AN ORDINANCE A-'WDING ORDINANCE NO. 53 ENTITLED "AN
ORDINANCE ESTABLISHING STANDARDS FOR THE CONSTRUCTION
OF STREETS AND ROADS WITHIN THE VILLAGE OF NAPLEW00D,
PROVIDING SPECIFICATIONS FOR WORK AND MATERIAL AND
PROCEDURES, AND PROVIDING PENALTIES FOR VIOLATION
THEREOF; AND, REPEALING ORDINANCE NO. 40.
THE COUNCIL OF THE VILLAGE OF M.APLEWOOD DOES HEREBY ORDAIN:
Section 1. Ordinance No. 53, Section 1-7, Subd. b, is hereby amended
to read as follows:
"Sec. 1-7, Subd. b. After the petitioners have paid the deposit
required in Subdivision a. of this section, the Council shall instruct the engineer
to prepare final plans and specifications and estimate of cost for the improvement,
construction or re—construction including drainage and utility installations as
petitioned and as recommended by the Engineer's preliminary report. When final
plans and specifications and estimate of cost are completed, the Engineer shall
present same to the Council and shall furnish a copy thereof to the Clerk for trans—
mittal to the petitioner. Before the Council orders the work done or advertises
for bids, the petitioners shall deliver to the Village a cash deposit, or a surety
bond, as the Council may determine, in the amount of one and one—half (1j) times
the Engineer's final estimate; and such cash deposit shall be used for, or such
surety bond shall guarantee, the payment in cash for all work as specified in the
payment terms of the contract as let by the Council.
If the petitioners fail to furnish said cash deposit or bond within
thirty (30) days from the date the Clerk forwards a copy of the Engineer's final
estimate to the petitioner, the project shall be terminated and the Clerk shall
forthwith deduct all expenses incurred by the Village from the deposit provided
in Subdivision a. of this section. Any balance remaining shall be paid back to
the petitioners.
Sec. 2. This ordinance shall take effect and be in force from and
after its passage and publication.
