AN ORDINANCE AMENDING SECTION 911.050
OF THE MAPLiWOOD CODE CO110ERNING
SPECIAL USE PERMITS
TUE CITY COUNCII. OF TIOi CITY OF MAPLEWOOD DOES irEREBY ORDAIN AS FOLLOWS:
Section 1. Section 911.050 of the Maplewood Code is hereby amended to read as
follows:
911.050. CONDITIONS, GUARANTEES AND REVIEW. (1) The City Council, in granting
a special use permit, may attach to the permit such conditions and guarantees as may
be necessary to the protection of the publie, the rights of others and the City. (2)
All special use permits which do not have a specific termination date or provision
for a periodic review, shall be reviewed withiu one (1) year of the date of passage
and publication of this Ordinance and every five (5) years thereafter.
The Council may, upon such review, determine that new conditions shall be imposed
and that, if reasonable under the circumstances, a termination date for said special
use permit may be established, and further that where the use should not involve the
construction of any special building or struetttte of a monetary value in excess of
Five Thousand and no/100 (55,000.00) Dollars, that the special use permit may be
terminated.
In the event the Council wishes to consider imposing new conditions or termination
of the special use permit, then and in that event, the City Council shall hold at
least one public hearing on the subject special use permit after a notice of the
hearing has been published in the official newspaper at least ten (10) days before
said hearing. The Council shall also cause a notice to be mailed to each of the
owners of property located within the City within 200 feet of the boundary lines of
the property upon which such use has been established. (These notices to be mailed
to the last know address of such owners at least five (5) days before the date of
the hearing.)
Section 2. This Ordinance shall take effect and be enforced from and after its
passage and publication as provided by law.
