H. UNFINISHED BUSINESS (continued) 4. Lot Division - 2705 E. Fifth Street a. Manager Miller presented the Planning Commissions recommendation to deny the request of Mr. Harold Funke, 2705 E. Fifth Street to divide his property into 2 lots; Lot 1 where the residence is will contain 9,540 sq, ft. and Lot 2 would have 7,800 sq. ft. Both lots would be below the;10,000 sq. ft. required by Village Codes. b. Mr. Funke thanked the Council for hearing his request and spoke on behalf of why he wishes to divide the lot. c. Councilman Wiegert moved to concur with the Planning Commissions recommendation to deny the request of Mr. Harold Funke to divide his lot. Seconded by Councilman Haugan. Ayes - all. 6. Ordinance Review - Natural Resources Commission a. Manager Miller stated the Planning Commission recommends the Ordinance fora Natural Resources Commission be tabled until the general plan is completed. The Park and Recreation Commission recommends adoption. The Staff concurs with the Planning Commission. b. Councilman Haugan moved that the Ordinances on a Natural Resources Commission be tabled until the general plan is completed. Seconded by Councilman Wiegert. Ayes - all. - 1 - . 8-13 8. Park Shelter - Upper Afton Field Delayed until Mr. Thomas Van Housen appears. 10. 11th Avenue - Utilities a. Manager Miller stated the Village of North Saint Paul is now proceeding with the improvement of 11th Avenue in conjunc- tion with the Target Development and would like to know if the Village of Maplewood wishes to install utilities in conjunction with the street improvement. This will require Council initia- tion of public hearings for Water and Sanitary Sewer and Storm Sewers for that area. The Staff recommends authority to prepare a feasibility study for the installation of these utilities. The Staff feels that the construction of these improvements will save ripping the street up at a future date and will save money on ever-increasing construction costs. %~see attached sheet for Councilwoman Olson's statement. b. Councilman Greavu introduced the following resolution and moved its adoption: 70-8- 107 WHEREAS, the Village Council has determined that it is necessary and expedient that the area described as: 11th Avenue - Ariel Street to White Bear Avenue be improved by construction of Water Mains, ' Sanitary Sewer and Service Connections appurtenances..:.. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MAPLEWOOD, MINNESOTAy that<.the improvements-as:hereinbefore described is `hereby'referredrto Village Engineer, and he is instructed to report to the Council with all convenient speed advising the Council in a preliminary way as to whether the proposed improvement is feasible and should best be made as proposed, and the°'estimated cost of the improvement as rec- ommended. Seconded by;Gouncilman Wiegert. Ayes - aT'1. I. NEW BUSINESS 1. Sign Regulations - Discussion a. Administrator Seida read the existing code on sign regulations. The Planning Department has picked up several signs which were r';', in violation of the Village's sign ordinances. The signs advertised garage sales, a commercial venture (not properly zoned) and the sale of worms. The enforcement has resulted in - 2 - 8-13 the request that this item be placed on the agenda for discussion. These types of signs are cluttering public right-of-way and are in need of regulation. b. After further discussion,Councilman Wiegert moved that the Staff attempt to draw un some sort of temporary sign regulations perhaps short of getting into the permit area and the Village offices promo- . ga e ese regu a ions roug ou e ommu m y. Seconded by Councilman Greavu. Ayes - all. 2. Swimming Pool Regulation - Discussion a. Councilwoman Olson moved to table this matter until the next regular meetin and to invite a representative from a swimming pool center to attend the meetin . Seconded by Councilman Naugan. Ayes - all. 4. Request for Deadline Extension Tilsen - Preliminary Plat a. Manager Miller stated that the Tilsen Company has requested a 90 day preliminary plat time extension. Mr. Tilsen stated he needed more time due to the engineering tests needed and also the determining of storm and sanitary sewer capacities in the Village of North St. Paul systems or as an alternative the Maplewood systems. b. Councilman Greavu moved to grant the Tilsen Compan a 90 day extension for their preliminary plat. Seconded by Councilwoman Olson: Ayes - all. 6. Final Plat - DeCoster a. Manager Miller presented the final plat of the Maplewood Office Center fpr approval. Mr. DeCoster has filed an irrevocable letter of credit issued by the 1st National Bank of St. Paul as faithful financial guaranteeing ' improvement of all public streets within the area to be platted. The Village attorney has reviewed the letter from the banking 'institution and has determined that the letter is acceptable. Approval is recommended subject to conditions. - 3 - 8-13 b. Councilman Haugan moved approval of the Maplewood Office Center final plat subject to the following conditions: 1. The subdivider shall be responsible to acquire all those necessary slope easements along the east side of Sloan Place, north of Roselawn Avenue to the Parkside Fire Department property. 2. Subdivider improve the public street right-of-way by October 15, 1970. (This is the date the _ letter of Credit runs out) 3. Agreement between Village and the subdividers which specifies the time necessary to start and complete all street improvements and failure to do so would then allow the Village to cause demand upon the letter of credit. 4. The Village Legal Staff prepare:! am; agreement which provides for street maintenance and liabilities for damages and repairs will be assumed by the subdivider for a period of time after Village acceptance and the amount of financial guarantee will be submitted to the Village to cover this stipulation. Seconded by Councilman Wiegert. Ayes - all. 7. Speed Limit Reduction Request a. Manager Miller stated a petition for the reduction of the speed limit on Rosewood Avenue to 10 M.P.N. Any reduction would have to be approved by the State Highway Commission. b. Councilman Greavu moved that the request for speed limit reduction on Rosewood Avenue to 10 miles per hour be denied. Seconded by Councilman Wiegert. Ayes - Mayor Axdahl, Councilmen Greavu, Haugan and Wiegert. Nay - Councilwoman Olson. 8. Upper Afton Park - Name a. Manager Miller presented a recommendation from the Park and Recreation Commission that the Upper Afton Road Park site be named "Will:iam L. Ebertz Memorial Park". Mr. Ebertz was a resident of Maplewood and had made substantial contributions to the Village in the development of the park! site at Upper Afton. - 4 - 8-13 Mr. Ebertz was killed on July 9, 1970 in a tractor accident at the gravel pit which he operated. b. The Staff recommends against this practice for the following reasons: 1) Naming a park after a Village resident a first time will set a prec~~ient which will require other difficult evaluations of citizens in the future. 2) An individual's public image, decision-making bodies which evaluate them, and the people who live in the neighborhood and use the facility' change in time. The situation may develop in which future generations who use the facility may no longer be aware of the significance of the park's name. 3) This precedent requires that public bodies make, before the public eye, difficult and emotional decisions regarding an individual's character and contribution. Generally we would not recom- mend this practice unless there is an unusual circumstance so unique that it becomes competing. c. Councilman Haugan moved to deny the request to rename the Upper Afton Park - The William L. Ebertz Memorial" and for the Village to express their appreciation for the contributions of Mr. Ebertz but Council feels policy should be to name recreational facilities for the area and not an individual person. Seconded by Councilman Wiegert. Ayes - all. 9. Resolutions: 1. Tax Exempt Property a. Manager Miller stated that the League of Minnesota Municipalities has requested that the Village adopt the enclosed resolution which endorses the adoption of Amendment No. 1 relating to tax-exempt property. b. Councilman Wiegert introduced the followin resolution and moved its adoption: 70-8- 108 WHEREAS, the Village of Maplewood is by law almost totally dependent on the property tax to finance municipal services; and - 5 - 8-13 WHEREAS, the Village Council is acutely aware of the burden which property taxes impose on property owners, particularly those individuals living on fixed incomes; and WHEREAS, the Village Council is concerned about the steady growth in tax-exempt property which serves to increase the burden of taxpaying property owners; and WHEREAS, the Village Council is not unmindful of the valuable services performed by many tax-exempt organizations, particularly religious and educational institutions, and WHEREAS, the Minnesota Legislature has thoroughly studied this problem and expressed its concern through the passage of Laws 1969c.925, which proposes to amend Article 9, Section 1 of the Minnesota Constitution to permit the Legislature to define or limit the classes of exempt property, except churches, houses of worship and property used solely for educational purposes; and WHEREAS, the Village Council believes the proposed amendment to be in the best interests of the Village of Maplewood and the State as a whole, and represents a reasonable means of meeting the need to more equitably spread the burden of financing local government services while at the same time avoiding imposing undue financial hardship on educational and religious institutions; NOW, THEREFORE,BE IT RESOLVED, that the Village Council of Maplewood endorses the principles of equitable tax policy and reform exemplified in Amendment No. 1 relating to tax- . exempt property and urges its ratification. Seconded by Councilman Greavu. Ayes - all. 2. Labor Relations Representative. a. Manager Miller stated that the League of Minnesota Municipalities recommends the appointment of the Village Manager as the exclusive labor relations representative of the Village. This in no way effects the final decision making power of the Coaacl. b. Councilwoman Olson moved that Manager Michael Miller be appointed as Labor Relations Representative for the Villa e. Seconded by Councilman Greavu. Ayes - all. - 6 - 8-13 10. Village Insurance a. Manager Miller stated that the Village's liability, fire, automobile etc. insurance to be inadequate. Staff requests permission to request quotations from several insurance companies for improved coverage. b. Mr. Bill Howard, 910 E. County Road C., suggested that an insurance committee be established, open to all full time insurance agents in the Community who are licensed. c. Councilwoman Olson moved that the insurance committee proposal be studied. Seconded by Councilman Haugan. Ayes - all. 12. Special Assessments. Manager Miller requested Council authorization to prepare the assessment rolls. The Staff presented a summary of project costs to enable the Council to set assessment rates for this year's hearings. Sanitary Sewer - $ 8.75 per foot 130.01 service connection Water $ 8.25 per foot 185.86 service connection Street Imp. Pleasantview Park - Highwood Avenue Area 14.00 per foot White Bear Avenue $3.50 per foot Storm Sewer $.02 per square foot residential $.04 per square foot Commercial and anything above R-1 Zoning. Councilman Greavu moved to set the rates as stated above for the improvements to be assessed. Seconded by Councilman Wiegert. Ayes - all. - 7 - 8 - 13 Resolutions authorizing preparation of assessment rolls. a. Councilman Greavu introduced the following resolution and moved it's adoption: 70-8- 109 WHEREAS, the Village Clerk and Village Engineer have presented the final figures for the improvement of County Road C - Linden Lane Sewer 68-SAS-1, _ ~K~Xr7bY~x9Ya~F~ NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MAPLEW00D, MINNESOTA: that the Village Clerk and Village Engineer shall forthwith calculate the proper amount to be specially assessed for such improvement against every assess- . able lot, piece or parcel of land abutting on the streets affected, without regard to cash valuation, as provided by law, and they .shall file a copy of such proposed assessment in the Village Office for inspection' FURTHER, the Clerk shall, upon completion of such pro- posed assessment notify the Council thereof. Councilman Greavu introduced the following resolution and moved it's adoption: 70- 8- 110 WHEREAS, the Village Clerk and Village Engineer have presented the final figures for the improvement of Pleasant- view Park - Highwood Avenue Utilities and Street 68-SAS-2, NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MAPLEWOOD, MINNESOTA: that the Village Clerk and Village Engineer shall forthwith calculate the proper amount to be specially assessed for such improvement against every assess- able lot, piece or parcel of land abutting on the streets affected, without regard to cash valuation, as provided by law, and they%shall file a copy of such proposed assessment in the Village Office for inspection. FURTHER, the Clerk shall, upon completion of such pro- posed assessment notify the Council thereof. Seconded by Councilman Wiegert. Manager Miller stated that 3M requests that the Village undertake a feasibility study for the upgrading of Conway Avenue. b. Councilman Greavu introduced the following resolution and moved its adoption: 70-8- 122 WHEREAS, the Village Council has determined that it is necessary and expedient that-the area described as: Conway Avenue from McKnight Road to Century Avenue be improved by construction of Street°:;Improvements. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MAPLEWOOD, MINNESOTA that the improvement as hereinbefore described is hereby referred to Village Enineer, and he is instructed to report to the Council with all convenient speed advising the Council in a preliminary way as to whether the proposed improvement is feasible and should best be made as proposed, and the estimated cost of the improvement as recom- mended. Manager Miller stated it is recommended by Staff that a feasibility study be ordered for the installation of Storm Sewer on Highwood Avenue from Crestview Drive to McKnight. b. Councilman Haugan introduced the following resolution and moved its adoption: 70-8-123 WHEREAS, the Village Council has determined that it is necessary and expedient that the area described as: Highwood Avenue from Crestview Drive to McKnight be improved by construction of Storm Sewer; NOW, THEREFORE, BE IT RESOLVED 'BY THE VILLAGE COUNCIL OF MAPLEWOOD, MINNESOTA that the improvement as hereinbefore described is hereby referred to Village Engineer, and he is instructed to report to the Council with all convenient speed advising the Council in a preliminary way as to whether - 16 - 8-13 the proposed improvement is feasible and should best be made as proposed, and the estimated cost of the improvement as recommended. Councilwoman Olson requested that the memorandum submitted by the Director of Public Safety be made a part of the minutes. The system appears to be adequate, except, for street signing which I was informed has been ordered and is past due. - 17 - 8-13 As far as public safety vehicles are concerned, T have asked East County Line Fire Department to check the park, particularly the entrance. Today they advised me that they checked with one of their trucks and they had no difficulty maneuvering into and out of the site from both directions. The entrance design was approved by the Ramsey County Safety Engineer. However, he also feels it will be a problem location until Lakewood Drive is realigned and raised. Manager Mr. Ray Hite met with the Highway Department regarding the intersection of Brookview Drive and Highway 1.20 and they are in the process of correcting the grades and are sloping the banks. The Manager met with Ramsey County regarding the problems on County Road C concerning the driveways. A solution is being worked out. P1r. Stanke's mailbox has been moved to its original location. Mr. Tony Hartman did not apply for a building permit as yet because of the lot being undersized but unless something is wrong with the building plans, the permit will be issued. The Beaver Lake Plobile Home Park has been checked for occu- pancy in trailers that have not been issued occupancy permits. Received a letter stating the Water Rates Study Committee will hold a meeting August 19, and would like a representative from the Village to attend. Councilman Wiegert will attend. L.
