HomeMy WebLinkAboutNo 136 Amending Ordinance No. 103, an Ordinance Defining Certain Acts as MisdemeanorsORDINANCE NO. 136 AN ORDINANCE AMENDING ORDINANCE NO. 103, AN ORDINANCE DEFINING CERTAIN ACTS AS MISDEMEANORS. THE COUNCIL OF THE VILLAGE OF MAPLEWOOD DOES HEREBY ORDAIPI AS FOLLOiPSs :lection 1. That Ordinance 'To. 103, Section 3, is hereby amended to read as follows: ection 3. Any person, or persons, who shall be found lurking, lying in wrxit or concealed in any house or other building, or in any yard or premises within the limits of the 'illage of aplewood, with intent to do any mischief or to steal or to commit any offense prohibited by the laws of this state or the ordinances of this Village shall be guilty of a misdemeanor. also, any person carrying concealed weapons within the 'tillage shall be guilty of a misdemeanor.'' Section 2. That Ordinance No. 103, ::action 5, is hereby amended to read as followse "ceetion 5. Any person, or persons, who shall make, aid or countenance, or assist in making any noise, riot, disturbance or improper diversion, to the annoyance or disturbance of the citizens, or other person, or persons, in the Village of Maplewood; or, who collect in bodies or crowds in any street or public place in said 7illag_p so as to obstruct public travel thereon, shall. be guilty of a misdemeanor. Any person discharging fire arms, unless otherwise lawfully authorized to do so, shall be ,guilty of a misdemeanor." lection 3. That Oriinance 70. 103, Eeetion 9, is hereby amended to read as follows: "Section 9• Any person who in committing any of the misdemeanors herein defined or who violates any traffic law of this State or violates any provision of Ordinance 'To. 1 of the Pillage of ?Maplewood and who, while being apprehended therefor by a police officer or any other person authorized to arrest, fails to stop on command of such arresting officer or person or attempts to flee from the custody of such arresting officer or person, or otherwise resists arrest, shall be F-uilty of a misdemeanor. llny person who makes any f; -Ase report to az`l �illf�.s police officer or turns in any fa.lsa report by means of telephone or otherwise which is intended to summon the police, sha-11 upon conviction t?iereof, be guilty of a misdemeanor." ::;action 4, what Ordinance `.o. 1039 .)eetion 12, is hereby canended. to read. as follows 3 :Iectior 12. .ny person engaged in gtunbling as a participant therein, or LnJ persona 7ho 1 owin ly permits ,ambling o:n his premises, such gambling being defined as gFmbling within the meaning of Chapter 614, Annesota Statutes, shall be :guilty of a misdemeanor." Section 5. That Ordinance No. 103 is further amended by adding a new section to be 6ection No. 13 to read as follows: "::lection 13. An,,- person convicted of a violation of the foregoing provisions of this 11rdinanoe shall be punished by a fine of not more than $100.00 or by imprison- ment for not more than ninety (90) days, or both, for each offense," ection_ 6.
