CALL TO ORDER A meeting of the City Council was held at the Maplewood City Hall – Council Chambers and was called to order at 7:16 p.m. by Mayor Slawik. Mayor Slawik reported on a fire truck parked outside an elementary school with a banner stating Drive Slowly and people going around the bus even with the stop arm extended. She warned residents to watch out for the kids. Chief Nadeau gave additional information. Councilmember Juenemann noted that Governor Dayton was at Carver Elementary welcoming the kids back on their first day of school. B. PLEDGE OF ALLEGIANCE C. APPROVAL OF AGENDA Fall Clean Up Medicine Drop Box Ash Tree Education Business Retention and Expansion Visit Candidate Forum Councilmember Xiong moved to approve the agenda as amended. Seconded by Councilmember Abrams Ayes – All The motion passed. E. APPROVAL OF MINUTES 1. August 27, 2018 City Council Workshop Minutes Councilmember Abrams moved to approve the August 27, 2018 City Council Workshop Minutes as submitted. Seconded by Councilmember Juenemann Ayes – All September 10, 2018 1 City Council Meeting Minutes The motion passed. 2. August 27, 2018 City Council Meeting Minutes Councilmember Smith moved to approve the August 27, 2018 City Council Meeting Minutes as submitted. Seconded by Councilmember Juenemann Ayes – All The motion passed. F. APPOINTMENTS AND PRESENTATIONS 1. Council Presentations Fall Clean Up Councilmember Juenemann noted there will not be a city clean up in the fall, instead there will be special pick up of bulky items. Medicine Drop Box Councilmember Juenemann reminded residents there is a medicine drop off outside City Hall at the night police entrance. Ash Tree Education Councilmember Juenemann reported there will be an Ash Tree Education Program through the Nature Center. Business Retention and Expansion Visit Mayor Slawik reported on the visit with 3M that took place earlier in the day. City Manager Coleman and Public Safety Director Nadeau gave additional information about the visit. Candidate Forum Councilmember Smith congratulated all the candidates that participated in the City Council and Mayoral Candidate Forum sponsored by the League of Women Voters. 2. Administrative Presentations a. Council Calendar Update City Manager Coleman gave the update to the council calendar, reviewed other topics of concern or interest requested by councilmembers and gave an overview of upcoming events in the community. Approval of Claims Councilmember Juenemann moved to approve the approval of claims. Travel Expenses for Mayor Slawik for Women Mayors of America Conference Councilmember Juenemann moved to approve travel expenses for Mayor Slawik to attend the Women Mayors of America – White House Conference. Seconded by Councilmember Xiong Ayes – All The motion passed. 3. Conditional Use Permit Review, Academy for Science and Agriculture, 1194 County Road C East September 10, 2018 3 City Council Meeting Minutes Councilmember Juenemann moved to approve the CUP review for Academy for Sciences and Agriculture and review again only if a problem arises or a major change is proposed. Seconded by Councilmember Xiong Ayes – All The motion passed. 4. Conditional Use Permit Review, Beyond Self Storage, 1315 Cope Ave Councilmember Juenemann moved to approve the CUP review for the Beyond Self Storage and review again in one year. Seconded by Councilmember Xiong Ayes – All The motion passed. 5. Resolution Directing Modification of Existing Construction Contract, Change Order No. 1, Wakefield Park Improvements Project, City Project PR 17-01 Councilmember Juenemann moved to approve the resolution directing modification of existing construction contract, Change Order No. 1, City Project PR 17-01. Resolution 18-09-1603 RESOLUTION DIRECTING MODIFICATION OF EXISTING CONSTRUCTION CONTRACT, CITY PROJECT PR 17-01, CHANGE ORDER NO. 1 WHEREAS, the City Council of Maplewood, Minnesota has heretofore ordered the Wakefield Park Improvements Project, PR 17-01, and has let a construction contract, and WHEREAS, it is now necessary and expedient that said contract be modified and designated as Wakefield Park Improvements Project, PR 17-01, Change Order No. 1. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, Minnesota, that 1. The Mayor and Parks & Recreation Director are hereby authorized and directed to modify the existing contract by executing said Change Order No. 1 which is an increase of $12,269.39 The revised contract amount is $2,087,166.97. Seconded by Councilmember Xiong Ayes – All The motion passed. 6. Reschedule Regular October 22 Council Meeting to October 25 Councilmember Juenemann moved to reschedule the regular city council meeting of September 10, 2018 4 City Council Meeting Minutes October 22, 2018 to October 25, 2018. Seconded by Councilmember Xiong Ayes – All The motion passed. H. PUBLIC HEARINGS None I. UNFINISHED BUSINESS None J. NEW BUSINESS 1. Resolution Providing Approval of the 2019 Preliminary Property Tax Levy and Setting the 2019 Budget Public Hearing Date and Time City Manager Coleman introduced the staff report. Finance Director Paulseth gave the presentation. Councilmember Smith moved to approve the resolution setting a preliminary tax levy for taxes payable in 2019 in the amount of $22,109,600 and setting the budget hearing for December 10, 2018 at 7:00 p.m. Resolution 18-09-1604 RESOLUTION PROVIDING APPROVAL OF THE 2019 PROPOSED TAX LEVY And SETTING 2019 BUDGET PUBLIC HEARING DATE WHEREAS, State law requires that the City Council adopt a proposed tax levy for taxes payable in 2019 by September 30, 2018; and WHEREAS, the City Council has reviewed the proposed 2019 Budget and has determined the amount of the proposed tax levy payable in 2019, which is the maximum amount that will be levied. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MAPLEWOOD, MINNESOTA THAT: 1. The proposed tax levy for taxes payable in 2019, in the amount of $22,109,600 is hereby adopted and shall be certified to the Ramsey County Auditor as follows: General Fund $16,138,910 Debt Service Funds $ 4,676,601 Market Value Debt Service $ 269,089 Recreation Fund $ 200,000 EDA Fund $ 100,000 Capital Improvement Fund $ 280,000 September 10, 2018 5 City Council Meeting Minutes Police Equipment Fund $ 185,000 Fire Equipment Fund $ 60,000 Community Center Fund $ 200,000 Total Levy $22,109,600 2. Debt levies have been reduced by other revenue sources to a total of $4,676,601 for tax capacity levies and $269,089 for market value levies. 3. The date for the public hearing and consideration of the final 2019 levy and budget shall be Monday, December 10, 2018 at 7:00 pm in the Maplewood City Council Chambers. Seconded by Councilmember Juenemann Ayes – Mayor Slawik, Council Members Juenemann, Smith and Xiong Nays – Councilmember Abrams The motion passed. 2. Ordinance Repealing the Police Civil Service Commission (5 votes) City Manage Coleman gave the staff report. Councilmember Juenemann moved to approve the ordinance repealing the Police Civil Service Commission. Ordinance 993 AN ORDINANCE REPEALING CHAPTER 2, ARTICLE IV, DIVISION 3 OF THE CITY CODE REGARDING THE POLICE CIVIL SERVICE COMMISSION THE CITY COUNCIL OF THE CITY OF MAPLEWOOD, MINNESOTA ORDAINS AS FOLLOWS: SECTION I. Chapter 2, Article IV, Division 3 of the city code is amended by repealing Sec. 2- 216 in full and renumbering the remaining sections as follows: DIVISION 3. – Reserved. Secs. 2-216 – 2-245. Reserved. SECTION II. This Ordinance shall be effective upon its adoption and publication. Seconded by Councilmember Abrams Ayes – All The motion passed. K.
