HomeMy WebLinkAboutNo 145 Relating to the Occupancy of Buildings Which Have Been Moved and Vacant Buildings Which Are Not in Conformance with the Building Code, Providing for Occupancy Permits and Establishing Penalties for Violation Thereofu ORDINANCE NO. ld5 AN ORDINANCE RELATING TO THE OCCUPANCY OF BUILDINGS ',i.HICH HAVE BEEN MOVED AND VACANT BUILDINGS ;4HICH _LRE, NOT IN CON- FORIWCE 'WITH THE BUILDING CODE, PROVIDING FvR OCCUPANCY PERTIITS AND ESTABLISHING PENALTIES FOR VIOLATION THEREOF. THE VILLAGE COUNCIL OF THE VILLAGE OF MA.PI0'00D DOES ORDAIN: Section 1. (a) No building or structure which has been moved, shall be occuppied or used in whole or in part for any purposes, whatsoever, until a certificate of occupancy as provided for herein, shall have been issued by the Building Inspector of the Village stating that the building or structure complies :with all pertinent provisions of the Village zoning ordinance and building code. (b) No building which has been vacant for a period of more than thirty (30) days and which does not comply with the building code of the Village, shall be occuppied or used in whole or in part, for any purpose, whatsoever, until a certificate of occupancy, as provided herein, shall have been issued by the Building Inspector of the Village, stating that the building or structure complies with all pertinent provisions of the Village zoning ordinance and building code. (c) No non -conforming use of any structure or building which has been vacant for thirty (30) days or more, shall be maintained, renewed, changed, or extended .Tri.thout a certificate of occupancy, therefore having first been issued pursuant to this ordinance, to the owner or leaseholder. Section 2. The Building Inspector shall maintain a record of all occupancy permits and certificates issued by him and he shall supply the Village Clerk with a copy of every such certificate so that the said Clerk can maintain a similar record. Copies of occupancy certificates shall be furnished by the Clerk or Inspector to any person having a proprietary or tenancy interest in such building, upon the request of such -person. Section 3. No permit for repair, reconstruction, or alteration of any building hereinbefore described, shall be issued unless the applicant therefore, applies at the same time for an occupancy permit. Section ¢. The fee for such occupancy permit shall be Five Dollars ($5.00). .,� Section 5. Any person violating any provisions of this ordinance, shall, upon conviction thereof, be guilty of a misdemeanor. The punishment for which shall be not more than ninety (90) days in jail or not more than One Hundred Dollars ($100.00 fine, or both; and each day that a violation continues shall be deemed to be a separate offense. Section 6. This ordinance shall take effect from and after its passage and publication. Passed by the Village Council of e Village of Maplewood this 13� day of 1961.
