It is hoped that by following these simple rules, everyone’s opinions can be heard and understood in a reasonable manner. Weappreciate the fact that when appearing at Council meetings, it is understood that everyone will follow these principles: Speak only for yourself, not for other councilmembers or citizens -unless specifically tasked by your colleagues to speak for the group or for citizens in the form of a petition. Show respect during comments and/or discussions, listen actively and do not interrupt or talk amongst each other. Be respectful of the process, keeping order and decorum. Councilmember Juenemann moved to approve the Resolution of Appreciation for Tom Sinn, Environmental and Natural Resources Commission. Resolution 19-09-1726 Resolution of Appreciation WHEREAS, Tom Sinn has been a member of the Maplewood Environmental and Natural Resources Commission for four years and ten months, serving from September 22, 2014 to July 31, 2019. Mr. Sinn has served faithfully in those capacities; and WHEREAS, the Environmental and Natural Resources Commission and City Council have appreciated his experience, insights and good judgment; and WHEREAS, Mr. Sinn has freely given of his time and energy, without compensation, for the betterment of the City of Maplewood; and WHEREAS, Mr. Sinn has shown dedication to his duties and has consistently contributed his leadership and efforts for the benefit of the City. NOW, THEREFORE, IT IS HEREBY RESOLVED for and on behalf of the City of Maplewood, Minnesota, and its citizens that Tom Sinn is hereby extended our gratitude and appreciation for his dedicated service. None I.UNFINISHED BUSINESS None J.NEW BUSINESS 1.Resolution Adopting the 2020 Preliminary Property Tax Levy and Setting the 2020 Finance Director Paulseth gave the staff report. Councilmember Juenemann moved to approve the resolution setting a preliminary tax levy for taxes payable in 2020 of $23,217,300; and setting the 2020 budget hearing for December 9, 2019 at 7:00 PM. Resolution19-09-1727 RESOLUTION ADOPTING THE 2020 PRELIMINARY PROPERTYTAX LEVY AND SETTING THE 2020 BUDGET PUBLIC HEARING DATE AND TIME WHEREAS, State law requires that the City Council adopt a proposed property tax levy for taxes payable in 2020 by September 30, 2019; and September 9, 20194 City Council Meeting Minutes Packet Page Number 5 of 236 E2 WHEREAS, the City Council has reviewed the proposed 2020 Budget and has determined the amount of the proposed tax levy payable in 2020, which is the maximum amount that will be levied. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MAPLEWOOD, MINNESOTA THAT: 1.The proposed tax levy for taxes payable in 2020, in the amount of $23,217,300 is hereby adopted and shall be certified to the Ramsey County Auditor as follows: General Fund$ 17,481,000 Debt Service Funds$ 4,407,856 Market Value Debt Service $ 274,444 EDA Fund$ 120,000 CapitalImprovement Fund $ 200,000 Public Safety Equipment Fund $ 330,000 Building and Facilities Fund $ 200,000 Community Center Fund$ 204,000 Total Levy$ 23,217,300 2.Debt levies have been reduced by other revenue sources to a total of $4,407,856 for tax capacity levies and $274,444 for market value levies. 3.The date for the public hearing and consideration of the final 2020 levy and budget shall be Monday, December 9,2019 at 7:00 pm in the Maplewood City Council Chambers. Councilmember Smith movedto approve the execution of the Contract between the City of Maplewood and Tennis Sanitation for curbside residential recycling. Seconded by Councilmember KnutsonAyes – All The motion passed. 3.Curbside Residential Trash and Yard Waste Contract with Republic Services Environmental Planner Finwall gave the staff report. Seconded by Councilmember NeblettAyes – All The motion passed. 4.Maplewood 2040 Comprehensive Plan a.Resolution Adopting Comprehensive Plan (4 votes) b.Authorize Preparation of Required Zoning Code and Map Amendments Assistant Community Development Director Martin gave the staff report. Planning Commissioner Chair Arbuckle addressed the council and gave the planning commission report. Councilmember Juenemann moved to approve the resolution adopting Maplewood’s 2040 Comprehensive Plan and give staff the authority to make non-substantive changes for clarity or to correct typographical errors as the final document is prepared for printing as well as placement on the City’s website. Resolution19-09-1728 RESOLUTION ADOPTING THE 2040 MAPLEWOOD COMPREHENSIVE PLAN UPDATE WHEREAS, Minnesota Statutes section 473.864 requires each local governmental unit to review and, if necessary, amend its entire comprehensive plan and its fiscal devices and official controlsat least once every ten years to ensure its comprehensive plan conforms to metropolitan system plans and ensure its fiscal devices and official controls do not conflict with the comprehensive plan or permit activities that conflict with metropolitan system plans; and WHEREAS,Minnesota Statutes sections 473.858 and 473.864 require local governmental unitsto complete their “decennial” reviews by December 31, 2018; and WHEREAS, the City of Maplewood authorized the review and update of its Comprehensive Plan; and WHEREAS, the proposed Maplewood 2040 Comprehensive Plan is a planning tool intended to guide the future growth and development of the City of Maplewood in a manner that conforms with metropolitan system plans and complies with the Metropolitan Land Planning Act and other applicable planning statutes; and WHEREAS, the proposed Maplewood 2040 Comprehensive Plan reflect a community planning process conducted in the years 2016 through 2018 involving elected officials, appointed officials, city staff, community organizations, the public at large, developers, and other stakeholders; and WHEREAS, pursuant to Minnesota Statutes section 473.858, the proposed 2040 Comprehensive Plan was submitted to adjacent governmental units and affected special September 9, 20196 City Council Meeting Minutes Packet Page Number 7 of 236 E2 districts and school districts for review and comment on April 13, 2018 and the statutory six-month review and comment period has elapsed; and WHEREAS, the Planning Commission has considered the proposed 2040 Comprehensive Plan and all public comments, and thereafter submitted its recommendations to the City Council of the City of Maplewood and WHEREAS, on March 20, 2018 and October 16, 2018 the City of Maplewood conducted a public hearings on the proposed 2040 Comprehensive Plan; and WHEREAS, the City of Maplewood approved Resolution 18-11-1628 authorizing the proposed 2040 Comprehensive Plan to be submitted to the Metropolitan Council for review; and WHEREAS, at its regular meeting on August 28, 2019, the Metropolitan Council completed its review ofthe proposed 2040 Comprehensive Plan and found that the Plan meets the requirements of the Metropolitan Land Planning Act; conforms to the metropolitan system plans for transportation (including aviation), water resources, and parks; is consistent with Thrive MSP 2040; and is compatible with the plans of adjacent jurisdictions and affected special districts and school districts; and WHEREAS, the 2040 Comprehensive Plan includes all revisions made during the review process and responds to additional advisory comments that are part of the Metropolitan Council’s actions authorizing the City of Maplewood to place its proposed 2040 Comprehensive Plan into effect. NOW THERE, BE IT RESOLVED BY THE CITY OF MAPLEWOOD, MINNESOTA,thatthe Maplewood 2040 Comprehensive Plan is adopted and is effective as of the date of this resolution. BE IT FURTHER RESOLVEDthat, pursuant to sections 473.864 and 473.865 of the Metropolitan Land Planning Act, the City of Maplewood will: (1) review its fiscal devices and official controls; (2) if necessary, amend its fiscal devices and official controls to ensure they do not conflict with the 2040 Comprehensive Plan or permit activity in conflict with metropolitan system plans; and (3) submit amendments to fiscal devices or official controls to the Metropolitan Council for “information purposes.” Seconded by Councilmember NeblettAyes – All The motion passed. Background On September 11, 2001, the City Council approved a motion to include a $2,000 appropriation to the Maplewood Historical Society in the city’s budget each year. In budget year 2017, the appropriation amount was increased to $5,000, with $3,000 coming from Charitable Gambling Funds. For budget year 2019, the amount of the appropriation was increased to $5,000, with an invitation to apply for additional funds from Charitable Gambling. Background Gregory Garcia had relatives that lived on Point Douglas Road near Carver Avenue when he was a child. He spent many summers playing in the Fish Creek area with his cousins and attending camp at Carver Lake Park. He always had an interest in the area. When Dorland Road south of Carver Avenue was developed he dreamed of building a home on that street. In 1991 the dream became reality when he and his wife bought a lot and he did as much work as his skills as a heavy equipment operator allowed. He excavated and backfilled the foundation, did the final grading, laid Packet Page Number 40 of 236 G3 the sod and landscaping and poured the concrete driveway and patio himself. He was so proud of the work he did and being able to raise his family in the area that he had such great childhood memories.He loved to walk Fish Creek from beginning to end,especially in the fall. His wife, Connie, still lives in their family home at 1388 Dorland Road and walks the trails at the Preserve as often as possible. She wishes to have a bench that honors her husband’s love of the area. Packet Page Number 43 of 236 H1 Background: City Council Review & Community Engagement The city council has reviewed the rental housing program and draft ordinance at several workshop meetings. In addition, the city held three community listening sessions – two for rental property owners and landlords, and one for tenants and residents. The property owner listening sessions were attended by more than 80 people. The themes that emerged during these listening sessions were: Reward well performing properties with fewer inspections and lower fees Focus on safety inspections –keep them reasonable Tenant training and compliance Support for requiring and/or providing training for landlords Support for more public safety interaction with properties Concern with burdensome regulations The listening session for tenants was attended by three people, and generally the attendees supported the city implementing a program to improve the maintenance, safety, and livability of rental properties. Public Hearing Notices The city wanted to provide broad notice to all potential owners ofrental properties in the city regarding the draft ordinance and public hearing. Public hearing notices were sent to owners of all multi-family rental properties in the community. The public hearing notice was also sent to all single- family residential properties that are classified as non-homestead for property tax purposes. City staff acknowledges that not all non-homestead single-family properties are rented, and therefore the ordinance would not impact all people that received the public hearing notices. Ordinance and Key Points The ordinance establishing a rental housing licensing program is attached for the council’s consideration and adoption. Key points of the draftordinance include: Beginning in 2020, all rental dwelling units will be required to have an annual license from the city. The only exceptions are for units that are occupied by the owner or the owner’s qualifying relative, units that are rented for less than 120 days when the owner resides in the unit the rest of the year, and for other residential facilities that have another types of license, such as group homes, nursing homes, and residential facilities in which the city has issued a license for reasonable accommodation under the Federal Fair Housing Amendments Act. Rental properties must pass a property inspection and must be maintained in accordance with city code requirements and property maintenance standards. Ownersor their property managers are required to attend crime-free housing training. Owners or their property managers are required to screen allpotential tenants by using a written rental application, and must conduct a criminal background check on all prospective tenants. The ordinance does not require that an owner or property manager take any action based on the results of the background check. The intent is that owners and property managers are aware of the criminal history of potential tenants as they make decisions regarding leasing. Packet Page Number 44 of 236 H1 Ownersor their property managers must have a written lease for all people that live in the rental unit. Leases must require tenants to sign a “Lease Addendum for Crime-Free/Drug- Free Housing.” Property owner must provide 24-hour contact information for a person who resides within the Twin City metropolitan area who is responsible for code compliance of the rental property. This person will be either the owner or agent of the propertyowner. The city manager may deny or not renew a license and the city council may revoke or suspend a rental license for failure to address any tenant or property issues, or fornot complying with any licensing requirements. Inspections All rental properties will be inspected on a regular basis to ensure that they comply with building code, fire code, and the city’s property maintenance code. The ordinance requires that the city establish an inspection policy that determines the frequency of inspections from one to three years. The inspection frequency will be based on the age of the structure, inspection history, and compliance record for the property. Since it is not feasible for the city to inspect all rental dwellings in the first year, the city intends to implement the initialinspections over athree year period under the following schedule: 2020– All multi-family rental properties would be inspected (96 properties and 4,328 units) 2021– One half of the single-family rental properties would be inspected (approximately 250 properties) 2022– The other one half of single-family rental properties would be inspected (approximately 250 properties) As each year of inspections are completed, each property would then be inspected according to the city’s ongoing inspections policy. Fees The city has established the fees for the annual license as $150 per building plus $50 for each unit within the building. The fees are based on the city’s cost to operate the rental licensing program. As proposed, the fees would cover the full cost of the licensing program staff and expenses so that the property tax levy would not support the program costs. Based on the fees, the following are examples of the annual cost for rental property owners: Single-family home$200 per year Duplex (both units)$250 per year 25-unit building$1,400 per year 50-unit building$2,650 per year 100-unit building$5,150 per year 150-unit building$7,650 per year The fee schedulewould include incentives for well-performing properties. Theinitial inspection and first re-inspection would not incur an additional fee. However, if the city hasto continually inspect a rental property, the second re-inspection would incur an additional $250 fee, and any third or subsequent re-inspection would incur an additional $500 fee per inspection. In addition, an amendment to the fee schedule amendments would be brought back to the council for adoption. Lastly, city staff would bring a separate ordinance amendment for the council’s consideration for the city to adopt the International Property Maintenance Code in place of the city’s current property maintenance requirements. In order to continue to operate out of three stations, the Central Station (Gladstone) would need several million dollars in renovations and the North Fire Station (Hazelwood) would need to be completely torn down and rebuilt. In 2017, the City hired Fitch & Associates to conduct a Fire Station Location and Operational Review. One of the recommendations that arose from the Fire Station Location and Operational Review was to cease operating out of the Central Fire Station and reallocate resources from the Central Fire Station to the North Fire Station. This recommendation came from the data analysis that demonstrated that continuing to operate three stations would only improve the department’s response reliability by one-half of one percent. Department administration concur with the consultants recommendations to consolidate to a two station model. If approved, staff would need to work with an architect to conduct a fire station needs assessment and design recommendations to ensure that the future fire station on the Hazelwood property will meet the Fire Department’s future needs. These recommendations will improve the Fire Department’s critical infrastructure, enhance operational effectiveness by reducing redundancy and will lead to financial sustainability as we will no longer have the operational costs associated with multiple aging stations. Background In 2017, the City hired Fitch & Associates to conduct a Fire Station Location and Operational Review. Fitch & Associates provided several recommendations that were presented to City Council on January 25, 2018. At the January 25, 2018City Council meeting, City Council authorized staff to implement a transition plan to a full-time fire department and to create a series of community meetings to discuss future fire station locations. Of particular note, Fitch & Associates pointed out the following: The department’s historical response (travel) time performance was 8.3 minutes with the three station configuration. Based on historical performance the consultants recommended that the department aim for an 8 minute response (travel) time for 90% of the incidents. The consultants found that the department could cover 96% of the incidents in 8 minutes or less utilizing only the North and South Fire Stations. Continuing to operate the Central Station would improve performance by less than 1 percent. o In other words, the Central Station is duplicated for 99% of the response areas within 8 minutes The Fire Department has successfully transitioned to a full-time staffing model beginning in March of 2018. In the summer of 2019, staff began community engagement efforts to discuss future fire station locations. Staff sent out communications via the city newsletter, social media and created a thth fire station realignment survey in Polco. Staff held open houses on June 26 and July 11, 2019 and feedback on the plan was largely positive. Prior to the consultant recommendations, cost estimates to remodel the North and Central fire stations were nearly 5 million dollars. Given the findings of the Fire Station Location and Operational Review, staff believe that the most effective financial and operational strategy is to adopt the recommendation to consolidate to a two station model. If approved, this model would reallocate the resources from the Central Station to the North Station. All future operations would be operated out of a new station built on the property of the current North Fire Station (1530 County Road C) and the South Fire Station (600 McKnight Road North).
