ADDENDUM TO THE AGENDA
Meeting No. 70 - 3
C - 1 We have uncovered nothing new regarding the zoning in the area of Keller
Parkway and Kohlman Lane. The 1942 map (revised to 1956) which was
reviewed at the last meeting is a copy which the Village had in its files.
We have been unable to locate a copy of the original. Vie do have a
Village map entitled "Zoning Map, Village of Maplewood" which was originally
prepared in 1959 and which shows the area in question as commercial. We
also have revisions of this map (July 1964, December 1964, and January 1966)
which also indicate commercial zoning for the area. These maps are n)t
marked "Official ". Bailey has reviewed the Village's written records and
can find no indication relative to the zoning of Lot 6. The map whic:a
was mentioned as showing the area as residential was a working copy map
which was penciled in by Village employees and was copied from the "Z�ning
Map, Village of Maplewood" mentioned above. Since the "Zoning Map" aid
all of its revisions show the area as commercial we have concluded that
the working copy reflected an error in copying. This map was utilizf�i
by a consulting planning firm employed by the Village and has not bee.i
seen since. At this point the Council has two alternates. It may show
the area on the official zoning map as:
(1) Residential, based on a "working copy" map and tax records
which have shown the area as both residential and commercial
(and which county officials deny has any official relations'.iip
to Village zoning); or
(2) Commercial, based on five zoning maps, which are not marked as
official but which agree to the zoning of the area as commercial.
F - 1 Ordinance No. 257 officially names Ramsey County as the collection ag=_ncy
for Maplewood's special assessments.
F - 2 Ordinance No. 258 establishes the sewer bill delinquency charge at $1.00
or 10;6 of the balance due, whichever is greater. The present late payment
charge of $1.00 is exceptionally cheap interest on a large bill and may
easily encourage, rather than discourage, late payment.
F - 3 Enclosed you will find the proposed Council Rules of Procedure for your
consideration and action.
F - 4 The Ramsey County League has agreed to sponsor a study of the water rates
charged suburbs by St. Paul. The League proposes that the cost of the
study be shared by those communities which purchase water from St. Paul
(Maplewood, Roseville, Falcon Heights, Arden Hills, Lauderdale, Mendota
Heights and West St. Paul). The cost is to be apportioned by population,
and if approved by all of the communities +iaplewood's share would be
$3,808.50. It is estimated that the total cost of the study (by the
Public Administration Services) will be $15,000. It is recommended that
the administration be authorized to notify the RCL that the Village o'
Maplewood is willing to participate in the study in accordance with
the proposal and that the Village plans to include its share in the 1971
Budget.

Other Items
I now have four applications for Village Attorney and expect one more.
I plan to meet with some of the applicants and make my recommendation
at the February 19th meeting.
Dale E. Razskazoff,-James T. Horton and Gerald W. Meyer have been
appointed to the police force. Two additional patrolment were authorized
for 1970 and one patrolman (Timothy McGinnis) resigned last December.
The signals at AcKnight and I -94 will be included in the April 1970
contract.

A. CALL TO ORDER
A regular meet,ng of the Village Council of Maplewood, Minnesota was held in
the Municipal Idministration Building and wi.s called to order at 7:32 P.M, by
Mayor Axdahl.

1. Hearing Ccatinuation - Adoption of Section 4 of Zoning Map.
a. Manager Michael Miller stated that -nothing new had been uncovered
regarding the zoning in the area of Keller Parkway and Kohlman Lane.
The 1542 map (revised to 1956) whicl was reviewed at the last
meetirg is a copy which the Village had in its files. The original
has nct been located. There is a map entitled "Zoning Map, Village
of Maplewood" which was originally prepared in 1959 and which shows
the azea in question was commercial. Revisions of this map (July
1964, December 1964, and January, 1966) also indicate commercial
zonin€ for the area. These maps ara not marked "Official ". The
Staff has reviewed the Village's written records and the map which

b. Mayor Axdahl read a letter from Mr. William Howard regarding a zoning
map dated January, 1959 prepared by Milna-r Carley and Associates,
showing a strip of land along County Road C zoned as R -1 instead of
Farm - Residence as it should be. The matter was referred to staff I
for investigation.
c. After further discussion the adoption of Section 4 of the Official
Zoning Map, Councilman Haugan moved that the Zoning Map Adoption
Hearing be postponed for 2 weeks (until the ne.Yt meeting) with a
decision being decided definitely at that time. Seconded by Councilman
Greavu. Ayes - all.
D. APPROVAL OF ACCOUNTS
Councilman Wiegert moved that the accounts a!, submitted in the amount of
$237,281.84 (Part 1 -Fees, Services, Expenses. Check No. 8978 through
Check No. 9103; $221,723.53; Part II - Payroll, Check No. 58 through Check
No. 120 and Check No. 6326, $15,558.31) be p<-.id. Seconded by Councilwoman
Olson.. AYES - all.

a. Councilman Greavu introduced the following ordinance and moved
its ado ttion: T
ORDINANCE NO. 257
AN ORDINANCE AMENDING THE MAPLEWOOD CODE BY
ADDING A NEW CHAPTER 209 RELA "ING TO THE
COLLECTION OF ASSESSMENTS FOR IMPROVEMENTS.
THE COUNCIL OF THE VILLAGE OF MAPLEWOOD DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. The Maplewood Code is hereby amended by adding a new Chapter
209 to read as follows:
"209. COLLECTION OF ASSESSMENT'S FOR IMPROVEMENTS 209.010.
CHAPTER 1095, MINNESOTA STATUTES. The Vi L.age of Maplewood deems it
necessary to enact this ordinance because the legislature of the State
of Minnesota did in 1969, enact Chapter 101.5 whereby amendment was made
to Minnesota Statutes, Section 429.061, Sui: division 3, providing that tha
remaining balance of an assessment if paid in advance of the regular
scheduled prc2edure for payment, shall be paid to the municipal treasure

209,020, AUTHORITY TO ESTABLISH PPOCEDURE. Whenever any property owner or
other person.desires to pay the remaining unpaid installments of any assessment
for improvement, the assessment roll of which has been certified to the County
Auditor for improvement, the assessment roll of which has been certified to the
County Auditor for collection with general taxes, the County Treasurer and the
County Auditor are hereby authorized to establish whatever procedure is necessary
to make possible the payment of said balance to the said county officials in
lieu of paying same to the municipal treasurer.as provided in Minnesota Statutes,
1967, Section 429.061, Subdivision 3, as amended. The said county officials
are hereby designated as agents for the Village of Maplewood to collect such
assessments and the mechanics thereof shall be established by the County Auditor,
County Treasurer and the Village Clerk so that the intent and purpose of this
ordinance can be accomplished.
209.030." PULPOSE. That this ordinance is made for the purpose of authorizing
County office:-s to collect remaining balances of assessments for improvei:ents
in order to a:-ford property owners and othe members of the public the conveni-
ence of makin;; such payment in the same place and in the manner that the,, pay
general taxes and installments of assessments."

2. Ordinance No. 258 - Sewer Delinquency Charge (Second Reading)
a. Councilman Wiegert introduced the following ordinance and moved
its aioption:
ORDINANCE NO. 258
AN ORDINANCE AMENDING THE MAPLEWOOD CODE
RELATING TO PAYMENT OF SEWER RENTAL CHARGES,
OR DELINQUENCIES THEREOF.
THE COUNCIL OF THE VILLAGE OF MAPLEtivOOD DOLS HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Section 206.140 (B) of the Maplewood Code is hereby amended
to read as follows:
206.140. RATES AND CHARGES. (B) Statements for sewer rental charges shall
be prepared cn a quarterly basis. Said statements shall be due and paya 'Dle
to the Village of Maplewood on or before the last day of the months as
shown below:
January, April, July and October Statements - due the last day of c ch
month respectively.
Februar}, May, August and November Statements - due the last day of each
month respectively.
March, :une, September and December S :atements - due on the last day of
each month respect:.vely.

There shall be added to all statements, not paid -by the date indicated above,
a deliquency charge of one ($1.00) or ten per cent (10 %) of the amount due,
whichever is greater."
SECTION 2. This ordinance shall take effect and be in force from and after
its passage and publication.
Adopted this 5th day of February, 1970
by the Council of the Village of Maplewood.

3. Council Riles of Procedure.

a. Village Manager Miller presented Council with a proposed resolut.`_on
regarding the Council Rules of Procedures.
b. The Council discussed several revisions to the proposed resolution
and referred said resolution to sUsff for revision and to be restib-
mitte.i at the next Council meeting,
4. Water Rate Study (Ramsey County League;
a. The Ramsey County League has agree( to sponsor a study of the Water
rates charged suburbs by the St. P..ul Water Department. The League
proposed that the cost of the study be shared by those communities
which purchase water from St. Paul (Maplewood, Roseville, Falcon
Heights and West St. Paul). The cast is to be apportioned by poDula-

b. Councilman Wiegert reported that h,! had attended the RCL Meeting
and that James Daglish from the City of St. Paul requested that the
League hold off action as far as retaining a consultant, that tc
his knowledge no municipality had :Mated a complaint to the St. Paul
Water Department. (Maplewood filed a complaint last year). Mr.
Wiegert further stated that the League invited St. Paul to participate
in tYis water study.
e. Councilman Wiegert moved that Maplewood participate in the water
stud} if such study does occur. Seconded by Councilman Greavu. Ayes - all_.
5. Property Division. (Correction)
a. Admiiistrator:Tom McMahon requestel a resolution correcting a property
Division resolution that was passel by the Council regarding the.
Robert Tilsen's Maplewood Heights '1o. 5 Assessments.

b. Councilman Wiegert introduced the follo�,7ing resolution and moved__

WHEREAS, it has been determined there is an error in the
description of a parcel of property described in Property Division.
No. 40405 as adopted by the Village Council of the Village of Maplewood
at the meeting of November 20, 1969 by Resolution No. 69 -11 -230;
VOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF
MAPLEWOOD, MINNESOTA, that said description be correctly changed
from Lot 3, Block 3, Robert Tilsen's Maplewood Heights No. 5 to
Lot 3, Block 2, Robert Tilsen's Maplewood Heights No. 5.
Seconded by Councilman Haugan. Ayes - al.'_.
6. Request b) Connect to Woodbury Water system (Gulf Oil Corporation)
a. AdminJ'_strator Tom McMahon presented a request from the Superior
Oil Company (Gulf) to connect their service station at 9 North
Centu:.-y Avenue to the Woodbury Water System. At the present,
Maplewood does not have a water main to serve this location.
b.. The a.)proval of this connection is based on the condition that s.iid
property waives the right to object to installation of a like utility
by tho Village of Maplewood in the future and accepts assessment3 for
such installation and also reconnects its service line(s) to the
Maplewood utility if and when it iE installed.
c. Councilman Haugan moved to approve the connection by the Superior
041 Corp. (Gulf) 9 North Century Ivenue to the Woodbury Water system
subje.t to the conditions listed alove being satisfied. Seconded by
Councilman Wiegert. Ayes - all.
7. Resolutiona Correcting Assessment
a. Councilman Greavu introduced the following resolution and moved its
adoption:

TMEREAS, pursuant to resolution 69 -9 -160 cf the Village
Council of Maplewood, Minnesota, adopted September 10, 1969, the
special assessments for the constriction of Larpenteur Avenue
Storm Sewer Improvement 67 - 1, Ph<se II, were levied against
property described as County Auditor's No. 57 - 2950 - 151 - 01; and
:TOW, THEREFORE, BE IT RESOLVE)- BY THE VILLAGE COUNCIL OF
MAPLE400D, MINNESOTA, that the assessments for Larpenteur Avenue
Storm Sewer Improvement 67 - 1 (Ph..se II) against County Auditor's.

8. Feasibility Report (Holland Developm&.t Co.)
a. Administrator Ton: McMahon present A a feasibility report for tl e
construction of Mount Vernon Stre:.t, Edgemont Street and Arkwri;ht
Street by sanitary sewer, water m..ins, service connections, apl..r=
teneaces and street construction.

b. Mr. McMahon stated the petition and request for the improvements
had been reviewed and found to be not feasible.
c. Councilman Greavu moved to accept the report and the recommendation.
Seconded by Councilman Wiegert.
9, Cab License.
Ayes - all.
a. Mana;er Miller presented requests from two taxicab companies t(
operate in Maplewood, Southwest Cab Company and the A -1 Cab
Company. Mr. Miller stated that since Maplewood at the present
time is without taxicab service ai:d until public hearings are held,
he recommended granting temporary licenses to both companies, subject
to c)mpliance to Maplewood's ordinances. This temporary license in
no way binds the Council to a perr. anent agreement.
b. Councilman Greavu moved to issue �:emporary licenses to both
companies (Southwest Cab Company <J.nd A -1 Cab Company) for a 30
day period and that each company ;provide insurance coverage in
the amount of $100,000 and $300,000. Seconded by Councilman Wiegert.
Ayes - all.
c. Our Ordinance at the present time only requires insurance coverage
of $25,000 and $50,000 for liabil-;.ty.
d. Councilman Wiegert moved to amend the ordinance to reflect higher
insurance coverage such as $100,010 and $300,000 for liability.
Seconded by Councilwoman Olson. Ayes - all.
e. Councilman Greavu introduced the :'ollowing resolution and moved
its adoption:

NOTICE IS HEREBY GIVEN, that pursuant to action by the
Village Council of the Village of Maplewood, a public hearing kill
be held on the 5th day of March, ._970 at 7:45 P.M. in the Municipal
Administration Building 1380 Fros: Avenue to consider the applica-
tion for issuance of a Taxicab Li,:ense to the A -1 Cab Company,
2529 East 7th Avenue, North Saint Paul; Minnesota. The Council is
proceeding in this matter as outl.ned under the provisions of the
Village Ordinances. Such persons as desire to be heard in re-
ference to this matter will be heard at this time.

Council of the Village of Maplewood, a public hearing will be held on
the 5th day of March, 1970 at 8:00 P.M. in the Municipal Administration
Building, 1380 Frost Avenue to consider the application for issuance
of Taxicab License to the Southwest Cab Co., 1030 North Concord Street,
South Saint Paul,, Minnesota. The Council is proceeding in this matter
as outlined under the provisions of the Village Ordinances. Such persons
as desire to be heard in reference to this matter will be heard at
this time.

10. State Aid Funds - Frost Avenue and ',Ihite Bear Avenue Intersection.
a. Ccuncilman Greavu introduced the following resolution and moped
its adoption: -

WHEREAS, the Village of Maplewood and the County of Ramsey
hEve entered an agreement whereby the County construct turn lanes
and install traffic signals at the intersection of Frost Aver:ue
and White Bear Avenue in the Village of Maplewood; and;
WHEREAS, in cooperation with the County of Ramsey, the pillage
of Maplewood did acquire certain rights -of -way, the costs of which
wcre to be borne by said Village, and;
WHEREAS, the final costs of acquisition of said rights -cf -way.
d :d - exceed the amounts requeste! from State Aid Funds by the Village
of Maplewood;
NOW, THEREFORE, BE IT RESCLVED that the Village of Maplewood
d(es herewith request release of funds from its State Aid
A'.lotment in the amound of $8885.00 to apply to said right -o'' -way
acquisition expenses, and herewith requests that the Commiss:'oner
o: Highways approve such release.

94 and McKnight Road? Bids should be let sometime in April or
May, 1970.
b. Received a letter from the Maplewood Library requesting possible
sign locations advertising the library. Referred to Staff for
investigation.

a. Councilman Wiegert requested the status of the -sewer contracts.
Nearing completion.
b. Coui_cilwoman Olson requested that a priority be given to minutes
being available preceeding the following Council meeting.
