Following are rules of civility the City of Maplewood expects of everyone appearing at Council
Meetings -elected officials, staff and citizens. It is hoped that by following these simple rules, everyone’s
opinions can be heard and understood in a reasonable manner. We appreciate the fact that when
appearing at Council meetings, it is understood that everyone will follow these principles:
Speak only for yourself, not for other councilmembers or citizens -unless specifically tasked by
your colleagues to speak for the group or for citizens in the form of a petition.
Show respect during comments and/or discussions, listen actively and do not interrupt or talk
amongst each other.
Be respectful of the process, keeping order and decorum. Do not be critical of councilmembers,
staff or others in public.
Be respectful of each other’s time keeping remarks brief, to the point and non-repetitive.

The council reconvened at 6:58 p.m.
City Manager Coleman reportedthe results of the votes and announced that William
Knutson and Sylvia Neblettwill fill the two vacant council seats.

WHEREAS, the Maplewood City Council has received the written resignation of
Councilmember Tou Xiong, effective on January 7, 2019; and
WHEREAS, the city council accepted the resignation and declared a vacancy in
the office of councilmember on January 14, 2019 for the term having less than two years
remaining; and
WHEREAS, Minn. Stat. 412.02, subd. 2a allows the city council to appoint a
person to fill the vacancy; and
WHEREAS, Minn. Stat. 412.02, subd. 2a further allows this appointment, as less than
two years, to serve out the remaining term;
NOW, THEREFORE, BE IT RESOLVED by the city council of Maplewood,
Minnesota, that:
The council appoints William Knutson to fill the vacancy in the office of councilmember
until the successor elected in the General Election of 2020 qualifies.

WHEREAS, the Maplewood City Council has received the resignation of
Councilmember Marylee Abrams by her taking the oath as mayor effective on January
14, 2019; and
WHEREAS, the city council accepted her resignation and declared a vacancy in
the office of councilmember on January 14, 2019 for the term having more than two
years remaining; and
WHEREAS, Minn. Stat. 412.02, subd. 2a allows the city council to appoint a
person to fill the vacancy; and
WHEREAS, Minn. Stat. 412.02, subd. 2a further allows this appointment to serve until a
successor is elected and qualified in the next regular city election;
NOW, THEREFORE, BE IT RESOLVED by the city council of Maplewood,
Minnesota, that:
1.The council appoints Sylvia Neblett to fill the vacancy in the office of
councilmember, who will serve until a successor is elected and qualified.
2.A special election to fill the vacancyfor the balance of the term will be held at
the city general election to be conducted on November 3, 2020.
3.A special primary will be conducted on August 11, 2020 if more than two
candidates file for the two-year councilmember office.

WHEREAS, Schmelz Countryside Volkswagen has presented to the Maplewood
Fire Department a donation in the amount of $1,000; and
WHEREAS, this donation is intended for the purpose of our Community Risk
Reduction Programs; and
WHEREAS, the Maplewood City Council is appreciative of the donation and
commends Jonathan Schmelz and Schmelz Countryside Volkswagen for their civic
efforts,
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Maplewood, Minnesota, that:
1.The donation is accepted and acknowledged with gratitude; and
2.The donation will be appropriated for the Fire Department as designated; and

Accepting Feasibility Study, Authorizing Preparation of Plans and
Specifications, andCalling for Public Hearing
WHEREAS, pursuant to a resolution of the council adopted August 27, 2018, a
report has been prepared by the City Engineering Division with reference to the
improvement of Ferndale-Ivy Area Street Improvements, City Project 18-01, and this
report was received by the council on February 11, 2019.
WHEREAS, the report provides information regarding whether the
proposed project is necessary, cost-effective, and feasible,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
MAPLEWOOD, MINNESOTA:
1.The City Council will consider the Ferndale-Ivy Area Street
Improvements, City Project 18-01 in accordance with the report and the assessment of
abutting property for all or a portion of the cost of the improvement pursuant to
Minnesota Statutes, Chapter 429 at an estimated total cost of$3,806,000.
2.The City Engineer or his designee is the designated engineer for
this improvement project and is hereby directed to prepare final plans and
specifications for the making of said improvement.
3.The Finance Director is hereby authorized to make the financial
transfers necessary for the preparation of plans and specifications. A proposed budget
of $3,806,000 shall be established. The proposed financing plan is asfollows:

commissions and groups of which the City is a member and to those who serve at the pleasure of the
Council. Given the council vacancies in January, all appointments other than Acting Mayor were tabled
until a full complement of the council was achieved.

The necessary maintenance and remodelwork on the Police Department will helpensure the City
Hall facilities are in good shape, easier to maintain, and provide more flexibilityof usewith both
bathrooms being converted to unisex bathrooms.
Background
On June 11, 2018 the City Council authorized the purchase of construction services from American
Liberty Construction in the amount of $49,900.00 for the maintenance and remodeling workon two
bathrooms in the City Hall Police Department.

Throughout the course of the project the need for additional tile work in the bathrooms was
identified. The cost for this additional tile work was $5,592.77. Thisincreased the final cost for
construction services from $49,900.00 to 55,492.77. Funding for this project is through the Building
Maintenance Bond Sale Proceeds. The Finance Director has reviewed the final payment
application and funding plan.
Thetwo Police Department bathrooms were not fully remodeled as part of the Police Expansion
project completed in2015. As part of the 2015 project, it was decided to make both bathrooms
accessible which resulted in the removal of a urinal from one of the bathrooms. The project did not
update/fix any of the broken tiles or update any of the fixtures.
This projectconvertedthe two bathrooms to unisex bathrooms.This willprovidemore flexibility
withthe use of the bathrooms. A urinal wasinstalled in one of the bathrooms as only one of the two
bathrooms are required to be accessible. The project also includedthe replacement of the
aged/damaged wall and floor tiles. The bathrooms will be easier tomaintain and keepclean with
the replacement of the damaged tiles and the installation of the urinal.

environmental, social, and health benefits. Diseased tree inspection is a critical piece for ensuring
its well-being.
Background
The contractedCity Forester inspects public and private properties for epidemic tree diseases or
pests including Dutch Elm disease, Oak Wilt, and Emerald Ash Borer(EAB).In addition,the City
Forester provides expertise and support to city staff on othertreeissues that arise.

Rehder Forestry Consulting $13,850($65/hour)
The Davey Tree Expert Company$17,200($86/hour)
Staff recommends acceptingthe quote from Rehder Forestry Consulting. Because the intensity of
disease and pests varies each year, staffwould like to add 10% contingency into the contract, with
servicesnot to exceed $15,235.It isbeneficial to have continuity with acontracted City Forester
from year to year since the Citygains efficiencies when a Forester is familiar with how disease is
playing out in various neighborhoods. Thus, staff recommends the contract includesa clause to
allow up to two years extensionof the contract aslong as performance standards are met and
pricing remains fairly consistent. City Council included an extension in the 2016 contract with S&S
Tree and Horticultural Specialistsandthe contract was renewedin both 2017 and 2018.

Background
MPCA Environmental Assistance Grants provide financial assistance for the development of
environmentally sustainable practices in Minnesota through voluntary partnerships and goal-
oriented, economically driven approaches to pollution prevention and resource conservation.
Through a competitive application process, MPCA seeks projects which further the agency's
mission of working with Minnesotans to protect, conserve, and improve our environment and
enhance quality of life in the state.
The fiscal year 2018-2019 grant round has a total funding of $493,000 applied across seven focus
areas. Focus Area 1 of the Environmental Assistance grant is “Communities adapting to climate
change and extreme weather.”Grants under this focus area are to help communities plan for
impacts of climate change and to improve community resilience. Funded projects will serve as
examples for other communities and accelerate adoption of resilience practices in Minnesota.
Funding for this focus area provides for a maximum of $30,000with a required commitment for 25%
matching funds.
Climate Vulnerabilities
In 2017 the Environmental and Natural Resources Commission reviewed a Climate Change
Vulnerabilities Review report. The report was created by paleBLUEdot LLCas a donation to the
City of Maplewood. paleBLUEdot LLC is a localsustainability business co-founded by Ted
Redmond.The report compiled demographic data and climate information for the City on a census
tract level. It identified climate vulnerabilities and climate vulnerable populations throughout the
City. Specific climate risks which can be anticipated by the City through the middle of this century
were identified and prioritized based on the City specific data. The Climate Change Vulnerabilities
Report included a “menu of goals and strategies” as preliminary illustrations of potential climate
adaptation actions the City could take to address climate adaptation and resilience needs. The
work of the Climate Change Vulnerabilities Report provides a basis for the development of a
Climate Adaptation Plan.
Climate AdaptationGrant Award
With staff support, paleBLUEdot LLC submitted an application for the MPCA Environmental
Assistance grant for the development of Climate Adaptation Plans for four cities including
Maplewood, Burnsville, Faribault, and Albert Lea. The Climate Adaptation Planning effort
supported through this grant will include:
Climate Risk and Vulnerabilities Review
Community Engagement: Develop a Community Engagement planwith City staff, for outreach
to their priority audiences and stakeholders, particularly vulnerable populations.
Climate Adaptation Strategy Development and Prioritization
Compile a Climate Adaptation Plan

The City of Maplewood chooses to purchase off of previously negotiated pricing agreements that
the State of MN has in place wherever possible. One such agreement is between the State of MN
and NASPO/Verizon Wireless for wireless services, phones, etc. In order to purchase off of this
agreement Verizon Wireless requires the City to sign off on the attached agreement. Doing so
means that the City will benefit from lower prices and additional services available to Public Safety.

Notices of the Public Hearing have been mailed and published. The Feasibility Study was accepted
by the City Council on February 11, 2019, with a Resolution Authorizing the Preparation of Plans
and Specifications, and Calling for a Public Hearing. The City Council will consider ordering the
improvements following the Public Hearing. A super majority vote is required to order the project.

The Ferndale-Ivy area neighborhood streets and utilities are an important part of the City’s
infrastructure. The streets and utilities in this area have deteriorated and are in need of repair and
replacement.
Background
The Ferndale-Ivy neighborhood streets total approximately 1.2 miles in length. The neighborhood
area is generally bounded by Union Pacific Railroad (UPR) tracks to the north, McKnight Road to
the west, Maryland Avenue to the south, Century Avenue to the east. See attached project location
map. This project is a part of the approved 2018 – 2022 Capital Improvement Plan
(CIP).
The aging and deteriorating condition of roads shown on the project location map presents an
ongoing maintenance problem for the City of Maplewood Street Department. The condition of the
existing streets also represents a decreased level of service for the residents of Maplewood, with
the City receiving numerous complaints fromarea residents about substandard street conditions.
The watermain within the project area is generally in good condition and meets current standards.
Saint Paul Regional Water Services (SPRWS) is not recommending watermain replacement at this
time. Minorrepairs to the sanitary sewer system are anticipated, this includes repairs at service
wyes or spot repairs of the sewer main. Major upgrades to the storm sewer system are currently
proposed to mitigatecurrent drainage issues in the project area. The proposed project will also
include a fog seal preventative maintenance treatment and sanitary sewer main lining in select
locations throughout the City. The exact location(s)for these two items will be determined as the
project moves into the design phase.
Neighborhood Correspondence
An informational packet was mailed to the neighborhood residents on September 4, 2018. The
mailing contained information about the proposed street improvement project and a questionnaire.
Informational neighborhood meetings were held on November 1, 2018 and January 8, 2019 at the
Maplewood Community Center. Staff mailed out the meeting invitations to 177 property owners for
each of the meetings. Approximately 14 resident’sattended meeting #1 and 21 residents attended
meeting #2. Each of the meetings generally ran from 6:00 p.m. to 7:30 p.m. including a
presentation, question and answer session, and one-on-one conversations. Items presented and
discussed at the meetings included the public improvement process, an explanation of why the
Ferndale-Ivy Area was chosen for improvements, project scope, preliminary assessments, and an
estimated project timeline. Additional neighborhood meetings and correspondence are planned
throughout the public improvement process to continue the conversations with area residents and
business owners to ensure they stay well informed.
During the neighborhood meetings staff asked residents to identify any concerns or questions they
have in regards to the proposed project. Concerns and questions revolvedaround current traffic
speed, street lighting, post project traffic speed, construction methods, streetscape options,
sidewalks, drainage, schedule, property access and assessments. Additionally, some residents
requested staff look into additional lighting on the project streets, the potential for a traffic signal at
Ivy Avenue/Century Avenue intersection, on street parking concerns and numerous drainage issues
in the project area. Overall, the general feeling at these two meetings was that the improvements to
the streets are necessary.

In the coming months, staff will continue to field and address resident questions and concerns.
Discussion
The existing public infrastructure for the streets in the project area generally consists of a
bituminous pavementsection,concrete curb & gutter, limited storm sewer, sanitary sewer, and
water utilities.
The proposed project will include the full reconstruction of the area streets. Full reconstruction of
these streets will include removal and replacement of the existing aggregate base and bituminous.
The street reconstruction will also include sub grade corrections consisting of replacing the sub
grade fill material with a sand sub base, drain tile, and a geo-textile fabric. The project will also
include the installation of new concrete curb and gutter on all project streets.
Majorupgrades to the storm sewer systemwithin the project area areproposedto address
drainage issues within the neighborhood.Minor upgrades to the water system and repairs to the
sanitarysewer systemare proposed as well.
Additional improvements, includingnew sidewalksadjacent to selectproject streets, bituminous fog
sealingof past improvement project areas, and sanitary sewer liningin select locations throughout
the Cityhave alsobeen included with this project.
The Feasibility Report confirms the proposed project is feasible, necessary, and cost effective from
an engineering standpoint. The Council approved the Feasibility Reporton February 11, 2019.
The Public Hearing is ameeting at which the residents have the opportunity to comment on the
proposed improvements. In order to proceed with the project, a super majority vote from City
Council is needed for ordering of the improvement after public testimony is received at the Public
Hearing.

The estimated costs include 10% contingencies and 12% overhead, which include geotechnical,
legal, and fiscal expenses. The feasibility report provides a more detailed construction and project
cost estimate.

The improvements are proposed to be financed through a combination of G.O. Improvement
Bonds, Special Benefit Assessments, the Environmental Utility Funds, Sanitary Sewer Funds,
W.A.C. funds, and SPRWS. An update to the financingplan may be needed in the future after the
special benefits appraisal is received.
The estimated project costs and proposed project funding plan have been reviewed by the Finance
Director.
An independent appraisal firm was hired to ascertain an opinion of special benefit received by
properties within the neighborhood project area. This information will ultimately be utilized to set
the special benefit assessment amounts for the project area. The rates established in the City’s
Special Assessment Policy were utilized for cost recovery estimation purposes and represent the
maximum potential assessment rates for this project.

ORDERING IMPROVEMENT
WHEREAS, pursuant to a resolution of the City Council adopted February 11, 2019,
fixed a date for a council hearing on the proposed street improvements for the Ferndale-Ivy
Area Street Improvements, City Project 18-01.
AND WHEREAS, ten days mailed notice and two weeks published notice of the hearing
was given, and the hearing was duly held on February 25, 2019; and the council has heard all
persons desiring to be heard on the matter and has fully considered the same;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD,
MINNESOTA:
1.That it is necessary, cost-effective and feasible, as detailed in the Feasibility
Report, that the City of Maplewood make improvements to the Ferndale-IvyArea Street
Improvements, City Project 18-01.
2.Such improvements ordered as proposed in the Council resolution adopted on

the 25day of February, 2019.
3.The City Engineer, or his designee, is the designated engineer for this
improvement project and is hereby directed to prepare final plans and specifications as
previously directed by the City Council at the February 11, 2019council meeting.
4.The Finance Director was authorized to make the financial transfers necessary
for the preparation of plans and specifications at the February 11, 2019council meeting. A
budget of $3,806,000 was established at that time. The proposed financing plan shallbe
implemented and is as follows:
