It is hoped that by following these simple rules, everyone’s opinions can be heard and understood in a reasonable manner. We appreciate the fact that when appearing at Council meetings, it is understood that everyone will follow these principles: Speak only for yourself, not for other councilmembers or citizens -unless specifically tasked by your colleagues to speak for the group or for citizens in the form of a petition. Show respect during comments and/or discussions, listen actively and do not interrupt or talk amongst each other. Be respectful of the process, keeping order and decorum. Do not be critical of councilmembers, staff or others in public. Be respectful of each other’s time keeping remarks brief, to the point and non-repetitive. Resolution 19-06-1703 Resolution Authorizing Interfund Loan WHEREAS, The City purchased the Maplewood Moose Lodge No. 963 at 1946 English Street, for a total price of $904,471.51; and WHEREAS, the EDA will facilitate the financing of the property; and WHEREAS, the EDA Fund does not have sufficient resources to finance the purchase of the property; and WHEREAS, the City is currently implementing debt reduction strategies and has determined that this purchase is suitable for financing with an interfund loan; and WHEREAS, the Sanitary Sewer Fund has sufficient resources to finance the purchase of the property, without undue negative impact to projected projects in the City’s 10-year capital improvement and long-term financing plans; THEREFORE, BE IT RESOLVED that an interfund loan, in the amount of $904,471.51, from the Sanitary Sewer Fund to the EDA Fund is hereby approved, effective 5/29/2019, with an annual calculated simple interest rate of 3% on the June 10, 2019 3 City Council Meeting Minutes Packet Page Number 4 of 132 E2 outstanding balance. Seconded by Councilmember SmithAyes – All The motion passed. 3.Resolution to Maintain Statutory Tort Liability Limits Councilmember Juenemann moved to approve the resolution to maintain the statutory tort liability limits. Resolution 19-06-1704 Resolution to Maintain the Statutory Tort Limits for Liability Insurance Proposed WHEREAS, the League of Minnesota Cities Insurance Trust annually requests member cities to make an election to waive or not waive the tort liability limit established by Minnesota Statutes 466.04; and WHEREAS, the City has three choices: to not waive the statutory limit, to waive the limit but to keep insurance coverage at the statutory limit, and to waive the limit and to add insurance to a new level; NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Maplewood hereby elects to not waive the statutory tort liability limit established by Minnesota Statutes 466.04. Seconded by CouncilmemberNeblettAyes – All The motion passed. 5.Conditional Use Permit Review, Frost English Village, 1957 English Street North CouncilmemberJuenemann moved to approve the CUP review for the Frost English Village Phase 2 and review again only if a problem arises or a major change is proposed. Seconded byCouncilmember SmithAyes – All June 10, 2019 4 City Council Meeting Minutes Packet Page Number 5 of 132 E2 The motion passed. 6.Parking Width Waiver andDesign Review, Aldrich Arena, 1850 White Bear Avenue North Councilmember Juenemann moved to approve thedesign plans date-stamped May 6, 2019 for the exterior and site improvements to Aldrich Area located at 1850 White Bear Avenue. This approval includespermitting parking stalls to be nine feet wide. Approval is subject to the applicant doing the following: 1.Repeat this review in two years if the city has not issued a building permit for this project. 2.All requirements of the fire marshal and building official must be met. 3.Satisfy the requirements set forth in the staff report authored by staff engineer Jon Jarosch, dated May 14, 2019. 4.Prior to the issuance of a building permit, submit all parking agreements to staff. 5.Prior to the issuance of a building permit, the applicant shall provide the city with cash escrow or an irrevocable letter of credit for the exterior landscaping and site improvements. Staff shall determine the dollar amount of the escrow. 6.The applicant shall complete the following before occupying the building: a.Replace any property irons removed because of this construction. b.Provide continuous concrete curb and gutter around the parking lot and driveways. c. Install all required landscaping and an in-ground lawn irrigation system for all landscaped areas. d.Install all required outdoor lighting. e.Install all required sidewalks. 7.If any required work is not done, the city may allow temporary occupancy if: a.The city determines that the work is not essential to the public health, safety orwelfare. b.The above-required letter of credit or cash escrow is held by the City of Maplewood for all required exterior improvements. The owner or contractor shall complete any unfinished exterior improvements by June 1 of the following year if occupancyof the building is in the fall or winter or within six weeks of occupancy of the building if occupancy is in the spring or summer. 8.All work shall follow the approved plans. Resolution 19-06-1705 Public Vacation Resolution WHEREAS, Pauline Hardwick has applied for the vacation of the following: The full width of the Sandhurst Avenue right-of-way lying easterly of Van Dyke Street North and westerly of the northern extension of the east line of the west 120 feet of the east 295 feet of Lots 1 and 2, Block 30, Smith and Tylor’s Addition to North St. Paul. WHEREAS, the Maplewood City Staff is also recommending approval of this vacation; WHEREAS, the history of this vacation is as follows: 1.On May 21, 2019, the planning commission held a public hearing. The city staff published a hearing notice in the Maplewood Review and sent notices to the surrounding property owners. The planning commission gave everyone at the hearing a chance to speak and present written statements. The planning commission recommended that the city council approve this vacation; 2.On June 10, 2019, the city council discussed the vacation. They considered reports and recommendations from the planning commission and city staff. WHEREAS, after the city approves this vacation, public interest will go to the abutting owners of the following properties: 2182 Van Dyke Street 2194 Van Dyke Street 1861 County Road B East 1863 County Road B East 1877 County Road B East 2195 Hazel Street NOW, THEREFORE, BE IT RESOLVED that the city councilapprovedthe above-described public vacation for the following reasons: June 10, 2019 6 City Council Meeting Minutes Packet Page Number 7 of 132 E2 It is in the public interest to approve this vacation since: 1.This street right-of way is not needed for any access or transportation purpose. 2.The vacation would return public right-of-way to the properties they were taken from. This vacation is subject to the conditions stipulated in the engineering report by Jon Jarosch dated May 15, 2019. Seconded by CouncilmemberSmithAyes – All The motion passed. 9.Replacement of the Sherwood Park Tennis Courts Councilmember Juenemann moved to approve thereplacement of the Sherwood Park Tennis Courts and to direct the City Manager and Mayor to enter into an agreement with ACI Asphalt & Concrete Inc. for construction services in the amount of $66,026.00. Seconded by CouncilmemberSmithAyes – All The motion passed. 10.Resolution Accepting Tree Planting Donation Councilmember Juenemann moved to approve theresolution accepting the tree planting donation in the amount of $93.75 to the City of Maplewood. Resolution 19-06-1706 Acceptance of Donation WHEREAS the City of Maplewood and the Parks and Recreation Department has received a donation from St. Paul and Ramsey County Friends of the Parks and Trails in the amount of $93.75 for planting trees at parks; NOW, THEREFORE, BE IT RESOLVEDthat the Maplewood City Council authorizes the City of Maplewood to accept this donation. Bill Skolnick, Attorney for the Myth addressed the council to report on the operational action plan for the Myth. Rich Stanek, former Hennepin County Sherriff addressed the council to give additional information on the Myth’s current security plan. Brian Jessen, General Manager at the Myth addressed the council to give additional information on the Myth security plan. KervySanchez addressed the council to give additional information on security at the Myth. Mayor Abrams moved to approve theMyth Operational Action Planwith the proviso that thecouncil will reconsider the metal detector portion of the plan in 90 days. J.NEW BUSINESS 1.Maplewood Moose Lodge, 3033 Hazelwood Street North a.Conditional Use Permit Resolution b.Design Review Community Development Director Thomson gave the staff report. Public Works Director Love answered questions of the council. Gary Leonard, Administrator of the Moose Lodge addressed the council to give additional information. Councilmember Smith moved to approve theconditional use permit resolution for the new Maplewood Moose Lodge club building, as places of amusement, recreation or assembly and buildings erected in the Light Manufacturing zoning district within 350 feet of a residential district require a conditional use permit. Resolution 19-06-1707 Conditional Use Permit Resolution WHEREAS, Maplewood Moose Lodge, owner of the property located at 3033 Hazelwood Street North, has applied for a conditional use permit for its club building to be built within the M1 (light manufacturing) district. WHEREAS, Section 44-637 of the city ordinances requires a conditional use permit for any building erected, altered or conducted within 350 feet of a residential district. WHEREAS, Section 44-512 of the city ordinances also requires a conditional use permit for a place of amusement, recreation or assembly. The legal description of the property is: Maekloth Addition, Lot 1, Block 1 WHEREAS, the history of this permit is as follows: 1.On May 21, 2019, the planning commission held a public hearing. NOW, THEREFORE, BE IT RESOLVED that the city council approvedthe above-described conditional use permit because: 1.The use would be located, designed, maintained, constructed and operated to be in conformity with the City’s Comprehensive Plan and Code ofOrdinances. 2.The use would not change the existing or planned character of the surrounding area. 3.The use would not depreciate property values. 4.The use would not involve any activity, process, materials, equipment or methods of operation that would be dangerous, hazardous, detrimental, disturbing or cause a nuisance to any person or property, because of excessive noise, glare, smoke, dust, odor, fumes, water or air pollution, drainage, water run-off, vibration, general unsightliness, electrical interference or other nuisances. 5.The use would not exceed the design standards of any affected street. 6.The use would be served by adequate public facilities and services, including streets, police and fire protection, drainage structures, water and sewer systems, schools and parks. 7.The use would not create excessive additional costs for public facilities or services. 8.The use would maximize the preservation of and incorporate the site’s natural and scenic features into the development design. 9.The use would cause minimal adverse environmental effects. Approval is subject to the following conditions: 1.All construction shall follow the site plan approved by the city. The director of community development may approve minor changes. 2.The proposed construction must be started within one year of council approval or the June 10, 2019 9 City Council Meeting Minutes Packet Page Number 10 of 132 E2 permit shall end. The council may extend this deadline for one year. 3.The city council shall review this permit in one year. 4.The proposed building is permitted to be built within 83 feet of the existing pipeline on the site. The site has unique characteristics and challenges that justify approval of a revised pipeline setback. 5.All activity shall be confined to the site. There shall be no parking of customer, employee anddelivery vehicles on the street rights-of-way. 6.The applicant must install screening to the east of the building, along the south property line and south of the parking lot. Screening shall be satisfied by the use of a screening fence, planting screen, berm or combination thereof. 7.Comply with all city ordinance requirements for signage, trash enclosures and parking. 8.If a parking shortage occurs, the applicant shall be required to build additional parking stalls to meet demand. 9.Prior to a certificate of occupancy being granted a security plan must be reviewed and approved via Public Safety. 10.All business licenses held by the Moose Lodge require new applications and approvals under the new address. Licenses are not transferrable between addresses. 11.All outdoor activities shall cease operation no later than 9 p.m. daily. 12.All music events shall occur indoors. No outdoor music is permitted. 13.There shall be no noise or disturbance related to the construction of the building or site between the hours of 7:00 p.m. and 7:00 a.m. Monday through Saturday and all day Sunday. Councilmember Smith moved to approve thedesign plans date-stamped May 6, 2019, and the revised landscape plan and building elevations submitted on May 24, 2019 and the new 5,000-square-foot Maplewood Moose Lodge club building, at 3033 Hazelwood Street North. Approval is subject to the applicant doing the following: 1.Repeat this review in two years if the city has not issued a building permit for this project. 2.Satisfy the requirements set forth in the staff report authored by staff engineer Jon Jarosch, dated May 15, 2019. June 10, 2019 10 City Council Meeting Minutes Packet Page Number 11 of 132 E2 3.All requirements of the fire marshal and building official must be met. 4.Any roof-top mechanical equipment shall be screened from view from all nearby residential properties. 5.Prior to issuance of a grading or building permit, the applicant must submit to staff for approval the following items: a.Revise the May 29, 2019 landscape plan to include additional plantings and screening south of the parking lot. Screening shall be satisfied by the use of a screening fence, planting screen, berm or combination thereof and be at least six feet tall and provide 80 percent opaqueness. The May 29, 2019 landscape plan shall also be revised to ensure all trees used for screening are at least six feet tall upon planting. b.Submit a revised photometric plan for staff approval – plan must meet all city requirements. c. The trash enclosure’s colors and building materials shall be consistent with the main building. d.A cash escrow or an irrevocable letter of credit for all required exterior improvements. The amount shall be 150 percent of the cost of the work. e.Writtendocumentation from all easement holders affecting this site indicating approval of the plans for the planned improvements. 6.The applicant shall complete the following before occupying the building: a.Replace any property irons removed because of this construction. b.Provide continuous concrete curb and gutter around the parking lot and driveways. c. Councilmember Smith moved to approve theResolution Authorizing Preparation of Plans and Specification for the 1902 Building HVAC Upgrades, City Project 19-18. Resolution 19-06-1708 Authorizing Preparation of Plans and Specifications WHEREAS, the City of Maplewood completed a citywide asset management study in 2015 to inform the decision making process for building facility improvements, and WHEREAS, the proposed 1902 Building HVAC Upgrade, City Project 19-18, has been prioritized and is identified in the approved 2019-2023 Capital Improvement Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MAPLEWOOD, MINNESOTA: 1.The proposed 1902 Building HVAC Upgrade, City Project 19-18, is hereby authorized to proceed with the development of plans and specification in order to bid the project according to State Statute. 2.The professional services firm, and authorized consultant, shall be LHB, Inc. LHB, Inc. shall be authorized in an amount of $27,785 upon signature of the Work Order Proposal by the Mayor and the City Manager. 3.The Finance Director is hereby authorized to make the financial transfers necessary for the preparation of plans and specifications. A proposed budget of $27,785 shall be established. The proposed financing is from the Building Maintenance Fund. Seconded by Councilmember JuenemannAyes – All The motion passed. F3Presentation of 2018 Comprehensive Annual Financial Report (CAFR) Finance Director Paulseth introduced the item. Michael Bösl, Audit Manager with Bergan KDV addressed the council to give the presentation. Councilmember Smith movedto accept the 2018 Comprehensive Annual Financial Report. The total cost was $404,876, which was financed through a seven-year utility bond. TheCity charges residents $.75 per household per month on their trash bill to cover the cost of the trash cart utility bond. The final payment for the trash cart utility bond was made in January of this year. While the carts are under warranty, new carts are needed from time to time to replenish the trash cart supply for new trash services and cart attrition due to loss of carts.Following is a history of trash cart purchases: March 23, 2016 –550Additional Trash Carts November 1, 2017 – 550Additional Trash Carts March 26, 2018 –720Additional Trash Carts June 11, 2018 – 564Additional Trash Carts July 9, 2018 – 655Additional Trash Carts At the beginning of the Maplewood Trash Programin 2012, the City did not have a sustainable cart management program in place. For that reason, yearly analysis of cart replacements were not taking place. As such,Republic Services rolled out many of their own carts throughout 2017. Those carts have since been replaced with Maplewood carts after the 2018 purchase of a large quantity of carts. Moving forwardthe City and Republic Services have a program for estimating the number of carts to be replaced yearly. In 2019 it is estimated that the City will need an additional 787 carts (180 - 35 gallon, 207 - 65 gallon, and 400 - 95 gallon). Recitals 1. Under Minn. Stat. § 216C.02, subd. 1, the State is empowered to enter into this grant. 2.The State is in need of content and staffing foran interactive display within the Energy Exhibit at the 2019 Eco Experience for communities to share clean energy successes with the public. 3. The Grantee represents that it is duly qualified and agrees to perform all services described in this grant contract to the satisfaction of the State. Pursuant to Minn. Stat. § 16B.98, subd.1, the Grantee agrees to minimize administrative costs as a condition of this grant. Reimbursement for travel and subsistence expenses actually and necessarily incurred by the Grantee as a result of this grant contract will not exceed Five Hundred dollars ($500.00) or Twenty percent (20%); provided that the Grantee will be reimbursed for travel and subsistence expenses in the same manner and in no greater amount than provided in the current “Commissioner’s Plan” established by the Commissioner of Minnesota Management and Budget (MMB). The Grantee will not be reimbursed for travel and subsistence expenses incurred outside Minnesota unless it has received the State’s prior written approval for out of state travel. Minnesota will be considered the home state for determining whether travel is out of state. The total obligation of the State for all compensation and reimbursements to the Grantee under this grant contract will not exceed Two Thousand Five Hundred dollars ($2,500.00) or One Hundred percent (100%) of the total actual, eligible costs incurred in the performance of the Grantee’s duties specified in Exhibit A. 4.2 Payment 4.2.1 Invoices. The State will promptly pay the Grantee after the Grantee presents an itemized invoice for the services actually performed and the State’s Authorized Representative accepts the invoiced services. Invoices must be submitted timely and according to the schedule as outlined in Exhibit A. 4.2.2 Federal funds. Payments under this grant contract will be made from federal funds obtained by the State through Title III, Part D, of the Energy Policy and Conservation Act. The Grantee is responsible for compliance with all federal requirements imposed on these funds and accepts full financial responsibility for any requirements imposed by the Grantee’s failure to comply with federal requirements. These requirements include, but are not limited to, Title III, part D, of the Energy Policy and Conservation Act (42 U.S.C. 6321 et seq. and amendments thereto); U.S. Department of Energy Financial Assistance Rules (10CFR600); and Title II Code of Federal Regulations Part 200. 4.2.3 Unexpended Funds. The Grantee must promptly return to the State any unexpended funds that have not been accounted for annually in a financial report to the State due at grant closeout. 4.3 Budget Categories. Upon notice to and written approval by the State’s Authorized Representative, the Grantee’s budget for any one category in Exhibit B may be increased by up to 10% of the amount shown in Exhibit B for that category, with the amount of the increase moved from one or more other categories in Exhibit B. To move more than 10% into a budget category from another budget category or categories will require an amendment to the grant contract. 5 Conditions of Payment All services provided by the Grantee under this grant contract must be performed to the State’s satisfaction, as determined at the sole discretion of the State’s Authorized Representative and in accordance with all applicable federal, state, and local laws, ordinances, rules, and regulations. The Grantee will not receive payment for work found by the State to be unsatisfactory or performed in violation of federal, state, or local law. 6 Authorized Representative The State’s Authorized Representative is Terry Webster, State Program Administrator Senior, 651-539-1862, or their successor, and has the responsibility to monitor the Grantee’s performance and the authority to accept the services provided under this grant contract. If the services are satisfactory, the State’s Authorized Representative will certify acceptance on each invoice submitted for payment. If the Grantee’s Authorized Representative changes at any time during this grant contract, the Grantee must immediately notify the State. 7 Assignment, Amendments, Waiver, and Grant Contract Complete 7.1 Assignment. The Grantee shall neither assign nor transfer any rights or obligations under this grant contract without the prior written consent of the State and a fully executed Assignment Agreement, executed and approved by the same parties who executed and approved this grant contract, or their successors in office. 7.2 Amendments. Any amendments to this grant contract must be in writing and will not be effective until it has been executed and approved by the same parties who executed and approved the original grant contract, or their successors in office. 7.3 Waiver. If the State fails to enforce any provision of this grant contract, that failure does not waive the provision or the State’s right to enforce it. 7.4 Grant Contract Complete. This grant contract contains all negotiations and agreements between the State and the Grantee. No other understanding regarding this grant contract, whether written or oral, may be used to bind either party. This clause will not be construed to bar any legal remedies the Grantee may have for the State’s failure to fulfill its obligations under this grant contract. 9 State Audits Under Minn. Stat. § 16B.98, subd. 8, the Grantee’s books, records, documents, and accounting procedures and practices of the Grantee or other party relevant to this grant contract or transaction are subject to examination by the State and/or the State Auditor or Legislative Auditor, as appropriate, for a minimum of six years from the end of this grant contract, receipt and approval of all final reports, or the required period of time to satisfy all state and program retention requirements, whichever is later. 10 Government Data Practices and Intellectual Property Rights 10.1 Government Data Practices. The Grantee and State must comply with the Minnesota Government Data Practices Act, Minn. Stat. Ch. 13, as it applies to all data provided by the State under this grant contract, and as it applies to all data created, collected, received, stored, used, maintained, or disseminated by the Grantee under this grant contract. The civil remedies of Minn. Stat. § 13.08 apply to the release of the data referred to in this clause by either the Grantee or the State. If the Grantee receives a request to release the data referred to in this Clause, the Grantee must immediately notify the State. The State will give the Grantee instructions concerning the release of the data to the requesting party before the data is released. The Grantee’s response to the request shall comply with applicable law. 10.2 Intellectual Property Rights. The Grantee shall own all rights, title, and interest in all of the intellectual property rights, including copyrights, patents, trade secrets, trademarks, and service marks in the works and documents. The “works” means all inventions, improvements, discoveries (whether or not patentable), databases, computer programs, reports, notes, studies, photographs, negatives, designs, drawings, specifications, materials, tapes, and disks conceived, reduced to practice, created or originated by the Grantee, its employees, agents, and subcontractors, either individually or jointly with others in the performance of this grant contract. “Works” includes documents. The “documents” are the originals of any databases, computer programs, reports, notes, studies, photographs, negatives, designs, drawings, specifications, materials, tapes, disks, or other materials, whether in tangible or electronic forms, prepared by the Grantee, its employees, agents, or subcontractors, in the performance of this grant contract. 10.3 License to the State. Subject to the terms and conditions of this grant contract, the Grantee hereby grants to the State a perpetual, irrevocable, no-fee right and license to make, have made, reproduce, modify distribute, perform and otherwise use the works and documents for any and all purposes, in all forms and manners that the State, in its sole discretion, deems appropriate. The Grantee shall upon the request of the State, execute all papers and perform all other acts necessary, to document and secure said right and license to the works and documents by the State. At the request of the State, the Grantee shall permit the State to inspect the original documents and provide a copy of any of the document to the State, without cost, for use by the State in any manner the State, in its sole discretion, deems appropriate. 10.4 Obligations. Grantee represents and warrants that materials produced or used under this grant contract do not and will not infringe upon any intellectual property rights of other persons or entities including but not limited to patents, copyrights, trade secrets, trade names, and service marks and names. Grantee shall indemnify and defend the State, at Grantee’s expense, from any action or claim brought against the State to the extent that it is based on a claim that all or part of the materials infringe upon the intellectual property rights of another. Grantee shall be responsible for payment of any and all such claims, demands, obligations, liabilities, costs, and damages including, but not limited to reasonable attorneys’ fees arising out of this grant contract, amendments and supplements thereto, which are attributable to such claims or actions. This remedy shall be in addition to and shall not be exclusive to other remedies provided by law. 11 Workers’ Compensation The Grantee certifies that it is in compliance with Minn. Stat. § 176.181, subd. 2, pertaining to workers’ compensation insurance coverage. The Grantee’s employees and agents will not be considered State employees. Any claims that may arise under the Minnesota Workers’ Compensation Act on behalf of these employees and any claims made by any third party as a consequence of any act or omission on the part of these employees are in no way the State’s obligation or responsibility. 12 Publicity and Endorsement 12.1 Publicity. Any publicity regarding the subject matter of this grant contract must identify the State as the sponsoring agency and must not be released without prior written approval from the State’s Authorized Representative. For purposes of this provision, publicity includes notices, informational pamphlets, press releases, research, reports, signs, and similar public notices prepared by or for the Grantee individually or jointly with others, or any subcontractors, with respect to the program, publications, or services provided resulting from this grant contract. All projects primarily funded by state grant appropriations must publicly credit the State of Minnesota, including on the grantee’s website when practicable. 12.2 Federal Acknowledgment and Disclaimer. N/A Background Maplewood’s current dog ordinance requires residents to license dogs over 3 months of age.For purposes of uniformity, the two-year license expiresevery other even year on December 31. The fee for the 2 years start at $21 with spay/neuter and senior discounts. This feealso applies toany new dog licensed within the 2 year cycle. Currently, a new cycle began January 1, 2019 and these will expire December 31, 2020. Records show 841 dogs are to be renewed. Renewal requires providing an original certificateof rabies vaccination if the past certificate has expired along with payment. Packet Page Number 106 of 132 J3 Staff has found ordering 1000 tags, which costs $300,for the 2 year cycle is sufficient to cover the number of renewals and new licenses. Each cycle sees a flux around 150 as some licensesarenot renewed due to attritionwhile new dogsare added. Administratively, staffestimatesaround 120- 150 hoursare spent licensing throughout the 2 year cycle. A new licensing software will be implemented in 2019to allow residents to obtain the license online and to pay with a credit card. Any cost or time saving is unknown at this point but customer convenience should be elevated. Annually over the past 5 years, the dog licenseprogramrevenue has averaged around $7,000. Presently, residences zoned R-1 or R-2 are allowed 2 dogs while R-3 unitsare allowed 1 dog. However, in R-1, a maximum of 3 dogs is allowed with a small kennel license. There is no process to allow more than 3 dogs. There are 12 activesmall kennel licenses at $45 each resulting in $540annual revenue. Any new small kennelapplications are charged an initial $85 fee for the first year.This small kennel license demands more staff time as letters are sent out to neighbor’s within 150 feet to receive at least 75% approval. Upon neighbor approval, a site visit is done by the CSOs to determine police approval. Other Municipalities Staff has surveyed 68 metro cities, including Ramsey County cities,on how dog licenses are handledand found there are four basic options. A yearly license of either one, two or three years with proof of rabies vaccination was found in 44 cities. No licensing requirement was maintained in 15 cities. Sixmunicipalities includingSt Pauland Minneapolisoffer either a yearlyorlifetime option. Lastly, alifetime license is the only option inBloomington, Fridleyand Lauderdale. The majority of cities use six months of age as the age threshold for requiring a license and have a stated maximum number of dogs allowed. However, there is an evensplit on whether torequire an additional licenseto reach that maximum. Even the 15 cities which do not license dogs are evenly split with seven using a multiplepet/kennel license and eight not having any additional requirement. Packet Page Number 107 of 132 J3 Dog Complaints When a dog complaint is called into dispatch, typically CSOs respond as Maplewood no longer contracts with an independent animal control officer. Whether nuisance complaints like barking or more serious complaints such as biting, the license does not grantthe owner or dog privileges over non-licensed dogs. After handling the complaint and potentially returning the dog or bringing it to St Paul for boarding, the CSO checks on whether the owners are following code requirements in regards to licensing and number allowed and follows up accordingly. Of the 625 animal calls in 2018 approximately 375 involved dogs and any subsequent follow up. The time spent per call can vary from 30 minutes to several hours depending on the issue. This number includes serious complaints which may be the start of designating a dog as dangerous or potentially dangerous. This process is a separate annual license and fee with requirements as set by state statute and city code. The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning: Animal shelter means any premises designated by the city administrative authority for the purposes of impounding and caring for dogs held under authority of this article. Dog means any living dog. Officer means any person designated by the city manager as an enforcement officer. Owner means any person owning, keeping or harboring dogs. Pet shop means any person engaged in the business of feeding, buying, selling or boarding animals of any species. Restraint. A dog or cat is under restraint within the meaning of this article if it is controlled by a leash which does not extend beyond the boundaries of the private property or within a vehicle being driven or parked on the streets or within the property of its owner/keeper, in a fenced area, if within an electronic fence with signage, controlled by a chain or under owner's control and supervision. Veterinary hospital means any establishment maintained and operated by a licensed veterinarian for the diagnosis and treatment of diseases and injuries of animals. (Ord. No. 973, 11-28-2016) Sec. 10-62. - Rules and regulations relating to permits and humane treatment. The council shall promulgate regulations governing the issuance of permits, and such regulations shall include requirements for humane care of the owner's dogs and for compliance with all sections of this article and other applicable state and local laws. The council may amend such regulations from time to time as it deems desirable for the public health and welfare and to protect dogs from cruelty. (Ord. No. 973, 11-28-2016) Sec. 10-63. - Limitation on number for each dwelling unit in residential zones. No more than two dogs over three months of age shall be housed or be kept on any one residential site in any area of the city zoned R-1 residence district or R-2 residence district. No more than one dog of any age shall be kept in a dwelling unit in any area of the city zoned R-3 residence district. (Ord. No. 973, 11-28-2016) State Law reference— Dogs, Minn. Stats. ch. 347. Officers designated by the city manager and approved by the council shall have police powers in the enforcement of this article; and no person shall interfere with, hinder or molest any such officer in the exercise of such powers. (a) Any person violating any of the sections of this article shall be deemed guilty of a misdemeanor and, upon conviction, shall be punished in accordance with section 1-15. (b) If any person is found guilty by a court of violation of section 10-1, his permit to own, keep, harbor or have custody of dogs shall be deemed automatically revoked; and no new permit may be issued for a period of one year. (Ord. No. 973, 11-28-2016) Secs. 10-66—10-90. - Reserved. DIVISION 2. - PERMIT Sec. 10-91. - Required; exceptions. No person shall, without first obtaining a permit in writing from the clerk, own, keep, harbor, or have custody of any dog over three months of age. However, this section shall not apply to the keeping of small caged birds or aquatic and amphibian animals solely as pets or for police canines of any political subdivision. (Ord. No. 973, 11-28-2016) Sec. 10-92. - Fees; issuance; current rabies vaccination certificate required. (a) Upon a showing by any applicant for a permit required under this division that he is prepared to comply with the regulations promulgated by the council, a permit shall be issued following payment of the applicable fee, as follows: (1) For each dog, the fee is as may be imposed, set, established and fixed by the city council, by resolution, from time to time. (2) No fee or permit shall be required of any Humane Society or veterinary hospital. (b) No permit shall be granted for a dog which has not been vaccinated against rabies as provided in this section on such date, but not more than two years will have elapsed from the date of such vaccination to the time of the expiration of the permit to be issued, unless stated upon the certificate that the vaccination is effective for at least three years. Vaccination shall be performed only by a doctor qualified to practice veterinary medicine in the state in which the dog is vaccinated, and the applicant shall present an original certificate from a qualified veterinarian showing that the dog to be permitted has been given a vaccination against rabies and the date on which the vaccination was administered. A new permit shall be obtained each even year by every owner and a new fee paid. A permit, if not revoked, shall be valid until the end of the permit period. Renewal permits must be obtained prior to the expiration date, and there shall be a late penalty charge on all renewal permits issued after the expiration date. (Ord. No. 973, 11-28-2016) Sec. 10-94. - Revocation. The city manager may revoke any permit issued under this division if the person holding the permit refuses or fails to comply with this article, any regulations promulgated by the council pursuant to this article, or any state or local law governing cruelty to animals or the keeping of animals. Any person whose permit is revoked shall, within ten days thereafter, humanely dispose of all dogs being owned, kept or harbored by such person; and no part of the permit fee shall be refunded. (Ord. No. 973, 11-28-2016) Sec. 10-95. - Tags. Upon issuing a permit to keep any dog under this division, the clerk shall issue to the owner a metallic or durable plastic tag stamped with an identifying number and with the month/date/year of expiration and so designated that it may be conveniently fastened to a dog collar or harness. Such tag shall be fastened to the dog's collar or harness by the owner and shall be worn at all times. The clerk shall maintain a record of the identifying numbers and shall make this record available to the public. (Ord. No. 973, 11-28-2016) Sec. 10-96. - Exemptions from division. The sections of this division requiring a permit shall not apply to owners of certified seeing eye and other handicapped-aid dogs, owners and handlers of bona fide working dogs (guard dogs, search dogs, etc.) and nonresidents of the city who are keeping only domestic pets, provided that domestic pets of nonresident owners shall not be kept in the city longer than 30 days annually and the animals shall be kept under restraint. (Ord. No. 973, 11-28-2016) Secs. 10-97—10-125. - Reserved. DIVISION 3. - RUNNING AT LARGE; NUISANCE Sec. 10-126. - Restraint. All dogs shall be kept under restraint at all times in the city. (Ord. No. 973, 11-28-2016) Sec. 10-127. - Duty of owners. Packet Page Number 111 of 132 J3, Attachment 1 (a) No owner or custodian of any dog, whether permitted or unpermitted, shall allow such dog to run at large, with the exception of within a designated off-leash dog area. It shall be the obligation of the owner or custodian of any dog in the city, whether permanently or temporarily therein, to prevent any such dog at anytime to be on any street, public park (with the exception of a park within an off-leash dog area as designated by Ramsey County or the City of Maplewood), school grounds or public place without being effectively restrained by a chain or leash not exceeding eight feet in length. (b) Any person having custody or control of any dog shall have the responsibility for cleaning up any feces of the dog and disposing of such feces in a sanitary manner. It shall furthermore be the duty of each person having the custody and control of any dog to have on such person possession of a device or equipment for picking up and removal of animal feces. This subsection shall not apply to a guide dog accompanying a blind person or to a dog when used in police or rescue activities. (c) No owner or custodian of any dog within the city shall allow the dog to remain outside and unattended for a period exceeding four consecutive hours. For the purpose of this subsection, the term "outside and unattended" shall mean that the dog is on or has free access to the exterior grounds of any premises and the owner or custodian is not physically present and in the company of the dog. (d) Owners or custodians of dogs are hereby charged to prevent their dogs from barking or making other noises which unreasonably disturb the peace and quiet of any person. The phrase "unreasonably disturb the peace and quiet" includes, but is not limited to, the creation of noises, by such dogs, audible to a peace officer or animal control officer outside the building or premises where the dogs are being kept and which noise occurs repeatedly over \[a\] five-minute period with a time lapse of one minute or less between repetitions over a five-minute period. Failure on the part of the owner or custodian to prevent a dog from committing such acts shall be subject to penalty provided in section 10-65. (Ord. No. 973, 11-28-2016) Sec. 10-128. - Female dogs in heat. Every female dog in heat in the city shall be confined in a building or secure enclosure in such manner that such female dog cannot come into contact with another dog, except for planned breeding. (Ord. No. 973, 11-28-2016) Sec. 10-129. - Duty of temporary visitors to city. It shall be unlawful for any person temporarily in the city, while staying at any private home or at any public accommodation such as a hotel or motel, to have a dog running at large or to permit his dog at any time, when out of the room or suite occupied by such person, to be upon the street or in any public or private place, unless firmly upon a leash at all times. (Ord. No. 973, 11-28-2016) Secs. 10-130—10-155. - Reserved. DIVISION 4. - IMPOUNDMENT Sec. 10-156. - Authority; notice to known owners; reclamation by owners; humane disposal of unclaimed dogs. Packet Page Number 112 of 132 J3, Attachment 1 Unrestrained dogs running at large in the city may be taken by police, the animal control officer or the Humane Society and impounded in an animal shelter and there confined in a humane manner. Impounded dogs shall be kept for not less than five days, unless reclaimed by their owners. If by a permit tag or by other means the owner can be identified, the animal control officer shall immediately, upon impoundment, notify the owner by telephone or mail of the impoundment of the dog. A dog not claimed by its owner within five days shall be humanely disposed of by an agency delegated by the council to exercise that authority. (Ord. No. 973, 11-28-2016) Sec. 10-157. - Fees; additional penalties. Any owner reclaiming a dog under this article, which has been impounded for any reason, shall pay a fee as set by council resolution from time to time. The owner may also be proceeded against for violation of this article, and his permit may be revoked. (Ord. No. 973, 11-28-2016) Sec. 10-158. - Return to owner of dog found at large. Notwithstanding the sections of this division, if a dog is found at large in the city and its owner can be identified and located, such dog need not be impounded but may, instead, be taken to the owner. (Ord. No. 973, 11-28-2016) Secs. 10-159—10-185. - Reserved. DIVISION 5. - DANGEROUS DOGS Secs. 10-186—10-188. - Reserved. Sec. 10-189. - Dangerous/potentially dangerous dogs. The provisions of Minn. Stats. §§ 347.50—347.56, inclusive, are hereby adopted as the potentially dangerous and dangerous dog regulations for the City of Maplewood. Where a conflict exists between the provisions of the City Code and the provisions of Minn. Stats. §§ 347.50—347.56, inclusive, the provisions of the Minnesota Statutes shall apply. (1) Definitions: For the purpose of this section, the terms defined have the meaning given to them: Dangerous dog means any dog that has: a. Without provocation, inflicted substantial bodily harm on a human being on public or private property; or b. Killed a domestic animal without provocation while off the owner's property; or c. Been found to be potentially dangerous, after the owner has notice that the dog is potentially dangerous, the dog aggressively bites, attacks, or endangers the safety of humans or domestic animals. Great bodily harm has the meaning given it under Minn. Stats. § 609.02, subdiv. 8. Owner means any person, firm, corporation, organization, or department possessing, harboring, keeping, having an interest in, or having care, custody, or control of a dog. Packet Page Number 113 of 132 J3, Attachment 1 Potentially dangerous dog means any dog that: a. When unprovoked, inflicts bites on a human or domestic animal on public or private property; or b. When unprovoked, chases or approaches a person, including a person on a bicycle, upon the streets, sidewalks, or any public or private property, other than the dog owner's property, in an apparent attitude of attack; or c. Has a known propensity, tendency, or disposition to attack unprovoked, causing injury or otherwise threatening the safety of humans or domestic animals. Proper enclosure means securely confined indoors or in a securely enclosed and locked pen or structure suitable to prevent the animal from escaping and providing protection from the elements for the dog. A proper enclosure does not include a porch, patio, or any part of a house, garage, or other structure that would allow the dog to exit of its own volition, or any house or structure in which the windows are open or in which door or window screens are the only obstacles that prevent the dog from exiting. Provocation means an act that adult could reasonably expect may cause a dog to attack or bite. Substantial bodily harm has the meaning given it under Minn. Stats. § 609.02, subdiv. 7a. (2) Initial determination. The city's designated animal control authority shall be responsible for initially determining (initial determination) whether a dog is a potentially dangerous dog or a dangerous dog. The animal control authority may retain custody of a dog which has been initially determined to be a dangerous dog pending the hearing as hereinafter provided. The initial determination shall be conclusive unless the owner appeals the initial determination as hereinafter provided. (3) Notice of initial determination. The notice of initial determination shall be personally served on the owner of the dog or on a person of suitable age at the residence of such owner. The notice of initial determination shall describe the dog deemed to be potentially dangerous or dangerous, shall identify the officer making the initial determination and shall inform the owner of the owner's right to appeal the initial determination. (4) Request for hearing and hearing. An owner may appeal the initial determination by filing a request and payment of the applicable fee for the hearing with the city manager within five days of the owner's receipt of the notice of initial determination. A hearing shall be held within seven days after the city's receipt of the request for hearing. The city manager shall assign a hearing officer, who shall not be the person who made the initial determination. At the hearing, the hearing officer shall consider the reports and comments of the animal control authority, the testimony of any witnesses, witness statements and the comments of the owner of the dog. After considering all of the evidence submitted, the hearing officer shall make written findings and shall determine whether the dog is a potentially dangerous dog or a dangerous dog (final determination). The findings shall be made within five days of the date of the hearing and shall be personally served upon the owner of the dog or upon a person of suitable age at the residence of the owner. (5) Seizure of dangerous dog or potentially dangerous dog. The animal control authority shall immediately seize any dangerous or potentially dangerous dog if, within 14 days after the service of the notice of final determination declaring a dog to be a dangerous dog: a. The owner has not registered the dog in compliance with the provisions of subsection 10- 189(8)a. or (10)a. b. The owner does not secure the proper surety bond or liability insurance pursuant to subsection 10-189(8)a.2. or (10)a.4. c. The dangerous or potentially dangerous dog is not maintained in a proper enclosure. Packet Page Number 114 of 132 J3, Attachment 1 d. The dangerous dog is outside a proper enclosure and not under the physical restraint of a responsible person. (6) Reclaiming a dangerous dog or potentially dangerous. A dangerous or potentially dangerous dog may be reclaimed by the owner of the dog upon payment of the impounding and boarding fees and upon presentation of proof to the animal control authority that the requirements of subsection 10-189(8)a. or (10)a. have been satisfied. A dangerous or potentially dangerous dog not reclaimed under this provision within seven days may be disposed of as provided in Minn. Stats. § 35.71, subdiv. 3, and the owner shall be liable to the animal control authority for costs incurred in confining and disposing of the dangerous dog. (7) Substantial/great bodily harm. Upon a final determination and notwithstanding the provisions of subsections 10-189(2)—(6), a dangerous dog that inflicted substantial bodily harm or great bodily harm on a human being on public or private property without provocation may be destroyed in a proper and humane manner by the animal control authority. (8) Dangerous dog restrictions. a. Registration required. No person may keep a dangerous dog in the City of Maplewood unless the dog is registered with the city clerk as provided in this section. The city clerk shall issue a certificate of registration to the owner of the dangerous dog if the owner presents the following information: 1. Proper enclosure. A proper enclosure exists for the dangerous dog and there is a posting on the premises with a clearly visible warning sign, including a warning symbol to inform children, that there is a dangerous dog on the property. 2. Bond/insurance. A surety bond issued by a surety company authorized to conduct business in the State of Minnesota in a form acceptable to the animal control authority in the sum of at least $300,000.00 payable to any person injured by the dangerous dog, or a policy of liability insurance issued by an insurance company authorized to conduct business in the State of Minnesota in the amount of at least $300,000.00 insuring the owner for any personal injuries inflicted by the dangerous dog. 3. Microchip. The owner has had a microchip identification implanted in the dangerous dog, and the name of the microchip manufacturer and identification number of the microchip must be provided to the animal control authority. If the microchip is not implanted by the owner, it may be implanted by the animal control authority with the costs borne by the dog's owner. 4. Warning symbol. The owner has posted a warning symbol to inform children that there is a dangerous dog on the property. The design of the warning symbol must have been approved by the Minnesota Commissioner of Public Safety. 5. Tag. The dangerous dog must have a standardized, easily identifiable tag identifying the dog as dangerous and containing the uniform dangerous dog symbol affixed to the dog's collar at all times. The design of the tag must have been approved by the Minnesota Commissioner of Public Safety. 6. Photograph. The owner of the dangerous dog shall make the dog available to be photographed for identification by the animal control authority at a time and place specified by the animal control authority. 7. Proof of disclosure. The owner of a dangerous dog who rents property from another where the dog will reside must submit proof of disclosure from the property owner that the property owner was notified, prior to entering into the lease agreement and at the time of any lease renewal, that the person owns a dangerous dog that will reside at the property. (9) Dangerous dog regulations. Packet Page Number 115 of 132 J3, Attachment 1 a. Annual fee. The owner of a dangerous dog shall pay an annual fee as determined by council ordinance, in addition to any regular dog licensing fees, to obtain a certificate of registration for a dangerous dog under this section. b. Annual renewal. The owner of a dangerous dog must renew the registration of the dog annually until the dog is deceased and pay the annual renewal fee as determined by city council ordinance. If the dog is removed from the city, it must be registered as a dangerous dog in its new jurisdiction. c. Death/transfer from city. The owner of any dangerous dog must notify the animal control authority in writing of the death of the dog, of its transfer to a residence outside of the city or of its transfer within the city within 30 \[days\] of the death or transfer. d. Notice to landlord. The owner of a dangerous dog who rents property from another where the dog will reside must disclose to the property owner, prior to entering into the lease agreement, and at the time of any lease renewal, that the person owns a dangerous dog that will reside at the property. e. Sale. The owner of a dangerous dog must notify the purchaser that the animal control authority has identified the dog as a dangerous dog. The seller must also notify the animal control authority in writing of the sale and provide the animal control authority with the new owner's name, address, and telephone number. f. Muzzling. If the dangerous dog is outside a proper enclosure, the dog must be muzzled and restrained by substantial chain or leash and be under the physical restraint of a reasonable person. The muzzle must be made in a manner that will prevent the dog from biting any person or animal but that will not cause injury to the dog or interfere with its vision or respiration. g. Sterilization. The animal control authority may require a dangerous dog to be sterilized at the owner's expense. If the owner does not have the dangerous dog sterilized, the animal control authority may have the animal sterilized at the owner's expense. (10) Potentially dangerous dog restrictions. a. Registration required. No person may keep a potentially dangerous dog in the City of Maplewood unless the dog is registered with the city clerk as provided in this section. (12) Annual review requests. If there are no additional reports of the behavior described in subsection (1)a. or (1)b. of this section within a 12-month period from the date of the designation as a dangerous dog or a six-month period from the date of the designation as a potentially dangerous dog, the dog's owner may request a review, in writing, of the declaration designation. The owner must provide documented evidence for review that the dog's behavior has changed due to environment, health, age, training, neutering or other relevant factor. The review request and supporting documentation must be submitted to the Maplewood Animal Control Authority, which shall rule on the review request based on the record. The owner of the dog shall be notified in writing of the review results within ten business days of receipt. An administrative fee shall be paid prior to the review. In cases where the owner has successfully completed a training program approved by the animal control authority, the administrative fee may be reduced or waived. The fees for such review shall be imposed, set, established and fixed by the city council, by resolution, from time to time. (Ord. No. 973, 11-28-2016) Secs. 10-190—10-215. - Reserved. DIVISION 6. - SMALL KENNEL LICENSES Sec. 10-216. - Construction and purpose of division. Packet Page Number 117 of 132 J3, Attachment 1 This division is supplementary to and in addition to all other sections of this Code or other ordinances in effect relating to the ownership, care and custody of dogs within the city and is deemed necessary by the council in order to regulate and control the ownership and the keeping of dogs in and near residential areas of the city. (Ord. No. 973, 11-28-2016) Sec. 10-217. - Required; limited to licensee's dogs; zoning classifications where permitted. (a) No person shall keep more than two dogs over three months of age anywhere within the city without first obtaining a small kennel license under this division for the keeping of such dogs for breeding, sale or show purposes. (b) Any licensee under this division may not board or train dogs belonging to other persons on such licensed premises. (c) Small kennel licenses will not be issued under this division in any part of the city, except on property zoned commercial or farm residential or residential R-1. (Ord. No. 973, 11-28-2016) Sec. 10-218. - Application; investigation; grant or denial of license. (a) Application. Any person desiring a small kennel license required under this division shall make written application to the city clerk upon a form prescribed by and containing such information as required by the city clerk. Among other things, the application shall contain the following information: (1) A description of the real property upon which it is desired to keep the dogs. (2) The species and number of dogs to be maintained on the premises. (3) A statement that the applicant or licensee will at all times keep the dogs in accordance with all the conditions prescribed by the police chief or a modification thereof and that failure to obey such conditions will constitute a violation of this chapter and grounds for cancellation of the license. (4) Such other and further information as may be required by the police chief. (b) Consent. Upon receipt of the completed small kennel license application, the city clerk's office will obtain a list of affected properties from GIS identifying properties within 150 feet of the applying property. Certified letters shall be sent to the affected property addresses requesting approval or objection to the kennel license. Upon written consent of 75 percent of the owners or occupants of privately or publicly owned real estate within 150 feet of the outer boundaries of the premises for which the license is being requested the license shall be forwarded to the police department for inspection and final approval. Where a property within 150 feet consists of a multiple dwelling, the applicant need obtain only the written consent of the owner or manager or other person in charge of the building if the building is renter-occupied; if the building is owner-occupied letters of consent or objection will be sent to each individual home owner for consent or objection. (c) Investigation; issuance or denial. The police chief shall make such investigation as is necessary and may grant, deny or refuse to renew any application for a license under this division. (d) Conditions. If granted, the license shall be issued by the city clerk and shall state the conditions, if any, imposed upon the permittee for the keeping of dogs under the license. The license shall specify the restrictions, limitations, conditions and prohibitions which the police chief deems reasonably necessary to protect any person or neighboring use from unsanitary conditions, unreasonable noise or odors or annoyance or to protect the public health and safety. Such license may be modified from time to time or revoked by the police chief for failure to conform to such restrictions, limitations or Packet Page Number 118 of 132 J3, Attachment 1 prohibitions. Such modification or revocation shall be effective from and after ten days following the mailing of written notice thereof by certified mail to the person keeping or maintaining such dogs. (e) Outside kennel. An outside kennel must be constructed of open-faced, galvanized fabric of suitable size to maintain and secure the keeping of particular breeds of dogs and to allow for sufficient space for particular breeds of dogs to exercise freely. The surface must be constructed of material of either concrete or gravel of sufficient depth to provide for proper cleaning, drainage, maintenance and needs of all particular breeds of dogs. (f) Refusal to grant or renew license. The police chief may refuse a license to keep or maintain dogs under this division for failure to comply with this chapter, if the facilities for the keeping of the dogs are or become inadequate for their purpose, if the conditions of the license are not met, if a nuisance condition is created, or if the public health and safety would be unreasonably endangered by the granting of such license. Refusal to grant or renew a small kennel license by the police chief may be appealed to the city council. (Ord. No. 973, 11-28-2016) Sec. 10-219. - Application and renewal fees. The initial application fee for a small kennel license under this division shall be imposed, set, established and fixed by the city council, by resolution, from time to time. The Feasibility Study is an essential element ofthe proposed Dennis-McClelland Area Street Improvements. The studyis the first step towards making infrastructure improvements in the project area. Background The Dennis-McClellandarea streets are generally bounded by Battle Creekto the north, McKnight Road to the west, Upper Afton Roadto the south, Century Avenue to the east (see attached project location map). This project is a part of the approved 2019 – 2023Capital improvement Plan (CIP). Packet Page Number 123 of 132 J4 The proposed project includes approximately 2.04 miles of streets which have an average pavement condition index (PCI) rating of 36(on a scale of 1 to 100) according to the most recent street rating survey. The pavement on these streets has continued to deteriorate over the years and is in need of replacement. The majority of the project streets have no concrete curb or gutter, with runoff being channeled along the street edge, further deteriorating the pavement. Area storm sewer is limited, with significant drainage improvements necessary to control runoffwithin the street sectionand meet City and Watershed District volume reduction requirements.As this area drains to Battle Creek, a regional drainage study is proposed to identify improvements necessary to meet the more stringent water quality requirements for this impaired water body. The estimated cost of this drainage study is $100,000 as identified in the approved CIP. This amount is included in the total requested for preparation of the feasibility study. As a part of this project it is anticipated the cast iron water mains will need to be replaced due to past break history and vulnerability to future breaks. Repairs to the sanitary sewer system are also anticipated. The proposed project will also include a fog seal preventative maintenance treatment in a past neighborhood improvement area and sanitary sewer main reliningboth on and off the project site. The location for both of these items will be determined during the Feasibility Study.Staff will commence with soil borings, preliminary surveying, appraisal analysis, neighborhood meetings, and all other tasks associated with preparing the Feasibility Study. Justification These streets have continued to deteriorate and will require a full reconstruction with the addition of concrete curb and gutter. The following streets are included in the improvements: Sterling St., James Dr., McClelland St., Ferndale St., Dennis Ln., O'Day St., Mayer Ln., Farrell St., and Mayhill Rd. Unique storm water treatment methods will be required in this area near Battle Creek along with installation of drainage infrastructure. The proposed project will also include pavement replacement, sidewalks, and trails. Project includes $30,000 for fog seal preventative maintenance treatment (area to be determined) and $100,000 for sanitary sewer main lining (location to be determined). The $100,000 in 2018 is for a regional drainage/hydraulic study to be completed prior to the feasibility study. In 2014, city crews were required to do an emergency repair to a portion of the storm sewer network that drains directly to Battle Creek. Mayer Lane sites approximately 35 feet above Battle Creek. Improving the storm sewer system in this area will be challenging due to the significant grade difference between the neighborhood and Battle Creek.
