CALL TO ORDER A meeting of the City Council was held in the City Hall Council Chambers and was called to order at 7:03 p.m. by Acting Mayor Smith. Acting Mayor Smith reported on the State of the City event that took place on Thursday, th January 10; Councilmember Juenemann and Abrams gave additional information about the event. B. PLEDGE OF ALLEGIANCE Zach Smith, son of Councilmember Smith, led the council in the pledge of allegiance. C. ROLL CALL Mayor Vacant Marylee Abrams, Councilmember Present Kathleen Juenemann, Councilmember Present Bryan Smith, Councilmember/Acting Mayor Present Councilmember Vacant D. APPROVAL OF AGENDA The following items were added to the agenda under Appointments and Presentations, Council Presentations: Recycle Your Holidays MN Chamber of Commerce Dinner Bachman’s Indoor Marketplace Grand Re-Opening of Cub Foods on County Road B YouTube Councilmember Abrams moved to approve the agenda as amended. Seconded by Councilmember Juenemann Ayes – All The motion passed. E. APPROVAL OF MINUTES 1. Approval of December 18, 2018 City Council Workshop Minutes Councilmember Juenemann moved to approve the December 10, 2018 City Council Workshop Minutes as submitted. Seconded by Councilmember Abrams Ayes – All January 14, 2019 1 City Council Meeting Minutes The motion passed. 2. Approval of December 10, 2018 City Council Meeting Minutes Councilmember Abrams moved to approve the December 10, 2018 City Council Meeting Minutes as amended. Seconded by Councilmember Juenemann Ayes – All The motion passed. F. APPOINTMENTS AND PRESENTATIONS 1. Administrative Presentations a. Council Calendar Update City Manager Coleman gave the update to the council calendar, reviewed other topics of concern or interest requested by councilmembers and gave an overview of upcoming events in the community. 2. Council Presentations Recycle Your Holidays Councilmember Juenemann reported on the Recycle Your Holidays to collect old Christmas lights. MN Chamber of Commerce Dinner Councilmember Abrams reported on the MN Chamber of Commerce Dinner she attended. Bachman’s Indoor Marketplace Councilmember Abrams reported on Bachman’s indoor farmer’s market. Grand Re-Opening of Cub Foods on County Road B Councilmember Abrams reported on the remodel/reopening of Cub Foods on County Road B she and Councilmember Juenemann attended. YouTube Acting Mayor Smith reported on Maplewood’s Communication Department’s YouTube videos. 3. Certificate of Achievement for Excellence in Financial Reporting City Manager Coleman gave the report. Acting Mayor Smith presented the award to Finance Director Paulseth and Assistant Finance Director Rueb. Finance Director Paulseth thanked the council. Presentation of Lifesaving Awards – Public Safety Department Director of Public Safety Nadeau reported on the lifesaving event and presented the Lifesaving Awards to the following recipients. Maplewood Middle School Staff Members Judy Lallier and Ty Evans Maplewood Police Officer Glen McCarty Maplewood Police Sergeant Kevin Johnson Maplewood Firefighters/Paramedics Michael Streff and Nick Danley Maplewood Firefighter/EMT Ken Nielsen Maplewood Battalion Chief Shawn Conway The following were not present to receive their award: Maplewood Firefighters/Paramedics Andy Bauman, Sam Perry, Jodi Halweg and Mike Maleski 5. Council Resignations and Vacancies a. Resolution Accepting Resignation and Declaring A Vacancy in the Office of Councilmember b. Consider Appointments for Vacancies Councilmember Abrams moved to approve the resolution accepting the resignation and declaring a vacancy in the office of councilmember. Resolution 19-01-1646 City of Maplewood Resolution Accepting Resignation and Declaring a Vacancy in the Office of Councilmember WHEREAS, Tou Xiong was elected as the State Representative for House District 53A in the 2018 State General Election with the term to begin January 7, 2019; and WHEREAS, the four-year term of the councilmember seat Tou Xiong holds has not expired and will be on the ballot in 2020; and WHEREAS, these elected offices are incompatible; and WHEREAS, the Maplewood City Council has received the written resignation of Councilmember Tou Xiong, effective on January 7, 2019. NOW, THEREFORE, BE IT RESOLVED by the city council of Maplewood, Minnesota, as follows: 1. The council accepts Councilmember Tou Xiong’s resignation as described above. Seconded by Councilmember Juenemann Ayes – All The motion passed. Councilmember Juenemann moved to approve the resolution accepting the resignation and declaring a vacancy in the office of mayor. Resolution 19-01-1647 City of Maplewood Resolution Accepting Resignation and Declaring a Vacancy in the Office of Mayor WHEREAS, Nora Slawik was elected as Mayor in the 2018 State General Election with the four-year term to begin January 7, 2019; and WHEREAS, Governor-elect Walz has named Nora Slawik as the Chair of the Metropolitan Council to begin January 7, 2019; and WHEREAS, these positions are incompatible; and WHEREAS, the Maplewood City Council has received the written resignation of Mayor Nora Slawik, effective on January 7, 2019, and; WHEREAS, Mayor-elect Nora Slawik has chosen not to serve as Maplewood mayor; NOW, THEREFORE, BE IT RESOLVED by the city council of Maplewood, Minnesota, as follows: 1. The council accepts Mayor Nora Slawik’s resignation as described above. 2. The council declares a vacancy in the office of mayor exists effective on January 7, 2019. Seconded by Councilmember Abrams Ayes – All The motion passed. Acting Mayor Smith reported on the appointment process to fill the Office of Mayor seat. Councilmember Abrams nominated herself to the appointment of Mayor. Councilmember Smith nominated himself to the office of Mayor. Councilmember Smith gave a statement of qualifications and strengths. Councilmember Abrams gave a statement of qualifications and strengths. Councilmember Juenemann asked two questions of Council Members Abrams and January 14, 2019 4 City Council Meeting Minutes Smith. City Attorney Batty reported on the process to vote for Mayor. Councilmember Abrams voted for Councilmember Smith Councilmember Smith voted for Councilmember Abrams Councilmember Juenemann voted for Councilmember Abrams Councilmember Juenemann moved to approve the resolution filling the vacancy and calling for a special election in the Office of Mayor. Resolution 19-01-1648 City of Maplewood Resolution Filling the Vacancy and Calling for a Special Election in the Office of Mayor WHEREAS, the Maplewood City Council has received the written resignation of Mayor Nora Slawik, effective on January 7, 2019; and WHEREAS, the city council accepted the resignation and declared a vacancy in the office of mayor on January 14, 2019; and WHEREAS, Minn. Stat. 412.02, subd. 2a allows the city council to appoint a person to fill the vacancy; and WHEREAS, Minn. Stat. 412.02, subd. 2a further allows this appointment to serve until a successor is elected and qualified at the next regular city election; NOW, THEREFORE, BE IT RESOLVED by the city council of Maplewood, Minnesota, that: 1. The council appoints Marylee Abrams to fill the vacancy in the office of mayor, who will serve until a successor is elected and qualified. 2. A special election to fill the vacancy for the balance of the mayoral term will be held at the city general election to be conducted on November 3, 2020. 3. A special primary will be conducted on August 11, 2020 if more than two candidates file for the office of mayor. Seconded by Councilmember Smith Ayes – Council Members Juenemann and Smith Abstain – Councilmember Abrams The motion passed. City Clerk Sindt performed the swearing in of Marylee Abrams to the Office of Mayor. Acting Mayor Smith handed the gavel over to newly appointed Mayor Abrams for the remainder of the meeting. January 14, 2019 5 City Council Meeting Minutes Councilmember Juenemann moved to approve the resolution accepting the resignation and declaring a vacancy in the office of councilmember. Resolution 19-01-1649 City of Maplewood Resolution Accepting Resignation and Declaring a Vacancy in the Office of Councilmember WHEREAS, there is a vacancy in the office of mayor; and WHEREAS, the council has appointed Councilmember Abrams to fill the vacancy; and WHEREAS, these offices are incompatible; and WHEREAS, taking the mayoral oath signals the resignation of Councilmember Abrams effective on January 14, 2019. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, AS FOLLOWS: 1. The council accepts Councilmember Abrams resignation as described above. 2. The council declares that a councilmember vacancy exists on council effective on January 14, 2019. Seconded by Councilmember Smith Ayes – All The motion passed. 6. 2019 City Council Appointment to Boards, Commissions and Miscellaneous Groups City Manager Coleman gave the report. Councilmember Smith moved to appoint Councilmember Juenemann as Acting Mayor for 2019 City Council appointments to boards, commissions and miscellaneous groups. Seconded by Councilmember Abrams Ayes – All The motion passed. Councilmember Smith moved to table the balance of the appointment for the 2019 City Council appointments to boards, commissions and miscellaneous groups until which time there is a full city council. Seconded by Councilmember Juenemann Ayes – All The motion passed. G. CONSENT AGENDA January 14, 2019 6 City Council Meeting Minutes Agenda item G4 & G5 were highlighted. Resolution Designating Depositories for City Funds Councilmember Juenemann moved to approve the resolution designating depositories for city funds. Resolution 19-01-1650 Designating Depositories for City Funds BE IT RESOLVED, that the following be and hereby are selected as depositories for deposits and investments of the City of Maplewood: Alerus Financial Premier Bank Wells Fargo Bank US Bank 4M Fund/PMA CitiBank RBC BE IT FURTHER RESOLVED that the deposits in any of the above depositories shall not exceed the amount of F.D.I.C. insurance covering such deposit unless collateral or a bond is furnished as additional security, and BE IT FURTHER RESOLVED that any funds in the above depositories may be withdrawn and electronically transferred to any other depository of the city by the request of the finance director or his/her designee. BE IT FURTHER RESOLVED that these depository designations are effective until December 31, 2019. Seconded by Councilmember Smith Ayes – All The motion passed. 3. Budget Adjustments and Transfers for 12/31/2018 Councilmember Juenemann moved to approve the transfers and budget adjustments dated 12/31/2018 and authorize the Finance Director to make the necessary accounting entries to close funds. Seconded by Councilmember Smith Ayes – All January 14, 2019 8 City Council Meeting Minutes The motion passed. 4. 2019 City Council Meeting Calendar Councilmember Juenemann moved to approve the 2019 city council meeting calendar with the meetings on the second and fourth Mondays with the exception of moving the May 27 meeting to May 28, the November 11 meeting to November 12 and cancelling the December 23 meeting. Seconded by Councilmember Smith Ayes – All The motion passed. 5. Donation to Maplewood Police Department Street Crimes Unit from Schmelz Countryside Councilmember Juenemann moved to approve the resolution accepting the donation made by Schmelz Countryside. Resolution 19-01-1651 Authorizing Gift to City WHEREAS, Maplewood is AUTHORIZED to receive and accept grants, gifts and devices of real and personal property and maintain the same for the benefit of the citizens and pursuant to the donor’s terms if so-prescribed, and; WHEREAS, Schmelz Countryside wishes to grant the City of Maplewood the following: $1,000, and; WHEREAS, Schmelz Countryside has instructed that the City will be required to use the aforementioned for: the efforts of the department’s Street Crimes Unit, and; WHEREAS, the City of Maplewood has agreed to use the subject of this resolution for the purposes and under the terms prescribed, and; WHEREAS, the City agrees that it will accept the gift by a super majority of its governing body’s membership pursuant to Minnesota Statute §465.03; NOW, THEREFORE, BE IT RESOLVED, pursuant to Minnesota Statute §465.03, that the Maplewood City Council approves, receives and accepts the gift aforementioned and under such terms and conditions as may be requested or required.
