Attests Maw or 400-6- ORDINANCE NO. 202 ,N ORDINANCE AMENDING ORDIN- ',NCE NO. 14 KNOWN AS THE 3UILDING CODE. THE COUNCIL OF THE VILLAGE )F MAPLEWOOD DOES HEREBY OR- DAIN AS FOLLOWS: Section 1. Ordinance No. 14, Section i-19 is hereby amended to read as fol- OW6: "5-19 (a) Fences, when constructed to enclose any lot or tract of land shall be located in such a way that the entire fence shall be on the property of the builder thereof. Post and framework shall be placed within the property line of the owner and the actual fencing material such as wire, lumber, pickets, etc., shall be placed on the side of the fence which faces the street or the ad- jacent property. (b) Fences surrounding an entire property for purpose of enclosing the lot or tract shall be limited to a maxi- mum height of four (4) feet. If a fence is constructed to surround a swimming pool, or patio, or other special purpose fence, the Building Inspector may in his discretion, allow such fence to be built to a maximum height in excess of four (4) feet if such fence will not be so located as to impair or obstruct the view from neighboring properties in the manner usually considered to be a so-called "spite fence." (c) Outdoor swimming pools on any private property shall be fenced and en- closed so as to prevent danger to young children when the pool is not in use or is unattended. The gate in such fence shall be securely fastened at all times when the pool is not in use." Section 2. This ordinance shall take effect and be in force from and after its passage and publication.
