HomeMy WebLinkAboutNo 195 Prohibiting the Discharge of Firearms and Explosives and Prohibiting the Wearing or Carrying of Concealed Weapons, and Providing Penalties for ViolationORDINANCE NO, 195 AN ORDINANCE PROHIBITING THE DISCHARGE OF FIREARMS AND EXPLOSIVES AND PROHIBITING THE WEARING OR CARRYING OF COMMALED WEAPONS, AND PROVIDING PENALTIES FOR VIOLATION. THE COUNCIL OF THE VILLAGE OF MAPLEWOOD DOES HERESY ORDAIN AS FOLLOWS: Section 1. It shall be unlawful for any person to shoot or discharge any gun, revolver, pistol, or firearms of any kind or description, including BB guns, pellet and air guns, and spring guns, within the Village of Maplewood, whether the same be loaded with powder and ball, loaded or blank cartridges or any kind of explosive, It shall also be unlawful for any person to shoot, discharge or explode any preparation of potash, mixture of sulphur and saltpeter, nitroglycerin, dynamite, plastic explosive, fireworks, or any other kind of explosive material, and all such acts are hereby prohibited unless specifically authorised by permit issued by the Village or by permit issued by the State Department of Conservation. Section 2. It shall be unlawful for any person within the limits of Maplewood to carry or wear concealed about his person any pistol, dagger, switch- blade knife, metal knuckles, blow -gun, bowie knife, razor or other dangerous or deadly weapons. Sec. 3. Any weapons or explosive materials duly adjudged by the Municipal Court of Maplewood to have been discharged, worn or carried in violation of Section 1 or 2 of this ordinance shall be confiscated by the Village of Maplewood and such weapons shall be turned over to the Chief of Police to be kept, sold or disposed of in the manner herein provided. Sec. 4, Any weapons or materials confiscated pursuant to Section 3 hereof may be kept and used by the Maplewood Police Department if the same are adaptable to police purposes. Such weapons and materials which would be dangerous to reintroduce into channels of private sale or use, rosy, in the discretion of the Chief of Police be destroyed, Such weapons or materials which may be safely placed into the hands of private owners may be sold by the Chief of Police at public auction pursuant to at least two weeks published notice of such sale, Sec. 3, This ordinance shall not apply to police officers or other authorised personnel when using firearm or other weapons in the regular course of performing their duties, sec. 6, A license to carry concealed weapons or to discharge firearms may be issued by the Village Cleric and the fee for such license shall be $3,00. Application for license shall be made on a form provided by the Village Police Department and such license shall expire at the end of the calendar year in which it is issued. Bvery license shall state the nano, age, location and residence of the person to whom it is granted and each such license shall be approved and countersigned by the Chief of Police before delivery to the licensee. Sec. 7. Any person who violates the provisions of this ordinance shall be punished by a fine of not more than One Hundred Dollars ($100.00) or by imprisonment for not to exceed ninety (90) days, or both. Sec. S. This ordinance shall take effect from and after its adoption and publication.
