HomeMy WebLinkAboutNo 252 Amending the Maplewood Code by Adding a New Chapter 1503 Prohibiting the Maintenance of Trees, Shrubs, Fences or Other Structures Near Street Intersections=JrWINANCE NO. 252 AN ORDINANCE AMENDING THE MAP LLVOOD CODS BY ADDING A NEW CIMPTZR 1543 -PROHIBIT MNG THE MINI`EW,,I+iCE OF TREES, SHRUB:,, FENCES OR ()THER STRUCTURES NEAR STREET INTERSECTIONS. THE COUNCIL OF Tom: VILLAGE OF MAPU7dOOD DOES HEREBY ORDAIN AS FOLLOWS: Section 1. The Maplewood Code is hereby amended by adding a new Chapter 1503 to read as follows: "1503.010. VISUAL OBSTRUCTIONS PROHIBITED. it shall be unlawful to keep or maintain upon any corner lot any tree, shrub, hedge or fence capable of so obstructing the view of persons operating vehicles upon the street as to constitute the primary cause of any injury or damage to any person or property. :she area of such corner lot to which this obstruction applies shall be that portion of lot inside of the lot lines which lies within twenty (24) feet of the corner of the lot. 1503.020. .AFFECTING ALL PROPERTY. The prohibition set forth in Section 1543.410 above shell apply to all corner properties within the Village of Maplewood from and after the effective date of this provision and the Village department responsible for street maintenance shall with the assistance of the .'olice Department, -,ake a note of all locations within the Village where a violation of this ordinance exists. As these violations are noted, they shall be passed on to the Village Clerk who shall forthwith send a written notice to the property owner or occupant of the property described, ordering the removal of such obstructions within ninety (90) days after the notice is given." 1503.030. FAILURE, TO COMPLY. 'Cf the property owner fails to comply with the notice given in Section 1503.020, the 'tillage may institute an appropriate action or proceeding to restrain, correct, or abate such violation." Section 2. Penalties for violation of this ordinance shall be as set forth in Section 101.1390 of the Piaplewood :.ode. Section 3. This ordinance shall take effect and be fn force from and after passage and publication pursuant to rules of the Village Council relating to readings and hearings of ordinances.
