AN ORDINANCE AMENDING THE MAPLEWOOD CODE
RELATING TO DISPOSAL OF GARBAGE AND RUBBISH
THE COUNCIL OF THE VILLAGE OF MAPLEWOOD DOES "!EREBY ORDAIN AS
FOLLOk'S:
Section 1. Section 1402.010. DISPOSAL REQUIREMENTS
OF THE MAPLEWOOD CODE is hereby amended to read as follows:
Section 1402.01.0, Disposal Requirements. Every person,
firm or corporation shall dispose of garbage which accumulates
upon his or its property at least once a week or more often as
directed by the Village Manager. Every householder, occupant
and owner of any dwelling, boarding house, apartment building,
mobile home, or any other structure including churches and hails
shall have garbage and rubbish collected by haulers licensed by,
the Village of Maplewood and shall comply with the provisions of
this ordinance and with the dates of collection and requirementa
therefor as established by the Village Manager.
Section 2. Section 1402.020 is hereby amended to read
as follows:
"Section 1402.020. DEFINITION. For the purpose of
this chapter, the following terms, phrases, words and their deriva-
tion shell have the meaning given therein:
(a) Garbage: Waste, food stuffs or table wastes o
vegettabl or animal origin, together with incidental
admixtures. Dead animals weighing no more than ten
(10) pounds shall be classified as garbage.
(b) Rubbish: This shall include all other waste ratters,
such a -ss- Mn` cans, glass, paper, ashes, sweeping, leaves,
grass, and other such materials except vegetative com-
post piles properly maintained for conservation, garden-
ing and landscaping purposes.
(c) Rem: Shall mean garbage and rubbish combined.
(d) Waste Materials: The following items of waste
material shall not be considered as rubbish or garbage:
Stones, sod, earth, concrete, contractor's building
materials, large automobile parts, large appliances,
inflammable liquids, tree trunk sections over four
inches in diameter and three feet in length, manure#
or articles so heavy or bulky that they cannot beeasily
lifted by one man. The aforesaid items shall not be
allowed to accumulate and shall be removed within
seventy-two (72) hours upon notice from the Village Mana-
ger, which away be given in writing to the owner or
occupant of theproperty upon which said materials are
accumulated, or by posting said notice upon the property
in a conspicuous place and failure to remove pursuant
to the order shall be a disdemeanor.
Section 3. Section 1402.030 of the code is emended to
read as follows:
"Section 1402.030. GARBAGE CONTAINERS. Every person,
firm or corporation, as a householder, occupant end/or owner of
any dwelling boarding house, apartment building, or any other
structure utilized for dwelling purposes and any restaurant, firm,
corporation or establishment that accumulates garbage shall pro-
vide one or more fly and water -tight metal or equivalent rodent -
proof garbage container, of not more than 32 -gallon capacity, to
contain all of the garbage which accumulates between collections
unless they are required to comply with Section 1402.030,
subsection (c) hereof.
No such container shall be filled in excess of seventy-
five (75) pounds.
(a) All persons living in accommodations not covered
under Section 140.030 (c) hereof shall place gar-
bage in a 1� mil. minimum polyethylene bags or
equivalent in performance of 30-32 gallon capacity
or equivalent system which shall be kept in the afore-
said containers except that on the day of collection,
the filled bags are to be closed or sealed so as
to be water and fly tight and removed from the con-
tainers, thew placed at the curb line or next to the
alley for pick-up unless special arrangements are
made with the hauler for walk-in service. Rubbish
shell be placed in 1�-mil, minimum polyethylene bags
or equivalent in performance in amounts mot weigh-
ing in excess of seventy-five (75) pounds or more
than 32 -gallon rapacity, and may be placed for pick
up on the gart?age pick-up date next to the curb
line or next to the alley.
(b) Tree limbs not exceeding four inches in diameter
nor three feet in length, tied in bundles of no more
than eighteen inches in diameter, and Christmas
trees up to seven feet in length may also be placed
in the same manner.
(c) The owners, operators of managgers of any buildi.og
containing more than two dewllinx units or of ary

under 1402.0200 Subsection (c) shall be disposed
of by means of a special pick-up of these items by

Section 4. Section 1402.050 of the Maplewood Code is
hereby amended to read as follows:
"Maintenance of sanitary conditions. Persons accumulat-
ing garbage or rubbish shall comply with the following requirements:
(a) No persons shall place any garbage or rubbish or
refuse in a street, alley or other public place,
or upon any private property whether owned by such
person or not except as provided by this ordinance.
(b) No person shell throw or place any garbage or rub-
bish or refuse in any stream or other bony of water.
(e) Waste material. No persons shall place any waste
material in any street, alley or other public place.
(d) No person shall cast, place, sweep or deposit any
garbage, rubbish or refuse in such a manner that
it may be carried by elements off his property.
(e) No persons shall bury or bur,z any garbage or rub-
bish or refuse in the Village except in accordance
with regulations established by the Minnesota Pol-
lution Control Agency and this ordinance.
(f) Location of Containers. All :petal containers or
equivalent shall, at all times, be located behind
the rear line of the dwelling or in the garage or
screened from view from the street and at least
ten feet from any abutting duelling.
(g) Highly inflammable or explosive materials shall not
be pplaced in containers for regular collection but
sh I be disposed of by notifying the fire marshal
who will issue directions for the disposal of said
item at the expense of the ocnier or possessor thereof.
(h) Any person, firm or corporation violating any of
the provisions of this ordinance shall be guilty
of a misdemeanor, and upon conviction, shall be
punished by a fine of not more than 5300.00 (Three
Hundred Dollars) or by imprisonment for not more
than ninety (90) days, or both. Each day that a
violation continues shall constitute a separate
violation."
Section 5. Section 1402.060 is hereby amended to reed
as follows$
"1402.060. COLLECTION AND DISPOSAL.
(a) All garbage and refuse accumulation in the Village
shall be collected, conveyed and disposed of under
the supervision of the Village Manager. The Village
Manager shall have the authority to make rules and
regulations concerning days of collection, type and
location of waste containers and such other scatters
as he deems necessary, provided that such are not
contrary to the provisions of this ordinance.
(b) In all single and two-family dwellings, it shall
be the responsibility of the occupant to contract
with the licensed hauler of his choice to remove
his garbage and rubbish. It is further respon-
sibility of the occupant to notify his hauler at
least one week in advance of discontinuance of
service.
(c) The collector shall notify the health officer
and the Village Manager of the notice of discon-
tinuance of service to any promises within two
days after service is discontinued.
(d) Fees for hauling shall not exceed the approved
maximum fees as approved by the Village and shall
be paid directly to the hauler by the owner, agent+
occupant or tenant of the premises of which the
garbage and/or rubbish is collected, and such fees
shell be full compensation for his services of
collection. The collector may refuse to make
collections of any premises when the fees are not
paid within one week from due date.
Section 6. This ordinance shall take affect and be in
force after the lst day of november$ 19730 and after its passage
and publication.

Section 4. Section 1402.050 of the
Maplewood Code is hereby amended to read
as follows:

Village except in accordance with

this ordinance.
