HomeMy WebLinkAboutNo 172 Relating to Sanitary Sewers, Providing Sanitary Sewer Service for Portions of the Town of Woodbury in Washington County and Extending to the Village of Landfall, Washington County, and ...ORDINANCE NO. 172 ..� AN ORDINANCE RELATING TO SANITARY SEWERS, PROVIDING SANITARY SEWER SERVICE FOR PORTIONS OF THE TO 7JLT OF -vWOODBURY IN WASHINGTON COUNTY AND EXTENDING SANITARY SEWER SERVICE TO THE VILLAGE OF LANDFALL, WASHINGTON COUNTY, AND A1,1ENDING ORDINANCE NO. 115 AS AMENDED BY ORDINANCES NO. 122, NO. 133, NO. 151 AND NO. 167. THE COUNCIL OF THE VILLAGE OF M PLEWOOD DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Section 1 of Ordinance No. 115, as amended, is hereby amended by adding a new subdivision (d) to read as follows: "(d) That certain part of said Township in Section 7, Township 28, Range 21, except that part of said Section 7 lying northerly of Upper Afton Road and except the South 112 of the S'94 of said Section 7; Also the Svc of Section 8, Township 28, Range 21." Section 2. Section 10 of Ordinance No. 115, as amended, is hereby amended by adding a new subdivision (e) to read as follows: "(e) The connecting sanitary sewer to serve that portion of Woodbury described in Section 1, subdivision (d) of this ordinance shall be installed along Lower Afton Road in Maplewood from MicKnight Road to Century Avenue, and shall be installed along Lower Afton Road in the City of St. Paul from the present terminus of the St. Paul sewer in said road at a point 1350 feet gest of T,IcKright Road to McKnight Road. This connecting sanitary sewer shall be constructed by vJoodbury at its expense, subject to approval by the City of St. Paul and the State Board of Health, and subject also to inspection and engineering approval by P;iaplewood, and subject to all other provisions of this ordinance as to construction, use and maintenance. 'Woodbury shall pay to Haplewood, at the time the construction of the Lower Afton '_Road connecting sewer is commenced, the sum of One Thousand and 00100 Dollars ($1,000.00) to cover all incidental costs and expenses incurred by:aplewood, and any unused portion of this sum will be returned to Woodbury. 'Joodbury shall reserve for Maplewood in said Lower Afton Road sanitary sewer the volumetric capacity of 0.80 cfs. The use of this capacity by Maplewood �... shall be undertaken whenever Maplewood decides to so do, provided however, that at the time such use occurs TJiaplewood shall pay to Woodbury the sum of Five Thousand Two hundred Fifty and 00 100 Dollars ($5,250.00) which is the proportionate amount of the cost, based on 0.80 cfs, of that portion of the line running from the center line of Section 12, T. 28, R. 22 in "vlaplewood to a point 1350 feet vilest of I,IcKnight Road in the City of St. Paul, plus engineering, legal, and other contingent costs. This determination is made on the basis of the Woodbury capacity of the said Lower Afton Road sewer line beim 3.40 cfs. Woodbury, shall upon completion of the work, certify by written document, the exact total of $5,250.00 plus contingencies which sum shall be the amount to be paid by Maplewood to Woodbury when H'aplewood commences use of the line. During all times of construction, ',JVoodbury and/or its contractor shall have, and keep in force, public liability insurance as provided for and required by the terms of subdivision (c) of this section. P�Iaintenance of this sewer line shall be performed by Haplewood and the said line shall be considered to be part of the Maplewood sanitary sewer system to which all provisions of Section 11 of this Ordinance No. 115, as amended, shall apply." Section 3. Ordinance No. 115, as amended, is hereby amended by adding a new Section 12 (a) to read as follows: "Section 12 (a) If, pursuant to the provisions of this ordinance, any sewer trunk lines which are constructed in I;Iaplewood by either I;aplewood or Woodbury, the cost of which is borne either wholly or partly by ;Woodbury, the amounts or sums paid out by ?Woodbury shall be credited to 'adoodbury, or shall be payable to Woodbury, as the case may be, at any time the City of St. Paul may hereafter purchase said trunk lines. It is the intention of this provision to preserve for both ';Woodbury and Maplewood their specific financial interests in any such trunk lines in the event that a change of method of contracting with the City of St. Paul would involve the -2- purchase 61 St. Paul of such trunk lines even though the lines built in Maplewood pursuant to this ordinance, are deemed to be the property and the maintenance obligation. of ?Maplewood." Section 4. ITithin fifteen (15) days after receipt by the Clerk of ,',00dbury of a certified copy of this Ordinance, to be forwarded by Registered Iriail by the Clerk of I:=aplewood to the said Clerk of Woodbury, the Town of Woodbury shall, by ordinance, approve and accept all of the terms of this ordinance. Time being of the essence in the execution of the work contemplated by all three municipalities under the terms of this ordinance, it is understood and agreed that all payments provided for in Section 2 of this ordinance, shall be made on or before the dates specified in said Section. Section 5. This ordinance shall take effect and be in force from and after its passage and publication. Passed by the Village Council of the Village of Maplewood this �/ day of November, 1963.
