HomeMy WebLinkAboutNo 115 Authorizing the Connection of a Sanitary Sewer in the Town of Woodbury, Washington County, to the Sewer System of the Village of Maplewood, and Providing for Inspection, Control and ChargesORDINANCE NO. 115 AN ORDINANCE AUTHORIZING THE C01PI`dECTION OF A SANITARY SEWER IN THE TOWN OF WOODBURY, WASHINGTON COUNTY, TO THE SEWER SYSTEM OF THE VILLAGE OF MAPLEWOOD, AND PROVIDING FOR INSPECTION, CONTROL AND CHARGES. THE VILLAGE COUNCIL OF THE VILLAGE OF MAPLEWOOD DOES HEREBY ORDAIN: Section 1. The Town of Woodbury, Washington County, is hereby granted permission and authority, subject to all of the terms and conditions hereinafter expressed, to construct and thereafter maintain and operate suitable connections according to conventional engineering standards approved as to construction, location and elevation by the Village of Maplewood sewer engineers and also by the Public Works Department of the City of Saint Paul, at or adjacent to the intersection of: Century Street and Upper Afton Road joining the sanitary sewer line in said Town of Woodbury with the public sewer system of Maplewood to be operated as the only outlet for said Town and for the convenience of property within said Town of Woodbury; it being understood that the only purpose and use for this sanitary sewer construction within the Town of Woodbury and the only property to be served by it shall be the public grade school of Independent School District i4o. 833 located upon the property described as: The west seven hundred eighty-nine and seven hundredths (789.07) feet of that part of the Northeast Quarter (NE4) of Section Seven (7), Township Twenty-eight (28) North, Range Twenty-one (21) West, lying Southerly of the center line of Upper Afton Road as it now exists, and subject to Upper Afton Road, containing 37,281 acres, more or less. Sec. 2. The Town of Woodbury, as part of its obligations hereunder, shall pay to the Village of Maplewood such sums as are required by the terms of Section 2 of St. Paul City Ordinance No. 11061 as (1) annual charge for each connection, and as (2) annual sewer rental charges, and the two charges shall be subject to change as they may hereafter be changed by actmn of the St. Paul City Council. Present annual charge at time of enactment of this ordinance is $8.00 per year for a school. That the Town of Woodbury shall permit no further properties or areas within or without its legal limits to make any connection other than that herein above expressly authorized without further express authorization by the Council of the Village of Maplewood subject to approval and authoriza- tion by the Council of the City of Saint Paul. That the sewer line or lines within Woodbury shall carry only sanitary sewage limited to house or industrial waste, exclusive of roof, storm or ground water drainage. That the Town of Woodbury, when so required by either Maplewood or St. Paul shapp adopt, enact, and enforce proper ordinance for the regulation of the construction use and maintenance of public sewers and house connections thereto within said Town limits. Sec. 4. That the Town of Woodbury shall be obliged to save harmless the Village of Maplewood and the City of St. Paul from any damage or cost and expense and fully indemnify said Maplewood and St. Paul against all liability -2- sustained by reason of the connecting or the maintenance of connections hereunder between said public sewer systems or by reason of any damage, cost, expense or loss that may be sustained by said Village or City, its inhabitants, or any other person or persons connected with the use of said Town sewer system or by reason of the diversion into said Town sewer of roof water or storm sewer drainage. Sec. 5. That the City of Saint Paul and the Village of Llaplewood shall have the right at any reasonable time and by exercise of all reasonable procedures and facilities to inspect, explore and survey all or any part of the Town sewer line or sewer system as existing at the time of connection here- under or as the same shall thereafter be extended or otherwise altered, together with house drains and other connections for the purpose, among other things, of determining whether or not the same conform to requirements of this ordinance and of ordinance No. 11061 of the City of St. Paul. Sec. 6. The Town of Woodbury, as a condition precedent to its right to extend or enlarge the sewer services provided by this ordinance shall submit complete plans and specifications to the Village of Maplewood, providing such additional copies of all such data as the Village may require; and, such extensions or enlargements shall require approval of both the Council of Maplewood and the Council of the City of St. Paul. Sec. 7. The said Town shall save both Maplewood and St. Paul harmless from all damages, costs, expenses or liability on account of any failure of said Town sewer system properly to serve for the purposes for which it is designed, or by reason of any injury occassioned by alleged inadequacy of said Town sewer system, and said Town shall indemnify both Maplewood and St. Paul on account of any action, claim or demand for recovery by any party against said Maplewood and/or St. Paul in every such case. -3- Sec. 8. The Town of Woodbury shall be obligated to compile and maintain all records as required by Section 8 of St. Paul Ordinance No. 11061; except that so long as the public school operated by School District No. 833 is the only user of this sewer, all such records and billings required for said school by the terms of Sections 8 and 9 of St. Paul Ordinance No. 11061 may be kept and performed by Maplewood. Sec. 9. All permission and authority hereunder shall be subject to all applicable rules and regulations of the Minnesota Board of Health, or by any other State or Federal agency having cognizance and by the City of St. Paul and the Village of Maplewood in the manner and also as provided by Section 10, St. Paul City Ordinance No. 11061. Sez. in. That the outlet for sewers provided hereunder shall be discharged into the Maplewood sewer in Upper Afton Road in said Village and the cost for the use of this Maplewood sewer, on Upper Afton Road, McKnight Street and Battle Creek in the Village of Maplewood, by Woodbury, calculated on the pe.r•centage of capacity available for such Woodbury use, not exceeding 1.1 c.f.s., has been determined to be $2,600.00, which sum, plus $400.00 for legal and engineering services, shall be paid to the Village of Maplewood on or before December 1st, 1960. Sec. 11. In addition to the connection charge of $2,600.00 as provided in paragraph 10 hereof; and, in addition to the annual charge and the annual sewer service charges established by the City of St. Paul as hereinbefore set forth, the Town of Woodbury shall pay to the Village of Maplewood an annual sewer maintenance charge based upon the current maintenance charges presently in force in the Village of Maplewood for comparable house, institutional, and industrial connections. It is further provided that such maintenance charge I— will be billed directly to the user by Maplewood if the Town of Woodbury so directs; otherwise, such billing for annual charge, annual sewer service charge and maintenance charge will be made quarterly to the Town of Woodbury by the Maplewood utilities department. Sec. 12. As and to the extent it becomes necessary by reason of the aforesaid connection between the Woodbury sewer line and the Maplewood sewer system, or by reason of any of the same hereunder, that additional sewage disposal facilities be incorporated in the public sewer system of Maplewood, such shall be dnne by Maplewood subject to the obligation of Woodbury, in each such instance, to fully reimburse said Maplewood on account of said Maplewood's actual expense necessarily incurred in and for the incorporation of such additional facility, pursuant to St. Paul City approval; and, that in no such instance shall said Maplewood be obligated to proceed with the incorporation of any such additional facilities until said Woodbury shall have deposited with Maplewood the equivalent of Maplewood's estimated cost in the premises. Sec. 13. This ordinance shall be approved by the Town of Woodbury by an ordinance of said Town, which ordinance shall by its terms accept and approve this ordinance of the Village of Maplewood. Such approving ordinance shall be adopted by Woodbury within ninety (90) days after the effective date of this ordinance, and two certified copies of such approving ordinance shall be, within ten (10) days after its effective date, transmitted to the Village Clerk of the Village of Maplewood. Sec.14. This ordinance shall take effect and be in force from and after its passage and publication. Passed by the Village Council of the Village of Maplewood this /-�" day of 't,c.� , 1960.
