AN ORDINANCE AMENDING ORDINANCE NO. 29 ENTITLED "AN
ORDINANCE REGULATING AND RESTRICTING THE HEIGHT, NUMBER
OF STORIES AND SIZE OF BUILDINGS AND OTHER STRUCTURES;
THE PERCENTAGE OF LOT THAT MAY BE OCCUPIED; THE SIZE OF
YARD, COURTS, AND OTHER OPEN SPACES; THE DENSITY OF POPU-
LATION; THE LOCATION AND USE OF BUILDINGS AND LAND FOP,
TRADE, INDUSTRY, RESIDENCE, OR OTHER PURPOSES; CREATING
DISTRICTS FOR SAID PURPOSES AND ESTABLISHING THE BOUNDARIES
OF SUCH DISTRICTS; PROVIDING FOR CHANGES Li THE REGULATIONS,
RESTRICTIONS AND BOUNDARIES OF SUCH DISTRICTS; DEFINING
CERTAIN TERMS USED HEREIN; PROVIDING FOR ENFORCEMENT; AND
IMPOSING FINES AND PENALTIES FOR VIOLATIONS".
THE COUNCIL OF THE VILLAGE OF MAPLEWOOD DOES HEREBY ORDAIN:
Section 1. Ordinance No. 299 Article V, Subd. B, is hereby amended to
read as followss
"Subd. B. HEIGHT REGULATIONS. No duplex shall hereafter be erected or
structurally altered hereafter to exceed thirty (30) feet in height measured
from the front or street side grade of the site. Other buildings under this
classification are limited to the same height of thirty (30) feet unless variation
is authorized by the Council."
Sec. 2. Ordinance No. 29, Article V., Subd. C, is hereby amended to read
as follows:
"Subd. C. AREA REGULATIONS. No duplex or double bungalow shall be built or
structurally altered hereafter on a site less than 12,000 square feet in area. No
duplex or double bungalow shall be built or structurally altered hereafter on any
site unless public sanitary sewer is available."
Sec. 3. Ordinance No. 29, Article VI, is hereby amended to read as follows:
ARTICLE VI.
11R-3, RESIDENCE DISTRICT (MULTIPLE DNELLING)
Subdivision A. USE REGULATIONS. In a multiple dwelling district, unless
otherwise provided in this ordinance, no building oil land shall hereafter be erected
or structurally altered except for one or more of the following usess
1. All uses permitted in Article IV, R-1, and Article V, R-2, except
single family dwellings and duplexes or double bungalows unless
specifically authorized by the Council.
2. Multiple dwelling apartment, but no business shall be conducted
therein unless it is incidental and only for guests, and can be
entered only from the inside of the building.

3. Clubs, lodges, fraternity and sorority houses without services
to public customarily carried on as a business.
4. Boarding and lodging houses.
5. The following uses, but only upon securing of a special permit
from the lawful governing body:
aj Hospitals, clinics, nursing homes and other buildings
used for treatment of human ailments.
b) Philanthropic and charitable institutions.
c) Any other use enumerated or specified in Article XI
relating to special use permits.
Subd. B. HEIGHT REGULATIONS. No multiple dwelling shall hereafter be
erected or structurally altered to exceed thirty-six feet (36 ft.) measured from the
front, or street side, grade level.
Subd. C. AREA '-tLGULATIONS. The building site for any multiple dwelling
shall consist of an area of 12,000 square feet fo.,_ the first unit plus 1,000 square
feet for each additional apartment unit. No multiple dwelling shall be built upon
any site which does not have public sanitary sewer service available.
Subd D. FRONT YARD RE(�UIREM NT. Each multiple dwelling shall have a
front yard of not less than 30 feet in depth facing any road or street. This
set back shall apply to both street sides where the building is located on a
corner- lot, unless the Council shall authorize a variation.
Subd. E. SIDE YARD REQ,UIRMIKIT. The side yards shall be no less than
five (5) feet unless otherwise permitted by the Village Council. Side yards for
churches, schools or public buildings shall be at least fifty feet (50 ft.) when
adjacent to other property except that variation may be authorized by the Village
Council.
Subd. F. REAR YARD REQUIRLIMT. Rear yard space for a multiple dwelling
shall be such as approved by the Village Council when site plans are submitted.
Subd. G. OFF-STREET PARKING REQUIRED4ENTS. Each multiple dwelling shall
have off-street parking space which will provide an average of 450 square feet
per apartment unit. All such parking space shall be screened as provided in the
Building Code. The site design and the location of parking areas and driveways
thereto shall be constructed as to provide for traffic movements with a minimum
of congestion and hazard.
Subd. H. All plans and specifications, including site use design, shall be
first approved by the Village Council before any building permit is issued for a
multiple dwelling or other structure authorized by this Code in an R-3 zone, and
the Council may permit variances from the foregoing provisions of this Article.
Sec. 4. This ordinance shall take effect and be in force from and after
its publication.
