CODE THE COUNCIL OF THE VZI.I (Z OF MAPLEWOOD DOES HEREBY ORDAIN AS FOi.T.CM r Section 1. Chapters 501 and 542 are hereby amended in their entirety to read as follows: 501. CONSTRUCTION OF STREETS AND ROADS' PRt`)CEDURE AND FINANCING 501,010. jURIsDic'aLAq. Pursuant to statutory authority of the Village to regulate, control. and maintain Village streets as provided in Minnesota Stastuteas$ Chapter 4120 the provisions of this ordinance are 'hereby declared to apply to all streets hereafter constructed within the Village and are declared to be necessary and essential because of the growth and expansion of said Vil- laxg*. 501.020. BUILDING PERMIT ISSUANCE. No building permits will be issued for any construction within the Village unless the building site is located adjacent to an existiag street which is dedicated and maintained as a Village street, or unless provision for .treet construction has been made in full compliance with this code and in no case until grading work as provided herein has been completed and certified to the clerk by the Village Engineer; except that in isolated in - P tances the Council may enter an agreement with a property Owner for special handling of an unusual situation which agreement shall be recorded so ns to run with the land affected. 501.030. TMWVZm TS WITHIN PUBLIC RIGHT-OF-WAY. Before any improvement construction or alterattion, of any kind whatsoever is undertaken within the; limits of as right of way, the person proposing such improvement, ent, construction or altor- ation, shall procure at permit therefor from the Village. 501.844. SUM IMMOVFMENT PETITION FM. Requests for street construction, improvement or re -construction shall be initiated d by a request to the Council upon a petition form., nta form of petition shall be: available to the public at all tis at the office of the Village Clerk or the Village Engineer, Such petition, when properly executed, shall be filed with the Village Clerk. The Village Council may initiate street improvement projects without submittal of a petition form. 501,050. pRELIMINARy RSpORT BY F.NCUEER. Upon receipt of a street improve - anent petition# the clerk shall present ;same to the Council, All such petitions* before being acted upon by the Council, shall be referred to the Village Engineer for as preliminary report az to the feasibility of the improvement, and as to the astimateed cost. When the engineer's report has been received, the Council shall determine whether such improvement is to be s-sde and crew it shall be financed. If the Council determines that the improvement shall be financed by assessment a ainat benefited property, all further proceedings shall be in accordance with the provisions of Chapter 395, Lags of 19539 as amended. If the Council determines that the improvement is to be financed by weans other than assesmuent of benefited property, all further proceedings shall bre In accordance with 501.060 of this section, 501.060. AEpoSIT OR SUREW Bon. (A.) 1,41hen the street improvement will not be financed by asssssmenL, a copy of the engineer's preliminary report shall be furnished to each petitioner. The petitioner or petitioners shall deposit frith. the Village an amount equal to ten percent (10%) of the preliminary estimate. Thi, scan shall be used to defray expenses incurred by the Village for plans, spci£ications, legal services, advertising, or any other expense in connection therewith. In the event the work is not ordered by the Council, any money re msintaZ in such ten percent (10) deposit after expenses as above specified have been paid, shall be refunded to the petitioners. (B) After the petitioners have paid the deposit required in (A) of this section, the Council shall instruct the enZinecr to prepare final plans and specifications and eatisute of cost for the improverent, construction or re- construction including drainage and utility installations as petitioned and as recommended by the engineer's preliminary report. When final pians and speci- fications and estimate of cost are completed, the engineer shall preiant ;;cine to the Council and shall furnish a copy thereof to the clerk fro transmittal to the petitioner. Before the Council orders the work done or advertises for bids, the petitioners'shall deliver to the Village a cash deposit, or a surety bond, as the Council may determine, in the amount of one and one-half (1h) times the an- ineer's final estimate; and such cash deposit sh_qll be used for, or such surety bonus shall guarantee, the payment in cash for all work as specified in the pay- ment terms of the contract as let by the Council. If the petitioners fail to furnish said cash deposit or bond within thirty (30) days from the date, the clerk forwards a copy of the engineer{s final estimate to the petitioner, the project shall be terminated and the cleric shall forthwith deduct all expenses incurred by the Village from the deposit provided in (A) of this section. Any balance raining shall be paid back:. to the petitioners, (C) Upon receiving) fmu the petitioner the crrh deposit or bond required by (B), the Council shall proceed in accordance with the provisions of Chapter 398, Laws of 1953, and acts amendatory thereof, .for the purpose of advertising for bids, and lettin contract for the work to be done. 1?Js language shall not be construed to require the issuance of bonds by the Village nor to require assessments to be spread. 501.070. STREET PATTERNS. in the development of a large subdivision or plat the street conrtriction shall conform to the requirements of section 1006 of the Platting Code. 501.050. StiB-STANDARD STREETS. Any tompor•iry or permanent street having a width of less than sixty (RO) feet and any alley may »e considered as a permissible variance from this ordinance providing the Village En;,ineer shall design such street or alley in the beet possible manner for the contemplated use. The petitioner may be required to enter into special agreements pertaining; to such sub-st,indird streets or €♦ueh =:Heys. 501.090. T7SfLNC OF STREET CONSTMCT10N. The Village shall at all times have the right to determine mid specify the timing of street construction and ntay, at its discretion, contract for grading under a separate contract from, the finishing or surfacing of the driving area. Whenever surfacing is delayed for a substantial period of time after grading, the Village may provide for snow plowing and general blading operations on such streets at the e4pense of the Village. If the Village does provide for, snow plowing and blading, much action on the part of the Village shall not in may way constitute or be decowd to be final acceptance by the Village of such streets for maintenance. If conditions require, during the period of such partial maintenance, the aggregate or gravel be applied to the entire driving sur- face, the application thereof shall be dewed to be part of the street construction to be paid for by the petitioner on a time ming rAterial basis to the Village, Such Such partial maintenance ns provided for to this paragraph shall not be construed to have any effect upon construction agrasomt:s existing between the Village and the petitioner# but shall be const -ted to be part of such construction agreements and shall be construed to be an exercise by the Council, of its rights under Chapter 3988 Law of 1955, and acts imendatory thereof, to perform part of the work an- to elated by Village labor and Village equipment on a time and materials basics. 5029010. FUNCTIONAL CLASSIFICATION OF STREM. The following functional. classifications ,are estnbli.siaeed for Village st:reets. The Council may, from time to time, designate certain streets to conform to these functional, 41assifectioxns. W) Principal. Arterial - A roadway primarily designed to serve relatively long trips offering minniarca.n service to abutting property through rather severe access limitations, This type of facility combines service to major centers of activity, carries, usually, the high"tr volume of traffic* and satisfies the long- est trip desires* and would tae, in most instances, of intercomunity nature. (B) Minor Arterial - A roadway offering entre land access orientation through controlled rather than limited access. This level of roadway should serve an intra - community need, carrying trips to, through, and/or :around major traffic generators. (C) Major Collector W a raeodvay designed ts? carry trips either from a major generator or minor collector to the arterial system. It literally "Collects" trips .from major sub -divisions, industries, com.ercial districts, partes, aeaW the like, and provides a reasonably high level of service to the arterial network. (D) Hinor Collector - A roadway designed to distribute traffic from the major c€tllector& and/or arterials to the mal System, amd conversely it "collects." traffic from the local System and ch;wneels it into the: hider systemse Land access and local traffic swve3mout* within the various neighborhoods and areas are provided with a moderate lavtiel of service.
