Ordinance1040 AN INTERIM ORDINANCE AUTHORIZING A STUDY AND IMPOSING A MORATORIUM ON THE OPERATION OF CANNABIS BUSINESSES The City Council of the City of Maplewood ordains as follows: ARTICLE I. Authority and Legislative Findings. August 14, 2023 City Council Meeting Minutes 6 Council Packet Page Number 7 of 187 E2 A.The Minnesota Legislature recently enacted and Governor Walz signed 2023 Minnesota Session Laws, Chapter 63 – H.F. No. 100 (“Act”), codified as Minnesota Statutes, sections 342.01, et seq., which is comprehensive legislation relating to cannabis including, but not limited to, the establishment of the Office of Cannabis Management (“OCM”), legalizing and limiting the possession and use of cannabis and certain hemp products by adults, providing for the licensing, inspection, and regulation of cannabis businesses and hemp businesses, taxing the sale of cannabis flower, cannabis products, and certain hemp products, establishing grant and loan programs, amending criminal penalties, providing for expungement of certain convictions and providing for the temporary regulation of certain edible cannabinoid products. B. The Act provides local units of government certain authority related to cannabis businesses, including the authority to (1) adopt reasonable restrictions on the time, place, and manner of the operation of cannabis businesses, provided that such restrictions do not prohibit the establishment or operation of a cannabis businesses, (2) limit the number of certain cannabis businesses based on the population of the community, (3) prohibit the operation of a cannabis business within 1,000 feet of a school or 500 feet of a day care, residential treatment facility, or an attraction within a public park that is regularly used by minors, including a playground or athletic field, and (4) require local registration of certain cannabis businesses operating retail establishments,. C. The Act requires the OCM, which was established effective July 1, 2023, to work with local governments to develop model ordinances for reasonable restrictions on the time, place, and manner of the operation of cannabis businesses. The Act also requires the OCM to establish additional rules and regulations relating to the operation of cannabis businesses. Maplewood will benefit from reviewing and analyzing the OCM’s model ordinances, rules and regulations before making any decisions related to the regulation of cannabis businesses in the City. D. Minnesota Statutes, section 342.13(e) expressly allows a local unit of government that is conducting studies or has authorized a study to be conducted or has held or scheduled a hearing for the purpose of considering adoption or amendment of reasonable restrictions on the time, place and manner of the operation of cannabis businessesto adopt an interim ordinance applicable to all or part of its jurisdiction for the purpose of protecting the planning process and the health, safety, and welfare of its citizens. The interim ordinance may regulate, restrict, or prohibit the operation ofcannabis businesses within the jurisdiction or a portion thereof until January 1, 2025. E. Given the uncertainty regarding the model ordinances to be developed by the OCM and the broad scope of the changes to Minnesota law brought about by the Act, Maplewood desires to adopt an interim ordinance for the purpose of protecting the planning process and the health, safety, and welfare of its citizens. F. Maplewood desires to conduct a study for the purpose of considering the adoption or amendment of reasonable restrictions on the time, place and manner of the operation of August 14, 2023 City Council Meeting Minutes 7 Council Packet Page Number 8 of 187 E2 cannabis businesses as well as the other regulations local units of government may adopt under the Act. G. On August 14, 2023, after providing at least 10 days published notice, the City Council held a public hearing regarding the consideration and adoption of an interim ordinance prohibiting the operation of cannabis businesses within the City until January 1, 2025. ARTICLE II. Definitions. For purposes of this Ordinance, the following terms shall have the meanings given them in this section. (a)“Act” means 2023 Minnesota Session Laws, Chapter 63 (H.F. No. 100), codified as Minnesota Statutes, sections 342.01, et seq. (b)“Cannabis Business” has the meaning given the term in Minnesota Statutes, section 342.01, subd. 14. (c)“City” means the City of Maplewood, Minnesota. (d)“Edible Cannabinoid Product” has the meaning given the term in Minnesota Statutes, section 151.72, subd. 1(f). (e)“OCM” means the Office of Cannabis Management, established as set forth in Minnesota Statutes, section 342.02, subd. 1. (f)“Ordinance” means this interim ordinance, which is adopted pursuant to Minnesota Statutes, section 342.13(e). ARTICLE III. Study Authorized.The City Council hereby authorizes and directs the City Manager to have City staff and consultants conduct a study regarding the adoption or amendment of reasonable restrictions on the time, place, and manner of the operation of Cannabis Businesses, as well as the other potentiallocal regulations allowed under the Act, and report to the City Council on the potential regulation of Cannabis Businesses. The study must include a review of the model ordinances the OCM is directed to draft under Minnesota Statutes, section 342.13(d), an analysis of potential setback regulations allowed under Minnesota Statues, section 342.13(c), and such other matters as staff may determine are relevant to the City Council’s consideration of this matter. The report shall include the City staff’s recommendations on whether the City Council should adopt regulations and, if so, the recommended types of regulations. ratorium. During the term of this Ordinance, no business, person, or entity may establish or operate a Cannabis Business within Maplewood. The City shall not accept, process, or act on any application, site plan, building permit, zoning request, or other approval, including any requestedconfirmation, certification, approval, or other request from the OCM or other governmental entity requesting City review of any application or proposal for a business proposing to engage in the operation of a Cannabis Business. Violation.During the term of the moratorium, it is a violation of this Ordinance for any business, person, or entity to establish or operate a Cannabis Business within the City. ARTICLE VI. Exceptions.Themoratorium imposed by this Ordinance does not apply to: (1) the continued operation of a business as part of the Medical Cannabis Program administered by the Minnesota Department of Health that was lawfully operating within the City prior to July 1, 2023; (2) the lawful sale of Edible Cannabinoid Products in compliance with Minnesota Statutes, section 151.72; or (3) sales of Edible Cannabinoid Products at an exclusive liquor store in accordance with Minnesota Statutes, section 340A.412, subd. 14. Nothing in this Article exempts a business, person, or entity that is selling Edible Cannabinoid Products from having to comply with all requirements and prohibitions of applicable laws and ordinances. ARTICLE VII. Enforcement.Violation of this Ordinance is a misdemeanor. The City may also enforce this Ordinance by mandamus, injunction, or other appropriate civil remedy in any court of competent jurisdiction. A violation of this Ordinance is also subject to the City’s general penalty in City Code and may result in the City reporting the violation to the OCM if relevant to OCM licensing. The City Council hereby authorizes the City Manager, in consultation with the City Attorney, to initiate any legal action deemed necessary to secure compliance with this Ordinance. ARTICLE VIII. Duration.This Ordinance shall become effectiveon the first day of publication after adoption and shall remain in effect until January 1, 2025. Resolution 23-08-2237 RESOLUTION AUTHORIZING PUBLICATION OFORDINANCE NO. 1040 BY TITLE AND SUMMARY August 14, 2023 City Council Meeting Minutes 9 Council Packet Page Number 10 of 187 E2 WHEREAS, the city council of the city of Maplewood has adopted Ordinance No. 1040, an interim ordinance establishing a moratorium on the operation of cannabis businesses; and WHEREAS, Minnesota Statutes, section412.191, subd. 4, allows publication by title and summary in the case of lengthy ordinances or those containing charts or maps; and WHEREAS, the ordinance is three pages in length; and WHEREAS, the city council believes that the following summary would clearly inform the public of the intent and effect of the ordinance. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Maplewood that the city clerk shall cause the following summary of Ordinance No. 1040 to be published in the official newspaper in lieu of the entire ordinance: Public Notice On August 14, 2023, the city council of the city of Maplewood adopted Ordinance No. 1040, an ordinanceestablishing a moratorium on the operation of cannabis businesses, as that term is now defined in state law. The 2023 Legislature adopted Minnesota Statutes, section 342.01, etseq. which permits the establishment and operation of cannabis businesses. The statute establishes a state Office of Cannabis Management (the “OCM”) which will be responsible for licensing cannabis businesses. Cities are allowed limited authority to regulate cannabis businesses. The OCM is required to draft model ordinances regarding reasonable restrictions on the time, place and manner of local regulations. The interim ordinance declares a moratorium on the operation of cannabis businesses and authorizes a study to determine if and how the city wishes to regulate them. Medical cannabis and other products which could be sold legally before July 1, 2023 are not covered by the moratorium. The moratorium will be in effect until January 1, 2025 unless repealed earlier. This public notice is intended only to summarize the ordinance. The City of Maplewood's Strategic Plan consists of SIX strategic priorities which are established by the City Council. These priorities are supported by a series of Key Outcomes and underlying Performance Measures, which describe desired outcomes and are a metric in measuring success. At the council retreat in May of 2023, a mission statement and values were established by the council and management staff. These were then officially approved by the council on June 12, 2023. Resolution 21-10-1995 CONDITIONAL USE PERMIT FOR A SHORELAND PLANNED UNIT DEVELOPMENT, PRELIMINARY PLAT AND FINAL PLAT RESOLUTION BE IT RESOLVED by the City Council of the City of Maplewood, Minnesota, as follows: Section 1. Background. 1.01 Mick Conlan, of Gramercy Development, has requested approval of a conditional use permit for a shoreland planned unit development. 1.02 The existing lot is currently an outlot and the applicant has requested approval for preliminary plat and final plat in order to develop this property. 1.03 The property is located at 1875 East Shore Drive and is legally described as: PIN: 162922310030 – Outlot A, Shores of Maplewood, Ramsey County, Minnesota. Section 2. Standards. 2.01 City Ordinance Section 44-1242 requires a Conditional Use Permit for a Shoreland Planned Unit Development. 2.02 Shoreland Conditional Use Permit Standards. City Ordinance Sec. 44-1247 states that the City Council must base approval of a Conditional Use Permit within Shoreland areas. 1. The proposed plan would limit the visibility of structures from public waters (assuming summer conditions). 3. The types, uses and numbers of any watercraft that the project would generate would be compatible with the capacity of the public waters to handle these watercraft. 2.03 General Conditional Use Permit Standards. City Ordinance Section 44-1097(a) states that the City Council must base approval of a Conditional Use Permit on the following nine standards for approval. 1. The use would be located, designed, maintained, constructed and operated to be in conformity with the City’s Comprehensive Plan and Code of Ordinances. 2. The use would not change the existing or planned character of the surrounding area. 3. The use would not depreciate property values. 4. The use would not involve any activity, process, materials, equipment or methods of operation that would be dangerous, hazardous, detrimental, disturbing or cause a nuisance to any person or property, because of excessive noise, glare, smoke, dust, odor, fumes, water or air pollution, drainage, water run-off, vibration, general unsightliness, electrical interference or other nuisances. 5. The use would not exceed the design standards of any affected street. 6. The use would be served by adequate public facilities and services, including streets, police and fire protection, drainage structures, water and sewer systems, schools and parks. 7. The use would not create excessive additional costs for public facilities or services. 8. The use would maximize the preservation of and incorporate the site’s natural and scenic features into the development design. 9. The use would cause minimal adverse environmental effects. 2.04 City Ordinance Section 34-8 sets the minimum design standards for preliminary plats and final plats. Section 3. Section 4. City Review Process 4.01 The City conducted the following review when considering the conditional use permit for a planned unit development amendment request. 1. On September 21, 2021, the planning commission held a public hearing. City staff published a hearing notice in the Pioneer Press and sent notices to the surrounding property owners. The planning commission gave everyone at the hearing a chance to speak and present written statements. The planning commission recommended that the city council approve this resolution. 2. On October 11, 2021, the city council discussed this resolution. They considered reports and recommendations from the planning commission and city staff. Section 5. City Council 5.01 The city council hereby approves the resolution. Approval is based on the findings outlined in section 3 of this resolution. Approval is subject to the following conditions: (additions are underlined and deletions are crossed out): 1. Adherence to the design and site plans date-stamped September 3, 2021. The director of community development may approve minor changes. 2. The proposed construction must be substantially started within one year of council approval or the permit shall become null and void. 3. The city council shall review this permit in one year. 4. This approval permits density credits for underground parking and high-rise units adding 0.69 acres to the overall site size. 5. The owner recently rebuilt a trash enclosure and repainted the monument sign facing Highway 36. In relation to the used auto sales on the site, no concerns or violations are present. The site does not have a comprehensive sign plan in place. Therefore, other than routine maintenance, painting, or re-facing the copy on signs, any changes to the location or size would require a comprehensive sign plan, and the owner would be required to submit an application for city review. The property has been inspected, and the conditions of the CUP have been achieved. Staff does not find any reason to continue reviewing the CUP unless a problem arises or a significant site change is proposed. Timeline/Previous Actions April 8, 1976: The city approved the development plans for Maplewood Office Park. City staff published a hearing notice in the Pioneer Press and sent notices to the surrounding property owners. The Planning Commission gave everyone at the hearing a chance to speak and present written statements. The Planning Commission recommended that the City Council approve this resolution. 2. On March 14, 2022, the City Council discussed this resolution. They considered reports and recommendations from the planning commission and City staff. Section 5. Background SCBAs are worn by firefighters to protect the lungs and face during emergency calls that present an Immediate Danger to Life and Health (IDLH) environment. The SCBA contains a high pressure cylinder of compressed air that the firefighters breathe, allowing them to work in hazardous environments. Once an SCBA cylinder is used by a firefighter it must be refilled with clean breathable air. Currently, the Maplewood Fire Department has an SCBA fill station at the North Station. In order to fill SCBA bottles at the South Station, the mobile air truck is utilized. However, the mobile air truck has a small fill station and does not have an air compressor; therefore, the mobile air truck must be transported to the North Station to fill the onboard air tanks after filling SCBA bottles. An SCBA fill station at the South Station will improve operational effectiveness by more efficiently returning SCBAs to a ready state. There is a 10 percent cost match of $4,249.01, the cost match will be paid out of the fire department’s operating budget. Staff evaluated two SCBA fill station systems. Staff have been using an Arctic SCBA fill station at the North Station since June of 2022. Staff have experienced several issues with the equipment which have resulted in the equipment failing to operate and operating at a reduced capacity. The issues have included oil consumption requiring monthly service, inconsistent air compressor activation, air leaks, and adaptors failing. This building addition would add a photo booth and service bays to the existing building, which provides overflow vehicle maintenance service for Maplewood Toyota – located approximately 0.3 miles south. This property is for internal use only; no general public or customers will be on-site. To move forward, the applicant needs city council approval of a conditional use permit amendment, a building setback variance, and design review. The initial 60-day review deadline for a decision is September 30, 2023. As stated in Minnesota State Statute 15.99, the city is allowed to take an additional 60 days if necessary to complete the review. Council Packet Page Number 150 of 187 J2 Background: Conditional Use Permit Amendment Article II, Section 44-637 of the city code requires a conditional use permit to operate a motor vehicle maintenance garage and to construct a building closer than 350 feet to an adjacent residential district within the light manufacturing (M-1) district. In 2004, the city council approved a CUP allowing Venburg Tire to construct the existing building and operate a motor vehicle maintenance garage. Since that time, Maplewood Toyota has purchased this building and is proposing a building addition that would add a photo booth and service bays to the existing building. Staff is unaware of any outstanding neighborhood concerns regarding the use of this property. Staff did inspect this property and found that the site’s trash receptacles are not being kept within the enclosure as required by ordinance. In addition, the building expansion will necessitate the removal of the existing trash enclosure. The applicant should be required to submit a revised site plan showing the location and design of the new required trash enclosure. Staff also recommends that the applicant be required to provide additional screening along the west property line. As part of the property’s 2004 approvals, screening was required on the west side of the property. Still, as the vegetation has matured, it is not meeting the ordinance requirements of six feet tall and 80 percent opaque to provide year-round screening. The applicant should be required to provide a landscaping plan for staff approval that adds four coniferous trees near the west property line. Setback Variance The proposed building addition will extend 60 feet westward from the existing building coming within 154 to the nearest residential property line. The addition requires a 196-foot variance. In 2004, the city approved a 130-foot variance. The site’s size and shape were dictated by the realignment of County Road D in the mid-2000s. Staff is comfortable with the variance request as the proposal is in keeping with the spirit and intent of the ordinance, and there are practical difficulties in making reasonable modifications to the site that are related to the operation of this site. Design Review Building Elevations The building addition is oriented towards the rear and will be constructed with insulated precast concrete wall panels to match the existing building. No changes are proposed to the front elevation of the building or the site’s circulation and access drives. While an existing light pole will be replaced with building-mounted lighting, there will be no changes to the site’s overall photometric plan – the applicant will continue to be required to meet the city’s lighting ordinance requirements. As mentioned earlier in this report, the applicant must submit a landscape plan showing the addition of four coniferous trees near the west property line. Council Packet Page Number 151 of 187 J2 Department Comments Engineering – Jon Jarosch The applicant shall obtain a grading/erosion control permit, along with a storm sewer permit for the proposed work. All conditions of these permits shall be met. Building Official – Randy Johnson The proposed building is required to meet the minimum requirements of the Minnesota State Building Code. Board and Commission Review Community Design Review Board August 15, 2023: The community design review board (CDRB) reviewed this project and recommended approval. The CDRB added a condition requiring that either the building's existing and proposed elevations be stained a single, matching color or the building addition be setback 12 inches south from the existing north building line. Planning Commission August 15, 2023: The planning commission held a public hearing, reviewed this project and recommended approval. Citizen Comments Staff sent public hearing notices to the 87 surrounding property owners within 500 feet of the proposed site and invited property owners to share their opinions about this proposal. Staff received the following comments. 1.We have six condominiums. That face southeast, overlooking the Vanburg building. We feel that any addition facing our condo's will take away from any view still left to us. When the leaves disappear in the fall, what are we left with but the view of buildings. In our opinion, this parcel of land is too small for an addition to this building. In addition, we will be losing, much needed, existing green space. If necessary, they could build on the other side of the building, closer to highway 61. City Ordinance Section 44-1097(a) states that the City Council must base approval of a Conditional Use Permit on the following nine standards for approval. 1.The use would be located, designed, maintained, constructed and operated to be in conformity with the City’s Comprehensive Plan and Code of Ordinances. 2.The use would not change the existing or planned character of the surrounding area. 3.The use would not depreciate property values. 4.The use would not involve any activity, process, materials, equipment or methods of operation that would be dangerous, hazardous, detrimental, disturbing or cause a nuisance to any person or property, because of excessive noise, glare, smoke, dust, odor, fumes, water or air pollution, drainage, water run-off, vibration, general unsightliness, electrical interference or other nuisances. 5.The use would not exceed the design standards of any affected street. The use would be served by adequate public facilities and services, including streets, police and fire protection, drainage structures, water and sewer systems, schools and parks. 7. The use would not create excessive additional costs for public facilities or services. 8. The use would cause minimal adverse environmental effects. 2.04 Variance Standard. City Ordinance Section 44-13 refers to state statute which states a variance may be granted from the requirements of the zoning ordinance when: (1) the variance is in harmony with the general purposes and intent of this ordinance; (2) when the variance is consistent with the comprehensive plan; and (3) when the applicant establishes that there are practical difficulties in complying with the ordinance. Practical difficulties mean: (1) The proposed use is reasonable; (2) the need for a variance is caused by circumstances unique to the property, not created by the property owner, and not solely based on economic conditions. Section 3. Findings. 3.01 The proposal meets the specific conditional use permit standards. 3.02 The proposal meets the specific variance standards. Section 4. City Review Process 4.01 The City conducted the following review when considering these conditional use permit amendment and setback variance requests. 1. On August 15, 2023, the planning commission held a public hearing. The city staff published a hearing notice in the Pioneer Press and sent notices to the surrounding property owners. The planning commission gave everyone at the hearing a chance to speak and present written statements. The planning commission recommended that the city council approve this resolution. 2. On August 28, 2023, the city council discussed this resolution. They considered reports and recommendations from the planning commission and city staff. Section 5. City Council 5.01 The city council hereby _______ the resolution. Approval is based on the findings outlined in section 3 of this resolution. Approval is subject to the following conditions: (additions are underlined and deletions are crossed out): 1. All construction shall follow the site plan that the city stamped February 3, 2004 August 1, 2023. The Director of Community Development may approve minor changes. City Ordinance Section 44-1097(a) states that the City Council must base approval of a Conditional Use Permit on the following nine standards for approval. 1. The use would be located, designed, maintained, constructed and operated to be in conformity with the City’s Comprehensive Plan and Code of Ordinances. 2. The use would not change the existing or planned character of the surrounding area. 3. The use would not depreciate property values. 4. The use would not involve any activity, process, materials, equipment or methods of operation that would be dangerous, hazardous, detrimental, disturbing or cause a nuisance to any person or property, because of excessive noise, glare, smoke, dust, odor, fumes, water or air pollution, drainage, water run-off, vibration, general unsightliness, electrical interference or other nuisances. 5. The use would not exceed the design standards of any affected street. 6. The use would be served by adequate public facilities and services, including streets, police and fire protection, drainage structures, water and sewer systems, schools and parks. 7. The use would not create excessive additional costs for public facilities or services. 8. The use would maximize the preservation of and incorporate the site’s natural and scenic features into the development design. 9. The use would cause minimal adverse environmental effects. 2.04 Variance Standard. City Ordinance Section 44-13 refers to state statute which states a variance may be granted from the requirements of the zoning ordinance when: (1) the variance is in harmony with the general purposes and intent of this ordinance; (2) when the variance is consistent with the comprehensive plan; and (3) when the applicant establishes that there are practical difficulties in complying with the ordinance. City Review Process 4.01 The City conducted the following review when considering these conditional use permit amendment and setback variance requests. 1. On August 15, 2023, the planning commission held a public hearing. The city staff published a hearing notice in the Pioneer Press and sent notices to the surrounding property owners. The planning commission gave everyone at the hearing a chance to speak and present written statements. The planning commission recommended that the city council approve this resolution. 2. On August 28, 2023, the city council discussed this resolution. They considered reports and recommendations from the planning commission and city staff. Section 5. City Council 5.01 The city council hereby _______ the resolution. Approval is based on the findings outlined in section 3 of this resolution. Approval is subject to the following conditions: (additions are underlined and deletions are crossed out): 1. According to tax records, the property is owned by William Acree (the “Owner”). The City of Maplewood began receiving complaints about the Property’s condition as early as 2007, and aerial images of the Property show it has been maintained as a hazardous/nuisance property since at least 2015. Both the front and back yards are overgrown with weeds, grass, and other foliage and contain an unlawful accumulation of debris and rubbish, further detailed in the attached resolution. To restore the Property to a safe, sanitary, and code-compliant condition, staff recommends that the city council approve the attached resolution and order the abatement of the hazardous and nuisance conditions on the Property. The resolution will authorize city staff and the city attorney to initiate legal proceedings against the Property’s owner in an effort to make the Property safe and bring it into compliance with state and local laws. Recommended Action: Motion to approve the Resolution Ordering the Abatement of Conditions Creating a Hazardous Property and Public Nuisance at 1145 Glendon Street North. The city attorney will be present to discuss the merits of the case, the proposed resolution, and potential strategies moving forward. The need for confidentiality in discussing the initiation of such legal proceedings outweighs the purposes of the open meeting law because of the intent to discuss the city’s litigation strategy and potential options if litigation is initiated. For that reason, a motion can be made to go into a closed session. Background: This Property has been maintained in a hazardous condition by the Owner for several years. In 2018, City staff entered the property due to a water main breakage and performed a welfare check based on the condition of the Property. The Property was found to be potentially hazardous and not in compliance with City Code at that time. Subsequent to this encounter, the City imposed several administrative citations and fines against the Owner for numerous code violations. The Owner did not pay the fines and requested a hearing before the City’s Administrative Hearing Officer to contest them. The Hearing Office upheld the citations and fines. An administrative warrant was secured to examine the Property and was executed on June 26, 2023. Based on the conditions of the Property observed during the execution of the warrant, staff has determined that the Property is hazardous, unsafe, and a public nuisance under state law and the city code. The applicable statutory and city code references are specified in the recommended resolution. Allowing the Property to remain in its current state presents significant health and safety concerns not only to any occupants of the Property but also to others in the community due to the negative impacts of maintaining a nuisance and hazardous property. The City has made multiple attempts to gain compliance, and staff has now determined that the only way to effectively abate the unlawful conditions at the Property is to initiate abatement proceedings pursuant to state law and the city code. A resolution has been prepared by the city attorney that (i) finds that the Property is both hazardous and a public nuisance pursuant to state law and the city code; and (ii) authorizes staff and consultants to serve an order on the owner that requires abatement of the unlawful conditions within 21 days by performing the following: 1. Remove unlawful accumulation of lawn ornaments and pots from the property; 2. Remove or properly store all inoperable or collectors’ vehicles, including, but not limited to, those with flat tires; 3. Remove or properly store boat; 4. Remove all accumulation of appliances and other scraps from the property; Council Packet Page Number 174 of 187 J3 5.Remove all accumulation of lawn and yard chemicals, pool chemicals, and other potentially dangerous substances from the property and properly dispose of them; 6. Remove unlawful accumulation of lawn chairs, tables, umbrellas, and fire pits; 7. Remove any and all containers with standing water, excessive hoses, and extension cords; 8. Remove unused extension cords, broken hoses, unusable grills; 9. Remove or store saws and other serrated tools, piles of gardening tools, and rusted bicycles; 10. Remove broken items and rubbish from shed and secure shed; 11. Remove all vermin nests and conditions that encourage the creation of vermin nests; 12. Trim and/or remove all noxious weed and overgrown vegetation; and 13. Remove all additional rubbish and debris. Should the owner fail to comply with the order, the city will initiate formal proceedings to request a court order authorizing the city to abate the hazardous and nuisance conditions on the Property pursuant to its legal authority to do so. The statutory and city code provisions authorizing abatement proceedings allow for the city to recover enforcement costs related to this action via a special assessment against the Property. Depending on the level of cooperation from the owner after the order is served, the city may also benefit from entering into an abatement agreement that will provide the owner an opportunity to perform abatement on his own, without formal legal proceedings. The agreement would also authorize the city to abate the hazardous conditions on the Property and assess the costs should the owner fail to comply. Such an agreement, if negotiated, would be presented to the city council for final approval before taking effect. If the recommended resolution is adopted, the city attorney’s office will work with staff to initiate abatement proceedings, with the ultimate goal of abating the conditions that make the Property both hazardous and a public nuisance, including bringing a civil action pursuant to Minnesota Statutes, chapter 463 and Maplewood City Code, chapter 18. City attorney Ron Batty will be present during the meeting to answer any questions that the city council may have related to this matter. and WHEREAS, Minnesota Statute 168.10, Subd. 1(e) requires that collector vehicles stored outdoors be screened from public view; and WHEREAS, both Minnesota Statutes, section 609.74 and section 18-30 of the City Code also deem it a public nuisance to maintain or permit a condition which unreasonably annoys, injures or endangers the safety, health, morals, comfort, or repose of the public; and WHEREAS, Minnesota Statutes, section 463.161and section 18-37 of the City Code authorize the city council to order the owners of any hazardous property or nuisance property within the City to correct or remove said conditions; and WHEREAS, by letters dated and mailed on May 17, 2022, andMay 31, 2022, the City notified the Owner of the hazardous conditions and other code violations addressed herein, as well as the steps needed to correct the conditions;
