Chapter 1215 is hereby amended in its entirety to read as follows: 1215 SNOWMOBILES 1215.010 ADOPTION OF SNOWMOBILE STATUTES. It is the intent of this ordinance to suppliment Minnesota Statutes 84.81 through 84.88 and Chapter 169 with respect to the operation and regulations of snowmobiles, and said statutes as hereafter amended are hereby adopted and incorporated as if fully set out herein. 1215.020 DEFINITIONS. For purposes of this ordinance, the following definitions are hereby set forth: A. "SNOWMOBILE"—a power driven, self-propelled vehicle designed to travel upon snow, ice or natural terrain. B. "OPERATOR"—The person who handles and operates the controls which are used to start, stop and direct the course of travel of a snowmobile. C. "DEAD MAN THROTTLE"—a device which automatically cuts the fuel supply to the engine whenever the operator releases pressure upon the throttle or accelerator. 1215.030. UNLAWFUL CIR- CUMSTANCES. It shall be unlawful for any person to drive, operate, control or direct the course of travel of any snowmobile under the following cir cumstances. Subd. 1. Upon private property without Permission of the owner or person en- titled to possession of such property. Subd. 2. Upon any school grounds, Park property, playgrounds, recreation areas or golf course except as and at such times as the persons in control of such property may authorize or designate. Subd. 3. In any manner which creates unnecessary and unusual noise and disturbance, either by the machine itself or the persons riding upon such machine Subd. 4. In a careless, negligent, dangerous manner which is reasonably possible to endanger the bodily health or safety of any person or the security of any property. Subd. 5. Without having the snowmobile registered as provided by Section 84.82 of Minnesota Statutes, except upon the private property of the owner of such vehicle. Subd. 6. Within or across any public street or road right-of-way or upon or across any public lands or waters un less the operator is at least 14 years of age and, if under 18 years of age, ha.s in possession a valid snowmobile sa tety certificate issued by the Commissioner of Conservation of the State of Alin nesota. Subd. 7. After the hour of 10:00 P.M. on any day or before the hour of 7:00 A. M. on any day. Subd. 8. a) Speed in excess of 30 mil es per hour unless otherwise posted. b) Speed in excess of 15 miles per hour " when within 150 feet of the shore line o,, ` any lake or waterway, ice fisherman, flshhouse, skating rink or area, sledding or ski tow area or where persons not on snowmobiles are present. Subd. 9. The following areas are hereby prohibited for operation of snowmobiles: Skating rinks, sledding areas, skiing areas or areas in use for other recreational purposes and any public land or waters posted and designated as a prohibited area. Subd. 10. When towing another person or thing on skis, sled, toboggan or other device unless by means of a rigid tow bar of not more than 10 feet in length except at the direction of a Police Of- ficer. Subd. 11. With more passengers than the designed capacity of the particular snowmobile. 215.040 UNATTENDED VIOLA- TIONS. a) No snowmobile shall be unattended while the motor is running or while the key is in the ignition switch. b) No operator shall leave a snowmobile unattended upon any public land or waters. A law enforcement of- ficer finding such unattended snowmobile may seize same. Any snowmobile seized shall be held for 60 days subject to claim by the owner thereof after appearance in Municipal Court and an order of said Court or dering same released to the claimant upon payment of any and all reasonable towing and storage charges. 1215.050. RACES. Snowmobile races may be held only upon permission of the Village Council after favorable recommendation by the Public Safety Director and subject to such conditions as the Council shall prescribe. 1215.060. RECREATION PROGRAMS. If the Director of Recreation for Maplewood provides for snowmobile programs as part of the department sponsored recreation events, the Director shall have the authority to designate Village -owned land areas as routes or areas for snowmobile operation 1215.070. EQUIPMENT REQUIRE- MENTS. In order to lawfully operate a snowmobile in Maplewood, such vehicle shall be equipped as follows: Subd. 1. Muffler to reduce operating noises, and no cut-out, bypass, or similar device to defeat muffling shall be allowed. Subd. 2. Adequate brakes as providea in Minnesota Statutes Section 169.67, Subd. 3. At least one headlight and one taillight. Subd. 4. A safety throttle, commonly described as a "dead -man" throttle, which shall be in operating condition at all times the vehicle is in use. 1215.080. STREET AND HIGHWAY RESTRICTIONS. No snowmobile shall be operated upon any street or highway or within the right of way thereof, except to cross such street at right angles to the centerline- No snowmobile shall cross any divided highway except at an established intersection crossing. The Council may by resolution allow other specified types of snowmobile operation in a street or road right of way for parades or specially designated events. Section 2. This ordinance shall be enforced in the same manner as any other provision of the Maplewood Code. Section 3.
