF GARBAGE AND RUBBISH. THE COUNCIL OF THE VILLAGE OF MAPLEWOOD DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Section 1402.010. DISPOSAL REQUIREMENTS OF THE MAPLEWOOD CODE IS hereby amended to read as follows: "Section 1402.010, Disposal Requirements. Every person, firm or corporation shall dispose of garbage and refuse which accumulates upon his or its property at least once a week or more often as directed by the Village Manager. Every householder occupant and owner of any dwelling, boarding house, apartment building, mobile home, or any other structure including churches and halls shall have garbage and rubbish collected by haulers licensed by the Village of Maplewood and shall comply with the provisions of this ordinance and with the dates of collection and requirements therefore as established by the Village Manager. - 5 - 9 -17 Section 2. Section 1402.020 is hereby amended to read as follows: "Section 1402.020. DEFINITION. For the purpose of this Chapter, the following terms, phrases, words and their derivation shall have the meaning given therein: (a) Garbage: Waste, food stuffs or table wastes of vegetable or animal origin, together with in- cidental admixtures. Dead animals weighing no more than ten (10) pounds shall be classified as garbage. (b) Rubbish: This shall include all other waste matters, such as tin cans, glass, paper, ashes, sweeping, leaves, grass, and other such materials except vegetative compost piles properly maintained for conservation, gardening and landscaping purposes. (c) Refuse: This shall mean garbage and rubbish combined. (d) Waste Materials: The following items of waste material shall not be considered as rubbish or garbage: Stones, sod, earth, concrete contractor's building materials, large automobile parts, large a appliances, inflammable liquids, tree trunk sections over four inches in diameter and three feet in length, manure, or articles so heavy or bulky that they cannot be easily lifted by one man. The aforesaid items shall not be allowed to accumulate and shall be removed within seventy -two (72) hours upon notice from the Village Manager, which may be given in writing to the owner or occupant of the property upon which said materials are accumulated, or by posting said notice upon the property in a conspicuous place and failure to remove pursuant to the order shall be a misdemeanor. Section 3. Section 1402.030 of the code is amended to read as follows: . "Section 1402.030. Garbage Containers. Every person, firm or corporation, as a householder, occupant and /or owner of any dwelling, boarding house, apartment building, or any other structure utilized for dwelling purposes and any restaurant, firm, corporation or establishment that accumulates garbage shall provide one or more fly and water tight metal or equivalent rodent proof garbage container, of not more than 32- gallon capacity, to contain all of the garbage which accumulates between collections unless they are required to comply with Section 1402. 030, subsection (c) hereof. - 6 - 9 -17 No such container shall be filled in excess of seventy -five (75) pounds. (a) All persons living in accommodations not covered under Section 1402.030 (c) hereof shall place garbage in a 1 -112 mil. minimum polyethylene bags or equivalent in performance of 30 -32 gallon capacity or equivalent system which shall be kept in the aforesaid containers except that on the day of collection, the filled bags are to be closed or sealed so as to be water and fly tight and removed from the containers, then placed at the curb line or next to the alley for pick -up unless special arrange- ments are made with the hauler for walk -in service. Rubbish shall be placed in 1 -112 mil. minimum polyethylene bags or equivalent in performance in amounts not weighing in excess of seventy -five (75) pounds or more than 32- gallon capacity, and may be placed nexti,to the curb line or next to the alley for pick up on the garbage pick -up date. (b) Tree limbs not exceeding four inches in diameter nor three feet in length, tied in bundles of no more than eighteen inches in diameter, and Christmas trees up to seven feet in length may also be placed in the same manner. (c) The owners, operators of managers of any building containing more than two dwelling units or of any firm or corporation or where garbage accumulates in excess of four 30 -32 gallon containers per week shall have vat service weekly from a commercial type hauler licensed to do business in Maplewood. The vats shall be of a minimum capacity of one cubic yard and of an approved sanitary type with the proper attachments for lifting on to refuse trucks. (d) Waste Material. Such items defined as waste material under 1402.020, Subsection (c) shall be disposed of by means of a special pick -up of these items by a hauler properly equipped to render such service." Section 4. Section 1402.050 of the Maplewood Code is hereby amended to read as follows: "Maintenance of sanitary conditions. Persons accumulating garbage or rubbish shall comply with the following requirements: (a) No persons shall place any garbage, rubbish or refuse in street, alley or other public place, or upon any private property, whether owned by such person or not except as provided by this ordinance. (b) No person shall throw or place any garbage, rubbish or refuse in any stream or other body of water. - 7 - 9 -17 (c) Waste material. No persons shall place any waste material in any street, alley or other public place. (d) No person shall cast, place, sweep or deposit any garbage - rubbish or refuse in such a manner that it may be carried by elements off his property. (e) No persons shall bury or burn garbage, rubbish or refuse in the Village except in accordance with regulations established by the Minnesota Pollution Control Agency and this Ordinance. (f) Location of Containers. All metal containers or equivalent shall at all times be located behind the rear line of the dwelling or in the garage or screened from view from the street and at least ten feet from any abutting dwelling. (g) Highly inflammable or explosive materials shall not be placed in containers for regular collection but shall be disposed of by notifying the fire marshal who will issue directions for the disposal of said item at the expense of the owner or possessor thereof. (h) Any person, firm or corporation, violating any of the provisions of this ordinance shall be guilty of a misdemeanor, and upon conviction, shall be punished by a fine of not more than $300.00 (three Hundred Dollars) or by imprisonment for not more than ninety (90) days, or both. Each day that a violation continues shall constitute a separate violation." Section 5. Section 1402.060 is hereby amended to read as follows: "1402.060. COLLECTION AND DISPOSAL. (a) All garbage and refuse accumulation in the Village shall be collected, conveyed and disposed of under the supervision of the Village Manager. The Village Manager shall have the authority to make rules and regulations concerning days of collection, type and location of waste containers and such other matters as he deems necessary, provided that such are not contrary to the provisions of this ordinance. (b) In all single and two- family dwellings, it shall be the responsibility of the occupant to contract with the licensed hauler of his choice to remove his garbage and refuse. It is further responsibility of the occupant to notify his hauler at least one week in advance of dis- continuance of service. - 8 - 9 -17 (c) The collector shall notify the health officer and the Village Manager of the notice of discontinuance of service to any premises within two days after service is discontinued. (d) Fees for hauling shall not exceed the approved maximum fees as approved by the Village and shall be paid directly to the hauler by the owner, agent, occupant or tenant of the premises of which the garbage and /or rubbish is collected, and such fees shall be full com pensation for his services of collection. The collector may refuse to make collections of any premises when the fees are not paid within one week from due date. Section 6. This ordinance shall take effect and be in force from and after the 1st day of November, 1970, and its passage and publication. ss /Lester G. Axdahl Mayor Attested byss/ Lucille E. Councilwoman Olson introduced the following ordinance and moved its adoption: Second Reading ORDINANCE NO. 270 AN ORDINANCE ADOPTING THE REGULATIONS OF THE MINNESOTA POLLUTION CONTROL AGENCY BY REFERENCE. THE COUNCIL OF THE VILLAGE OF MAPLEWOOD DOES HEREBY ORDAIN AS FOLLOWS: Section 1. This Section shall be known as Chapter 1404, Air Pollution Control Regulations. Section 2. "Section 1404.010, Adoption of Regulations of Minnesota Pollution Control Agency. There is hereby adopted by the Village of Maplewood for the purpose of prescribing regulations governing conditions hazardous to life and property the AMBIENT AIR QUALITY STANDARDS AND AIR POLLUTION CONTROL REGULATIONS as published by the Minnesota Pollution Control Agency and in effect as of the date hereof, of which standards and regulations not less than three copies have been received and are now marked as official copies and filed for use and examination by the public in the office of the Clerk of the Village, and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this ordinance takes effect, the provision thereof shall be controlling within the limits of the Village of Maplewood." - 9 - 9 -17 Section 3. "Section 1404.020. In addition to the approval of any exception, as provided in the standards and regulations of the Minnesota Pollution Control Agency, granted by the director of said agency, the applicant must also obtain approval of the Village Fire Marshal before starting any fire pursuant to such permit." Section 4. "Section 1404.030. Any person violating any of the provisions of the Ambient Air Quality Standards and Air Pollution Control Regulations shall be guilty of a misdemeanor, and upon convic- tion, shall be unished by a fine of not more than $300.00 (Three Hundred Dollars or by imprisonment for not more than ninety (90) days, or both. Each day that a violation continues shall constitute a separate violation." Section 5. All ordinances in conflict with the aforesaid standards and regulations are hereby repealed. Section 6. Councilman Wiegert introduced the following Ordinance and moved its adoption: (Second Reading ORDINANCE NO. 271 AN ORDINANCE AMENDING THE MAPLEWOOD CODE SECTION 1403, RELATING TO LICENSING GARBAGE COLLECTORS. THE COUNCIL OF THE VILLAGE OF MAPLEWOOD DOES HEREBY ORDAIN AS FOLLOWS: Section 1. 1403.020 of the Maplewood Code is hereby amended to read as follows: 1403.020. APPLICATION AND FEE. Any person, firm or corporation desiring a license to collect garbage and /or rubbish and refuse shall make application for the same to the Clerk upon a form prescribed by the Village Council. The application shall set forth: (1) The name and address of the applicant; (2) A list of the equipment which he proposes to use in such collection; - 10 - 9 -17 (3) The place or places to which the garbage and /or rubbish is to be disposed of; (4) The manner in which said garbage and /or rubbish is to be disposed of; (5) The portion of the Village in which collections are to be made; (6) A five -year plan of disposal and conformity with the Minnesota Pollution Control Agency regulations. Said application shall be submitted to the Health Officer for his investigation and report. If the Health Officer finds that the applicant is responsible and has proper equipment for such collection and that no nuisance is liable to be created by the granting of said license, he shall endorse his approval upon the application. Before any license may be issued, the applicant shall pay to the Clerk a license fee of $35.00 (Thirty -Five Dollars), which fee shall accompany the application. No license issued hereunder shall be for a longer period than one year, and all licenses shall expire on December 31st of each year. Section Z. Section 1403.050 of the Maplewood Code is hereby amended by adding the following Sections: 1403.050. Before being granted ,a license, the applicant shall provide a continuing performance bond in the amount of $3,000.00 (Three Thousand Dollars) for the benefit of the Village and its customers. It shall provide a certificate of public liability insurance in the minimum amount of $300,000.00 (Three Hundred Thousand Dollars) for one injury and $500,000.00 (Five Hundred Thousand Dollars) for more than one injured person per accident and $100,000.00 (One ' Hundred Thousand Dollars) property damage coverage per accident on each and every vehicle used in the Village of Maplewood for the pur- pose of collecting garbage and rubbish provided that such bond and insurance policies shall be subject to the approval of the Village Manager; and where more than one vehicle is used, the applicant may provide an improved blanket policy of liability insurance with the minimum coverages as stated. 1403.060. Applicant shall consent to and follow a schedule of pickup, setting the day and area of pick -up, as established by the Village Manager, so as to limit area pick -ups to the same day per week each week. 1403.070. Each licensed hauler shall report any accumulations of garbage or rubbish in violation of the Ordinances of the Village to the Village Manager. 1403.080. All rates of picking up rubbish or garbage, including fees for additional pick -up, which were in effect as of the 1st day of November, 1970, shall remain in effect and continue in force until changed as hereinafter provided - 11 - 9 -17 The Council may, upon its own initiative, or shall, upon petition of the licensee, but not more often than once each year, review the operations of the licenses; and after a public hearinq of which ten days' published notice shall be given as prescribed by ordinance, within sixty (60) days after the filing of such petition, the Council may establish reasonable rates which shall be the maximum that the licensee may charge for such services. In the case of a new licensee, said licensee shall file with the Village Clerk and the Village Manager a copy of all rates and charges, including the charges for additional pick -ups; and if said proposed rates are in excess of the then approved rates and charges, the license shall not be issued until either the rates are in conformity with the approved maximum charges or the applicant receives approval for said charges from the Village Council. 1403.090. Failure to comply with these regulations shall be grounds for revocation of the license brought by action of the Village Council after a hearing for said purpose. In the event the Village Manager finds violations and orders corrections of same which licensee fails to make, Village Manager may suspend the licensee's right to operate under the terms of the license and order his appearance at the next regular meeting of the Village Council for the purpose of hearing whether or not said suspension should continue in effect. Section 3. Section 3 of this amended ordinance. This ordinance shall take effect and be in force from and after the 1st day of November, 1970, and its passage and publication. ss/ Lester G. Manager Miller presented a resolution stating that the Village will implement all the standards and regulations of the Minnesota Pollution Control Agency except for the burning of leaves until the capacity to haul and dispose of leaves is established. Councilman Greavu introduced the following resolution and moved its adoption: 70 -9 -144 WHEREAS, THE MINNESOTA POLLUTION CONTROL AGENCY regulations require a municipality to determine whether or::not it has the - 12 - 9 -17 capability to haul garbage and rubbish either by private or public means, and report said finding to the Minnesota Pollution Control Agency; and WHEREAS, this is a new program of rather extensive proportion; and WHEREAS, the Council of the Village of Maplewood believes it has sufficient capacity through private haulers to remove garbage and refuse under normal conditions, it does not have capacity to handle a peak load of leaves which accumulate in the fall of the year; NOW, THEREFORE, BE IT RESOLVED that the Village Council of the Village of Maplewood will implement all of the standards and regulations in hauling of garbage and rubbish of the Minnesota Pol -ution Control Agency except for the burning of leaves until the capacity to haul and dispose of said leaves is established. RESOLVED FURTHER, that any burning-of leaves must be in conformity with the standards of the Village relative to burning within approved containers and the fire safety standards. RESOLVED FURTHER, that the Village Clerk is hereby authorized and directed to forward a certified copy of this Resolution to the Director of the Minnesota Pollution Control Agency. RESOLVED FURTHER, that,:the Village Council is concerned about the lack of adequate and economical P.C.A. approved disposal sites and request that immediate action be taken to resolve this problem. Manager Miller stated he is looking into the methods of closing the dump and requested Council authority to instruct the Staff to proceed. 2. Councilman Greavu moved that the Village Staff be instructed to investigate the Droner methods of closing the Maplewood Village Dump and report back to the Council. Seconded by Councilman Wiegert. Ayes - all. 2. Cope Avenue - Resolution a. Manager Miller stated that the State will not approve the Cope Street project until the Council officially adopts a position of ultimately opening the Cope Avenue intersection to the east and providing for access to Cope for the residences northeast of the proposed intersection of Cope and White Bear. Staff request passage of a resolution to be forwarded to the State. Award of bids for the project should not be made until the State accepts the project for aid. b. Councilman Greavu introduced the following resolution and moved its adoption: 70 -9 -145 WHEREAS, the Village has deemed it necessary to construct Cope Avenue from Hazelwood to White Bear Avenue; and WHEREAS, the Village has designated this street as a state - aid - street; and WHEREAS, the Village recognizing the potential conflict problem in the area of the intersection of Cope Avenue and White Bear Avenue NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MAPLEWOOD, MINNESOTA, that the Village of Maplewood hereby declares itself to extend Cope Avenue easterly of White Bear Avenue in accordance with Phase II of Municipal State Aid Project 38- 115 -01 or in accordance with those facilities included in said Municipal State Aid Project 38- 115 -02 but labled "Not Applicable This Contract" prior to opening to through traffic on that portion of Cope Avenue as shown on the construction plans identified as Municipal State Aid Project 38- 115 -02. Councilman Wiegert introduced the followin Ordinance and moved its adoption: Second Reading ORDINANCE NO. 272 AN ORDINANCE OF THE VILLAGE OF MAPLEWOOD RELATING TO DRUGS, NARCOTICS, POISONS AND CHEMICALS THE COUNCIL OF THE VILLAGE OF MAPLEWOOD DOES HEREBY ORDAIN AS FOLLOWS: Section 1. The title of Chapter 1214.061 is as follows: Drugs, Narcotics, Poison and Chemicals. Section 1214.061 is added to read as follows: Section 1214.061. POSSESSION OF INJECTION IMPLEMENTS. No person or persons except dealers or salesmen in surgical instruments, registered pharmacies, licensed pharmacists, licensed doctors of medicine, doctors of osteopathy duly licensed to practice medicine, licensed doctors of dentistry, licensed doctors of veterinary medicine, or nurses or interns in any licensed hospital or other Licensed institutions wherein sick and injured persons are cared for or treated, or bona fide hospitals wherein animals are treated, when under the direction and supervision of a licensed doctor as defined above, shall at any time have or possess any hypodermic syringe or needle or any instrument or implement adopted for the use of cocaine or narcotic drugs by subcutaneous injections, and which is possessed for that purpose, unless such possession be authorized by the certificate of a physician issued within the period of one year prior to any time of such possession. No person shall use, possess or have under his control for use any stem, bowl, lamp, yen hock or other opium smoking paraphernalia or accessories used for the smoking or inhalation of opium. Section 2. Section 1214.062 is added to read as follows: Section 1214.062. "MENACE TO PUBLIC WELFARE ". Any possession, sale distribution, prescribing, administration, dispensation or use of drugs, narcotics, poison or chemicals, or of any hypodermic syringe or needle, or any instrument or implement adopted for the use of narcotic drugs or any stem, bowl, lamp, yen hock or other narcotic smoking paraphernalia or acsessories used for the smoking or inhalation of narcotics contrary to the provisions of this Chapter, is hereby de- clared to be dangerous to the public health and a menace to the public welfare. - 15 - 9 -17 Section 3. Section 1214,070 is added to read as follows: Section 1214,070, State Pharmacy Law of 1937, Prohibited Drug Act and Uniform Narcotic Drug Adopted. The provisions of Minnesota Statutes annotated. Chapters 151, 152 and 618, each as amended by subsequent laws of the State of Minnesota, are adopted as part of a Drug, Narcotics, Poisons and Chemicals Ordinance regulating the transfer of possession, possession and use of drugs, narcotics, poisons and chemicals within the Village and are hereby incorporated in and made a part of this chapter as completely as if set out here in full. Section 4. Section 1214.080 is added to read as follows: Section 1214.080. Violation of this Chapter. Any person violating any provisisons of this Chapter shall be guilty of a misdemeanor. Section 5. This change will allow off- street parking lots in all areas as a special use with Council approval after a public hearing. b. Councilman Haugan introduced the following Ordinance and moved its adoption: (First Reading ORDINANCE NO. 274 AN ORDINANCE AMENDING SECTION 911.010 OF THE MAPLEWOOD CODE RELATING TO OFF- STREET PARKING Seconded by Councilman Wiegert. Ayes - all. - 16 - 9 -17 5 10 Proposed Park Site - Ostergren Property a. Village Attorney Don Lais presented a report on the progress of purchasing the Ostergren property. Mr. Ostergren is willing to sell but a problem has arisen as to how to allocate, the monies. Mr. Ostergren has agreed to grant immediate possession to the Westerly 193 ft.of the property for the skating rink and Mr. Lais stated he has an agreement and he requested the Mayor be authorized to sign it. The total price is $47,000.00 and $12,000.00 is to be paid at this time. Mr. Ostergren will deed the portion of the property for the skating rink immediately. b. Councilman Wiegert moved to authorize the Mayor to sign the agreement. Seconded by Councilman Greavu. Village Insurance Ayes - all. a. Manager Miller stated that the Staff recommended that the existing Village Insurance be continued through its third and final year. The cost of the insurance is about $17,000. with the new higher values. The Staff believes that a comprehensive study of our insurance pro- gram should be undertaken and that any such study, if done well, will take time. In addition, the method of determining the coverage (staff or insurance committee) should be thoroughly studied. b. Councilman Wiegert moved to authorize the Staff to continue with the present Village Insurance and to proceed with the comprehensive study of the insurance program. Seconded by Councilwoman Olson. Ayes - all. 7. Resolution - Highwood Avenue Storm Sewer a. Manager Miller stated that a resolution would be necessary to request the cooperation of St. Paul and Ramsey County to provide necessary and adequate storm water relief for the Highwood Avenue - McKnight Road area. b. Councilman Greavu introduced the following resolution and moved its adoption: 70 -9- 146 RESOLVED, by the Village Council of Maplewood, Minnesota, that the health, safety and welfare of the citizens of the Village of Maplewood, County or Ramsey and City of Saint Paul are threatened by the present lack of adequate storm water relief in the vicinity of the intersection of Highwood Avenue and McKnight Road; that to provide the necessary storm water relief in this area necessitates the cooperation of the Village of Maplewood, the County of Ramsey and the City of St. Paul; RESOLVED FURTHER, that the Village Council of Maplewood, Minnesota, requests the cooperation of the Board of Ramsey County Commissioners - 17 - 9 -17 and the Council of the City of Saint Paul in providing the necessary and adequate storm water relief in the area of Highwood Avenue and McKnight Road. Human Rights Commission - Survey Results a. Mr. Dwight Jessup, representing the Human Rights Commission, presented Council with a report regarding the results of the survey taken by the Commission this spring. He also presented a letter signed by Chairman Clarence Harris with 7 recommendations the Commission wished to have Council consider and submit an answer to the Human Rights Commission by November 1, 1970. b. The Council indicated they would meet with the Human Rights Commission to discuss the proposals. 2. Building Plans - Maplewood Bowl a. Mr. Robert Hall owner of the Maplewood Bowl presented plans for an addition to his building at 1955 English. The addition is to be added to the west of the existing building. He has enough land to provide adequate parking facilities. The addition will provide additional bowling lanes, a dance floor etc. b. Administrator Seida made the Staff presentation which included the recommendation to approve the addition subject to several condi- tions. Conern was :expressed regarding the drainage problems in the area. Mr. Hall stated he would construct the parking lot so that the run off water would flow to the north also the run off from the building would be directed to the north. c. Following further discussion, Councilman Haugan moved to approve the buildi pl ng ans of Mr. Robert Hall for the addition to the Maplewood Bowl subject to the following Staff recommendations: 1. A final grade elevation plan for the proposed parking lot must be submitted and approved prior to any paving of the parking lot; 2. A retaining wall along the south side of the proposed parking lot shall be provided and approved by the Village Engineer; - 18 - 9 -17 3. The drainage of the expansion parking lot shall be to the north towards the railroad tracks; 4. The parking lot shall be paved, marked and properly signed prior to occupancy approval of the expansion portion of the building; 5. The parking lot shall have an approved and installed lighting plan prior to occupancy permit being granted; 6. A paved safety Slarie along the north side of the building shall be required; 7. All refuse and garbage receptacles shall be required to be kept on the north side of the building; 8. All parking stalls shall be so designed to eliminate vehicles from extending over property lines; 9. The driveway leading from the parking lot to Atlantic Street shall be paved and curbed on the south side and drained to the north towards the railroad tracks; 10. There shall be a minimum 6" high concrete curb raised above finish parking lot grade along the south and west side of the lot to channel surface water to the north towards the railroad tracks. Seconded by Councilman Greavu. 3. Ordinance (Disorderly Conduct) Ayes - all. a. Village Attorney Lais read the proposed ordinance amending Section 1202 of the Maplewood Code relating to disorderly conduct. This Ordinance would improve the enforcebility of the Villages disorderly conduct regulations. b. Eberty, removed fill material from the property of Gerta Vanderhoff; and WHEREAS, Gerda Vanderhoff sued the Village, W. J. Ebertz and Roy Delaney and said case came to trial in Ramsey County and was settled for the sum of $375.00, Roy Delany to pay $75.00 and the Village to pay $300.00.
