AN ORDINANCE AMENDING THE MAPLEWOOD CODE SECTIONS
1401.040, and 1401.070(A) ':ELATING TO BURNING
REGULATIONS.
THE COUNCIL OF THE VILLAGE Or MAPLEWOOD DOES HEREBY ORDAIN AS FOLLOWS:
Section 1. Section 1401.040 of the Iianlewood '-ode is hereby amended to
read as follows:
'11401.040. CO101ERCIAL OPERATION. Any persons engaged in a comraercial operation
shall refrain frorz burning any refuse, paper or other coribustible material unless such
burning is done in an indoor or outdoor incinerator or burner which has been constructed
pursuant to Village inspection and approval and such burning shall be confined to the
hours between 9:00 A.M. and 9:00 P.M. on any day. All corlercial buildings shall be
required to have installed within or without such building an incinerator constructed
pursuant to Village inspection and approval.''
Section 2. Section 1401.070(A) of the ILAa.plewood .,ode is hereby amended to
read as follows:
"1401.070. FIRE DEPARTMENT PERIdIT. (A.) No person shall start any fire except
in an approved incinerator or burner at any time without first obtaining from. the
Fire Department a permit to start such fire. Application for such permit must be
made to the t=hief of the Fire Department or officer in charge, who is responsible for
protecting the area where the property is located upon which the applicant desires to
start a fire. This section shall be construed to mean that no bonfire, campfire or
any other kind of open fire can be started at any location in the Village without
obtaining a permit as herein provided. 'she permit shall set forth the time, date,
and location of the burning authorized by such permit."
Section 3. This ordinance shall take effect and be in force frora and after
its passage and publication pursuant to rules of the village ;"ouncil relating to
readings and hearings of ordinances.

040, and 1401.070(A) RELATING TO
BURNING REGULATIONS.
The Council of the Village of Maple-
wood does hereby ordain as follows:
Section I. Section 1401.040 of the
Maplewood Code is hereby amended to
read as follows:
"1401.040. COMMERCIAL OPERA-

Maplewood Code is hereby amended to
read as follows:

and has full knowledge of the facts herein stated as follows: (1) Said newspaper is printed in the
English language ,in newspaper format and in column and sheet form equivalent in printed space to at
least 900 square inches. (2) Said newspaper is a weekly and is distributed at least once each week.
(3) Said newspaper has 50 percent of its news columns devoted to news of local interest to the com-
munity which it purports to serve and does not wholly duplicate any other publication and is not made
up entirely of patents, plate matter and advertisements. (d) Said newspaper is circulated in and near
the municipality which it purports to serve, has at least 500 copies regularly delivered to paying
subscribers, has an average of at least 75 percent of its total circulation currently paid or no more than
three months in arrears and has entry as second-class matter in its local post -office. '(5) said newspaper
purports to serve the Village of North St. Paul in the County of Ramsey and it has its known office
of issue in the Village of North St. Paul in said county, established and open during its regular
businese hours for ,the gathering of news, sale of advertisements and sale of subscriptions and main-
tained by the publisher of said newspaper or persons in his employ and subject to his direction and
control during all such regular business hours at which said newspaper is printed. (6) Said news-
paper files a copy of each issue immediately with the State Historical Society. (7) Said newspaper has
complied with all the foregoing conditions for at least two years preceding the day or dates of publi-
cation mentioned below. (8) Said newspaper has filed with the Secretary of State of Minnesota prior
to January 1, 1966, and each January 1 thereafter an affidavit in the form prescribed by the Secretary
of State and signed by the publisher and sworn to before a notary public stating that the newspaper is
a legal newspaper.
