- elected officials, staff and citizens. It is hoped that by following these simple rules, everyone’s opinions can be
heard and understood in a reasonable manner. We appreciate the fact that when appearing at Council
meetings, it is understood that everyone will follow these principles:
Speak only for yourself, not for other council members or citizens - unless specifically tasked by your
colleagues to speak for the group or for citizens in the form of a petition.
Show respect during comments and/or discussions, listen actively and do not interrupt or talk amongst
each other.
Be respectful of the process, keeping order and decorum. Do not be critical of council members, staff or
others in public.
Be respectful of each other’s time keeping remarks brief, to the point and non-repetitive.

pinning of hisbadge.

INFLOW AND INFILTRATION IMPROVEMENTS
WHEREAS, the City Council of Maplewood, Minnesota has heretofore approved the
grant agreement between the City of Maplewood and the Metropolitan Council for inflow and
infiltration improvements.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD,
MINNESOTA, that:
1.The Mayor and City Manager are hereby authorized to enter into the grant agreement.

MERRICK, INC.
WHEREAS, Merrick, Inc. has submitted an Application to Conduct Off-Site Gambling

at the July 4Celebration at Hazelwood Park, 1663 County Road D East in Maplewood, MN
55109; and
WHEREAS, the off-site gambling will take place during the July 4th Celebration on
Monday, July 4, 2022.
BE IT HEREBY RESOLVED, by the City Council of Maplewood, Minnesota, that
Application to Conduct Off-Site Gambling is approved for Merrick, Inc. during the date stated
above.
FURTHERMORE, that the Maplewood City Council requests that the Gambling
Control Board approve said permit application as being in compliance with Minnesota Statute
§349.213.
NOW, THEREFORE, be it further resolved that this Resolution by the City Council of
Maplewood, Minnesota, be forwarded to the Gambling Control Board for their approval

DIRECTING MODIFICATION OF EXISTING CONSTRUCTION CONTRACT,
NORTH FIRE STATION CONSTRUCTION PROJECT, CHANGE ORDER NO. 46, 47,
AND CHANGE ORDER NO. 48
WHEREAS, the City Council of Maplewood, Minnesota has heretofore ordered the
construction of the North Fire Station, and has approved construction contracts related to the
project.
WHEREAS, it is now necessary and expedient that said contract be modified and
designated as North Fire Station Construction Project, Change Order No. 46, 47 and
Change Order No. 48.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD,
Minnesota, that
1.The Mayor, City Manager, and Fire and EMS Chief are hereby authorized and
directed to modify the existing contract by executing said Change Order No. 46
which will not change the overall project amount.
The revised contract amount for Work Scope 23-A, General Sheet Metal
Company, LLC., is $1,061,662.98.
The revised contract amount for Work Scope 08-D, Yale Mechanical, LLC., is
$541,506.
2.The Mayor, City Manager, and Fire and EMS Chief are hereby authorized and
directed to modify the existing contract by executing said Change Order No. 47
which will decrease the project amount by $4,350.
The revised contract amount for Work Scope 32-D, Century Fence Company is
$27,645.
3.The Mayor, City Manager, and Fire and EMS Chief are hereby authorized and
directed to modify the existing contract by executing said Change Order No. 48
which will increase the project amount by $5,444.04.
The revised contract amount for Work Scope 6-G, Ebert Construction., is
$440,589.

WHEREAS, MN State Statute 204B.21, Subd. 2 states election judges for precincts in a

WHEREAS, approval of the resolution does not qualify individuals to serve as an election
judge; and
WHEREAS, appointments will be made from the list to fill the needed positions after training
and required paperwork have been completed; and
WHEREAS, additional election judges have expressed interest in serving for the Primary
after the initial list of election judges were approved by city council on June 13, 2022; and
WHEREAS, appointment of additional election judges within the 25 days before the election
may be made if the appointing authority determines that additional election judges will be required;
and
NOW, THEREFORE, IT BE RESOLVED, that the City Clerk or designee assign Election
Judges to serve in the 2022 State Primary Election to be held on Tuesday, August 9, 2022 also

CUP have been achieved. All escrows have been released, and the project is in good standing with
the city. Staff does not find any reason to continue reviewing the CUP unless a problem arises or a
significant site change is proposed.

Community Development Director Thomson gave the staff report. Steve McDaniels with
Maplewood Toyota addressed the council and gave further information.
Councilmember Neblett moved to approve the resolution for a conditional use permit and
setback variance at 2999 Highway 61 with the addition of #11 for additional screening to
the west side to decrease the view of the vehicles from the neighborhood.

1.01 Maplewood Toyota has requested approval of a conditional use
permit.
1.02 The applicant has also requested approval of a setback variance.
1.03 The property located at 2999 Maplewood Drive is legally
described as:
Parcel 1: That part of the North 409.5 feet of the East 500 feet of
the South Half of the Northeast Quarter of Section 4, Township
29, Range 22, Ramsey County Minnesota, lying Southerly of a
line drawn from a point on the East line of said Northeast Quarter

said South Half of the Northeast Quarter of Section 4 to a point on
the West line of said East 500 feet of the South Half of the

Section 2. Standards.
2.01 City Ordinance Section 44-512(4) requires a Conditional Use
Permit for the exterior storage of goods or materials.
2.02 Section 44-637(b) requires a Conditional Use Permit for any
building or exterior use within 350 feet of a residential district.
2.03 General Conditional Use Permit Standards. City Ordinance
Section 44-1097(a) states that the City Council must base
approval of a Conditional Use Permit on the following nine
standards for approval.
1. The use would be located, designed, maintained, constructed
and operated to be in conformity with the City’s
Comprehensive Plan and Code of Ordinances.
2. The use would not change the existing or planned character of
the surrounding area.
3. The use would not depreciate property values.
4. The use would not involve any activity, process, materials,
equipment or methods of operation that would be dangerous,

hazardous, detrimental, disturbing or cause a nuisance to any
person or property, because of excessive noise, glare, smoke,

5. The use would not exceed the design standards of any
affected street.
6. The use would be served by adequate public facilities and
services, including streets, police and fire protection, drainage
structures, water and sewer systems, schools and parks.
7. The use would not create excessive additional costs for public
facilities or services.
8. The use would maximize the preservation of and incorporate
the site’s natural and scenic features into the development
design.
9. The use would cause minimal adverse environmental effects.
2.04 Variance Standard. City Ordinance Section 44-13 refers to state
statute which states a variance may be granted from the
requirements of the zoning ordinance when: (1) the variance is in
harmony with the general purposes and intent of this ordinance;
(2) when the variance is consistent with the comprehensive plan;
and (3) when the applicant establishes that there are practical
difficulties in complying with the ordinance. Practical difficulties
mean: (1) The proposed use is reasonable; (2) the need for a
variance is caused by circumstances unique to the property, not
created by the property owner, and not solely based on economic
conditions.

4.01 The City conducted the following review when considering the
conditional use permit and setback variance requests.
1. On October 20, 2020, the planning commission held a public
hearing. The city staff published a hearing notice in the
Pioneer Press and sent notices to the surrounding property
owners. The planning commission gave everyone at the
hearing a chance to speak and present written statements.

approve this resolution.
2. On November 9, 2020, the city council discussed this
resolution. They considered reports and recommendations
from the planning commission and city staff.
Section 5. City Council
5.01 The city council hereby approves the resolution. Approval is based
on the findings outlined in section 3 of this resolution. Approval is
subject to the following conditions:
1. Adherence to the site plan date-stamped September 24, 2020.
The director of community development may approve minor
changes.
2. The proposed construction must be started within one year of
council approval or the permit shall end. The council may
extend this deadline for one year.
3. The city council shall review this permit in one year.
4. An exterior public address system shall not be allowed.
5. All activity shall be confined to the site. There shall be no
loading or unloading of vehicles on any public or private street
rights-of-way. No employee parking is allowed on any public
street. Parking of vehicles is permitted on the north side of the
private street – Gulden Road – that bisects the properties
located at 2999 and 3001 Highway 61.
6. No vehicle maintenance of any kind is permitted on this site.
7. Comply with all city ordinance requirements for signage.
8. All site lighting must meet city requirements and be shielded
away from the neighboring residential properties.
9. Submit a security plan to the public safety department for
review and approval.
10. The applicant shall obtain any required permits from the City of
Maplewood, Ramsey Washington Metro Watershed District,
Ramsey County and the State of Minnesota and meet the
requirements of those agencies
11. Applicant shall submit a landscaping plan along the west side
of the site showing additional screening for staff review and
approval.

2021 TRASH AND YARD WASTE RATES
Be it resolved by the City Council of the City of Maplewood, Minnesota,
as follows:
WHEREAS, the City has a contract with Republic Services for residential
trash and yard waste collection; and
WHEREAS, the trash and yard waste collection contract runs from
January 1, 2020, until June 30, 2025; and
WHEREAS, most of the trash and yard waste rates are set throughout the
term of the contract or include yearly increases that were approved by the City as
part of the contract; and
WHEREAS, the contract outlines that the Pay As You Throw disposal and
overall trash rate is negotiated yearly; and
WHEREAS, the City Council reviewed the contract rates and approved
the Pay As You Throw disposal and overall trash rates on November 9, 2020.
NOW, THEREFORE, BE IT RESOLVED THAT the City of Maplewood:

5. The applicant shall submit a parking restriping plan and maintenance plan for
staff approval.
6. The applicant shall comply with the City’s tree preservation ordinance and tree

8. Signs shall follow the City’s sign ordinance. Signs shall not be installed unless
the applicant first obtains sign permits.
9. Any and all trash receptacles shall be contained within an enclosed structure.
Design of a new structure shall be subject to the City’s design review process.
10. The proposed use must be substantially started within one year of council
approval or the permit shall become null and void. The council may extend this
deadline for one year. The City Council shall review this permit in one year.
11. All of the applicant’s parking shall be confined to the site and not allowed on
city streets or neighboring properties.
12. The applicant shall comply with all requirements of the building official, fire
chief and city engineer.
13. The applicant shall submit an application to the City’s Environmental Health
Official for an annual food permit prior to operation.

Policy Issue:
Ramsey County is leading a road improvement project for Larpenteur Avenue, White Bear Avenue,
and North Saint Paul Road. The project is currently being designed and will include improvements
to the roadway, utilities, signals, and new sidewalks. The project design requires the the acquisition
of right of way as part of the project. The City Council will consider entering into cooperative
agreement, with Ramsey County, for right of way acquisition for the White Bear Avenue
Improvements project.
Recommended Action:
Motion to approve the attached cooperative agreement, with Ramsey County, for right of way
acquisition for the White Bear Avenue Improvements project and direct the Mayor and City
Manager to sign the agreement. Minor revisions as approved by the City Attorney are authorized
as needed.

Use of Reserves Other: Maplewood’s estimated cost share of the
right-of-way aquisition is $565,093.50. The proposed improvements will be funded through
Municiple State Aid funds. These improvements are included in the Draft 2023-2027 Capital
Improvement Plan with payment taking place in 2024.

This agreement covers the responsiblilties of Ramsey County and the City of Maplewood for the
acquisition of right of way as part of the White Bear Avenue Improvements project. The proposed
project will include improvements of the street condition, upgrade existing utilities, and will add new
pedestrian improvements on White Bear Avenue, Larpenteur Avenue, and North Saint Paul Road.

Background
Ramsey County is leading a street improvement project on the following roads (see attached
project location map):
Larpenteur Avenue – to be reconstructed between Flandrau Street to Hazel Street
North Saint Paul Road – to be reconstructed between White Bear Avenue and Ripley
Avenue
White Bear Avenue – concrete pavement repairs between Larpenteur Avenue and Frost
Avenue
The proposed project will also include ADA upgrades, utility improvements, traffic signal upgrades,
sidewalk replacement, new sidewalks along the west side of White Bear Avenue and along
Larpenteur Avenue.
To accommodate the proposed improvements additional right of way is required. The total
estimated right of way costs $1,130,187.00. Per Ramsey County Cost Participation Policy, right of
way acquisition will be split 50/50 between Ramsey County ($565,093.50) and the City
($565,093.50). The City’s share of the right of way costs will be funded through Municipal State Aid
Funds. The project funding is accounted for in the draft 2023-2027 Capital Improvement Plan.
The City Attorney has reviewed the attached cooperative agreement with Ramsey County for right
of way acquisition for the White Bear Avenue Improvements project. Staff recommends approving
the attached cooperative agreement with Ramsey County.

This Agreement is between the City of Maplewood, a municipal corporation ("City") and
Ramsey County, a political subdivision of the State of Minnesota, ("County") for Right of
Way Acquisition.
WHEREAS, White Bear Avenue (County State Aid Highway 65) from Larpenteur Avenue
to Frost Avenue, Larpenteur Avenue (County State Aid Highway 30) from Flandrau Street
to Hazel Street, and North St. Paul Road (County State Aid Highway 29) from White Bear
Avenue to Ripley Avenue (“Project”) is identified in Ramsey County’s 2022-2026
Transportation Improvement Program for Roadway Construction Improvements; and
WHEREAS, the City and County desire to perform concrete repairs on White Bear
Avenue from Larpenteur Avenue to Frost Avenue, reconstruct Larpenteur Avenue from
Flandrau St to Hazel St, reconstruct North St. Paul Road from White Bear Avenue to
Ripley Avenue, and make certain improvements associated with said improvements; and
WHEREAS, White Bear Avenue, in the area affected by construction, is designated
County State Aid Highway 65, Larpenteur Avenue, in the area affected by construction, is
designated County State Aid Highway 30, and North St. Paul Road, in the area affected
by construction is designated County State Aid Highway 29, and is located in the City; and
WHEREAS, the reconstruction requires right of way (“ROW”) acquisition; and
WHEREAS, the project has been designated for funding by the Minnesota Department of
Transportation (“MnDOT”) as eligible for County State Aid Highway (“CSAH”) funds, and,
Municipal State Aid System (“MSAS”) funds; and

WHEREAS, the Project has been designated as County State Aid Project 062-629-011,
062-630-074, and 062-665-062 and Municipal State Aid Project 138-020-042, 138-020-
043, and 138-020-044; and
WHEREAS, plans for the Project showing proposed ROW acquisition and estimated costs
of said acquisition according to the County and City share are included herein as
attachments;
NOW, THEREFORE, BE IT MUTUALLY AGREED AS FOLLOWS:
AGREEMENT
1. Responsibility for the Right of Way Plan and Acquisition
1.1. The County will prepare a right of way acquisition plan showing easements and
other property interests required for construction of the Project in accordance
with Mn/DOT State Aid standards.
1.2. The County will acquire the proposed easements and ROW in accordance with
Mn/DOT State Aid requirements.
2. Procurement and Award of Contract
2.1. The County will purchase ROWacquisition services and appraisal services in
accordance with State law and County procedures.
3. Project Costs
3.1. Except as provided herein, the County and City will participate in the costs of
ROW acquisition in accordance with the Ramsey County Cost Participation
Policy and approved in the 2022 – 2026 Ramsey County Transportation
Improvement Plan. If there is a conflict between the Cost Participation Policy and
this Agreement, this Agreement shall prevail.
3.2. ROW Acquisition Costs
3.2.1. ROW acquisition costs including payment to owners, relocation
assistance, and other related costs of acquiring ROW for the Project will
be shared 50% by the County and 50% by the City.
3.2.2. The County will not be responsible for assessments, fees, or fines,
associated with owning property acquired for the Project. If the City
imposes assessments, fees, or fines, the County will pay those costs and
the City will reimburse the County for those costs.

3.2.3. The County will pay 100% of County staff time for ROW acquisition.
4. Payment Schedule
4.1. ROW acquisition costs and payment will be invoiced as one lump-sum payment.

Payment shall be madeafter January 1, 2024 prior to April 1, 2024.
4.2. Payment will be made within 35 days of receipt of an invoice.
5. ROW acquired under this Agreement will be owned and maintained by the
County.
6. The City grants the County temporary construction easements over all City owned
ROW and property within the limits of the Project for use during construction at no
cost to the County.
7. The City and County shall indemnify, defend, and hold each other harmless against
any and all liability, losses, costs, damages, expenses, claims, or actions, including
attorney’s fees, which the indemnified party, its officials, agents, or employees may
hereafter sustain, incur, or be required to pay, arising out of or by reason of any act or
omission of the indemnifying party, its officials, agents, or employees, in the execution,
performance, or failure to adequately perform the indemnifying party’s obligation
pursuant to this Agreement. Nothing in this Agreement shall constitute a waiver by the
County or the City of any statutory or common law immunities, limits, or exceptions on
liability.
8. This Agreement shall remain in full force and effect until terminated by written mutual
agreement of the parties.
