AN ORDINANCE RELATING TO THE ESTABLISHMENT OF PUBLIC DU1PS
OR DUMPING GROUNDS, PROVIDING FOR REGULATIONS THEREOF AND
PRESCRIBING PENALTIES FOR VIOLATIONS.
THE COUNCIL OF THE VILLAGE OF MAPLENOOD DOES ORDAINS
Section 1. No dump shall be operated within the Village by any person
or as a public dump operated by the Village except pursuant to the provisions
of this Ordinance.
Sec. 2. The establishment of a dump at any location within the Village
shall be permitted only pursuant to Council authorization after such public
hearing as the Council may prescribe.
Sec. 3. Any dumping operation carried on within the Village shall be
managed and operated as a sanitary landfill so that all refuse, cast-off
materials shall be periodically covered with at least twelve (1211) inches of
earth fill and this covering shall be maintained and continued at such intervals
as will guarantee that at no time shall more than ten (10) feet of refuse extended
ahead of the fill be exposed.
Sec. 4. Such dump shall be maintained and operated either as a free
dump, a pay dump, or a restricted dump, as the Council may determine; and, in
making such determination the Council may take into consideration the fact of
residence of users. The Council may restrict the use of the dump to residents
of Maplewood and participating municipalities. Such fees and/or restrictions
may be set from time to time by Council resolution.
Sec. 5. No dump shall be open or available for use except when an
attendant is on duty and the dump shall be properly barricaded so as to prevent
its use at all other times. The attendant appointed by the Council shall have
limited police power to issue summons for violations of this Ordinance.
Sec. 6. No animal or vegetable matter shall be deposited in any dump
and proper rodent control measures shall be provided by the Village at all times
and under supervision of the Village Health Department.
Sec. 7. The hours during which the dump shall be open shall be established
by Council resolution from time to time.
Sec. 8. P;o person shall bring into the dump such materials as embers,
hot ashes, hot coals or other materials that may cause the dump to be set afire.
Ido person shall at any time start a fire in or on the dump.
Sec. 9. Any person convicted of a violation of the provisions of t1i.s
Ordinance or of any of the regulations authorized by the terms of this Ordinance
shall be guilty of a misdemeanor and punished by a fine of not more than One
Hundred and N01100 ($100.00 Dollars or imprisonment of ninety (90) days, or
both.
Sec. 10. This ordinance shall take effect and be in force from and
after its passage and publication.
